The original (buff -colored form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the final decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance require additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance. With the requirements of a S.E.P.A. document needed for the dredging, we feel that process would take too long and the riprap is most important at this time. The CAMA Major Permit request will only include shoreline stabilization and the ---filling of 1,500 square feet of coastal wetlands. The riprap request appears to be consistent with Specific Use Standard 07H .0208(7) Bulkheads and Shoreline Stabilization and there is strong evidence of erosion along the shoreline. The system being proposed will afford protection to the wetland fringe while allowing continued growth. The second part of the request includes filling approximately 1,500 square feet of coastal wetlands between the pond and the Currituck Sound, along the south side of the property. Over the years wetland species have established between existing riprap material and in an low strip adjacent to the shore. The County's representative Mike Doxey, indicated the reasons behind the filling is for esthetics and to reduce the possibility of the wetland harboring snakes. The applicant has not given sufficient reason the fill the coastal wetland fringe and is not necessary for the full development of the property. I would like to recommend that the project be approved with the following conditions: 1. The riprap will not extend waterward more than 16' feet from the mean high water level along the northern side of the old landing strip. 2. The alignment of the proposed riprap must be staked by a representative of the Division of Coastal Management (DCM) within a maximum of thirty (30) days prior to the start of construction. DATE: September 20, 1996 The project proposal is to place 1,175 foot of rip -rap along estuarine shoreline on Currituck Sound; and, filling about 1,500 square feet of coastal wetlands. Consistency Determination: The County's proposal is consistent with it's LUP document. . Basis for Determination: The Currituck County 1990 Land Use Plan certified by the CRC on July 25, 1991 was reviewed to consider a determination. The proposal involves extensive rip -rap along the Estuarine Shoreline. County Land Use Goals and Policies related to estuarine systems includes the following on page 62: "Goal: 7.2 To maintain the high quality of estuarine waters and to promote appropriate development along estuarine shorelines so as not to degrade the Estuarine System." LUP text also states: "Appropriate development for estuarine waters include low impact recreational uses that do not interfere with the vital functions of the estuarine waters such as raised walkways, docks, bulkheads, boathouses, etc., and other uses that comply with CAMA regulations of the Unified Development Ordinance and that comply with the CAMA regulations ..... Appropriate erosion and sedimentation control devices, measures, or structures be used to prevent sediment from entering the adjacent wetlands/watercourses/ property (e.g., silt fence, diversion swales/berms, sand fence, etc.). 5. Box 39 Currituck, North Carolina 27929 RE: Dredged Canal at Whalehead Bay Dear Mr. Richardson: As an agency involved in the Division of Coastal Managements major permit application review process, we have determined that more than one acre will be disturbed by the activities as described. Therefore, in addition to a permit from the Division of Coastal Management, an erosion and sedimentation control plan must be submitted to and approved by this office before development begins. The requiring of an erosion and sedimentation control plan is based on a mandatory standard for land -disturbing activity of the Sedimentation Pollution Control Act of 1973 [NCGS 113A-57(4) and 113A-54(d)(4)], which states: No person shall initiate any land -disturbing activity, if at least one acre is to be uncovered, unless an erosion and sedimentation control plan for the activity is filed with the agency having jurisdiction and approved. County of Currituck Bio Report Page 2 Project Setting The project setting is at the Historic Whalehead Club on Currituck County's Outer Banks. The property is located between Currituck Sound and NC 12, just south of the Currituck Lighthouse and adjacent to Whalehead Bay. The property consists of 16.55 acres and has a variety of structures including the main house, a boathouse with docking facilities for 36 boats, a swimming pool and associated cabana, a sound side walk with gazebo, and a foot bridge that crosses a short canal entrance to a boat basin. Also located on the property, between the sound and the clubhouse, is a 1.4 acre pond that with an average depth of four feet. Approximately 10,250 square feet of the pond lies within CAMA's Area of Environmental Concern. Vegetation growing along the edge of the pond includes, but is not limited to Black Needlerush (Juncus roemerianuc), Olney's Three Square (Scirpus amerfcanus), Salt Meadow Cordgrass (Spartina patens), and Sea Ox-eye(Borrichia fnuescens). Vegetation found in upland areas of the property include a variety of lawn grasses, Loblolly Pine (Mnus taeda), Wax -myrtle (Myrica cerlfera), and Live Oak (Quercus virginiana). The waters in the area of the proposed project have a history of containing high levels of submerged aquatic vegetation (SAV) including Eurasian Watermilfoil (Myriophyllum spicatum) and Eelgrass (Zostera marina). The access canal leading into the basin is approximately 34' wide with an average depth of 3'- 3". The foot bridge crossing the canal has a 14' wide open area to allow boats to enter the boat basin. Depths in the boat basin range from 3'- 0" to 41- 6". There are no visible channels leading to the property near the proposed alignment. Review of aerial photography indicates that around 1984 a channel existed adjacent to the shoreline and ran south of the canal entrance out towards the point along the remnant bulkhead (See Staff Workplat). The shoreline around the property is irregular and shows signs of severe erosion in some places. Two sections along the point contain coastal wetlands. A 165' x 10' wetland fringe is located along the northwest side of the point and extends from the shore to a remnant bulkhead, and along the southeast side there is a 110'x 2' fringe. Project Description There are three phases of work to be accomplished under the proposed project: The first phase of the project includes hydraulically dredging a 2,250' x 55'x 6' channel from an existing boat basin to a connecting depth of 6' in the Currituck Sound. The 2,250 channel will start at the mouth of the access canal entering the boat basin where the depth is significantly shallower that the adjacent canal. The project does not include any dredging activity inside, the County of Currituck Bio Report Page 3 canal or the boat basin. The depth of the canal is an average of ,3'- 0" while the depth in the basin ranges from 3'- 0" to 4'- 6". A second channel, 275'x 55' x 6' will be hydraulically dredged from an existing boat ramp to the main channel. The shorter channel will lead directly to the boat ramp and will not include any dredging around the existing boat slips adjacent to the boat ramp. Depths around the boat slips ranges from V- 0" to 2'- 0". The average depth of the main channel is currently 4' and will result in 8,166 cubic yards of spoil material. The smaller channel has an average depth of 2'- 0" and will result in approximately 1,622 cubic yards of spoil material. Spoil material from the project will be pumped into a pond located to the rear of the old Whalehead Clubhouse. The pond is 1.4 acres (60,984 square feet) and has an average depth of 4'- 0". A 3'- 0" high berm will be placed around the perimeter of the pond and will have a holding capacity of approximately 11,293 cubic yards (See Enclosed Plan Page 2 of 3). The second phase of the project will include the placement of riprap breakwater system along 1,138' of estuarine shoreline. While the application indicates that the length of the shoreline to be stabilized is 1,138', field measurements indicate that 1,175 of shoreline will be involved. Approximately 356' of the shoreline has a coastal wetland fringe that the applicant proposes to riprap on the waterward side. Wetland vegetation found along the shore includes Olney's Three Square (Scirpus americanus), Cattail (7ypha sp.) and Salt Meadow Cordgrass (Spartina patens). The riprap will extend between 8' to 16' waterward of mean high water along areas with coastal wetlands. The remaining shoreline has a severe erosion scarp with no coastal vegetation associated. Riprap along the erosion scarp will extend approximately 3' waterward of mean high water. The total area of shallow water, below Mean High Water, that will be filled by the placement of riprap is approximately 4,593 square feet. The final phase of the project will include the filling of approximately 1,500 square feet of coastal wetlands that has emerged in and around an existing section of riprap immediately adjacent to the pond as shown on the plan noted as •"Page 3 of 3". While the total area involved is approximately 150' x 10' riprap material is in and around the vegetation, reducing the actual area of coastal wetland that will be affected. Anticipated Impacts 1) The first phase of the project will result in approximately 138,875 square feet of shallow water bottom will be disturbed by hydraulic dredging and increase turbidity in surrounding water. The 1.4 acre pond located adjacent to the sound will be filled by the resulting spoil material and result in the filling of approximately 1,180 square foot fringe County of Currituck Bio Report Page 4 of wetland vegetation located around the perimeter of the pond. Submerged aquatic vegetation is evident in the project area and it is anticipated that it will be impacted. In previous years heavy mats of vegetation have established along the mouth of the basin canal and in the sound. 2) According to the application the placement of riprap along the estuarine shoreline will impact approximately 5,481 square feet of shallow water bottom and result in short term turbidity of surrounding water. 3) The final phase of the project will result in the filling of an area of coastal wetlands not to exceed 1,500 square feet. 4) While no cheological sites are known to associated with this property, shell midden is presen 6666ng the erosion scarp on the east end of the point. The property is a historical site that is currently being offered to the State of North Carolina by Currituck County. 5) There are no unique remnant species or geological formations known to be associated with this site. 6) The Whalehead Club is listed on the National Historic Register. The applicant proposes to dispose of the spoil in Federal jurisdictional wetlands and an open water (1.4 acre) pond onsite. Additionally, the applicant proposes to place riprap along 1,175 linear (non -continuous) feet of shoreline. This shoreline was previously bulkheaded, and has erosion escarpments. The riprap will be located waterward of fringe wetlands, filling this habitat. This is the report of the Service submitted pursuant to, and in accordance with, provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and the Endangered Species Act of 1973 (87 Stat. 884, as amended; 16 U.S.C. 1531 et seq.). The Service recommends the District Engineer request a modification of this permit application such that (1) the riprap is placed landward of the Normal Water Level (NWL) and makes use of clean, washed material, and (2) an alternate, upland spoil disposal site be found and used for dredged material disposal. The proposed activities would impose avoidable adverse impacts on fish and wildlife resources. The shoreline was historically bulkheaded, and this often that backfill was used to create an artificial shore upland attributes. The bulkhead has degraded, and the (backfill) has eroded landward. The Service believes tha artificial shoreline which have retreated landward are, in effect, -.-•:-; reclaimed aquatic habitat. We recommend that either the present shoreline, or the -original, pre -bulkhead shoreline, be considered the baseline condition for this site. Placing the riprap as proposed represents a net loss of current =<' (reclaimed) wetlands and aquatic habitat. The proposed riprap should be installed landward of the NWL. Similarly, wetland and aquatic habitat will be lost should dredging spoil be placed in the existing pond.' This is clearly an avoidable loss of wetlands. An upland site should be selected for spoil disposal, and that site should have sufficient safeguards to ensure that turbid or sediment -laden drainwater doesnot enter any surface waters. The purpose of the project is to provide better boating access to the existing boat basin and boat ramp at the Whalehead Club. This letter details reasons: (1) why there may be substantial and unacceptable adverse impacts to aquatic resources of national importance; and (2) why issuance of the specified permit must be conditioned or denied to protect these resources. The proposed work consists of the construction of two access channels in Currituck Sound. One, a 2250-foot-long by 55-foot-wide by 6-foot-deep channel connecting the existing boat basin with the six foot normal water level (NWL) contour and the other a 275-foot- long by 55-foot-wide by 6-foot-deep channel connecting the existing boat ramp to the main channel. The current average depth in the area of the main channel and boat ramp channel is 4-feet and 2-feet NWL, respectively. A hydraulic dredge will be use to construct the proposed channels with the resulting 9,788 cubic yards of dredged material deposited in an existing 1.4 acre pond on the applicant's property. Also proposed is the placement of riprap material along 1,175 feet of estuarine shoreline for erosion control. The proposed riprap will extend between 8 and 16 feet waterward of the NWL and result in the filling of 4,493 square feet of shallow water and 1,500 square feet of emergent marsh. Based on coordination with the North Carolina Division of Coastal Management (NCDCM), the North Carolina Division Environmental Management (NCDEM), and our knowledge of the project area, we believe that this project would adversely impact living marine resources. A review of aerial photography of Currituck Sound and Whalebone Bay, which includes the project area, indicates that the proposed channel alignments are vegetated with several species of submerged aquatic vegetation (SAV). An on -site inspection by the NCDCM on July 30, 1996, found widgeon grass (Ruppia maritima), eelgrass (Zostera marina) and milfoil (Myriophvllum spp.) within the proposed channel alignments. Areas of SAV are of special concern in that they constitute an aquatic resource of national importance. Studies conducted by the NMFS indicate that SAV is an important source of primary production in the aquatic food chain and provides essential forage and nursery habitat for a variety of estuarine dependent species.1,2 Construction of the access channels as proposed would alter approximately 3.19 acres of SAV and shallow water benthic habitat and, thereby, eliminate or reduce their value to fisheries. In addition to SAV, shallow water bottoms at the project area also support epibenthic green algae that contribute to overall estuarine productivity.3 Deepening the area to six feet would limit available light and reduce algal productivity. These areas also support benthic species such as polychaetes and shellfish that are important food sources in the aquatic food chain. .In addition, the proposed riprap along the shoreline would fill 0.13 acre of shallow bottom and 0.03 acre of coastal wetlands that provides the functions and values addressed above. Commercially, recreationally, and ecologically important estuarine dependent fishery resources that utilize the project area as habitat include Atlantic croaker (Micronoaonias undulatus), spotted seatrout (Cvnoscion nebulosus), flounders (Paralichthvs spp.), red drum (Sciaenops ocellatus), striped mullet (Muail cephalus) Atlantic menhaden (Brevoortia tvrannus), shrimp (Penaeus spp.) and coquina clam (Donax parvula). Additionally, the Mid -Atlantic Fishery Management Council, in cooperation with the SAFMC, has developed FMPs for summer flounder. The FMPs for red drum, shrimp, and flounders specify rigorous management and protection of the managed species and their essential habitat. The site has historically been used for access to Currituck Sound by small boats, and we have no objection to its continued use for this purpose. However, no justification for the need for an access channel of a magnitude requiring the loss of 3.19 acres of SAV and shallow water habitat is provided in the public notice. In view of the above, we have determined that this work would result in an unacceptable loss of habitat that supports NMFS trust resources of national importance and recommend that federal authorization of this project not be granted. Alternatively, the applicant should consider improvements to the facility that would allow for the current level of use for small boats to continue without the loss of SAV habitat and with only minimal impacts to emergent marsh and shallow water habitat.
