This permit, issued on July 25, 2000 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil•action; or may cause thepermit to be null and void. 1) This minor modification authorizes the increase of the width of the existing floating docks from 3 ft. to 6 ft., in accordance with the attached workplan drawing dated 4/28100. 2) This minor modification must be attached to the original of Permit No. 143-96, which was issued on 10/18/96, along with the subsequent renewal issued on 115100, and all documents must be readily available on site when a Division representative inspects the project for compliance. 3) All conditions and stipulations of the active permit remain in force under this modification unless altered herein. 'This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. The Department of the Army (DA) permit issued on October 22, 1996, authorized dredging of shallow bottom around a pier and gazebo with a floating dock system to be constructed in Greenville Sound, at 305 Bradley Creek Point Road in Wilmington, New Hanover County, North Carolina. Your proposal continues to be consistent with the provisions and objectives of general permit No. 198000291. The permit is hereby modified to include the work as requested. It is understood that all other conditions of your permit remain applicable and that the expiration date is December 31, 2000. Please be advised that, pursuant to recent Corps of Engineers' policy, the following is hereby a condition of your modified DA permit: The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. The Coastal Resources Commission makes the final decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance require additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise conceming permit conditions, environmental safeguards, orproblem areas, you may contact Department personnel at any time for assistance. The proposal increases the width of the floating docks to six (6) feet, rather than three (3), or an increase of 92 square feet. Provided that the in line portion of the floating dock is not counted in the allotted square footage (per policy), then the proposed increase would not exceed the allowable square footage for the applicant's shoreline length. I have no objection to the proposed modification. We are requesting to change the original floating docks from (1) 4'x3l' & (1) 3'x15' to (1) 6'x3l' & (1) 6'x15'. This would result in an additional 92 square feet of floating dock (as per plans). We are making this request due to the fact that the docks are located along the A.I. W. W. and would be unstable due to boat wakes.
