Moore Permit 4165-96 Page 2 of 3 ADDITIONAL CONDITIONS 3) The only excavation that will be allowed in regards to the canal widening is that which is shown on revised plat No. 2 dated October 30, 1996. All spoils must be placed on high ground. 4) The proposed canal maintenance excavation and the proposed entrance channel excavation will coincide with plat No. 2 dated May 16, 1996 and will not exceed 4.0 feet at NWL. Bulkhead and Riprap Installation 5) All wooden bulkheads which are to be placed waterward of wetlands must be constructed no higher than the adjacent wetlands and can not be backfilled. 6) All bulkhead and/or riprap alignments must be staked by a representative of the DCM prior to its construction. 7) The placement of riprap or a wood bulkhead will not exceed the limitations as shown on plat No. 4 dated May 16, 1996. 8) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure. 9) The riprap material must be free from loose dirt or any other pollutant. It must be of a size sufficient to prevent its movement from the site by wave or current action. 10) The riprap material must consist of clean rock or masonry materials such as, but not limited to, granite or broken concrete. Materials such as tires, car bodies, scrap metal, paper products, tree limbs, wood debris, organic material or similar material, are not considered riprap. Bride 11) No culvert will be placed within the canal. Instead, access will be gained by a bridge as shown on revised plat No. 3 and revised plat No. 5 dated October 28, 1996. The bridge will have a minimal clearance of 6.0 feet above the NWL at the lowest part of the bridge. The minimal amount of horizontal clearance will be 12.0 feet. Pier and Groins 12) The proposed pier and groins must be constructed as shown on plat. No. 2 dated May 16, 1996, except that no groin may be placed within 15.0 feet of any adjacent property line. N. General 15) Prior to any construction, the permittee shall call for a site meeting with a representative of the Division of Coastal Management in order to preclude misunderstanding of permit conditions. 16) The temporary placement or double -handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 17) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 18) A permanent ground cover sufficient to restrain erosion will be provided on all exposed areas within the shorter of 30 working or 120 calendar days after project completion. 19) Appropriate erosion and sedimentation control devices, measures, or structures will be used to prevent sediment from entering the adjacent wetlands/watercourses/property (e.g., silt fence, diversion swales/berms, sand fence, etc.). The purpose of the work is to stabilize the shoreline and provide navigational access to a proposed boat basin. The proposed project consists of placing a total of 349 feet of riprap material along the shoreline of Pamlico Sound, the existing canal, and a proposed boat basin. In addition, three riprap groins would be placed in the Pamlico River and a 3.5-foot-wide by 63- foot-long L-shaped pier would be constructed. The existing canal will be maintained to a depth of four feet at normal water and a 100-foot-long by 25-foot-wide access channel will level el excavated in the river to connect with the four foot contour. Alsbe o proposed is widening of the waterward 85 feet of the canal and constructing a 43-foot-long by 21-foot-wide boat basin in wetlands. A 25-foot-long by 15-foot-wide boat ramp will be constructed in the canal and fill material will be placed in the canal to construct a 20-foot-wide causeway to provide access across the canal to a residential construction site. We do not object to the proposed placement of riprap along the shoreline, the construction control, or to tof the three groins for erosion he maintenance excavation of the existing canal provided no wetlands are excavated or filled. Also, we have no objection to the proposed causeway across the canal or boat ramp provided wetland and open water impacts are minimized. Mr. Moore also proposed extensive maintenance excavation and boat ramp construction. As an adjoining landowner, I am opposed to the project for the following reasons: The proposed culvert would make the canal unnavigatable to boats for which the canal was originally constructed. I'm in my late sixties and became a first time boat owner only two months ago. I would like to reserve the right to utilize the canal to access the Pamlico River. • My property would no longer be considered waterfront if water access is precluded by a culverted road crossing, thus depreciating property value. Should I decide to sell my property in the future, I feel waterfront and boat access to the Pamlico River would be key assets to the property's value. • The proposed culvert would restrict critical drainage flow during storm events like Hurricane Bertha. The potential threat for severe and prolonged flooding of my property and others within the Cedar Circle community and adjoining watershed would increase if the culvert is constructed. • Over time the canal has filled in with sediment even with unrestricted flow to the river. A culvert would accelerate the sedimentation process behind the structure, which can lead to a higher water table, and associated problems with the surrounding septic systems. I feel other alternatives exist which do not constitute construction of a culvert, and these need to be explored before any consideration is given to the permit. Currently, Mr. Moore can access his property and the canal through my property on the south side of the canal. Given this fact, I question the necessity to construct a culverted road crossing over the canal from the north or Edgewater Beach side, when he can already access the proposed site from the south side of the canal. Cox, adjacent property.owner to Henry and Stuart Moore, object to the proposal and application for permit to construct a culvert and a road over the canal adjacent to my property. I also object to a bridge that is not high enough to give access to a small day sailer sailboat. A culvert and road over the canal will cut off access to the river from my property. In the Moore's application they have my father as the property owner, where in fact my father has life estate and the property owners are myself (Casey R. Cox) owning one half, my brother (Tracey F. Cox) owning one quarter and my sister ( Gay I. Cox) owning one quarter. In 1964 my father Holman F. Cox built a house in Cedar Circle. In 1971 my father and Bridget Cox paid to have a canal dug from the Pamlico River by what is now Fortescue's property, Moore's property, Smithwick'S property, Kelder's property, Cox's property, and the property owner adjacent to the Kelders (which to my knowledge has not been notified of the Moore's application). The property adjacent to the Kelders is the futherest property up the canal and is were my family lived when my father paid to have the canal dug. In 1973 my father purchased property from Bridget Cox which was passed to my brother, sister and I in 1975. For a number of years I have planned (after I retire from the US Coast Guard and build a house on the property) to clean the canal out to allow navigable boat access, as it was years ago when my family used the canal for access to the river. My planned cleaning of the canal would have no other construction plans, would not include disturbing wet land, and would not obstruct anyones access to the river. I believe the Moore's proposed road will be in wet land. Their drawings are misleading. The Moore's do have a 25' easement on my property but that easement ends approximately 50' before reaching the edge of the canal. There is a existing road that leads all the way to the Moore's property from Riverside that does not call for obstructing the canal or disturbing wet land. It is my opinion that the Moore's forgot to get a right away from their adjacent property owners when they sold that property. I do not see why my family should suffer from an obstructed canal when my family paid to have the canal dug. The Moore's should purchase a right away from the Smithwick's rather than obstructing a canal that can be used by 6 differt parties. The Moore's application should be looked at carefully, and I request that an actual inspection of the site with the adjacent property owners be performed so that a permit will not be issued that may later have to be revoked. Blue -line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the Revised 03/95 Form DCM-MP-1 site. PROJECT SUMMARY: The applicant is proposing to develop a single family homesite which involves the upgrading of an existing canal, placement of riprap, the construction of a pier, access road, and boatramp. f , N. HENRY MOORE JR. AND STUART B. MOORE Beaufort County Environmental settine The applicant owns a 1.23 acre tract of land off of SR 1309 adjacent to the Pamlico River in Beaufort County. Of the 1.23 acres, a considerable amount of the property has been designated as wetlands by the COE. The wetland delineation is shown on Plat No. 2 in the application package. Historically the property has experienced ongoing erosion along the Pamlico River, which is evident by an erosion scarp. No, shoreline stabilization efforts have been made until this time. Along the eastern edge of the property a canal is present which connects to the Pamlico River. The applicants' eastern property line is located within this canal. The canal, which has a width of ±20", continues past the applicants' property and thus is adjacent to other properties. The canal has not been maintained in many years and now averages ±1' in depth at normal water. At approximately 100' south of the mouth of the canal the Pamlico River has a depth of ±4' at NWL. Along a majority of the length of the canal, as shown on Plats 2 and 3i much of the adjacent areas have been designated as wetlands by the COE. This area is predominately vegetated with Carex App., Virginia Wild Rye Grass, Smart Weed, Marsh Mallow and many other species. The highground portions of the property is vegetated with both pines and a variety of hardwood trees. On 12 July 1996 Hurricane Bertha had a severe impact on the property. Several large trees have fallen which are crossed throughout the wetland area. Also a rack line indicates that several feet of water was over much of the property. Project proposal The applicant is proposing the following: (1) The placement of riprap along ±154' of shoreline adjacent to the Pamlico River. This riprap will average ±5' and will be a maximum of ±10' beyond the NWL. This riprap will extend from the western property line to the mouth of the canal. Where the riprap is to be waterward of wetland vegetation, it will not be placed atop the wetlands, nor any higher than the ground elevation of the wetlands. (2) The placement of riprap along the edge of the proposed widen canal (see #7) and around the proposed boatbasin (see #9). This area of riprap will have a length of ± 195' and it will be. placed as close as possible to the toe of the canal edge. As in #1, since this entire area is bordering wetlands, no riprap will be placed atop any wetlands nor higher than the ground elevation of the wetlands. (3) The placement of three riprap groins in the Pamlico River. The locations of these groins are shown on plat #2. Each groin will extend 15' beyond the NWL. Moore Page 2 (4) The construction of a 3.5' wide by 63' long pier with a 16' by 12' L-shaped platform within the Pamlico River. The location of the pier is shown on plat #2. (5) The proposed excavation of a ±100' long by ±25' wide access channel in the Pamlico River to provide better access to the mouth of the existing canal. This area averages ±3' in depth at normal water and will be excavated to a ±4' depth at normal water. All spoils are to be placed on highground. (6) The maintenance excavation of ±392' of canal. The canal averages ±20' in width, has an existing depth of ±1.3' at normal water and will be excavated to a depth of -4' at normal water. The canal is shown on Plats 2 and 3. All spoils are to be placed on highground. It should be noted that a portion of this canal is on the property of Mr. Perry Fortesque. A letter from Mr. Fortesque is in the application package giving the applicants permission to work on his property. (7) The widening of the southern most ±85' of the existing canal. This widening will extend from the mouth of the canal to the proposed boatbasin (see #9). This widening will involve the excavation of a ±17' wide strip of wetlands along the western edge of the existing canal. This area will also be excavated to a depth of -4' at NWL. (8) The maintenance excavation of a ±43' long area which has a width of ±9' and a depth of ±1.0'. This area is located along the west side of the canal and is being described as an existing boatbasin on plat #2. The area actually has very little resemblance to a boatbasin. The area proposed is to be excavated to a depth of -4' at NWL. All spoils are to be placed on highground. (9) The proposed enlarging of the area that is being described as a boatbasin by the excavation of wetlands on both the north and south sides of the area. The excavation will result in a 43' long by 21' wide by -4' deep at NWL boatbasin connected to the existing canal. All spoils will be placed on highground. See plat #2 for details. (10) The construction of a dock along the north and west sides of the new boatbasin. This dock will have a total length of ±60' and will have a width of 2.5". See plat #2 for details. (11) The construction of a 25' long by 15' wide concrete boatramp, of which 15' will extend beyond the NWL. The ramp will be constructed within a wetland area on the northeast side of the canal (see plat #3). This ramp will result in ±270 sq. ft. of wetlands to be excavated and ±407 sq. ft. to be filled. Present access is now on the west side of the canal, however, the applicant wishes to obtain access from additional property he owns on the east side of the canal (see plat #3). The causeway will have a 16' top width and will be crossing the canal at an area which has a width of ±20'. A 3' culvert will be placed within the causeway to allow for continued drainage. Riprap will be placed atop the pipe on each side of the causeway. (13) The development of a single family homesite on the highground portion of the property. As part of the landscaping, the applicant is proposing to fill a ±440 sq. ft. area of isolated wetlands (see plat #3). Environmental impact The following environmental impacts will occur: (1) The placement of riprap to stabilize the shoreline will result in +1.745 sq. ft. of open water area filled within the Pamlico River and the manmade canal. (2) The construction of the three groins will result in +225 sq. ft. of open water area to be filled in the Pamlico River. (3) The access channel will result in +2.500 4. ft. of shallow water habitat to be excavated in the Pamlico River. (4) The canal widening will result in +1.445 sq. ft. of wetland vegetation to be excavated on the west side of the canal. (5) The canal maintenance excavation will result in +7.480 sq. ft. of shallow water area to be excavated. (6) The boatbasin maintenance excavation will result in +387 sq. ft. of shallow water area to be excavated. (7) The enlarging of the boatbasin will result in +553 sq. ft. of wetland vegetation to be excavated. (8) The placement of the boatramp will result in +270 sq. ft. of wetland vegetation being excavated. As you are aware, when the application package was circulated objections were received from several agencies and two adjacent property owners. The agency objections were mainly based on the widening of the existing canal and the widening of an existing boat basin, both in wetlands under the jurisdiction of the COE. The total amount of wetlands to be excavated was 1,998 square feet. Also, concerns were expressed over the blocking of tradational navagation by a proposed culvert in the canal. The culvert was also the concern of the adjacent property owners. On 28 October 1996 I met the applicants at the site along with Raleigh Bland and Bill Biddlecome, both with the COE, to try an modify the project so that it could become permittable. During this meeting it was decided to modify the project as follows: 1. To replace the proposed culvert with a bridge. The bridge will have a minimal clearance of 6.0 feet above the NWL. 2. To move the proposed boat basin out of wetlands and place it in highground. The new proposed basin will have a length of 56.0 feet and a width of 15.0 feet. 3. To reduce the widening of the canal to only that necessary to advoid the existing boat house which is located in the canal and owned by one of the adjacent property owners. The wetlands to be excavated will have a length of 74.0 feet and a width of 10.0 feet. The moving of the boat basin as described in No. 2 and the reducing of the width of the canal will reduce the total amount of wetlands to be excavated from 1,998 square feet to 740.0 square feet. 4. To replace the proposed riprap with a low bulkhead which will be constructed no higher than the adjacent wetlands and will not be backfilled. Enclosed is a package of material dated 31 October 1996 from the applicants which reflect the changes that I have described above. I recommed that the permit be issued with the attached plats reflecting the changes. All spoils must be placed on highground. No culvert will be placed within the canal. Instead, access will be gained by a bridge as shown on revised plat No. 3 and revised plat No.5 dated 28 October 1996. The bridge will have a minimal clearance of 6.0 feet above the NWL at the lowest part of the bridge. The minimal amount of horizonal clearance will be 12.0 feet. The only excavation that will be allowed in regards to the canal widening is that which is shown on revised plat No. 2 dated 30 October 1996. All spoils must be placed on highground. The proposed pier and groins must be constructed as shown on plat No.2 dated 16 May 1996, except that no groin may be placed within 15.0 feet any adjacent property line. All wooden bulkheads which are to be placed waterward of wetlands must be constructed no higher than the adjacent wetlands and can not be backfilled. All bulkhead and/or riprap alignments must be staked by a representative of the DCM prior to its construction. 7. The proposed boatramp will be constructed as described on plat No.5 dated 28 r 1 October 1996 and on plat No. 3 dated 16 May 1996. 8. The placement of riprap or a wood bulkhead will not exceed the liminitations as shown on plat No. 4 dated 16 May 1996 C 9. $ The proposed canal maintenance excavation and the proposed entrance channel excavation will coincide with plat No. 2 dated 16 May 1996 and will not exceed 4.0 feet at NWL. 10.1 The riprap material must be free from loose dirt or any other pollutant. It must be of a size sufficient to prevent its movement from the site by wave or current action. 11.10 The riprap material must consist of clean rock or masonry materials such as but not limited to granite or broken concrete. The NCDMF primary concern with the proposed activities is the loss of wetlands associated with widening the existing canal (item #7) and enlarging the 'boat basin' (item #9). Loss of wetlands indirectly impact fishery resources. Wetlands play an important role in modifying hydrologic events. For example, wetlands moderate stormwater runoff, trap sediments dropped from suspension as the water flow is lowered, and fix mineral nutrients in plant tissues which are later released as detritus. Wetlands act as a sponge soaking up and filtering pollutants that would otherwise run into sensitive coastal water. All of these functions are beneficial to the "health" of associated estuarine systems. From the other proposed activities the applicant appears to have reasonable utilization of the property for boating without infringing on additional wetland areas. Biologists on the Wildlife Resources Commission staff have reviewed this permit application and are familiar with habitat values of the project area. A site visit was conducted on September 26, 1996. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicants propose to dredge a boat basin and channel in an existing swamp slough; construct a pier, access road and boat ramp; and stabilize 250 ft. of shoreline with riprap and 3 groins. Pamlico River is classified as SB by the Environmental Management Commission. The applicants own a 1.23 acre tract of land off of SR 1309 adjacent to the Pamlico River in Beaufort County. Of the 1.23 acres, a considerable amount of the property has been designated as wetlands by the COE. The edge of a sandy ridge sloping down into a swampy area makes up the upland portion of this property. We support using riprap for shoreline stabilization. The applicants also state that riprap placed waterward of wetlands will not exceed the ground elevation of the wetlands. The applicants refer to the proposed dredging as maintenance excavation of a canal. The "canal" is actually a narrow shallow slough with shrubby vegetation and trees growing along the N. Henry Moore 2 September 27, 1996 Sides. The "canal' averages 20 ft. wide and 16 inches deep. The applicants propose to excavate the "canal' to 37 ft. wide and 4 ft. deep as well as a boat basin. The proposed dredging will impact 12,365 ft' of forested wetlands and shallow water habitat. Access to the property exists by a private highground road on the west side of the canal, however, the applicants wish to obtain access from the east side of the canal. The applicants propose to place a 3 ft. diameter culvert in the 20 ft. wide canal and fill the remaining canal and adjacent wetlands. If canoes or small jon boats are using this canal then the proposed access road will block navigation. A 25 ft. long x 15 ft. wide concrete boat ramp is also proposed. We will not oppose permit issuance if the following recommendations are included as permit conditions. rl 1A. The proposed dredging is deleted from the project. Q\,r, 2. The contact of wet cement with water has been shown to be toxic to aquatic organisms in the immediate vicinity. PROJECT SUMMARY: The applicant is proposing to develop a single family homesite which involves the upgrading of an existing canal, placement of riprap, the construction of a pier, access road, and boatramp. A N. HENRY MOORE JR. AND STUART B. MOORE Beaufort County Environmental setting The applicant owns a 1.23 acre tract of land off of SR 1309 adjacent to the Pamlico River in Beaufort County. Of the 1.23 acres, a considerable amount of the property has been designated as wetlands by the COE. The wetland delineation is shown on Plat No. 2 in the application package. Historically the property has experienced ongoing erosion along the Pamlico River, which is evident by an erosion scarp. No shoreline stabilization efforts have been made until this time. Along the eastern edge of the property a canal is present which connects to the Pamlico River. The applicants' eastern property line is located within this canal. The canal, which has a width of ±20", continues past the applicants' property and thus is adjacent to other properties. The canal has not been maintained in many years and now averages ±1' in depth at normal water. At approximately 100' south of the mouth of the canal the Pamlico River has a depth of ±4' at NWL. Along a majority of the length of the canal, as shown on Plats 2 and 3, much of the adjacent areas have been designated as wetlands by the COE. This area is predominately vegetated with Carex Wp., Virginia Wild Rye Grass, Smart Weed, Marsh Mallow and many other species. The highground portions of the property is vegetated with both pines and a variety of hardwood trees. On 12 July 1996 Hurricane Bertha had a severe impact on the property. Several large trees have fallen which are crossed throughout the wetland area. Also a rack line indicates that several feet of water was over much of the property. Project proposal The applicant is proposing the following: (1) The placement of riprap along ±154' of shoreline adjacent to the Pamlico River. This riprap will average ±5' and will be a maximum of ±10' beyond the NWL. This riprap will extend from the western property line to the mouth of the canal. Where the riprap is to be waterward of wetland vegetation, it will not be placed atop the wetlands, nor any higher than the ground elevation of the wetlands. (2) The placement of riprap along the edge of the proposed widen canal (see #') and around the proposed boatbasin (see #9). This area of riprap will have a length of ±195' and it will be placed as close as possible to the toe of the canal edge. As in #1, since this entire area is bordering wetlands, no riprap will be placed atop any wetlands nor higher than the ground elevation of the wetlands. (3) The placement of three riprap groins in the Pamlico River. The locations of these groins are shown on plat #2. Each groin will extend 15' beyond the NWL. Each will have a bottom width of 5', a top width of 1.5' and will extend 1.5' above the NWL. N. Henry Moore Jr. and Stuart B. Moore Page 2 (4) The construction of a 3.5' wide by 63' long pier with a 16' by 12' L-shaped platform within the Pamlico River. The location of the pier is shown on plat #2. (5) The proposed excavation of a ±100' long by ±25' wide access channel in the Pamlico River to provide better access to the mouth of the existing canal. This area averages ±3' in depth at normal water and will be excavated to a ±4' depth at normal water. All spoils are to be placed on highground. (6) The maintenance excavation of ±392' of canal. The canal averages ±20' in width, has an existing depth of ±1.3' at normal water and will be excavated to a depth of -4' at normal water. The canal is shown on Plats 2 and 3. All spoils are to be placed on highground. It should be noted that a portion of this canal is on the property of Mr. Perry Fortesque. A letter from Mr. Fortesque is in the application package giving the applicants permission to work on his property. (7) The widening of the southern most ±85' of the existing canal. This widening will extend from the mouth of the canal to the proposed boatbasin (see #9). This widening will involve the excavation of a ±17' wide strip of wetlands along the western edge of the existing canal. This area will also be excavated to a depth of -4' at NWL. (8) The maintenance excavation of a ±43' long area which has a width of ±9' and a depth of ± 1.0'. This area is located along the west side of the canal and is being described as an existing boatbasin on plat #2. The area actually has very little resemblance to a boatbasin. The area proposed is to be excavated to a depth of 4' at NWL.. All spoils are to be placed on highground. (9) The proposed enlarging of the area that is being described as a boatbasin by the excavation of wetlands on both the north and south sides of the area. The excavation will result in a 43' long by 21' wide by -4' deep at NWL boatbasin connected to the existing canal: All spoils will be placed on highground. See plat #2 for details. (10) The construction of a dock along the north and west sides of the new boatbasin. This dock will have a total length of ±60' and will have a width of 2.5". See plat #2 for details. (11) The construction of a 25' long by 15' wide concrete boatramp, of which 15' will extend beyond the NWL. The ramp will be constructed within a wetland area on the northeast side of the canal (see plat #3). This ramp will result in ±270 sq. ft. of wetlands to be excavated and ±407 sq. ft. to be filled. Present access is now on the west side of the canal, however, the applicant wishes to obtain access from additional property he owns on the east side of the canal (see plat #3). The causeway will have a 16' top width and will be crossing the canal at an area which has a width of ±20'. A 3' culvert will be placed within the .causeway to allow for continued drainage. Riprap will be placed atop the pipe on each side of the causeway. (13) The development of a single family homesite on the highground portion of the property. As part of the landscaping, the applicant is proposing to fill a ±440 sq. ft. area of isolated wetlands (see plat #3). Environmental impact The following environmental impacts will occur: (1) The placement of riprap to stabilize the shoreline will result in +1.745 sq. ft. of open water area filled within the Pamlico River and the manmade canal. (2) The construction of the three groins will result in +225 sq. ft. of open water area to be filled in the Pamlico River. (3) The access channel will result in +2.500 sq. ft. of shallow water habitat to be excavated in the Pamlico River. (4) The canal widening will result in +1.445 sq. ft. of wetland vegetation to be excavated on the west side of the canal. (5) The canal maintenance excavation will result in +7.480 sq. ft. of shallow water area to be excavated. No. 199605014. The applicants, N. Henry Jr. and Stuart B. Moore, propose to stabilize a length of the Pamlico River's shoreline on their property and backfill the open water and wetland areas landward of the stabilization project, construct groins, a boat basin, boat ramp, docking facility and filled canal crossing, and to widen and deepen a neglected canal adjacent to a tract of land off SR 1309 in Beaufort County, North Carolina. The dredging and widening activities would be conducted by backhoe working from the sides of the canal. No mitigation for sedimentation is proposed. About 2,268 sq. ft. of vegetated wetlands and 10,367 sq, ft. of open water areas would be dredged, and over 3,000 sq. ft. of those habitat types wold be filled under the proposal. The applicants stated purpose is to construct a homesite on the tract of land. This is the report of the Service submitted pursuant to, and in accordance with, provisions of the Fish and Wildlife Coordination Act (48'Stat. 401, as amended;l6 U.S.C. 661 et seq.) and the Endangered Species Act of 1973 (87 Stat. 884, as amended; 16 U.S.C. 1531 et seq.). We recommend that the District Engineer seek extensive modifications of the proposed activities. It appears that most of the facilities the applicant proposes can be constructed on high ground, and that a majority of the anticipated impacts to jurisdictional wetlands can be avoided on the available property. We recommend that the boat basin, dock, and access channel be excavated from the non -wetland area along the western property line (south of the "proposed house") depicted on plat No. 1. The shoreline immediately adjacent to this excavated access channel, and the new channel itself, can be protected with riprap. This simple re -arrangement does not impact the applicant's house or overall development plans, yet avoids almost all of the proposed impacts to wetlands and open water habitat. Further, the proposed boat ramp should be designed and constructed in the excavated boat basin. Lastly, while we recognize the utility of the proposed access road and canal crossing, we are concerned that a small culvert may impair water flow and impede passage by some aquatic organisms. Therefore, we recommend that the fill and culvert be installed in the dry, and removed (also in the dry), within one year of installation. The access road -should cross the canal via a bridge which spans the canal and as much of the wetlands as possible. It is important to note that houselots such as the applicant's have historically been created, in whole or in part, by filling wetlands or littoral zones. If this is true in this case, the "ongoing erosion" -observed at the site can be considered reclamation of aquatic habitat, albeit accentuated by boat traffic and other anthropogenic causes. It is evident from the FIR that the site is part of the Pamlico River's floodplain. In either case, the baseline for protective structures such as riprap should be the current plane of ordinary high water. This baseline is important to consider because any shoreline stabilization attempts waterward of it have a reduced probability of longterm success. By proposing to stabilize the shoreline so far waterward from the current baseline, the applicant may be designing the site in a manner counter to the river's hydrologic forces. This means the periodicity and magnitude of maintenance activities will probably be greater than if the current baseline had been used in the design. These episodic maintenance activities each have some adverse impact on fish and wildlife resources. They represent a cumulative (temporal) adverse impact. The proposed activities can be modified to avoid impacts to jurisdictional wetlands and aquatic habitat, and such modifications would probably reduce cumulative impacts as well.
