Any violation of or deviation from the plan approved by the DEM will be considered a violation of this CAMA permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the final decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance require additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. The applicant has graded approximately 1.25 acres within the ORW Estuarine Shoreline AEC; the project will ultimately involve the construction of a single family residence, a workshop, driveway, well and septic tank. No wetlands (coastal or 404) have been or are to be disturbed; impervious surface coverage is intended to be 10% of total lot area. The location and complete description of the project are in the Field Investigation Report. LAND USE CLASSIFICATION: Conservation (including AEC's and hydric soils) LAND USE POLICIES AND IMPLEMENTATION MEASURES: County policy will be to permit development which is proposed to be located outside hydric soil areas and meets all zoning, Health Department and flooding regulations and other State and federal regulations. (p.45) Pender County policy shall be to protect the water quality in designated ORW waters and in waters within 1,000 feet of designated ORW waters (ORW buffer). (p.45) The County makes multiple reference in its land use plan to the County's desire to protect and enhance water quality of the estuarine areas, especially the ORW adjacent to applicant's project area. CONSISTENCY OPINION: This project lies in an area of special consideration in the Pender County Land Use Plan: Outstanding Resource Waters. The County has exceeded state guidelines for protection of these high quality waters. It is, in my opinion, the intent of the Plan to guard these waters against the impacts of unwise land and water development which might jeopardize estuarine water quality. This project will be cdnsistent with the Render County Land Use Plan when all conditions placed on the permit by DCM and other review agencies for the protection of state waters are met. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.) and the Coastal Area Management Act (G.S. 113A-100 through 113A-128). The applicants propose to construct a residence, workshop, well, and septic system on a partly cleared lot on Mill Creek. Although a CAMA permit has not yet been obtained, the house pad area had been graded and the foundation was being dug at the time of our site visit. Mill Creek is classified SA -Outstanding Resource Waters (ORW) and designated a Primary Nursery Area (PNA). The entire lot is within the 575 ft. ORW estuarine shoreline Area of Environmental Concern (AEC). The project will result in additional impervious surface adjacent to an ORW and PNA. Of even greater concern to us, however, is placement of a septic tank within the estuarine shoreline AEC. Cumulative impacts of this type to the sensitive and valuable waters of Mill Creek can be expected to degrade the estuary'S water quality over time. Hollis and Carol Batson Page 2 9. PROJECT DESCRIPTION III NV/L•LI The project site lies within the Deerfield Subdivision of Pender County off of Highway 17. Lot #90 is 2.1 acres in size, and averages 9' above mean sea level. This property is adjacent to Mill Creek on the north side. The applicant graded 1.25 acres of the lot for homesite preparation without obtaining a CAMA Permit. The intention is to construct a home, driveway, and workshop, to be serviced by a well and septic system. The project was served with a Notice of Violation, stopping work within the AEC until the proper permits are obtained. There is an existing pier and dock on the property that was authorized under a General Permit issued on 5/19/95. The waters of Mill Creek are classified SA-ORW by the Division of Environmental Management. The Division of Marine Fisheries has designated the Mill Creek as Primary Nursery Area; it is closed to the taking of shellfish for consumption. The Pender County Land Use Plan classifies the area as Conservation. The area that has been graded for the house pad and improvements is approximately 1.25 acres in size. This is all high ground that was previously vegetated with oaks, pines, wax myrtles, and yaupons. There is a fringe of Phrasmites australis along the waters edge, giving way to Snartina alterniflora. On the west side of the lot there are wetlands delineated as section 404 wetlands. Neither of these is within the project area. The grading terminates approximately 25' from the mean high water mark. The entire lot is within the 575' ORW Estuarine Shoreline Area of Environmental Concern. The applicant proposes to construct a 3000 square foot single family residence, with a 768 square foot workshop, a 3120 square foot driveway, with a 920 square foot turn -around. The total impervious surface area proposed is approximately 10% of the lot size, or approximately 8879 square feet. The applicant has submitted the plans for stormwater certification and sedimentation/erosion control approval. 10. ANTICIPATED IMPACTS The project as proposed will cause to be graded approximately 1.25 acres of high ground adjacent to Mill Creek. Approximately 8879 square feet (approximately 10% of the ORW Estuarine Shoreline) of this will be covered impervious. This is an after -the -fact permit request that was required due to a 1.25 acre minor land disturbance activity, which automatically required a Major CAMA Permit to be applied for. The minor land disturbance activity occurred as a result of underbrushing and clearing for a single family residential home on Lot #90 of Deerfield Subdivision. The acreage overage (0.25 acres) was done by the contractor and owner who were unaware that minor land disturbance activities over one acre required a Major CAMA permit. The area of land disturbance is entirely within "uplands", is +25 ft from any "wetlands", and has non -disturbed areas for buffers. There has been no sedimentation or erosion off -site, or into 404-CAMA Wetlands, or into U.S. waters. After notification the owner immediately installed silt fencing down -gradient between the disturbed areas and wetland areas, seeded all disturbed areas with rye grass, and applied mulch to the perimeter. These preventive measures should further insure that no sedimentation or erosion can occur off - site. The 404 Wetland and CAMA Wetland lines have been delineated in the field by Land Management Group, Inc. EXHIBIT A Beginning at an iron pipe in the curved northern right of way line of Mill Dam Road, 30 feet from the centerline thereof, said point being located a chord bearing and distance of North 85 degrees, 50 minutes 50 seconds West 62.84 feet from an iron pipe in said right of way line at the eastern end of a curve here -in -after refered to as Curve number 21, said right of way curve having a radius of 362.10 feet, said curve point being located along said right of way line North 80 degrees 52 minutes Wiest 157.605 feet from an iron pipe at its intersection with the western right of way line of Creekview drive, 30 feet from the center line thereof, said point being located a chord bearing and distance of North 8 degrees 17 minutes 20 seconds West 269.93 feet from the right of way P.C. of Curve number 6 as shown on the map of Deerfield dated February 1975, recorded in Map Book 13 at Page 59 at the Pender County Registry; running thence from said beginning iron pipe, with the above -mentioned curved northern right of way line of Mill Dam Road to an iron pipe at the western terminus at Mill Dam Road, said iron pipe being located a chord bearing and distance of South 79 degrees 02 minutes 20 seconds West 127.485 feet from the preceding or beginning iron pipe; running thence with the same curved line of a small tract to be retained by Lanwillo Development Company to an iron pipe in the Bellamy line, said point being located a chord bearing and distance of South 64 degrees 09 minutes West 59.97 feet from the preceding point; running thence with the Bellamy line, North 30 degrees 34 minutes West 483.48 feet to a stone "RHB" at the high water line of Mill Creek; running thence with said high water line to an iron pipe that is located the following 7 courses and distances from the stone "RHB", 1. South 78 degrees 34-minutes East 49.36 feet, 2. South 68 degrees 47-minutes East 75.45 feet, 3. South 65 degrees 19 minutes East 45.4 feet, 4. North 84 degrees 36 minutes East 81.4 feet, 5. South 85 degrees 40 minutes East 58.7 feet, 6. South 64 degrees 24 minutes East 49.8 feet, and 7. South 23 degrees 21 minutes East 73.5 feet, running thence from said iron pipe in the high water line, South 19 degrees 19 minutes 10 seconds East 88.77 feet to an iron pipe; running thence South 7 degrees 54 minutes 50 seconds East 143.12 feet to the beginning and containing 2.10 acrfes more orless and being all of Lot 90 of Deerfield and also being a part of Tract D according to the above -mentioned map of Deerfield. Subejct to a drainage easement 10 feet in width adjacent to the last 2 calls of the above -described tract and within said tract and reaching from Mill Dam Road to the high water line of Mill Creek.
