An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. Box 39 Currituck, NC 28469 Dear Sir: The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the final decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. Schecter, Director MEMORANDUM NANAyEWNT TO: John Parker, Jr. 19 - IV FROM: Lynn Mathis SUBJECT: Minor Mo ' cation of Currituck County's Major Permit #166-96 DATE: January 27, 1997 The applicant would like to construct a drainage system to alleviate problems associated with surface runoff and standing water on streets within the Idistoric Whalehead Club property in Corolla, Currituck County. Surface runoff results from groundwater and stormwater, which drains unobstructed into a canal on the property, causing severe erosion long its point of entrance. The applicant believes that the drainage system will prevent future problems associated with standing water while stabilizing the shoreline and reducing siltation in the canal. The canal bank where the erosion is occurring has a steep slope and is approximately four feet above mean high water. More than 200 square feet of the bank has eroded, creating a deep gouge approximately 15' wide at the canal and extending landward 28'. The eroded pocket is triangular, as shown in attachment #1, and slopes down to a small triangular pocket below the normal water line (5' x 10). While there is evidence of minor erosion along the canal bank, the erosion where the runoff enters the canal is more dramatic. The applicant proposes to install a storm drainpipe system that will terminate 165' east of the NWL created by erosion. The drainpipe will flow into a six-foot wide drainage swale with a two -foot wide base and side slopes of 4:1. The drainage swale will graduate into the canal at a 4:1 slope and have an apron lined with filter fabric and 18" of rock. The riprap apron will begin approximately 20' landward of the canal and four feet landward of the waterward slope. Based on the configuration shown on the enclosed drawings 15.5 cubic yards of rock will be placed within the Estuarine Shoreline and Estuarine Water AEC. The area to be covered with riprap will be 344 square feet, and of that 25 square feet will be in estuarine water. A small pocket of erosion, landward of the riprap apron, and 22.6 square feet in size, will also require fill material. Approximately 785 square feet of land disturbing activity will occur above the NWL within the Estuarine AEC. The problem has been on going for several years and the erosion at the site has accelerated within the last year (This is based on personal observation during several field visits in association with other County projects). Review of the NC Administrative Code, Section 07H .0208(b)(4) indicates that the project can comply with the specific standards. I would like to recommend that the proposal be approved with the condition that all land J disturbing activity be undertaken landward of a silt fence or protective barrier to prevent further 1 siltation of the adjacent canal. Installation of the proposed drainage improvements would not only alleviate the problem of water standing on the streets and adjoining property, but would also decrease or eliminate the erosion which is occurring at the canal.
