Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be nun and void. Docking Facility 1) Unless specifically altered herein, this permit authorizes only the additional boat lift to the existing docking facility, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2016 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Cerasani Permit # 75-13 Page 2 of 3 ADDITIONAL CONDITIONS 2) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall -be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) This permit authorizes one additional boat slip for a maximum of four formalized boat slips. General 7) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall, cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States. or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 8) No Coastal Wetlands or open water areas shall be excavated or filled, even temporarily. 9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 10) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation. Skvarla, III Secretary The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the final decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance requires additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. To get to the site from Wilmington take US Hwy 17 N to Country Club Road (approximately 2.37 miles north of the intersection of Highway 17 and 210 in Hampstead). Turn right onto Country Club Road and travel approximately 0.70 miles before turning right onto Olde Point Road. Travel along Olde Point Road approximately 1.10 miles and turn right onto Olde Point Loop Road. Follow Olde Point Loop Road for approximately 0.30 miles and then turn right onto White Heron Cove Road. The subject property is located on the left hand side of White Heron Cove Road, at house number 437. The lot is approximately 0.72 acres and existing man-made features on the property include a single-family residence, bulkhead, pier and docking system. The high ground portion is elevated approximately 10-12 feet above the Normal High Water (NHW). Vegetation on the tract consists of lawn grasses, ornamental trees and shrubs. The highground transitions to an area of high marsh consisting of Spikegrass (Distichlis spicata), Salt Meadow Hay (&N mina patens), and Black Needlerush (Anus roemerianus) which extends approximately 5-10 feet in width toward the Normal High Water (NHW). The high marsh transitions waterward to an area of low marsh (approximately 40 feet in width) that consists primarily of Smooth Cordgrass (Spartina Alternii lora). The property has approximately 150 linear feet of shoreline, all of which is stabilized by a wooden bulkhead. The existing pier is located along the northern property line, adjacent to Old Topsail Creek. The existing pier (5' x 55') terminates approximately 5 feet beyond the edge of the marsh (bordering the property). A ramp (gang way) extends from the end of the pier, north to an existing 8' x 32' section of floating dock, which runs parallel to the shoreline. The existing docking facility also includes a small jet -ski lift (davit lift) that is located at the terminal end of the existing pier. The width of the waterbody in this area of Old Topsail Creek ranges from 88 to 93 feet, as measured from the edge of marsh to edge of marsh. Current water depths around the existing facility range from approximately -2.0' to -4.7', relative to Normal Low Water (NLW). The waters of Old Topsail Creek, adjacent to the project site, are classified as SA by the North Carolina Division of Water Quality. They ARE designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to construct a new 12' x 12' boatlift along the southern side of the existing docking facility. Specifically, the proposed lift would be located immediately adjacent to the existing floating dock. As documented, the width of the waterbody (in the vicinity of the proposed lift) measures between 88 and 93 feet. Holding to the''/4 width length limitation, all new development would need to terminate a distance of 22'-23' from the outer edge of the coastal marsh; however, due to the current dock configuration, in addition to the adjacent docking facilities on either side (i.e. pier -head line), it appears the applicant may exceed the'/4 width limitation and extend approximately 30 feet from the outer edge of the marsh. As proposed, the boatlift would extend approximately 28'-30' from the edge of the marsh, but would be within 1/3rd of the width of the water, as well as within the existing pier -head line. In addition, the proposed lift would be located landward of the edge of the maintained channel. Water depths in the area of the proposed boatlift range from -3.0' to -4.01, relative to NLW. According to the work plat drawings, the lift would be located outside of the maintained channel, within the pier -head alignment, within 1/3rd of the width of the waterbody and within the applicant's area of riparian access. ANTICIPATED IMPACTS As proposed, the planned development would incorporate approximately 144 sq. ft. of Public Trust Waters. The applicant has approximately 150 linear feet of shoreline allowing up to 1,200 sq. ft. of platform or docking space. As constructed, the total square footage of the existing facility (platform and floating dock) equals approximately 256 sq. ft. No impacts to Coastal or "404" wetlands would occur as a result of construction. Any permit issued should also include the following conditions: 1. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the established pier head line. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 5. The proposed structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 6. This permit does not authorize the interference with any existing or proposed Federal project, and, the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third -party. 8. This permit authorizes a maximum of four (4) boat slips. At no time shall more than four (4) vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. PROJECT DESCRIPTION: The project site is located at 437 White Heron Cove Road, adjacent to Old Topsail Creek, in Hampstead, Pender County. To get to the site from Wilmington take US Hwy 17 N to Country Club Road (approximately 2.37 miles north of the intersection of Highway 17 and 210 in Hampstead). Turn right onto Country Club Road and travel approximately 0.70 miles before turning right onto Olde Point Road. Travel along Olde Point Road approximately 1.10 miles and turn right onto Olde Point Loop Road. Follow Olde Point Loop Road for approximately 0.30 miles and then turn right onto White Heron Cove Road. The subject property is located on the left hand side of White Heron Cove Road, at house number 437. The lot is approximately 0.72 acres and existing man-made features on the property include a single-family residence, bulkhead, pier and docking system. The high ground portion is elevated approximately 10-12 feet above the Normal High Water (NHW). Vegetation on the tract consists of lawn grasses, ornamental trees and shrubs. The highground transitions to an area of high marsh consisting of Spikegrass (Distichlis spicata), Salt Meadow Hay (Spartina patens), and Black Needlerush C&ncus roemerianus) which extends approximately 5-10 feet in width toward the Normal High Water (NHW). The high marsh transitions waterward to an area of low marsh (approximately 40 feet in width) that consists primarily of Smooth Cordgrass (Spartina Alterniora). The property has approximately 150 linear feet of shoreline, all of which is stabilized by a wooden bulkhead. The existing pier is located along the northern property line, adjacent to Old Topsail Creek. The existing pier (5' x 55') terminates approximately 5 feet beyond the edge of the marsh (bordering the property). A ramp (gang way) extends from the end of the pier, north to an existing 8' x 32' section of floating dock, which runs parallel to the shoreline. The existing docking facility also includes a small jet -ski lift (davit lift) that is located at the terminal end of the existing pier. The width of the waterbody in this area of Old Topsail Creek ranges from 88 to 93 feet, as measured from the edge of marsh to edge of marsh. Current water depths around the existing facility range from approximately -2.0' to -4.7', relative to Normal Low Water (NLW). The waters of Old Topsail Creek, adjacent to the project site, are classified as SA by the North Carolina Division of Water Quality. They ARE designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to construct a new 12' x 12' boatlift along the southern side of the existing docking facility. Specifically, the proposed lift would be located immediately adjacent to the existing floating dock. As documented, the width of the waterbody (in the vicinity of the proposed lift) measures between 88 and 93 feet. Holding to the'/4 width length limitation, all new development would need to terminate a distance of 22'-23' from the outer edge of the coastal marsh; however, due to the current dock configuration, in addition to the adjacent docking facilities on either side (i.e. pier -head line), it appears the applicant may exceed the'/4 width limitation and extend approximately 30 feet from the outer edge of the marsh. As proposed, the boatlift would extend approximately 28'-30' from the edge of the marsh, but would be within 1/3 s of the width of the water, as well as within the existing pier -head line. In addition, the proposed lift would be located landward of the edge of the maintained channel. Water depths in the area of the proposed boatlift range from -3.0' to -4.0', relative to NLW. According to the work plat drawings, the lift would be located outside of the maintained channel, within the pier -head alignment, within 1/3 s of the width of th applicant's area of riparian access. ANTICIPATED IMPACTS As proposed, the planned development would incorporate approximately 144 sq. ft. of Public Trust Waters. The applicant has approximately 150 linear feet of shoreline allowing up to 1,200 sq. ft. of platform or docking space. As constructed, the total square footage of the existing facility (platform and floating dock) equals approximately 256 sq. ft. No impacts to Coastal or "404" wetlands would occur as a result of construction. As previously indicated, the planned development would be located within the applicant's area of riparian access (outside of the 15' setback), within the pier -head line and within 1/3rd of the width of the waterbody. Skavarla, III Secretary The Division of Coastal Management hereby acknowledges receipt of your application requesting State approval for development of your property located at 437 White Heron Cove Road, adjacent to Topsail Creek, in Hampstead, Pender County. Your application was received complete on April 10, 2013, and appears to be adequate for processing at this time. The projected deadline for making a decision is June 25, 2013. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75`" day. If this agency does not render a permit decision within 70 days from April 10, 2013, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property.
