with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
"A) Unless specifically altered herein, this permit authorizes only the reconfigured docking facility and
other structures and uses located in or over the water that are expressly and specifically set forth in
the permit application. No other structure, whether floating or stationary, shall become a permanent
part of this docking facility without permit modification. No non -water dependent uses of structures
shall be conducted on, in or over public trust waters without permit modification.
2) No attempt shall be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
3) No portion of the authorized docking facility shall extend beyond the established pier head line.

This, permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date..' An appeal requires resolution prior to work initiation or
continuance as the case may be.
This :permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on

ADDITIONAL CONDITIONS
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
,6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.

This permit authorizes two additional boat slips for a maximum of three formalized boat slips.
8), The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
i T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. New dredging in any manner, including "kicking" with boat
propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
General
€..;'9). `' The permittee understands and agrees that, if future operations by the United States requires the
? removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
t unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
p removal or alteration.

NOTE: Future development of the pern ittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this .determination. The permittee is further advised that many non -water
" dependent activities are not authorized within 30 feet of the normal high water level.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is retained by
you and it must be available on site when the project is inspected for compliance. Please sign both the original and the
copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have
waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or
113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days
of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance.
By working in accordance with the permit, you will be helping to protect our vitally important coastal resources.

The project site is located at 184 Sound View Drive, adjacent the Atlantic Intracoastal Waterway (AIWW), between Masonboro
Loop Road and Masonboro Sound, near Wilmington, in New Hanover County. To locate the property of interest from the
Wilmington Regional Office (WiRO), travel southwest on Cardinal Drive Extension until you reach Eastwood Road. Turn left
onto Eastwood Road and travel east approximately 2.0 miles until you reach Military Cut -Off Road. Turn right on Military Cut -
Off Road and continue onto Oleander Drive for approximately 3.3 miles until you reach Pine Grove Drive. Turn left onto Pine
Grove Drive and travel south for approximately 2.0 miles until you reach Masonboro Loop Road. Turn right onto Masonboro
Loop Road and travel south approximately 2.2 miles until you reach Sound View Drive, which will be located on the left. The
Brown residence is located at the end of Sound View Drive on the right hand side of the road. The approximately 0.35 acre
property has an average elevation of approximately 6' above normal high water (NHW) with approximately 140' of shoreline,
which is currently stabilized by a timber bulkhead. This bulkhead currently ties into an existing timber bulkhead located on the
applicant's adjacent property to the east, which is currently undeveloped. Both of the applicant's properties border a cove
located on the western side of Masonboro Sound and the AIW W. The applicant currently maintains single-family residence on
this property.
The applicant also maintains a private docking facility for each property within the natural cove off of Masonboro Sound and
the AIW W. At low tide there is an exposed sandbar within the middle portion of the cove and a natural channel within the cove
is apparent along the applicant's properties and the properties towards the south. This channel is approximately 140' across at
low tide. The property of interest has an existing pier, measuring approximately 48' in length by 5' in width which extends from
the existing bulkhead towards the south into the cove. An access ramp leads onto a floating landing platform, measuring
approximately 4' in length by 4' in width. The landing platform then leads onto a floating dock, measuring approximately 16'
in length by 8' in width, which creates a "T-head" configuration. There are two (2) existing "Jet -Dock" type of floating
platforms, each measuring approximately 12' in length by 4' in width and located on landward side of the "T-head"
configuration. The application states that the existing docking facility currently accommodates up to one (1) vessel within water
depths ranging from approximately -1.3' to -2.4' at normal low water (NLW); however, the existing docking facility could
potentially accommodate up to three (3) vessels with the two "Jet -Docks" located on the landward side of the existing floating
dock, which are designed to accommodate smaller personal watercrafts. The N.C. Division of Coastal Management (DCM)
could not locate a previous permit for the existing docking facility at this property, but it appears through historical aerial
photography review that there has been a docking facility at this location since the late 1980's.
Upland vegetation consists of maintained lawn grass and ornamental landscaping. Located on the western end of the property
the vegetation transitions which exhibits §404 type wetlands, consisting primarily of Grounsel-bush (Baccharus halimifolia),
Marsh -elder (Iva fratescens) and Wax Myrtle (Myrica cerifera) shrubs. A narrow border of Sea Oxeye (Borrichia frutescens)
and high coastal marsh vegetation, including, Black Needle Rush (Juncus roemarianus), and Salt Meadow Grass (Spartina
patens) transitions to an area of Smooth Cordgrass (Spartina alternii lora) approximately 25' in width to the open water area of
Masonboro Sound.
The Wilmington/New Hanover County Land Use Plan 2006 update classifies adjacent waters as Conservation, and the adjacent
high ground portion of the project area as Resource Protection. The waters of Masonboro Sound are Classed as Outstanding
Resource Water (SA-ORW) by the NC Division of Water Resources and are designated as a Primary N 5 Ra (PNA),
by the NC Division of Marine Fisheries. The area of Masonboro Sound is OPEN to the harvesting of shellfish.

PROPOSED PROJECT:
The applicant proposes to reconfigure a docking facility in Masonboro Sound. The existing floating dRs VQ4T;6 entirely
removed and then replaced with a new "T-head" floating dock configuration, which would include a new landing platform,
measuring approximately 12' in length by 6' in width and a new floating dock, measuring approximately 20' in length by 10' in
width. The existing "Jet -Dock" floating platforms would also be located on the landward side of this new floating dock.

The proposed configuration would locate the new docking facility approximately 10' waterward of the existing footprint to
provide better water depths. Based on the provided water depths, the application states that the proposed docking facility would
accommodate up to three (3) vessels within water depths ranging from -1.7' to -2.6' at NLW (See Sheets 1 and 3 of 3 and
Project Narrative).
10. ANTICIPATED IMPACTS
The proposed structures would incorporate approximately 368 sq. ft. of Public Trust Area and Estuarine Waters; however much
of this area was usurped by the previous docking facility. The structures would not encroach into the 15' riparian corridor
setback requirement of the adjacent riparian properties. Based on the provided water depths and drawings, the proposed
structures do not appear to encroach into the edge of deep water of the natural channel within the cove. The proposed structures
would extend approximately 60' into a waterbody of the cove, which measures approximately 640' across. This distance
appears to conform to the 1/4 width rule and the established pier length. The proposed structures would accommodate up to
three (3) vessels at this location within current water depths ranging from -1.7' to -2.6' relative to NLW. The nearest docking
facility is approximately 60' or less to the east. Minor turbidity increases may be expected during the construction process.

The total square footage of platforms and dock were calculated as follows:
Shoreline length = —140' x 8 sq. ft = 1,120 sq. ft. allowable
Floating docks= 12' x 6' and 10' x 20 = 272 sq. ft.
Floating "Jet -Dock" platforms: 2 @ 4' x 12' = 96 sq. ft.
Total = 368 sq. ft.
It is the staffs recommendation that the proposed docking facility appears to be consistent with the use standards set forth in
NCAC 07H .0208(bx6) including the eight square foot rule and the 1/4 distance rule. This office has no objection to the
proposed work, provided it is consistent with all other state and federal permitting requirements. Any permit issued should
include the following conditions:
1. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly
and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a
permanent part of the structure without permit modification. No non -water dependent uses of structures may be
conducted on, in, or over public trust waters without permit modification.
2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or
adjacent to the authorized work.
3. The authorized structure and associated activity must not cause an unacceptable interference with navigation.
4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast
Guard, through regulations or otherwise, on authorized facilities.
5. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of
this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit
transferred to a third -party.
6. This permit authorizes a maximum of three (3) boat slips. At no time shall more than three (3) vessels be moored or
docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not
limited to motorboats, sailing vessels and personal watercraft.
7. The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with 07H.0208 of the
Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted.
Dredging in any manner, including "kicking" with boat propellers, is not authorized.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or
authorizations that may be required.
NOTE: The permittee is cautioned that this permit does not authorize the placement of tie piles in association with the docking
facility. Furthermore, due to the proximity of the AIW W, boats utilizing the docking facility will be subject to frequent
wave wash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps
to ensure the integrity of the structure and the safety of moored boats. The permittee shall not hold the State of North
Carolina or the United States liable for any damage to the structure or moored boats.

The Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources received a copy of the CAMA Major
Permit Application for the subject project on August 16, 2013. Staff review of the plans and specifications has determined that
the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The
Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from
stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000, the
stormwater rules. By copy of this letter, we are informing you that this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also subject to
the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an
NPDES permit for stormwater discharge from projects meeting these criteria. All temporary built -upon area associated with the
construction of the project must be removed within 30 days of completion of the project, or when it is no longer needed,
whichever occurs first.

This project is consistent with the Wilmington -New Hanover Joint Land Use Plan
Update.
The applicant proposes to reconfigure a docking facility in Masonboro Sound,
Wilmington, New Hanover County. The project is located at 184 Sound View Drive.
Areas of Environmental Concern (AEC's) impacted by the proposal are ORW, Estuarine
Waters and Public Trust areas. Waters at the project site are classified as SA-ORW and
are open to the harvesting of shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover
County Joint Land Use Plan and offer the following comments.
The general area of the project is classified as Conservation.
In general, New Hanover County allows development in Conservation classified AECs,
which is consistent with the State's minimum use standards. The Wilmington -New
Hanover County Joint Land Use Plan contains some policies, which exceed the State's
minimum use standards. However, none of these standards appear to be applicable to this
proposal.
This project is consistent with the 2006 Wilmington -New Hanover County Joint Land
Use Plan Update.

The Division of Coastal Management hereby acknowledges receipt of your application for State approval for proposed
development located at your property located at 184 Sound View Drive, adjacent to Masonboro Sound, in New Hanover
County. It was received as complete on August 5, 2013, and appears to be adequate for processing at this time. The
projected deadline for making a decision is October 20, 2013. An additional 75-day review period is provided by law
when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline
stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your
notice of an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from August 5, 2013, you may request a meeting with the
Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will
be held within five working days from the receipt of your written request and shall include the property owner, developer,
and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property; or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal review agencies
for their comments. If additional information is required based on this review, the agencies may contact you directly.
