.This permit, issued on March 10, 2014 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) Unless specifically altered herein, this permit authorizes only the reconfiguration and extension of the
previously authorized docking facility with associated boat house, gazebo, and other structures and
uses located in or over the water that are expressly and specifically set forth in the permit application.
No other structure, whether floating or stationary, shall become a permanent part of this docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over public trust waters without permit modification.

Thus permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date An appeal requires resolution prior to work initiation or
"Continuance as the case may be.

ADDITIONAL CONDITIONS
2) , The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access.
3) t` The authorized covered gazebo shall not be enclosed. Any material used on the sides shall not obstruct
view and must be permeable to air and water. Screen or wire on the sides along with benches and knee
r" ,, walls are permitted. Lattice is specifically excluded from being used under this authorization.
i4) The roof of the covered gazebo shall not be designed for second story use.
5) ~ No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work
6) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he/she abandons the
permitted activity without having it transferred to a third party.
7) ` This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
. interest.
8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
This permit authorizes a maximum of one formalized boat slip.
General
The permittee understands and agrees that, if fixture operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
No Coastal Wetlands or open water areas shall be excavated or filled, even temporarily.
This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.

13) The permittee and/or his contractor shall meet with a representative of the Division prior to project
initiation.
14):, This major modification shall be attached to the original Permit No. 50-13, which was issued on 4/23/13
and copies of both documents shall be readily available on site when Division personnel inspect the
project for compliance.
15). All conditions and stipulations of the active permit remain in force under this major modification unless
specifically altered herein.

land disturbing activities are not allowed within the Environmental Management Commission's

Project Narrative:
Our company has been contracted to construct an addition to the existing dock located at 1174 Murphy
Farm Rd. on Bay River in Pamlico County in Township #2. The project consists of extending the
existing 5' x 260'dock another 230' feet and relocating the 9' x 40' platform to the end of the
extension. A 9' x 10' gazebo is planned for the left hand side of the platform followed by a 26' x 14'
boat house. The boat house and gazebo will have a hip roof and the dock and platform will be
constructed with concrete slats. The boat house is located approximately V off the western riparian
line and the platform is located approximately 12' from the eastern riparian line. The water depth at the
end of the current dock is inaccessible by boat and therefore the current boat lift is useless. The current
water depth is barely 3' on NWL. By extending the dock to 499' to the depth of 4 1/2' will allow use
of the boat lift. By extending the dock it also allows shorter access to deep water and less chance for
wear and tear of boat. This is a private residential dock. The width of the water body at this point on
the Bay River is approximately 4183' and the distance to the channel is approximately 850'
The property consist of a 100' x 300' lot with no wetlands present, the lawn is mowed up to the
wooden bulkhead with a few trees and shrubs. The lot has a home with a gravel driveway, a concrete
parking pad and a 260' concrete pier and a wooden bulkhead. The property is not near a PNA, the
property does lie within the prohibited shell fishing area as seen on Area F-6 (map 19).
The water classification is Bay River 27-150-(9.5)From a line across Bay River from Flea Point to The
Hammock, (excluding that portion of the Bay River landward of a line running from Poorhouse Point
to Darby Point which is classified SC SW NSW), to Pamlico Sound SA;HQW,NS
Mr. Huff Connor is the riparian owner on both sides of the project and has reviewed the project and
has no objections.

copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have
waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or
113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,1919) 733-2698 within twenty (20) days
of this decision on your permit. You should also be aware that if another qualified parry submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit

LUP Consistency Determination: The proposal is Consistent With & Not in Conflict with the
2004 Pamlico County Land Use Plan as certified and

Overview:
Areas of Environmental Concern (AECs) impacted by the proposal include Public Trust Area
(PTA) and Estuarine Waters (EW). The Waters at the project site are classified as SC;S,
NSWand are closed to the harvesting of shellfish. The area is classified a Primary Nursery Area.
The Pamlico County Future Land Use Map designates the subject property as Rural with
Services. Development within the designated AECs is limited by CAMA regulations and
development guidelines. Applicable or related policy includes the following:
"Only development associated with water -dependent uses is allowed (in estuarine
waters). Examples of appropriate development may include public access facilities,
docks and piers, erosion control structures, or other uses that are permitted by CAMA

9. Narrative Description:
This is a Major Modification Request to State Permit # 50-I3. It was issued on April23, 2023. It
is set to expire on December 31, 2016 However, the authorized docking facility was not
constructed due to the applicant's miscalculation of the actual water depth needed for the draft of
his particular vessel.
The property is located in Merritt at 1174 Murphy Farm Road (SR 1332), off of Florence Road (SR
1324) in Pamlico County. This site is developed with a single family residence, driveway, bulkhead,
and a docking facility. The lot is 0.71 acres. The adjacent lot to the east is similarly developed, and the
adjacent lot to the west is undeveloped. Both of the adjacent properties are owned by the same
individual.
The elevation of the high ground of the parcel is about +4' above the normal water level (nwl).
Vegetation'on the lot mainly consists of lawn grasses. There are no Coastal Wetlands on this
property. This lot has approximately 100' of continuous shoreline along the Bay River. Immediate
offshore water depths adjacent to the lot range from —l' to —4' nwl. The subaqueous substrate is firm
without shell.
There is a cultural resource in the nearby vicinity of the project area (PM23). This waterbody is
approximately 4,183 feet across at this location. These waters are not classified as a Primary Nursery
Area and there is not any submerged aquatic vegetation present. This area is closed to shellfish
harvest and is classified as SCA; Sw, Nutrient Sensitive Waters. There is not a defined Federal
Channel in this area. This project area is subject to the Neuse River Riparian Buffer Rules.
10. Proposed Development:
The applicant wishes to extend and reconfigure the existing private docking facility adjacent to the
Bay River, near Merritt. The proposed development will take place at 1174 Murphy Farm Road (SR
1332), off of Florence Road (SR 1324). The purpose of extending the docking facility is to gain
access to deeper water depths. There is a firm sandy shoal immediately adjacent to this section of
shoreline. The -4' NWL water depth contour is not measured until approximately 500' waterward of
the applicant's bulkhead.
The existing docking facility has a main access pier that leaves the bulkhead and connects to an
uncovered "T" platform that supports an uncovered boatlift on the western side. This existing
docking facility extends approximately 260' waterward of the bulkhead at the NWL. The water depth
at the end of the existing platform is -2' NWL. The applicant wishes to remove the existing "T"
platform and boatlift and extend the 5'-wide walkway another 230' waterward. The applicant will
then reconstruct the 9' by 40' "T" platform at the waterward terminus of this proposed extension. The
proposed platform will be partially covered on the western side. The 13' by 13' boat lift will be
constructed on the western side and a 14' by 26' boat house will be constructed over this boat lift.
The water depth at the terminus of the proposed extension is -4' NWL. The applicant states that there
are two existing boat slips, and that there will be no increase in the number of boat slips at this private

residential docking facility.
10. Anticipated Impacts:
The docking facility will not pose a hazard to navigation because it will be less than 1/4 of the width of
the waterbody and approximately 800' from the channel. The proposed docking facility will not be
longer than the pier head line established by the adjacent docking facilities. The docking facility will
be greater than 15' from both of the adjacent riparian property lines. This proposed private docking
facility will usurp and shade 3,174 ftZ of Public Trust Waters. This proposed extension will result in a
1,514 fe increase in shading of Public Trust Waters from the existing docking facility. The proposed
docking facility will extend the existing docking facility by another 230', and thus will extend 499'
waterward of the bulkhead at NWL. The Bay River is 4,183' wide at this location. This proposed
extension will give the applicant access to deeper water depths of -4' NWL. (Note: This water depth
was verified by field staff, with the Authorized Agent, on December 19, 2013 at this location.)
Traditional marine construction methodology will be utilized during the construction of this private
docking facility. Temporary, short-lived turbidity impacts are anticipated during the setting of the
docking facility's pilings. There is no proposed change in the number of boat slips, nor any
proposed change in the usage of the dock:
There is a cultural resource in the nearby vicinity of the project area (PM23). This project area is
subject to the Neuse River Riparian Buffer Rules. Water depths within the proposed boat slip are
deep enough to prevent scouring of the bottom habitat. These waters of the Bay River are not
classified as a Primary Nursery Area and there is not any submerged aquatic vegetation present.
This area is closed to shellfish harvest and is classified as SC; Sw, Nutrient Sensitive Waters.
There is not a defined Federal Channel in this area.

Our company has been contracted to construct an addition to the existing dock located at 1174 Murphy
Farm Rd. on Bay River in Pamlico County in Township #2. The project consists of extending the
existing 5' x 260'dock another 230' feet and relocating the 9' x 40' platform to the end of the
extension. A 9' x 10' gazebo is planned for the left hand side of the platform followed by a 26' x 14'
boat house. The boat house and gazebo will have a hip roof and the dock and platform will be
constructed with concrete slats. The boat house is located approximately 1' off the western riparian
line and the platform is located approximately 12' from the eastern riparian line. The water depth at the
end of the current dock is inaccessible by boat and therefore the current boat lift is useless. The current
water depth is barely 3' on NWL. By extending the dock to 499' to the depth of 4 1/2' will allow use
of the boat lift. By extending the dock it also allows shorter access to deep water and less chance for
wear and tear of boat This is a private residential dock The width of the water body at this point on
the Bay River is approximately 4183' and the distance to the channel is approximately 850'
The property consist of a 100' x 300' lot with no wetlands present, the lawn is mowed up to the
wooden bulkhead with a few trees and shrubs. The lot has a home with a gravel driveway, a concrete
parking pad and a 260' concrete pier and a wooden bulkhead. The property is not near a PNA, the
property does lie within the prohibited shell fishing area as seen on Area F-6 (map 19).
The water classification is Bay River 27-150-(9.5)From a line across Bay River from Flea Point to The
Hammock, (excluding that portion of the Bay River landward of a line running from Poorhouse Point
to Darby Point which is classified SC SW NSW), to Pamlico Sound SA;HQW,NS
Mr. Huff Connor is the riparian owner on both sides of the project and has reviewed the project and
has no objections.

9. Narrative Description:
This is a Major Modification Request to State Permit # 50-13. It was issued on April 23,2013. It
is set to expire on December 31, 2016. However, the authorized docking facility was not
constructed due to the applicant's miscalculation of the actual water depth needed for the draft of
his particular vessel.
The property is located in Merritt at 1174 Murphy Farm Road (SR 1332), off of Florence Road (SR
1324) in Pamlico County. This site is developed with a single family residence, driveway, bulkhead,
and a docking facility. The lot is 0.71 acres. The adjacent lot to the east is similarly developed, and the
adjacent lot to the west is undeveloped. Both of the adjacent properties are owned by the same
individual.
The elevation of the high ground of the parcel is about +4' above the normal water level (nwl).
Vegetation on the lot mainly consists of lawn grasses. There are no Coastal Wetlands on this
property. This lot has approximately 100' of continuous shoreline along the Bay River. Immediate
offshore water depths adjacent to the lot range from —F to —4' nwl. The subaqueous substrate is firm
without shell.
There is a cultural resource in the nearby vicinity of the project area (PM23). This waterbody is
approximately 4,183 feet across at this location. These waters are not classified as a Primary Nursery
Area and there is not any submerged aquatic vegetation present. This area is closed to shellfish
harvest and is classified as SCA; Sw, Nutrient Sensitive Waters. There is not a defined Federal
Channel in this area. This project area is subject to the Neuse River Riparian Buffer Rules.
10. Proposed Development:
The applicant wishes to extend and reconfigure the existing private docking facility adjacent to the
liav River, near Merritt. The proposed development will take place at 1174 Murphy Farm Road (SR
1332), off of Florence Road (SR 1324). The purpose of extending the docking facility is to gain
access to d== water depths. There is a firm sandy shoal immediately adjacent to this section of
shoreline. The -4' NWL water depth contour is not measured until approximately 500' waterward of
the applicant's bulkhead.
The existing docking facility has a main access pier that leaves the bulkhead and connects to an
uncovered `"f" alatform that supports an uncovered boatlift on the western side. This existing
docking facility extends approximately 260' waterward of the bulkhead at the NWL. The water depth
at the end of the existing platform is -2' NWL. The applicant wishes to remove the existing `T'
platform and boatlift and extend the_5'-wide walkway another 24n' waterward The applicant will
then reconstruct the 9' by 40' `"T" platform at the waterward terminus of this proposed extension. The
proposed platform will be partially covered on the western side. The 13' by 13' boat lift will be
constructed on the western side and a 14' by 26' boat house will be constructed over this boat lift.

residential docking facility.
10. Anticipated Imaacts:
The docking facility will not pose a hazard to navigation because it will be less than 1/4 of the width of
the waterbody and approximately 800' from the channel. The proposed docking facility will not be
longer than the pier head line established by the adjacent docking facilities. The docking facility will
be greater than 15' from both of the adjacent riparian property lines. This proposed private docking
facility will usurp and shade 3,174 ftZ of Public Trust Waters. This proposed extension will result in a
1,514 ft2 increase in shading of Public Trust Waters from the existing docking facility. The proposed
docking facility will extend the existing docking facility by another 230', and thus will extend 499'
waterward of the bulkhead at NWL. The Bay River is 4,183' wide at this location. This proposed
extension will give the applicant access to deeper water depths of -4' NWL. (Note: This water depth
was verified by field staff, with the Authorized Agent, on December 19, 2013 at this location.)
Traditional marine construction methodology will be utilized during the construction of this private
docking facility. Temporary, short-lived turbidity impacts are anticipated during the setting of the
docking facility's pilings. There is no proposed change in the number of boat slips, nor any
proposed change in the usage of the dock:
There is a cultural resource in the nearby vicinity of the project area (PM23). This project area is
subject to the Neuse River Riparian Buffer Rules. Water depths within the proposed boat slip are
deep enough to prevent scouring of the bottom habitat. These waters of the Bay River are not
classified as a Primary Nursery Area and there is not any submerged aquatic vegetation present.

There is not a defined Federal Channel in this area.

Our company has been contracted to construct an addition to the existing dock located at 1174 Murphy
Farm Rd. on Bay River in Pamlico County in Township #2. The project consists of extending the
existing 5' x 260' dock another 230' feet and relocating the 9' x 40' platform to the end of the
extension. A 9' x 10' gazebo is planned for the left hand side of the platform followed by a 26' x 14'
boat house. The boat house and gazebo will have a hip roof and the dock and platform will be
constructed with concrete slats. The boathouse is located approximately 1' off the western riparian
line and the platform is located approximately 12' from the eastern riparian line. The water depth at the
end of the current dock is inaccessible by boat and therefore the current boat lift is useless. The current
water depth is barely 3' on NWL. By extending the dock to 499' to the depth of 4 1/2' will allow use
of the boat lift. By extending the dock it also allows shorter access to deep water and less chance for
wear and tear of boat. This is a private residential dock. The width of the water body at this point on
the Bay River is approximately 4183' and the distance to the channel is approximately 850'
The property consist of a 100' x 300' lot with no wetlands present, the lawn is mowed up to the
wooden bulkhead with a few trees and shrubs. The lot has a home with a gravel driveway, a concrete
parking pad and a 260' concrete pier and a wooden bulkhead. The property is not near a PNA, the
property does lie within the prohibited shell fishing area as seen on Area F-6 (map 19).
The water classification is Bay River 27-150-(9.5)From a line across Bay River from Flea Point to The
Hammock, (excluding that portion of the Bay River landward of a line running from Poorhouse Point
to Darby Point which is classified SC SW NSW), to Pamlico Sound SA;HQW,NS
Mr. Huff Connor is the riparian owner on both sides of the project and has reviewed the project and
has no objections.

9. Narrative Description:
This is a Major Modification Request to State Permit # 50-13. It was issued on April 23, 2013. It
is set to expire on December 31, 2016. However, the authorized docking facility was not
constructed due to the applicant's miscalculation of the actual water depth needed for the draft -of
his particular vessel.
The property is located in Merritt at 1174 Murphy Farm Road (SR 1332), off of Florence Road (SR
1324) in Pamlico County. This site is developed with a single family residence, driveway; bulkhead,
and a docking facility. The lot is 0.71 acres. The adjacent lot to the east is similarly developed, and the
adjacent lot to the west is undeveloped. Both of the adjacent properties are owned by the same
individual.
The elevation of the high ground of the parcel is about +4' above the normal water level (nwl).
Vegetation'on the lot mainly consists of lawn grasses. There are no Coastal Wetlands on this
property. This lot has approximately 100' of continuous shoreline along the Bay River. Immediate
offshore water depths adjacent to the lot range from —V to —4' nwl. The subaqueous substrate is firm
without shell.,
There is a cultural resource in the nearby vicinity of the project area (PM23). This waterbody is
approximately 4,183 feet across at this location. These waters are not classified as a Primary Nursery
Area and there is not any submerged aquatic vegetation present. This area is closed to shellfish
harvest and is classified as SCA; Sw, Nutrient Sensitive Waters. There is not a defined Federal
Channel in this area. This project area is subject to the Neuse River Riparian Buffer Rules.
10. Proposed Development:
The applicant wishes to extend and reconfigure the existing private docking facility adjacent to the
Bay River, near Merritt. The proposed development will take place at 1174 Murphy Farm Road (SR
1332), off of Florence Road (SR 1324). The purpose of extending the docking facility is to gain
access to deeper water depths. There is a firm sandy shoal immediately adjacent to this section of
shoreline. The -4' NWL water depth contour is not measured until approximately 500' waterward of
the applicant's bulkhead.
The existing docking facility has a main access pier that leaves the bulkhead and connects to an
uncovered "T" platform that supports an uncovered boatlift on the western side. This existing
docking facility extends approximately 260' waterward of the bulkhead at the NWL. The water depth
at the end of the existing platform is -2' NWL. The applicant wishes to remove the existing "T"
platform and boatlift and extend the 5'-wide walkway another 230' waterward. The applicant will
then reconstruct the 9' by 40' "T" platform at the waterward terminus of this proposed extension. The
proposed platform will be partially covered on the western side. The 13' by 13' boat lift will be
constructed on the western side and a 14' by 26' boat house will be.constructed over this boat lift.
The water depth at the terminus of the proposed extension is -4' NWL. The applicant states that there
are two existing boat slips, and that there will be no increase in the number of boat slips at this private

residential docking facility.
10. Anticipated Impacts:
The docking facility will not pose a hazard to navigation because it will be less than 1/4 of the width of
the waterbody and approximately 800' from the channel. The proposed docking facility will not be
longer than the pier head line established by the adjacent docking facilities. The docking facility will
be greater than 15' from both of the adjacent riparian property lines. This proposed private docking
facility will usurp and shade 3,174 ft2 of Public Trust Waters. This proposed extension will result in a
1,514 ft2 increase in shading of Public Trust Waters from the existing docking facility. The proposed
docking facility will extend the existing docking facility by another 230', and thus will extend 499'
waterward of the bulkhead at NWL. The Bay River is 4,183' wide at this location. This proposed
extension will give the applicant access to deeper water depths of 4' NWL. (Note: This water depth
was verified by field staff, with the Authorized Agent, on December 19, 2013 at this location.)
Traditional marine construction methodology will be utilized during the construction of this private
docking facility. Temporary, short-lived turbidity impacts are anticipated during the setting of the
docking facility's pilings. There is no proposed change in the number of boat slips, nor any
proposed change in the usage of the dock:
There is a cultural resource in the nearby vicinity of the project area (PM23). This project area is
subject to the Neuse River Riparian Buffer Rules. Water depths within the proposed boat slip are
deep enough to prevent scouring of the bottom habitat. These waters of the Bay River are not
classified as a Primary Nursery Area and there is not any submerged aquatic vegetation present.

Our company has been contracted to construct an addition to the existing dock located at 1174 Murphy
Farm Rd. on Bay River in Pamlico County in Township #2. The project consists of extending the
existing 5' x 260'dock another 230' feet and relocating the 9'. x 40' platform to the end of the
extension. A 9' x 10' gazebo is planned for the left hand side of the platform followed by a 26' x 14'
boat house. The boat house and gazebo will have a hip roof and the dock and platform will be
constructed with concrete slats. The boat house is located approximately 1' off the western riparian
line and the platform is located approximately 12' from the eastern riparian line. The water depth at the
end of the current dock is inaccessible by boat and therefore the current boat lift is useless. The current
water depth is barely 3' on NWL. By extending the dock to 499' to the depth of 4 1/2' will allow use
of the boat lift. By extending the dock it also allows shorter access to deep water and less chance for
wear and tear of boat. This is a private residential dock. The width of the water body at this point on
the Bay River is approximately 4183' and the distance to the channel is approximately 850'
The property consist of a 100' x 300' lot with no wetlands present, the lawn is mowed up to the
wooden bulkhead with a few trees and shrubs. The lot has a home with a gravel driveway, a concrete
parking pad and a 260' concrete pier and a wooden bulkhead. The property is not near a PNA, the
property does lie within the prohibited shell fishing area as seen on Area F-6 (map 19).
The water classification is Bay River 27-150-(9.5)From a line across Bay River from Flea Point to The
Hammock, (excluding that portion of the Bay River landward of a line running from Poorhouse Point
to Darby Point which is classified SC SW NSW), to Pamlico Sound SA;HQW,NS
Mr. Huff Connor is the riparian owner on both sides of the project and has reviewed the project and
has no objections.

The following is my assessment and consequent recommendations of the above referenced proposal: This
proposal shades and incorporates 3,174 square feet of Public Trust Waters. This proposed docking facility
extends out approximately 500' from the existing bulkhead to the waterward edge of a sandy shoal in Bay
River.
These waters of the Bay River are closed to shellfish harvest. This waterbody is not a Primary Nursery Area.
This proposal will not pose a hazard to navigation. Assuming that state and federal agencies concur with the
proposal, I recommend the project be authorized as proposed, and that all the previous permit conditions shall
still apply.

The NC Division of Coastal Management hereby acknowledges receipt of your application for State approval
for development of your property located adjacent to the Bay Creek at 1174 Murphy Farm Road near Merritt,
Pamlico County. It was received on December 19, 2013, and appears to be adequate for processing at this time.
The projected deadline for making a decision is March 4, 2014. An additional 75-day review period is provided
by law when such time is necessary to complete the review. If you have not been notified of a final action by
the initial deadline stated above, you should consider the review period extended. Under those circumstances,
this letter will serve as your notice of an extended review. However, an additional letter will be provided on or
about the 75th day.
If this agency does not render a permit decision within 70 days from December 19, 2013, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request and shall
include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a 'Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your,
property where it can be observed from a public road. Some examples would be: Nailing the notice card to a
telephone pole or tree along the road right-of-way fronting your property, or at a point along the road right-of-
way where a private road would lead one into your property. Failure to post this notice could result in an
incomplete application.

DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as required by NCGS 113A-
119(b) that application for a development permit in an Area of Environmental Concern as designated under the CAMA
was received on December 19, 2013. According to said application, Mr. Thomas Cowan proposes to extend and
reconfigure a private docking facility in the Bay River at 1174 Murphy Farm Road (SR 1332), off of Florence Road
(1324), near Merritt. A copy of the entire application may be examined or copied at the office of Brad Connell, NC
Division of Coastal Management, located at 400 Commerce Avenue, Morehead City, NC, [phone] during normal
business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400 Commerce Avenue,
Morehead City, N.C. 28557, prior to February 28, 2014, will be considered in making the permit decision. Later
comments will be accepted and considered up to the time of permit decision. Project modification may occur based on
review and comment by the public and state and federal agencies. Notice of the permit decision in this matter will be

that Mr. Cowan is proposing to go 499' waterward of the bulkhead. Therefore, the DCM has insufficient data to make a
