Upland Basin Excavation 1) Unless specifically altered herein, the dimensions of the area to be excavated shall not exceed the area that is expressly and specifically set forth in the attached permit application and workplan drawings. Any proposal to change the area to be excavated shall require permit modification. 2) Excavation shall not exceed —4' feet below normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2016 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. Spoil Disposal 6) All excavated materials shall be confined above normal water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 7) Any change in the spoil disposal area shall require additional authorization from the Division of Coastal Management. Shoreline Stabilization 8) The authorized bulkhead shall adhere to the alignments depicted on the attached workplan drawings. 9) The bulkhead shall be constructed prior to any backfilling activities. 10) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 11) The bulkhead wall shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles or other suitable materials approved by division personnel. 12) All backfill material shall be clean and free of any pollutants except in trace quantities. 13) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. Sedimentation and Erosion Control 14) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. l . George C. Loai'house/Doc',sina Facility 16) Unless specifically altered herein, this permit authorizes the docking facility, catwalk, and boathouse that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 17) The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. 18) The authorized boathouse shall be single story, and shall not be designed to allow for second story use. 19) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable water at or adjacent to authorized work. 20) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 21) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 22) This permit authorizes one additional boat slip for a maximum of three formalized boat slips. General 1)3) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 24) Any additional land disturbing activities and/or construction may require a modification of this permit. . Clark Smith Shores Beaufort County Project Setting The 0.73 acre project site is located in a residential subdivision off SR 1769, Smith Shores Road, at 22 Ravenwood Lane adjacent the Smith Shores canal off Pungo Creek in the community of Smithton near Belhaven in Beaufort County, North Carolina. The project site is a developed single family residential lot bordered to the north by Smith Shores Road, to the east by Ravenwood Lane, to the south by another developed single family residential lot and to the west by the Smith Shores canal. The Smith Shore canal, at this location, terminates after turning to the west for t300', parallel to Smith Shores Road. The lot contains no wetlands and is vegetated with upland lawn grasses. The ground elevation of the lot is 2.5' to 3' above the normal water level (NWL) of the canal. There is no woody vegetation on the lot. There is a two car garage with an upstairs apartment located on the east side of the property immediately adjacent Ravenwood lane. There is a drainage swale/ditch between the lot and Smith Shores Road. The lot has 165' feet of shoreline stabilized with an aging wood bulkhead. There are two small wood platforms/docks located adjacent/landward of the bulkhead, the largest serving as a dock/slip for a 28' sailboat. There are four tie pilings just offshore of the bulkhead used to moor the aforementioned sailboat. Smith Shore canal is 30' wide in the vicinity of the project site. Water depths in the canal are 6' below the NWL in the center and gradually get shallower as you move from the center toward the banks. The Smith Shores canal is designated as Estuarine Waters by the Marine Fisheries Commission and is classified as SC NSW by the Environmental Management Commission and is closed to shellfishing. Project Description The applicant proposes to excavate an area 16' wide x 30' long of the canal and adjacent uplands to a depth of -4' below the NWL for the purpose of creating a boat slip/basin to be covered with a 14' x 24' boathouse. A 2' wide catwalk is proposed down the north side of the boathouse. The upland cut is to be stabilized with a bulkhead. The proposed basin is to be located immediately adjacent the ditch/swale and Smith Shores Road. The mouth of the ditch/swale is open water thus the upland cut will have only two sides which the applicant proposes to stabilize with a bulkhead. Spoil material from the basin excavation will be spread onsite in a low area adjacent Ravenwood Lane. The applicant also proposes to replace the existing bulkhead by removing it and then excavating some areas as much as f2' landward along the alignment to achieve a more straight alignment without encroaching the bulkhead into the navigable area of the canal. The applicant also proposes to construct a 15' wide x 20' long boat ramp by excavating the boat ramp slope landward of the existing bulkhead. Approximately 5' of the concrete boat ramp will extend into the canal. Anticipated Impacts The basin excavation will disturb 160 ft2 of canal bottom and 320 ft2 of uplands. The boat ramp construction will disturb 225 ft2 of uplands and 75 ft2 of canal bottom. The bulkhead installation will result in the excavation of 330 ft2 of uplands and the filling of 1,650 ft2 of uplands. Spoil disposal will fill 4,000 ftZ of uplands. The project will disturb a total of 7,096 ft2. The boathouse will shade 336 ft2 of canal basin bottom. There will be some short term localized turbidity during excavation and bulkhead construction activities. The boat ramp and boat house will increase small boat usage in the area and their associated impacts. Clark Smith Shores Beaufort County Project Setting c i102912 The 0.73 acre project site is located in a residential subdivision off SR 1769, I9mitla Shores Road, at 22 Ravenwood Lane adjacent the Smith Shores canal off Pungo Creek in the community of Smithton near Belhaven in Beaufort County, North Carolina. The project site is a developed single family residential lot bordered to the north by Smith Shores Road, to the east by Ravenwood Lane, to the south by another developed single family residential lot and to the west by the Smith Shores canal. The Smith Shore canal, at this location, terminates after turning to the west for f300', parallel to Smith Shores Road. The lot contains no wetlands and is vegetated with upland lawn grasses. The ground elevation of the lot is 2.5' to 3' above the normal water level (NWL) of the canal. There is no woody vegetation on the lot. There is a two car garage with an upstairs apartment located on the east side of the property immediately adjacent Ravenwood lane. There is a drainage swale/ditch between the lot and Smith Shores Road. The lot has 165' feet of shoreline stabilized with an aging wood bulkhead. There are two small wood platforms/docks located adjacent/landward of the bulkhead, the largest serving as a dock/slip for a 28' sailboat. There are four tie pilings just offshore of the bulkhead used to moor the aforementioned sailboat. Smith Shore canal is 30' wide in the vicinity of the project site. Water depths in the canal are 6' below the NWL in the center and gradually get shallower as you move from the center toward the banks. The Smith Shores canal is designated as Estuarine Waters by the Marine Fisheries Commission and is classified as SC NSW by the Environmental Management Commission and is closed to shellfishing. Project Description The applicant proposes to excavate an area 16' wide x 30' long of the canal and adjacent uplands to a depth of -4' below the NWL for the purpose of creating a boat slip/basin to be covered with a 14' x 24' boathouse. A 2' wide catwalk is proposed down the north side of the boathouse. The upland cut is to be stabilized with a bulkhead. The proposed basin is to be located immediately adjacent the ditch/swale and Smith Shores Road. The mouth of the ditch/swale is open water thus the upland cut will have only two sides which the applicant proposes to stabilize with a bulkhead. Spoil material from the basin excavation will be spread onsite in a low area adjacent Ravenwood Lane. The applicant also proposes to replace the existing bulkhead by removing it and then excavating some areas as much as t2' landward along the alignment to achieve a more straight alignment without encroaching the bulkhead into the navigable area of the canal. The applicant also proposes to construct a 15' wide x 20' long boat ramp by excavating the boat ramp slope landward of the existing bulkhead. Approximately 5' of the concrete boat ramp will extend into the canal. Anticipated Impacts The basin excavation will disturb 160 ft2 of canal bottom and 320 ft' of uplands. The boat ramp construction will disturb 225 ft' of uplands and 75 ft' of canal bottom. The bulkhead installation will result in the excavation of 330 ft' of uplands and the filling of 1,650 ft' of uplands. Spoil disposal will fill 4,000 ft' of uplands. The project will disturb a total of 7,096 ft'. The boathouse will shade 336 ft' of canal/basin bottom. There will be some short term localized turbidity during excavation and bulkhead construction activities.
