(Refer to Coastal Resources Commission Rule 71.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue -line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the Revised 03/95 Form DCM-MP-1 site. The project site is a 35-acre tract located off SR 1224, east of the Town of Mesic, in Pamlico County and is adjacent Bear, Wins and Plum Creeks. Areas of Environmental Concern (AECs) located at the site and potentially impacted by the proposed work include Public Trust Areas, Estuarine Waters, Coastal Wetlands and the Estuarine Shoreline. In addition, 1404, wetlands are also located on the site. Bear, Wins and Plum Creeks are classified as SA NSW and are closed to shellfishing. The waters of the three creeks are also Primary Nursery Areas. I have reviewed this proposal for consistency with the 1992 Pamlico County Land Use Plan (LUP) Update and offer the following comments. The general area of the project is classified as Rural with Services, while the AECs and 1404' wetlands located on the site are classified as Conservation. The Estuarine Shoreline is classified as Conservation I, the '404' wetlands are classified as Conservation II, the Coastal Wetlands are classified as Conservation III, and the Public Trust and Estuarine Waters are classified as Conservation IV. Within the Conservation I classification, Pamlico County has established a permanent conservation zone within seventy-five feet of the mean high water level for all shorelines bordering Primary Nursery Areas and other estuarine and public trust waters. Development in this zone, which corresponds to the Estuarine Shoreline AEC, are strictly limited. However, some activities, including shoreline stabilization activities, are allowed. Allowed uses in the Conservation III classification (Coastal Wetlands) are those uses allowed by the State's 7H Use Standards. Allowed uses in the Conservation IV classification (Estuarine and Public Trust Areas) also correspond to those uses allowed by the State. Development which is consistent with federal, state and local regulations is allowed in 1404' wetland areas (Conservation II classification). Applicable policies contained in the LUP include those for Marine Resource Areas. These policies also state the County's support for the 7H Use Standards for Estuarine and Public Trust Areas. Bulkhead Construction Policies state that the County does not oppose bulkhead construction that meets the 7H Use Standards and the North Carolina State Building Code. The Pamlico County LUP also places restrictions regarding minimum lot sizes and minimum water frontage on properties located within the Rural with Services classification. Based on the size of the applicants' tract of property, these restrictions appear to be met. NARRATIVE DESCRIPTION: Project Setting The applicants own a 35-acre tract of land just east of the Town of Mesic, adjacent Bear, Wins, and Plum Creeks, in Pamlico County. Plum and Wins Creek are located immediately to the east and west of the property forming a peninsula that extends out into Bear Creek. A single family residence is located on the point of the property on approximately 2 acres of high ground. An extensive high marsh system vegetated with SSpartina patens, Juncus roemerianus. and Distchlis s icata borders both creeks. Jurisdictional 404 wetlands extend even farther into the property. The only section of high ground that abuts the water has previously been bulkheaded. A boatramp and pier currently exist on the property. Erosion is evident along much of the east side of the property. And the erosion has obviously been accelerated the past several months as a result of Hurricanes Bertha and Fran. The applicants estimate that the average annual erosion rate is between 8" - 12". Although SAVs are common in these shallow creeks, there was no vegetation observed during the site visit. Bear, Wins and Plum Creeks are all Primary Nursery Areas. All three creeks are SA NSW and closed to shellfishing. Project Description The applicants propose to hand place approximately 40 yds' of rock rip rap marl (measuring 4" to 10" in size) along Plum Creek to prevent further shoreline erosion. The rock would be placed along three areas totalling approximately 310' in length. Given the low shoreline bank, the applicants propose to place the rock at an average 2.5' waterward of the NWL. And at no point would the rock be place any farther than 3' waterward of the NWL. No backfilling is proposed. Anticipated Impacts The placement of the rock would fill approximately 775 fe of shallow estuarine waters of Plum Creek. An additional 465 ft' of nonvegetated eroded estuarine shoreline would also be filled. The project would involve the placement of approximately 40 yds' of marl. Minimal if any impact to the coastal wetlands is anticipated. And since the rock would be hand placed there would be negligible impact to adjacent wetlands during construction. M. However, after a review of the application, I have determined that there are several minor points that need to be addressed as well as additional technical information that must be provided before the application can be accepted as complete and a review by the agencies can begin. I am returning the $250 application fee and the entire application package along with this request for more information. Please address the following items: 1) The back side of Form DCM-MP-2 is missing. This is a critical part of your application and must be completed. I have enclosed a form for your use. 2) The platwork as submitted is not adequate for processing. There should be title blocks, dates, north arrows, and accurate scales on all work plats. The plat that was signed by the COE expired in 1994, consequently the wetland survey needs to be reapproved by the COE. There is too much extraneous material, markings, etc. on the work plat. It is difficult to distinguish between miscellaneous black markings and actual markings for pier pilings, etc. The scale and wording is so small it is difficult to read. Please either have another plat produced or clean up the one submitted. 3) Likewise, the areas to have rip rap installed appear as triangular projections of the land, consequently I don't believe the review agencies will understand what you are proposing. There appears to be a descrepancy in the length of rip rap adjacent the boatramp. It says 68' but scaled off it is closer to 100'. Please address. The back page of DCM-MP-2 should indicate 3 stabilized along with one total distseparate areas to be ance. 4) The cross section should indicate the rock being place only at the wetland/marsh grade, not extending above or landward of this area.
