PROJECT SUMMARY: The applicants proposes to extend a commercial dock, add two platforms, and relocate two dolphin clusters. FIELD INVESTIGATION REPORT: ATLANTIC BOAT WORKS/CARTERET COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: Project Setting The applicants' property is located at 216 Front Street adjacent Taylors Creek in the Town of Beaufort, Carteret County. The 64'-wide X 138'-long lot is bulkheaded with an existing 3-story building on the site. The Blue Moon Expresso Bar & Cafe and retail shops comprise the bottom floor of the building while rental office space, including Atlantic Boat Works, occupy the other two floors. The Spouter Inn Restaurant and dock is located immediately downstream while a private dock is located immediately upstream. There is an existing 6'-wide X 47'-long, two -slip dock and two 5-piling dolphin clusters on the site. Miscellaneous debris including metal cables, rods, and etc. can be found immediately waterward of the bulkhead. Water depth is not an issue except in the area of debris immediately waterward of the bulkhead. The project site is located within the Beaufort Historic District and is located adjacent to the Taylors Creek channel and basin, a Federal Project. The project also appears to be located either in or adjacent to the site labeled Cr 152 on the Cultural Resource maps. Taylors Creek is classified SC and is closed to shellfishing. Project Description The applicants propose to extend their existing commercial dock by 27 feet, add two 9'-wide X 28.5'-long platforms waterward of their existing bulkhead, and move the two existing 5-piling dolphin clusters to the end of the proposed dock. The applicants wouldkeep a single piling at each of the two former dolphin cluster locations, essentially creating two larger slips. According to the applicant, the project would extend out to the alignment established by the Beaufort docks. Both adjacent riparian property owners have waived the 15' required setback. Anticipated Impacts It appears that the dock extension would encroach an additional 27' farther out into the basin and would extend approximately 40' offshore of the Spouter Inn dock and 28' farther offshore of the adjacent upstream dock. However, it does appear that the dock would fall within the alignment established by the Beaufort docks and the western most dock on Front Street. The project would encompass an additional 1,395 fe of Public Trust Area of Taylors Creek. M. AECs impacted by this proposal include Public Trust Areas and Estuarine Waters. Waters at the site are classified as SC and are closed to the harvesting of shellfish. The area is not a Primary Nursery Area. The project site is located within the Beaufort Historic District and is identified on Cultural Resources maps as Cr 152. I have reviewed this proposal for consistency with the 1990 Town of Beaufort Land Use Plan (LUP) Update and offer the following comments. The general area of the project is classified as Developed, while the AECs impacted by the work are classified as Conservation. The Land Classification System is discussed on Pages III-1 through III-3 of the LUP. The Town of Beaufort allows uses consistent with the 7H Use Standards in conservation classified Public Trust Areas and Estuarine Waters. The only exception regards the prohibition of floating structures and does not appear to be applicable to this project. Resource Production and Management Policies for Marine Resource Areas are discussed on Page IV-7. The policies reiterate the Town's support for the 7H Use Standards for development in Estuarine Waters and Public Trust Areas. Policies for Cultural/Historic Resources are located on Page IV-4. These policies state the Town's intentions to support and protect the Historic District and to coordinate such projects with the N.C. Division of Archives and History. We are, however, concerned about the 27.07- foot new addition to the dock since it extends the dock well into the viewshed of the residential properties located across the street. The existing piers to the west of the site appear to be nearly even with the permittee's existing dock and there are no large structures west of the proposed extension to buffer the view from the residences across and along Front Street. We assume the line indicating the extent of the Beaufort docks refers to the docks east of the site which are in a more commercial and heavily trafficked area. Extension to that limit at the proposed site would create a precedent for further extensions of docks west of Orange Street and compound the adverse effect of the current proposal along that stretch of Taylor's Creek. This permit does not authorize the interference with any existing or proposed Federal project. The permittee will not be entitled to compensation for damage or injury to the authorized structure or work that may be caused from existing or future operations undertaken by the United States in the public interest. C. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or next to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. d. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. e. The permittee will maintain the authorized work in good condition and in concordance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. f. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required State/Federal coordination. g.
