renewed on 2/10/00 and 12/3/02, and all documents must be readily. available on site when Division
personnel inspect the project for compliance.
2) , All conditions and stipulations of the active permit remain in force under this renewal.
NOTE: Future development of the permittee's property, including dredging beyond authorized limits,
may require a modification of this permit. Contact a representative of the Division. at (252)
264-3901 prior to the commencement of any such activity for this determination. The
permittee is further advised that many non -water dependent activities are not authorized
within 30 feet of the normal high water level.
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2005
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.
Signed by the authority of the Secretary of DENR and the
Chairman of the Coastal Resources Commission.

Wallace Beckham, Dare County
DATE: January 8, 2004
On December 23, 2003, this office received a request from the permittee to extend
CAMA Major Permit # 20-96. This permit was issued to Cutty Sark Development, and
authorized maintenance excavation of an existing canal that connects to Mill Creek, a
tributary to the Pamlico Sound in Avon, Dare County. Mr. Wallace Beckham is the
owner of Cutty Sark Development. This permit expired on December 31, 2003.
The permittee has submitted the $100 filing fee, check No. 1012, drawn on First United
Bank, December 18, 2003. During a recent site visit with Mr. Beckham and his
contactors, it was determined that the project has remained in compliance with the
original permit conditions. I have been able to confirm that work has been continuing. ,,.�
I believe that the permittee has provided the information as required by NCAC 07J.
During my meetings with Mr. Beckham, he has stated he will abide by the conditions of
the existing permit. I have no objection to the renewal of this permit, so long as the
permit renewal includes the conditions of the existing permit, and the renewal includes a
condition that the canal footprint shall not be modified beyond the current footprint
without a modification of this permit. In addition, that no excavation is authorized in Mill
Creek or the Pamlico Sound, again without the modification of this permit. A copy of the
above referenced check is attached, as well as the related correspondence, and pertinent
permits and plats.

Dear Mr. Sampson,
Cutty Sark Development is requesting the renewal/extension of CAMA Major Pam
Attached is a 100.00 fee payable to NCDENR for the renewal fee.
The dredging contractor (Cape Dredging, Inc.) has not been able to finish the dredging
property due the backlog of work created by Hurricane Isabel. 1 still wish to proceed wi the
dredging and plan to request a modification of the permit for a bulkhead in the first qua of
2004.
1 am continuing with construction of my unfinished home at the site under a CAMA
and will request a modification for bulkhead work at the site.
Cape Dredging is scheduled to complete the dredging by February 1, 2004_
The work will be'completed under the same plans as was originally permitted.

MEMORANDUM

I am requesting that you take whatever steps you can to expedite the
processing of this permit extension request. The request for the
extension came in on 23 December 2003. Dennis Hawthorn's Memo recommending
approval of the request is attached to this email.
A delay in all dredging projects has been experienced in this area due
to the result of Hurricane Isabel, and a long backlog of projects has
also resulted. While it was not anticipated that this project would be
ready to go forward quite this soon, the holders of this permit are now
at the head of the list for the dredging company to tackle, and they do
not want to have to wait the several months that could put them into a
moratorium if they do not have the permit to allow the dredging company
to proceed.
I advised the applicant today that I would ask that a special effort be
made to get this extension issued so that commencement of the project
could proceed without delay.
Since I will be out tomorrow, I would appreciate it if you could convey
your decision/extension directly to Yvonne, who can then contact the
applicants. Anything you can do to effect this request for expeditious
processing is much appreciated.
