This permit, issued on Ikepmher 70 2013 .i_giihiect to compliance with the application (where consistent with the
permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Barge Landing
1) Unless specifically altered herein, this permit authorizes the construction of a 50' x 30' platform with
a 10' wide bluff access and 14 dolphin clusters and other structures and uses that are expressly and
specifically set forth in the permit application and workplan drawings. No other structure, whether
floating or stationary, shall become a permanent part of this barge landing without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over public
trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
barge landing. Any sewage discharge at the barge landing shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2016
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
8) This permit authorizes a maximum of 2 new formalized boatslips in association with this barge landing.
General
9) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this pemmit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the work or obstructions caused
thereby, without expense to the United States or the state of North Carolina. No claim shall be made
against the United States or the state of North Carolina on account of any such removal or alteration.
10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the
written approval of the Division of Coastal Management.
11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.

waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or
113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, [phone] within twenty (20) days
of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance.
By working in accordance with the permit, you will be helping to protect our vitally important coastal resources.

Thank you for your letter concerning the Coastal Area Management Act (CAMA) major permit
request submitted by CapCorp, LLC c/o Armas John Jaskey, Jr., who has requested authorization

Project Setting
Mr. Gary Greene with Gary Greene Engineers, on behalf of Armas John Jaskey, Jr. of CapCorp, LLC,
has submitted the attached application for a CAMA Major Permit to install 16 timber pile dolphin clusters with
a 50' long by 30' wide dock and 10' wide bluff access to create dockage for two ±195' long barges in the
Roanoke River. The project site is located at 28809 U.S. Hwy 64 near Jamesville, in Bertie and Martin
Counties, North Carolina. The shoreline on the southern side of the Roanoke River in this area is the dividing
line between Martin and Bertie Counties. The River below normal water level (NWL) is within the boundaries
of Bertie County. The site was previously reviewed for the development of an ethanol plant that was never
constructed.
Mr. Jaskey's property is ±82 acres in size and currently has no structure development. A portion of the
uplands has been disturbed by removal of topsoil, and has resulted in sparse vegetation growth in these areas.
The property is vegetated with maintained upland grasses and weeds that is separated from a forested area on a
tall bluff by a man-made berm. The forest extends down the bluff to the water's edge, and although a fringe of
wetlands exists along some of the applicant's shoreline, there are no wetlands present within the proposed
development area. The bluff is ±40' tall within the project area. There are a few single family residences
immediately downstream (east) of the applicant's property that are surrounded by agriculture row crops. The
property immediately upstream (west) of the applicant's property is in industrial use by Carolina Store Fixtures.
The Roanoke River at the project site is just over 300' wide with a water depth of -12' at normal water
level (NWL) at the waterward end of the proposed structures. The Roanoke River is classified C; Sw by the
Environmental Management Commission and Joint Anadromous Fish Spawning Area (AFSA) Waters by the
Marine Fisheries Commission and Wildlife Resources Commission. The Roanoke River at this location is
closed to shellfrshing. There were no SAV observed during site visits.
Project Description
The applicant proposes to construct a 50' long by 30' wide (1,500 ft2) platform connected to a t70' long
by 10' wide step access over a tall bluff. The platform will be centered and immediately landward of the
installation of fourteen 7-pile dolphin clusters and two 13-pile end dolphin clusters along a total of 600' of
shoreline to provide t40' wide dockage area for two t195' long barges. The barge slip areas will be located in
-12' to -26' deep water of the Roanoke River relative to NWL. The barges will be located just outside the '/4
width of the Roanoke River, will be well outside the 15' setback requirement from riparian property lines, and
over 1,000' from adjacent docking facilities. The applicant owns a total of f2,925 linear feet of shoreline
allowing up to 2,000 ft2 of shaded impact. In water pile driving is proposed by barge with a vibrating hammer
and there is no high ground development associated with this project other than step access with no land grading
down the tall bluff. The applicant has expressed interest in selling the property to a potential buyer that may
benefit from a barge landing for most likely transport of agricultural products or aggregates.
Anticipated Impacts
The proposed platform will shade 1,500 ft2 of Public Trust Area and Estuarine Water Areas of
Environmental Concern (AECs) of Roanoke River bottom. The proposed two -barge facility`#611 > fB✓n,000

Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the
permit application with regard to impacts on fish and wildlife resources. The project site is located at
28809 US Hwy 64 near Jamesville, adjacent the Roanoke River. Our comments are provided in
accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as
amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to construct a 50' by 30' platform with 10' wide bluff access associated
with fourteen 7-pile dolphin clusters and two 13 pile end dolphin clusters to provide a 600' by 40'
docking areas for two 195' barges. The Roanoke River in this location is classified C Sw by the

from the Jerden Thicket Road intersection, in Martin County.

Consistency Determination: The request is consistent with/not in conflict with the Bertie
County 1998 Land Use Plan certified by the CRC on
September 8, 1999.
Overview: The project site is located within the Roanoke River in Bertie County adjacent to an
82 acre undeveloped property located on the north side of US Highway 64 in Martin County.
The property has just over 2,925 linear feet of shoreline along the river. The shoreline is the
dividing line between Bertie and Martin counties. The Roanoke River at the project site is just
over 300 feet wide. The property has a Section 404 wetland fringe along the shoreline. A
forested area extends from the water's edge up along a 40 foot high bluff to a man-made
berm.
Installation of a 30 foot wide by 50 foot long platform, fourteen (14) seven (7)-pile dolphin
clusters and two (2) thirteen (13)-pile end dolphin clusters to create two (2) 40 foot wide barge
dockage areas is proposed. The barge docking facility will extend along 600 feet of the
shoreline and accommodate barges 195 feet in length. The platform will be centrally located
along the shoreline and be connected to the property by a 10 foot wide by 70 foot long step
access over the bluff. The dolphin clusters will be placed on 40 foot centers on either side of
the centrally located platform, with a barge dock located on either side of the platform. The
barge slips will be located in water depths -12 feet to -26 feet below NWL. Docking barges
will be located just outside the''% width of the Roanoke River.
The waters of the Roanoke River are classified as C; Sw in this area and are closed to
shellfishing. The waters are designated as a joint Anadromous Fish Spawning Area (AFSA).
There were no Submerged Aquatic Vegetation (SAV) observed during site visits. A review of

Anticipated impacts: resulting from this project are expected to include: the shading of 1,500
sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC) and the
usurpation of 42,000 sq. ft. of Public Trust Area/Estuarine Waters AEC.
Basis for Determination:
The Bertie County Future Land Use Map identifies the Roanoke River as "Conservation", per
narrative on Page 94 that includes Public Trust Waters and Estuarine Waters in the
classification. The following LUP policies may be applicable to this request:

"Bertie County officials are very much aware that protection of the estuarine
waters and adjacent estuarine shorelines is of paramount importance to fishing,
both commercially and for recreation. Bertie County recognizes that certain
actions within the estuarine shoreline, which is defined as the area extending 75
feet landward of the mean high water line of the estuarine waters, could be
detrimental to these sensitive areas and wishes to protect them.
In order to promote the quality of the estuarine waters, Bertie County officials will
consider land use controls which protect the values of the estuarine system.
Residential, recreational, and commercial uses would also be controlled within
the estuarine shoreline, provided that:
A significant change of pollution occurring from the development does
not exist.
Development does not have a significant adverse impact on estuarine
resources
Development does not significantly interfere with existing public rights
or access to, or use of, navigable waters or public resources."

detriment to the physical or biological functions of Public Trust Waters. Such
uses as navigational channels, drainage ditches, bulkheads to prevent erosion,
piers, docks, marinas, and bridges will be encouraged."

moratorium in the river to minimize the impacts of elevated noise and turbidity levels from the installation of
the piles. Messieh et al. (1977) states that larval herring can be inhibited by re -suspension of dredged materials
and larval herring will avoid areas with concentrations of re -suspended material as low as a few milligrams per
liter (Wilber et al. 2005). Working outside of this period will minimize the noise and turbidity levels that can
have adverse impacts on spawning, migrating, and foraging fishes (Deaton et al. 2010).

Mr. Gary Greene with Gary Greene Engineers, on behalf of Armas John Jaskey, Jr. of
CapCorp, LLC, has submitted the attached application for a CAMA Major Permit to install 16
timber pile dolphin clusters with a 50' long by 30' wide dock and 10' wide bluff access to create
dockage for two ±195' long barges in the Roanoke River. The project site is located at 28809
U.S. Hwy 64 near Jamesville, in Bertie and Martin Counties, North Carolina.
Staff has reviewed the proposed project with regard to rules found in Subchapter 7H
concerning development in Coastal Shorelines. It is staff's recommendation that the proposed
project appears consistent with 15A NCAC 07H .0208 as described below.
Staff has reviewed the project, and considering Mr. Jaskey owns a total of f2,925 linear
feet of shoreline, the proposed project appears to be consistent with the rules found in
7H.0208(b)(6). In regards to (B) of this rule, which in part states, "total square footage of shaded
impact allowed shall be 8 ft' per linear foot of shoreline with a maximum of 2,000 ftz," and
shaded impact for this project is 1,500 ft' for the proposed platform. The project is located in an
area of the Roanoke River that is 339' wide. The proposed barge slips with barges in them will
not extend beyond'/4 width of the water body, consistent with 7H.0208(b)(6)(G)(iii).
The applicant has properly notified the riparian neighbors to the project via certified return
receipt and a copy of the white receipts from the United States Post Office are attached. You
will be sent a copy of the signed and dated green cards as proof of receipt by the neighbors once
the applicants have provided them to staff. If the permit is issued, staff would suggest the
following conditions:

Docking Facility
1. Unless specifically altered herein, this permit authorizes only the docks, piers,
boathouse, and other structures and uses located in or over the water that are
expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, may become a permanent part of this docking facility
without permit modification. No non -water dependent uses of structures may be
conducted on, in or over public trust waters without permit modification.
2. No attempt will be made by the permittee to prevent the full and free use by the
public of all navigable waters at or adjacent to the authorized work.
3. The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee is not
relieved of this requirement if he abandons the permitted activity without having it
transferred to a third party.
4. This permit does not authorize the interference with any existing or proposed Federal
project, and the permittee will not be entitled to compensation for damage to the
authorized structure or work, or injury which may be caused from existing or future
operations undertaken by the United States in the public interest.
5. The permittee must install and maintain at his expense any signal lights or signals
prescribed by the U.S. Coast Guard, through regulation or otherwise, on the
authorized facilities. At a minimum, permanent reflectors should be attached to the
structure in order to make it more visible during hours of darkness or inclement
weather.
6. This permit authorizes a maximum of two formalized barge slips.
General
7. The permittee understands and agrees that, if future operations by the United States
requires the removal, relocation, or other alteration of the structure or work
authorized by this permit, or if in the opinion of the Secretary of the Army or his
authorized representative, said structure or work shall cause unreasonable obstruction
to free navigation of the navigable waters, the permittee will be required, upon due
notice from the Corps of Engineers, to remove relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of
North Carolina. No claim shall be made against the United States or the state of
North Carolina on account of any such removal or alteration.

Reference the application of John Jaskey, CapCorp LLc, for Department of the Army
authorization to construct a 50' long by 30' wide (1500 sq ft) platform with a 10' wide bluff
access with associated fourteen 7-pile dolphin clusters and two 13-pile end clusters, on the
Roanoke River, at 28809 US Highway 64, near Jamesville, Martin County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.

3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of this
project, in such a manner as to impair normal flows and circulation patterns within waters or
wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
6. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the
work authorized by this permit and again upon completion of the work authorized by this permit.
8. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
9. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
10. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less. in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not

considered significant.
11. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

Narrative for CapCorp LLC's Proposed Barge Moorings
on the Roanoke River in Martin County
CapCorp LLC proposes to construct a barge mooring at their property on the Roanoke River in
Martin / Bertie Counties to enhance the potential use of their property located on US Highway 64
east of Jamesville in Martin County. The existing site has no waterfront improvements along the
tract. The applicant proposes to install 14 composite (timber and steel pile) dolphins at 40 feet
centers along with two additional dolphins at each end providing a length of 600 feet along the
applicant's 2925 feet ± water frontage. Additionally, a 50 ft x 30 ft platform will be centered along
the barge mooring berth. Access to the platform will be a via a 10 feet wide stairway constructed
with timber or metal for commercial use.
The alignment of the dolphins locates the structures as close to the applicants shoreline as possible
while providing sufficient minimum depth (approximately 12 feet) without excavation (dredging).
The proposed layout will allow a remaining navigable with of 190 feet + which will be sufficient
to accommodate two way traffic for recreational and commercial traffic at the site. Navigation to
the site from the Albemarle sound via the Roanoke River is feasible without impacting river bottom
based on previous trips made by a local barge / tug company. If required by U S Coast Guard,
reflector markers will be installed on piles at each end.
The use of the property is not identified for this permit application. The ability of installing the
proposed barge moorings will be beneficial to the applicant attracting / marketing the use of the site.
Some potential developments could include storage and loading for barge transport of agricultural
products, wood chips / pellets or aggregates.

The Department of Environment and Natural Resources hereby gives public notice as
required by N.C.G.S. I I3A-119(b) that an application for a development permit in an Area of
Environmental Concern as designated under the Coastal Area Management Act (CAMA) was
received on 7 October 2013. According to the said application submitted CapCorp LLC c/o
Armas John Jaskey, Jr., applicant proposes to construct a 50' long by 30' wide (1500 ft2)
platform with a 10' wide bluff access associated with fourteen 7-pile dolphin clusters and two 13
pile end dolphin clusters to provide a total of 600' long by f40' wide dockage area for two f 195'
long barges, in Bertie/Martin Counties, North Carolina

The NC Division of Coastal Management hereby acknowledges receipt of your

near Jamesville, adjacent the Roanoke River in Bertie and Martin Counties, North Carolina It
was received on 7 October 2013, and appears to be adequate for processing at this time. The
projected deadline for making a decision is 21 December 2013. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have not
been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from the 7 October 2013,
you may request a meeting with the Director of the Division of Coastal Management and permit
staff to discuss the status of your project. Such a meeting will be held within five working days
from the receipt of your written request and shall include the property owner, developer, and
project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property, or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be
