In addition to the completed application form, the
following items must be submitted:
• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an g 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

site. Include highway or secondary road (SR)
numbers, landmarks, and the like.
• A Stormwater Certification, if one is necessary.
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and
signed return receipts as proof that such owners
have received a copy of the application and plats
by certified mail. Such landowners must be advised
that they have 30 days in which to submit comments
on the proposed project to the Division of Coastal
Management. Upon signing this form, the applicant
further certifies that such notice has been provided.

Dear Mr. Parker:
Reference the application of Marc Basnight for a Department of the Army
(DA) permit to construct a pier, covered platform, six boatslips, and an
offshore rock breakwater, on property located off the south side of U.S.
Highway 64/264, adjacent the Nags Head Causeway and the Roanoke Sound, Dare
County, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following condition(s) be included in the State
authorization:
1. All work authorized by this permit must be performed in strict
compliance with the permit plans.
2. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.
3. The riprap material will be clean and free of any pollutants except
in trace quantities. Metal products, organic materials, or unsightly debris
will not be used.
4. The authorized structure and associated activity will not cause an
unacceptable interference with navigation.

I recommend that the permit be issued for the construction of a 6' x 98' pier with a 495
square foot platform, four crab shedders, six boat slips and a 5' x 26' rock breakwater under
the 6' x 30' "L" located at the waterward end of the pier with the following conditions:

SUBJECT: Marc Basnight Major Permit Nags Head Land Use Plan Consistency Review
DATE: May 1, 1996
This project involves the construction of a 6' x 98' pier with a 496 square foot covered
platform, four crab shedders and six boat slips. A 5' x 26' rock breakwater is proposed under
the 6' x 30' "L" located at the waterward end of the pier.
The project is proposed within Estuarine and Public Trust Waters, which the Town of
Nags Head includes in the conservation class (subclass E-2). The purpose of this class "is to
provide for the effective long term management and protection of significant, limited or
irreplaceable resource areas". Uses within those areas are "limited to those allowed by the
Zoning Ordinance at the time of consideration of the proposed use" (Chapter 20, pg. 85).
The Town's plan also states "It is the goal of Nags Head to permit commercial and other
uses which provide residents and visitors with adequate services and amenities necessary for the
Town to maintain its self-sufficiency" (Chapter 9, pg. 46).
One of the types of development the Town considers undesirable and which "will not be
permitted" is a "large (more than ten boats) commercial boat marina" (Chapter 1, pg. 2).
Based on the above, so long as the project is allowed by the Zoning Ordinance at the
time of consideration, is of such scale that it does not constitute a large commercial boat marina
and provides an amenity and service which helps the Town maintain self-sufficiency, this project
will be consistent with the Nags Head Land Use Plan.

Biologists on the Wildlife Resources Commission staff have reviewed this permit
application and are familiar with habitat values of the project area. A site visit was conducted on
April 19, 1996. Our comments are provided in accordance with provisions of the Coastal Area
Management Act (G.S. 113A-100 through I I3A-128), as amended, and the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to construct a 6 ft. x 98 ft. pier with a 496 ft2 covered platform,
four crab shedders and six boat slips. A 5 ft. x 26 ft. rock breakwater is proposed under the 6 ft.
x 30 ft. "L" located at the waterward end of the pier. Waters at the site are classified as SA but
are closed to shellfish harvest.
The project is located in a protected shallow water bay on the east side of Roanoke
Sound. We do not have any comments regarding the pier, crab shedders, or boat slips but the
need for a breakwater is unclear especially in a naturally protected bay. Waters at the site are
estuarine therefore, we will support any decision and comments made by the Division of Marine
Fisheries.

covered by General Water Quality Certification Number 3025.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.

Site Description
Marc and Carolyn Basnight have recently acquired a 1.5 acre restaurant site on the
south side of US Highway 64/264 on the causeway in Nags Head, Dare County adjacent
Roanoke Sound. The triangular shaped parcel fronts US 64/264 for 425 feet and runs
approximately 450 linear feet along the shoreline of the sound. Roanoke Sound is classified
SA waters by the NC Division of Environmental Management. The property is
approximately 4' above NWL with a 150 seat restaurant and 62 asphalt parking spaces. In
1981, the Daniels Restaurant building was substantially enlarged and approximately 28
parking spaces were added. Recent changes by current owners, include a 16' x 24' office
addition and approximately 500 square feet of new decking as authorized by CAMA Minor
Development Permit #96-001 issued January 16, 1996. The present owners removed solid
surfacing in the form of poured concrete tailings from approximately 5,000 square feet of
area along the shoreline. They subsequently installed 300 linear feet of concrete riprap a
maximum distance of 5' waterward of the NWL as authorized by CAMA General Permit
#015023A, issued February 9, 1996.
Proposed Development
The applicants propose to construct a 6' x 98' pier with 496 square feet of covered
platform and 6 boat slips. Four crab shedders are proposed on the eastern side of the
platform. A 5' x 26' rock breakwater is to be constructed under the 6' x 30' "L" located at
the waterward end of the pier, in approximately 3 feet of water. The pier is approximately
20' from the western neighbor's riparian access corridor. No associated highground
development is proposed.
Anticinated Impact
The construction of a 5' wide x 26' long breakwater will fill 125 square feet of shallow
water habitat. An additional 731 square feet of shallow water habitat will be shaded by the
98' long pier. Some short term turbidity will occur during installation of the breakwater,
pier pilings and 5 mooring pilings.
No archeological/historical significance has been associated with this site. No unique

BEGINNING at a concrete monument located in the South right-of-way
lines of U.S. Highway 64 - 264, said highway having a right=of=way
'i of 90 feet, said concrete monument also being the Northeast corner
t of the now or formerly R. D. Edwards property (said beginning point
being located North 68 degrees 43' 35" East a distance of 1,1067.8
feet from a N.C.G.S. monument "Daniels" Northeast corner of bridge
parapet wall of the Melvin R. Daniels, Sr., Bridge, as said bridge
existed on May 2, 1984); running thence and along the South right-
of-way line of U. S. Highway 64 - 264 North 65 degrees 30' East a
distance of 425.0 feet to an existing concrete monument being the
Northwest corner of the now or formerly Morgan property; running
thence South 24 degrees 30' East through an existing concrete
monument and along the West line of the Morgan property a distance
of 70 feet, more or less, to the shores of the Roanoke Sound;
running thence in a general Southwestwardly direction and along the
shoreline of the Roanoke Sound and concrete rip rap a distance of
450 feet, more or less, to the Southeast corner of the now or
formerly R. D. Edward property (a straight tie line being South 46
degrees 19' West 412.54 feet -to a point and North 55 degrees 14'
West a distance of 69.19 feet to an iron pipe set in concrete);

Dear Mr. Basnight:
The Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of your property located on the south side of US
Highway 64/264, on the Nags Head Causeway, Dare County adjacent Roanoke Sound. It
was received on April 8, 1996, and appears to be adequate for processing at this time. The
projected deadline for making a decision is June 22, 1996. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have
not been notified of a final action by the initial deadline stated above, you should consider
the review period extended. Under those circumstances, this letter will serve as your notice
of an extended review. However, an additional letter will be provided on or about the 75th
day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of
the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard
which must be posted at the property of your proposed development. You should post this
notice at a conspicuous point along your property where it can be observed from a public
road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a
private road would lead one into your property. Failure to post this notice could result in an
incomplete application.
An onsite inspection will be made, and if additional information is required, you will
be contacted by the appropriate State or Federal agency. Please contact me if you have any
