I) Unless specifically altered herein, this Minor Modification authorizes the construction of a new retaining wall between the existing bulkhead and the newly constructed retaining wall, construction of a 14' x 32' uncovered wooden deck approximately 12' above ground level, and construction of steps down the existing slope with a landing, all as expressly and specifically set forth in the attached letter and workplan drawings. Any additional development activities may require a modification of this permit. 2) This Minor Modification shall be attached to the original Permit No. 19-13, which was issued on 2/4/13, and copies of both documents must be readily available on site whenRi[(MWEt0 inspect the project for compliance. VAN DER VAARI 19-13 issued to Tony Carrow BRAX]ON DAVIS CAMA Major Permit No. 19-13 was issued to Tony Carrow on 4 February 2013 for development located at 264 Driftwood Drive in the Crystal Beach Subdivision near the Blounts Creek Community on the Pamlico River. The permit was issued to construct a new retaining wall 40' landward of the existing bulkhead, two 20' long groins, 236' long by 6' wide pier with a 16' by 14' T-Head platform, two uncovered 13' by 13' boatlifts and two wet slips. The permit expires on 31 December 2016. The permittee request to modify the permit to construct a new retaining wall between the existing bulkhead and the newly constructed retaining wall permitted under this CAMA Major permit. The permittee also proposes to construct a 14' by 32' uncovered wooden deck approximately 12' above ground level. Additionally, the applicant proposes to construct a 4' wide steps down the existing steep slope. The $100.00 modification fee has been deposited into the Department's account. My recommendation is we modify permit no. 19-13 as requested. If you have any questions, please don't hesitate to contact me. Diffuse Flow An additional condition is that all stormwater shall be directed as. diffuse flow at non -erosive velocities through the'protected stream buffers and will not re -concentrate before discharging into the stream as identified within 15A NCAC 2B .0259(5). 3. The Permittee shall, replant the vegetation within temporeri)y disturbed areas associated with'this project in an "in kind" manner immediately following construction. (Example: Disturbed areas with pre-existing grassed lawns must be replanted with grass. Disturbed areas with pre-existing trees or woody vegetation must be replanted with trees.and woody vegetation: Disturbed: areas with pre- existing forest vegetation must be replanted with forest vegetation including at least two different native hardwood tree species at a density sufficient to provide 260 trees per acre at maturity. This density can usually be achieved by planting approximately 360 (11 x 11 spacing) to 538 (9 x 9 spacing) trees per acne.) .Restoration of trees/shrubs/forest must be completed by the first :subsequent . planting season (November 1 through March 30). The original (buff -colored form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS I I3A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance requires additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation.
