with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) This permit modification authorizes a relocation of the dredge spoil retention area from the project
highground to the spoil area located across the AIW W as depicted in the. attached location map and
photo copy.
2) The spoil retention dikes etc. must be inspected by a DCM representative prior to spoil being
pumped to the area.
3) All conditions and stipulations of the original permit remain in force under this modification. Under
this modification, strict adherence to conditions Nos. 3-12 is emphasized.
4) This modification must be attached to the original of permit No. 169-96 and all pertinent documents
must be readily available on site when a Division representative inspects the project for compliance.
This permit_action may be appealed by the pemtittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31,1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

Dear Sir:
The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable,
the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the ptoject site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for
assistance. By working in, accordance with the permit, you will be helping to protect our vitally important coastal
resources.

As discussed by phone, my client CEG Associates, LLC would like to request a minor
modification of Permit Number 169-96 to place their dredge material on the spoil island north of
Shinn Creek on the AIW W. Development of the Greenville Sound Gardens subdivision in
underway and most of the dry material has been mechanically excavated from the marina basin.
The remaining wet material to be dredged totals approximately 5000 cubic yards. Our original
plan involved dewatering the spoil on site. However, during the EA and application review
process, work was begun on private home construction for the owner of lot 13. Utilities were
installed to service the lot from Towles Road and buried in the proposed on -site spoil location.
This makes the construction of a spoil dike on site virtually impossible.
We have secured permission from the owners of the dredge spoil island (Shore Acres Company,
Inc.) to pump the remaining material to their property for dewatering. The portion of the island to
be used is outside the Corps right of way and the local Corps office has no problem with this
usage. The disposal area shown on the attached aerial photo has been diked and used previously
for dredge spoil placement. No 404 or coastal wetlands are within the area to be used. CEG's
Marine contractor, All State Environmental Dredging will prepare the inner dike area to
accommodate the pumped material and erect a water control structure with an effluent pipeline to
carry the clarified water to beyond mean low water.
I have enclosed a Corps aerial showing the 1000' right of way, spoil island area to be used and
permitted project site; USGS quad map detailing the island's location; written permission from
Shore Acres Company; and a copy of the deed for the property. Obviously this minor
modification is needed quickly to allow for the dredging to be accomplished this season. Please let
me know of your decision by phone and/or fax as soon as possible. I am available to address any

confirming same. Mr. Lawrence B. Lee, President- of Shore
Acres Company, Inc., has granted you permission to deposit
Sand Spoil on the Island East of the Intracoastal Waterway
and North of. Shinn Creek which is currently owned by Shore
Acres Company, Inc. The cost for this service will be $1.00
per, Cubic Yard of Sand Spoil. It is understood that you are
