Permit Class Permit Number NEW 19-13 STATE OF NORTH CAROLINA Department of Environment and Natural Resources and Coastal Resources Commission Verm't for ' X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to Tony R. Carrow, 202 Carrow Lane, Chocowinity, NC 27817 Authorizing development in Beaufort - Countyat Pamlico River, 264 Driftwood Drive, 'Blounts Creek, Crystal Beach SM , as requested in the permittee's application dated 11 /7/12 including the attached workplan drawing (4), all dated 11/7/12 This permit, issued on February 4., 2013 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may 1 be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. t. Retaining Wall 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the retaining walls, all as expressly and specifically set forth in the attached permit application and workplan i drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (252) 946-6481 for this determination. 2) The alignment of the retaining wall shall be staked by the permittee and approved on site by a Division of Coastal Management representative prior to initiation of construction. (See attached sheets for Additional Conditions) ;'This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2016 In issuing this permit, the State of North Carolina agrees 'that your project is consistent with the North Carolina Coastal Management Program. Carrow Permit #19-13 Page 2 of 4 ADDITIONAL CONDITIONS 3) The authorized retaining wall shall adhere to the alignment depicted on the attached workplan drawings. 4) The retaining wall shall be constructed prior to any backfilling activities. 5) , The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 6) The retaining wall shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) The retaining wall shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 8) All backfill material shall be clean and free of any pollutants except in trace quantities. Docking Facility 9) Unless specifically altered herein, this permit authorizes the docks, piers, boatlifts and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure; whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 10) Should either adjacent waterfront lot be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) agreeing to allow the construction of the permitted docking facility within the riparian corridor of that property, and a copy of the new agreement shall be submitted to the Division of Coastal Management prior to initiating construction of the docking facility. .11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 12) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 13) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 14) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. Carrow Permit #19-13 Page 3 of 4 ADDITIONAL CONDITIONS 35) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 16) This permit authorizes a maximum of four (4) formalized boat slips in association with this docking facility. Groins = 17) The dimensions of the permitted groin shall not exceed those shown on the attached workplan drawings. 18) The height of the groins shall not exceed one foot above normal water level. 19) The permitted groin shall be constructed of treated wood, plastic lumber, metal sheet piles or other suitable materials approved by Division of Coastal Management personnel. Sedimentation and Erosion Control 20)< In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 21) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the top of the retaining wall immediately following completion of backfilling activities. General 12) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 23) No wetlands shall be excavated or filled, even temporarily. :.24) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 25) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: The permittee is advised that many development or land disturbing activities are not allowed within the Environmental Management Commission's Neuse River basin. Contact a representative of the Division of Water Quality at (252) 946-6481 for more information concerning allowable uses within the Tar/Pamlico River Buffer. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. NOTE: The N.C. Skvarla, III Secretary The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the final decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance requires additional . approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. The lot is approximately 0.2 acres (8,840 ft=) in size and has approximately 52 linear feet of shoreline. A natural bluff, ±20' above normal water level (NWL) in elevation, is a dominating geographic feature within the Crystal Beach subdivision. The subject property is located on this eroding bluff shoreline. Man-made features on this property consist of a single-family dwelling 85' landward of a bulkhead. The single-family dwelling is 20' — 25' landward of the top of erosion escarpement. Additionally, a metal retaining wall located approximately 17' feet landward of the existing bulkhead was destroyed by Hurricane Irene in 2011. Remnants of a boathouse are located approximately240' offshore. The River in the nearshore area is very shallow and largely consists of sandy soil. Although Submerged Aquatic Vegetation is known to present in the nearshore area of Crystal Beach none was observed in the vicinity of the proposed pier. This may be due to the fact that a pier previously existed on this property. Both the eastern (downstream) side and western (upstream) side of the proposed project site are developed lots with single-familydwellings which have the same elevation oft 20' above NWL. The upstream lot has a bulkhead with a retaining wall 25' from the bulkhead. The downstream lot is bulkheaded and has a rapidly eroding bluff shoreline. There is some riprap material located waterward of the bulkhead on the downstream lot. The nearest upstream pier is 330' in length and the nearest downstream pier is 250' in length. The Pamlico River is classified as SB NSW by the Environmental Management Commission at the project site. The Pamlico River is Coastal Fishing waters and is not open to shell fishing. Project description The applicant proposes to replace the retaining wall in the same location as the one destroyed by Hurricane Irene. A new retainingwall is proposed 40' landward of the bulkhead to reduce the slope to prevent erosion and protect the existing single-family dwelling. Two 20' long groins are proposed just inside of the applicant's property lines. Additionally, the applicantproposesto construct 236' long by 6' wide pier with a 16' by 14' T-Head platform. Uncovered 13' by 13' boatlifts will be located on both sides of the proposed T- Head platform. These boatlifts will be surrounded with "U" shaped finger piers that will be 2' wide and 45' in totallength. Staff review of the plans and specifications has determined that the project, as proposed, consists of activities that will not pose surface water quality threats from stormwater runoff since no significant new impervious area is proposed. The Director has determined that projects that are reviewed and approved by the Division as not posing water quality threats from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 21-1.1000 and SL 2008-211. For this reason, we are informing you by way of this letter that your project will not require a State Stormwater management permit at this time. The stormwater rules require the Division to permit the common plan of development, therefore, any future development on the property, regardless of whether a SEC plan or CAMA Major permit is also required, will require a Stormwater Management Permit application and permit issuance from the Division of Water Quality prior to any construction. Carrow has submitted a CAMA Major Permit application request for the installation of two retaining walls, two groins pier with platform with 2 uncovered boatlifts and 2 wet slips at his property located off SR 1102 at 264 Driftwood Drive in the Crystal Beach Subdivision on the Pamlico River near the Blounts Creek community in Beaufort County, North Carolina. This office has reviewed the proposed project with regard to rules found in Subchapter 7H concerning development in a Public Trust Area. It is staff s recommendation that the proposed project appears consistent with 15A NCAC 07H .0208 as described below. This office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(B) which states in part that "The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be 8 square feet per linear foot of shoreline with a maximum of 2,000 square feet." The applicant has 52 linear feet of shoreline which provides a maximum shaded impact of 416 ft'. The applicant is proposing 404 ft' of shaded impact. Additionally, NCAC 07H .0208(b)(6)(G)(i) states that "pier and docking facility length shall be limited by not extending beyond the established pier or docking facility length along the same shoreline for similar use". The nearest adjacent pier is 330 feet in length. Mr. Carrow is proposing a pier which is 250' in length. Mr. Carrow has obtained waivers of the 15' setback from both adjacent riparian property owners. Staff recommend the following conditions be included if the project is permitted. 1. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 2. This permit authorizes only the structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 3. This permit authorizes a maximum of four boat slips. 4. The groins shall not exceed one foot in height above the Normal Water Level. 5. The retaining walls shall be structurally tight before the installation of any backfill.
