Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Barge Landing 1) Unless specifically altered herein, this permit authorizes the construction of a 50' x 30' platform with a 10' wide bluff access and 14 dolphin clusters and other structures and uses that are expressly and specifically set forth in the permit application and workplan drawings. No other structure, whether floating or stationary, shall become a permanent part of this barge landing without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the barge landing. Any sewage discharge at the barge landing shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2016 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third parry. 6) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 8) This permit authorizes a maximum of 2 new formalized boatslips in association with this barge landing. General 9) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this pemmit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the written approval of the Division of Coastal Management. 11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. The project site is located at 28809 U.S. Hwy 64 near Jamesville, in Bertie and Martin Counties, North Carolina. The shoreline on the southern side of the Roanoke River in this area is the dividing line between Martin and Bertie Counties. The River below normal water level (NWL) is within the boundaries of Bertie County. The site was previously reviewed for the development of an ethanol plant that was never constructed. Mr. Jaskey's property is ±82 acres in size and currently has no structure development. A portion of the uplands has been disturbed by removal of topsoil, and has resulted in sparse vegetation growth in these areas. The property is vegetated with maintained upland grasses and weeds that is separated from a forested area on a tall bluff by a man-made berm. The forest extends down the bluff to the water's edge, and although a fringe of wetlands exists along some of the applicant's shoreline, there are no wetlands present within the proposed development area. The bluff is ±40' tall within the project area. There are a few single family residences immediately downstream (east) of the applicant's property that are surrounded by agriculture row crops. The property immediately upstream (west) of the applicant's property is in industrial use by Carolina Store Fixtures. The Roanoke River at the project site is just over 300' wide with a water depth of -12' at normal water level (NWL) at the waterward end of the proposed structures. The Roanoke River is classified C; Sw by the Environmental Management Commission and Joint Anadromous Fish Spawning Area (AFSA) Waters by the Marine Fisheries Commission and Wildlife Resources Commission. The Roanoke River at this location is closed to shellfrshing. There were no SAV observed during site visits. Project Description The applicant proposes to construct a 50' long by 30' wide (1,500 ft2) platform connected to a t70' long by 10' wide step access over a tall bluff. The platform will be centered and immediately landward of the installation of fourteen 7-pile dolphin clusters and two 13-pile end dolphin clusters along a total of 600' of shoreline to provide t40' wide dockage area for two t195' long barges. The barge slip areas will be located in -12' to -26' deep water of the Roanoke River relative to NWL. The barges will be located just outside the '/4 width of the Roanoke River, will be well outside the 15' setback requirement from riparian property lines, and over 1,000' from adjacent docking facilities. The applicant owns a total of f2,925 linear feet of shoreline allowing up to 2,000 ft2 of shaded impact. In water pile driving is proposed by barge with a vibrating hammer and there is no high ground development associated with this project other than step access with no land grading down the tall bluff. The applicant has expressed interest in selling the property to a potential buyer that may benefit from a barge landing for most likely transport of agricultural products or aggregates. Anticipated Impacts The proposed platform will shade 1,500 ft2 of Public Trust Area and Estuarine Water Areas of Environmental Concern (AECs) of Roanoke River bottom. The property has just over 2,925 linear feet of shoreline along the river. The shoreline is the dividing line between Bertie and Martin counties. The Roanoke River at the project site is just over 300 feet wide. The property has a Section 404 wetland fringe along the shoreline. A forested area extends from the water's edge up along a 40 foot high bluff to a man-made berm. Installation of a 30 foot wide by 50 foot long platform, fourteen (14) seven (7)-pile dolphin clusters and two (2) thirteen (13)-pile end dolphin clusters to create two (2) 40 foot wide barge dockage areas is proposed. The barge docking facility will extend along 600 feet of the shoreline and accommodate barges 195 feet in length. The platform will be centrally located along the shoreline and be connected to the property by a 10 foot wide by 70 foot long step access over the bluff. The dolphin clusters will be placed on 40 foot centers on either side of the centrally located platform, with a barge dock located on either side of the platform. The barge slips will be located in water depths -12 feet to -26 feet below NWL. Docking barges will be located just outside the''% width of the Roanoke River. The waters of the Roanoke River are classified as C; Sw in this area and are closed to shellfishing. The waters are designated as a joint Anadromous Fish Spawning Area (AFSA). The existing site has no waterfront improvements along the tract. The applicant proposes to install 14 composite (timber and steel pile) dolphins at 40 feet centers along with two additional dolphins at each end providing a length of 600 feet along the applicant's 2925 feet ± water frontage. Additionally, a 50 ft x 30 ft platform will be centered along the barge mooring berth. Access to the platform will be a via a 10 feet wide stairway constructed with timber or metal for commercial use. The alignment of the dolphins locates the structures as close to the applicants shoreline as possible while providing sufficient minimum depth (approximately 12 feet) without excavation (dredging). The proposed layout will allow a remaining navigable with of 190 feet + which will be sufficient to accommodate two way traffic for recreational and commercial traffic at the site. Navigation to the site from the Albemarle sound via the Roanoke River is feasible without impacting river bottom based on previous trips made by a local barge / tug company. If required by U S Coast Guard, reflector markers will be installed on piles at each end. The use of the property is not identified for this permit application. The ability of installing the proposed barge moorings will be beneficial to the applicant attracting / marketing the use of the site.
