Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. Docking Facility 4) Unless specifically altered herein, this permit authorizes the removal of the existing launch pier and dock and the construction of the two floating docks and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable water at or adjacent to authorized work. 6) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 7) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structures in order to make them more visible during hours of darkness or inclement weather. 9) This permit does not authorize any formalized boat slips. Shoreline Stabilization 10) The authorized bulkhead shall adhere to the alignment depicted on the attached workplan drawings. 11) The alignment of the authorized bulkhead and riprap shall be staked by the permittee and approved by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. Town of Aurora Permit # 130-13 Page 3 of 4 ADDITIONAL CONDITIONS 12); The bulkhead shall be constructed prior to any backfilling activities. 13) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 14) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 15) All backfill material shall be clean and free of any pollutants except in trace quantities. 16) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. Sedimentation and Erosion Control 17) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 18) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 19) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the petmittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 20) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 21) The permittee and/or his contractor shall meet on site with a representative of the Division prior to project initiation. Proiect Narrative Project Information: Date: 8/21l2013 Aurora Boating Access Area Beaufort County Engineer: RECEIVED Preston Royster, PE North Carolina Wildlife Resources Commission OCT Q 2 ZO13 1718 NC Hwy 56 W Creedmoor, NC 27522 DCM-D4HD CITY Project Summary: The Aurora Boating Access Area (BAA) project is located on the east end of Main Street on South Creek in the Town of Aurora, NC. The existing property consists of the Main Street public right-of-way and five parcels owned by the Town of Aurora. The site is contains an existing boat ramp, parking lot, and fishing pier. This project involves the renovation of the existing NCWRC boating access area. The existing ramp, parking lot, and dock will be removed. The existing bulkhead that surrounds the peninsula will also be replaced. The existing fixed wooden fishing pier will remain, however. The BAA will consist of two single lane launch ramps with a floating dock between the ramps. There will also be a floating courtesy T-dock installed. Uphill from the ramps, the existing parking lot will be renovated. Upon completion, it will consist of two single vehicle parking spaces and 22 trailer parking spaces. Impervious Surface Calculations: Based on soil borings, the material used to construct the peninsula consists of gravel and shell just below the ground surface. In addition, the majority of the unpaved area has been parked on at one point or another due to an insufficient number of paved parking spaces. As a result, the entire project area will be considered impervious. Because of these findings and interpretation, the project will not cause an increase in impervious surface despite the increase in the amount of asphalt pavement. Dredging: No dredging is proposed for this project. The only work required in the water will be the removal of the existing ramp and the installation of the new concrete ramp and stone base. tRECEIVED OCT 0 �, 2013 Grading: The total amount of earthwork for this project will be approximately 700 cubic yards. This includes rough and fine grading, preparing the subgrade of the drive aisles and parking lots, and any fill that needs to be brought to the site as well as any excess that may need to be hauled off. Any spoil material that will be generated should consist primarily of the existing asphalt which will either be disposed of at the nearest landfill or recycled. If another site is found or needed, we will inform DCM and submit the necessary information or make the necessary revisions to obtain approval to use the site. The total disturbed area of this project is approximately 49,000 sf (1.12 acres). Upland Excavation and Earthwork: The upland excavation on this site will be to reach the proposed subgrade for the drive aisles and parking lots. Additional excavation may be necessary due to unsuitable soils. However, this will not be known until construction begins. Existing Stormwater Conditions: Currently, runoff from the site enters two existing storm drain inlets in the parking lot. These inlets drain directly into South Creek via 4" pipes. The portion of the site that does not enter the inlets drains into South Creek by overland flow down the existing ramp, to the existing rip rap lined shoreline, and toward the western end of the existing bulkhead on the north side of the peninsula. Proposed Stormwater Conditions: The proposed project will not alter the current drainage patterns. The existing inlets and 4" pipes will be replaced/upgraded to handle the nmoff. Currently, the pipes are undersized. The new pipes will discharge in the same locations as the existing pipes, so no new discharge points will be created as a result of the proposed development. Following development, a portion of the site will still drain to the existing rip rap lined shore line and the western end of the bulkhead on the north side of the peninsula. The ramp will be graded to minimize the amount of area that drains directly into the creek to just the ramp itself. No upland areas will drain down the ramp. Ramps/Docks: The proposed project includes the construction of two, single lane launch ramps. Each land will be 15' wide, for a total width of 30'. The will be an 8'x60' floating dock between the pimps. A floating courtesy T-dock with an 8'x52' walkway and 8'x48' tee will be provided at the end of the peninsula. Since this pier extends into South Creek, reflectors will be installed for the safety of night time boat traffic. The proposed project is located at 1 Main Street, adjacent to South Creek in the Town of Aurora in Beaufort County, North Carolina. The $400 application fee was deposited into the Departments account via electronic transfer. Additionally, this office has only received one of the adjacent property owner's certified mail green cards. Once I receive it from the NC WRC I will forward to you. The applicant proposes the following: 1. The existing boat ramp will be removed. The applicant proposes to construct two 15' (38' total boat ramp width) wide concrete boat ramps with an 8' wide by 60' long floating dock separating the two ramps. The new ramps will be located in the same location as the existing boat ramp. The boat ramp will extend approximately 45' into South Creek. A concrete apron will extend approximately 45' landward of the NWL. 2. The property has three sections of bulkhead which measure 390 feet, 157 feet and 217 feet. The bulkheads will be replaced in each of these three sections. The alignment of the new bulkheads will be 2' waterward of the existing bulkheads. 3. The existing launch pier and associated dock on the downstream (northern) side of the boat ramp will be removed. A new floating pier with a concrete abutment will be installed approximately 40' downstream of the boat ramp. This 8' wide floating dock will extend 52' waterward of the bulkhead and have a 8' wide by 48' long T-Head platform at the terminal end. 4. The existing gravel and asphalt parking area will be regraded and paved. Approximately 49,000 ft (1.12 acres) of uplands will be disturbed for the regrading and repaving of the maneuvering and parking area. Existing runoff from the site enters two storm drain inlets that drain directly into South Creek through two pipes and surface runoff. As a part of the parking area redevelopment these 2 drains will be upgraded to larger pipes and the remaining runoff will be directed to the shoreline that is currently stabilized with riprap. I have reviewed the proposed project with regard to rules found in Subchapter 7H concerning development in a Public Trust Area. It is staffs recommendation the proposed project is consistent with 15A NCAC 07H .0208 as described below. Historically, the NC Wildlife Resources Commission has requested piers to be 8' in width to improve safety and ease of use by the public. The Division of Energy, Mineral, and Land Resources issued the WRC a Stormwater Permit (#SW7130808) Exclusion Redevelopment Permit on 9 September 2013. If the permit is issued staff suggest the following conditions: The authorized structures and associated activity shall not cause an unacceptable interference with navigation. 2. The penmittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. 3. Disturbed areas will, within fifteen (15) working days or thirty (30) calendar days of completion of any phase of grading, whichever period is shorter, be planted or otherwise Provided with ground cover sufficient to restrain erosion. 4. The bulkhead alignment shall be no farther waterward than 2' as measured from the outside of the existing sheet to the outside of the new sheeting. 5. The bulkhead shall be constructed prior to any backfilling activities. The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 6. No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding waters outside of the alignment of the fill area indicated on the workplan drawing(s). 7. The concrete boat ramp shall be poured on high ground and pushed or placed into the water once hardened, or the applicant shall provide information on other construction methodologies that will be considered for approval on a case -by -case basis by Division of Coastal Management personnel. No live concrete shall come into contact with the waters of the State. 8. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this marina/docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. Staff review of the plans and supporting documents has determined that the project proposes activities that are excluded from State Stormwater permitting requirements as set forth in Section 2.(d)(3) of Session Law 2008-211, effective October 1, 2008, and the stormwater rules under Title 15A NCAC 2H .1000, as amended. Do you know when the time will be confirmed? What time do we need to get to the meeting? I also got your message about the Aurora BAA CAMA Major permit and the riparian notifications. The adjacent parcel on the north side of the peninsula is owned by Clydie Kinnion based on the Beaufort County GIS and the register of deeds. A riparian notification letter and package were sent to the address listed for Ms. Kinnion on August 20 (see attached). The package was returned to NCWRC as undeliverable. So, I contacted the County's register of deeds office to see if they had a more up to date deed for the property. Apparently Ms. Kinnion passed away in 2010. The register of deeds gave me a few names of possible heirs. So, another riparian notification letter was sent to Mr. Kevin Kinnion on October 24 (see attached). Staff review of the plans and supporting documents has determined that the project proposes activities that are excluded from State Stormwater permitting requirements as set forth in Section 2.(dx3) of Session Law 2008-211, effective October 1, 2008, and the stormwater rules under Title I SA NCAC 2H .1000, as amended. Therefore, the Division of Energy, Mineral, and Land Resources is hereby providing confirmation that the subject project is excluded from State Stormwater permitting requirements under the following conditions: 1) The project must be constructed as shown on the plans submitted to this Office; 2) The project, proposes no net increase in impervious area; and 3) The proposed stormwater control, provides better protection of surface waters then the existing stormwater control. Under Section .1003(b) of the stormwater rules, the entire common plan of development must be permitted. Therefore, . any future development or changes to the proposed development, including but not limited to, the locations of the built - upon area and construction of additional built -upon area, may require approval or a Stormwater Management permit application and permit issuance from the Division of Energy, Mineral, and Land Resources prior to any construction. Any construction on the site prior to receipt of the required approval or permit will constitute a violation of Title 15A NCAC 2H.1000 and Session Law 2008-211, and may result in the initiation of appropriate enforcement action.
