D. White, P. O. Box 352, Shallotte, NC 28459 authorizing development in Brunswick County 27-96 the Shallotte River, west side, off of SR1191 (Copas Road) , as requested in the permittee's application dated 6/7/95 including workplan drawing set, sheets 1-9 of 9 for "The Rock Golf Links", dated June, 1995. This permit, issued on FEBRUARY 27, 1996 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subiect to a fine, imprisonment or civil action; or may cause the permit to be null and void. Shoreline/MHW Line Natural Buffer 1) An undisturbed naturally vegetated buffer, not less than thirty feet (30) in width, will be maintained for the life of the project between the mean high water line (MHW) and all golf course fairways and greens. Retaining walls necessary to prevent erosion or sloughing of highground may be installed as requested in the workplans. Such retaining walls must be above the wetland line. Installation, including tie backs, where necessary, will disturb the buffer as little as possible. 2) Golf course turf grass management techniques, i.e., the application of fertilizer, herbicides, etc., will at no time be applied to the natural buffer. (See attached sheet for Additional Conditions) This per nit action maybe appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1999 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee 3 "The Rock Golf Links" Permit #27-96 Page 2 of 5 ADDMONAL CONDITIONS 3) Grading landward of the undisturbed buffer will be sloped toward the interior of the project and away from the coastal wetland line. 4) Adequate sedimentation and erosion control measures shall be implemented and maintained to prevent erosion of unconsolidated soil into adjacent wetlands and/or waters. This is a priority concern during the extensive grading and landscaping of the golf course construction. All disturbed areas shall be immediately stabilized with vegetative cover. Bulkheads/Retaining_Walls 5) Alignment of the proposed bulkheads shall be staked by a representative of the Division prior to construction. 6) The bulkhead shall be constructed prior to any backfilling activity. All backfill material will be obtained from an upland source. 7) The construction of the bulkhead shall be completed in such a manner as to prevent the erosion of unconsolidated earthen materials into the adjacent waters/wetlands. 8) The bulkhead shall be structurally tight so as to prevent seepage of backfill material through the structure. Cart and Foot Bridges 9) Golf cart bridges over wetlands shall be elevated approximately four (4) feet above wetland substrate. Golf cart bridges over navigable waters shall provide 6-8 feet of clearance above the MHW elevation contour and 14-16 feet clear span width. Protection of Archaeological Sites 10) Prior to initiation of ground -disturbing construction activities in the immediate vicinity of archaeological site 31BW574, archaeological testing shall be conducted to determine if the site is eligible for listing in the National Register of Historic Places. If site 31BW574 is determined eligible for listing in the National Register, and if the site will be adversely affected by proposed construction activities, a detailed impact mitigation plan shall be developed and executed. 11) All archaeological investigations shall be conducted under the direction of an experienced archaeologist. Upon completion of the site testing, a written report will be submitted to the N. C. Division of Archives and History. Any mitigation plans developed for the site must be approved by the Division of Archives and History prior to implementation. "The Rock Golf Links" Permit #27-96 Page 3 of 5 ADDITIONAL CONDITIONS If the permittee discovers any previously unknown historic or archaeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required State/Federal coordination. Excavation and Fill - General 12) All excavated materials will be confined landward of the mean high water (MIM elevation contour within adequate dikes or other retaining structures to prevent the spillover of solids into any vegetated wetlands os surrounding waters. 13) The temporary placement or double -handling of excavated or full materials within waters or vegetated wetlands is not authorized. 14) The fill material will be clean and free of any pollutants, except in trace quantities. 15) The activitywill be conducted in a way that prevents a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 25 NTUs or less in all saltwater classes are not considered significant. Mitigation For Fresh Wetland Impacts 16) Mitigation to offset the impacts 3.87 acres of woody wetlands resulting from the propsed project will be the excavation of shallow ponds in highground. A 40 foot wide fringe around the perimeter of each pond will be planted with species of emergent grass. 17) Prior to beginning any work, a detailed mitigation plan will be submitted to and approved by the U. S. Army Corps of Engineers (USACE), the N.C. Division of Coastal Management (NCDCM), and the N. C. Division of Environmental Management (NCDEM). 18) Within the wetland mitigation areas, the physical and chemical properties of the soils will be suitable to support target plant species. Hydrology will be maintained such that the soils are either saturated within 12 inches of the surface, or ponded or flooded for at least 12.5 percent of the growing season under reasonably average climatic conditions. The geomorphology of the area will be suitable to meet hydrology requirements with regards to contours, elevation, and drainage/connections with surface waters. The plan will also describe the numbers of each species to be planted and the planting plan. Changes in planted species and locations of planted vegetation may be altered in accordance with onsite field conditions. Finalization of the planted species and the locations of each species will be located on a map and forwarded to the USACE, NCDCM, and NCDEM. 20) Survival rates of each species will be at least 80 percent of the number planted. Survival rate monitoring will be conducted for three years from the initial planting, and will occur at the beginning and the end of each growing season. If a survival rate of less than 80 percent occurs, the species will be replanted in accordance with the original planting plan, and a new three year monitoring period will begin. 21) Failure of any of the proposed parameters will result in your arrangement of a meeting with the USACE, NCDCM, and NCDEM to allow approval of a revised plan. 22) At the end of a successful three year monitoring period, coordination with the USACE, NCDCM and NCDEM to ensure that the mitigation areas remain functional wetlands in perpetuity, of similar or higher quality than the initial design. Local Government Regulation 23) The entire project, known as "The Rock Golf Links", including a 571 unit subdivision, must meet Subdivision Regulations and receive Zoning Conditional Use approval of the Town of Shallotte, prior to construction. Stormwater Management 24) The Division of Environmental Management approved this project as a Low Density Stormwater Project on November 28, 1995. Any violation of stormwater management permit No. SW8950618 will be considered a violation of this CAMA permit. ?jQM An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment, Health and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405-3845. NOTE: Subsequent residential development of individual lots within any areas of Environmental Concern will require additional permitting through the Division of Coastal Management, which executes the Town of Shallotte's Minor CAMA Permit Program. NOTE: The pennittee is advised to contact the Brunswick County Mosquito Control and Operations Services in Bolivia for advice on methods to reduce mosquito breeding areas from being created during construction. Dear Ed: Enclosed please find 24 copies of the blueline drawings of "The Rock" which details all of the proposed interior wetland 404 impacts and dimensions of the various site improvements. As discussed in the application package Mr. R.D. White, et.al. owns the 569 acre property and they desire to construct the 18 hole golf course with clubhouse and amenities plus plat and develop 571 single family residential lots. Mr. White also has 3 multi -family sections which will remain undeveloped until public sewer becomes available. With this CAMA Major submission the sedimentation control plan and stormwater plans arb also being included as vital parts of the application package. A summary of 404 wetland impacts is attached as a reduced 11'x 17" color coded map which helps to illustrate various locations of specific land use impacts. The $250.00 application fee and a sheet containing riparian land owner names and address is also attached. On some adjacent riparian neighbors Mr. White has explained the project personally and on others he has mailed the attached "Notification Letter" by Certified Mail, Return Receipt Requested. As the return receipts come in Mr. White will forward them to you. As to CAMA concerns there will be no saltmarsh or estuarine waters directly filled or excavated. There will be, however, 7 elevated wooden cart paths over saltmarsh vegetation but in order to reduce shading impacts they will be at least 6 ft. above the MHW contour. Also, there are potentially 11 separate locations for bulkhead/riprap retaining walls all at or above all 404 wetlands and/or MHW or NWL contours. The purpose of the 2250 L.F. of bulkheading is to stabilize either existing eroding bluffs or help prevent sediment from newly constructed fairways from reaching saltmarsh areas. Ed Brooks Page 2 The 404/CAMA wetlands were identified during the Fall of 1993 and the Corps approved the line in January of 1994. The wetland lines are illustrated on the attached bluelines. In order to save money, the 404/CAMA wetland line is used as the MHW contour which Mr. White recognizes increases his impervious cover ratios. Finally, the 3.87 acres of "woody" 404 wetlands which will be impacted with fill or excavation are to be mitigated by a 1:1 replacement by the creation of shallow ponds out of uplands and the planting of a 40' wide wetland shelf around their perimeters which will be planted with emergent grass like plant species. Secondary and long term impacts are always associated with any development, however, the proposed density and built -upon area for this project is approximately 1/2 of allowable coverage under current regulatory guidelines. The applicant has been advised to contact the USACOE directly, as my conversations with Corps staff indicated that they may require an individual permit application for the proposed pond excavation and mitigation plan. The applicant's consultants reported that the COE approved wetland delineation was based on vegetation and soils only, and that if wells were installed to monitor the hydrology, the wetland area would be significantly reduced. My observations on the site would support this statement to the extent that, many of the delineated areas are associated with existing/remnant ditches which may have reduced or eliminated wetland hydrologic functions. Provided that the wetland losses from proposed road crossings and fairway fill, receive 401 certification, that the USACOE authorizes the road crossings and the pond excavation and mitigation plan, and the proposed project is consistent with local planning and zoning requirements, I have no objections to the proposed project subject to the following conditions: 1. Adequate sedimentation and erosion control measures shall be implemented and maintained to prevent erosion of unconsolidated soil into adjacent wetlands and/or waters. This is a priority concern during the extensive grading and landscaping of the golf course construction. All disturbed areas shall be immediately stabilized with vegetative cover. f �T 2. Subsequent residential development of individual lots within any area(s) of Environmental a q Concern will require additional permitting through the Division, which executes the Town of Shallotte's Minor CAMA Permit Program. r4. Alignment of the proposed bulkheads shall be staked by a representative of the Division prior to construction. The bulkhead shall be constructed prior to any backfilling activity. All backfill material will be 3 obtained from an upland source. 5. The construction of the bulkhead shall be completed in such a manner as to prevent the erosion of unconsolidated earthen materials into the adjacent waters/wetlands. I 6. The bulkhead shall be structurally tight so as to prevent seepage of backfill material through the structure. y 9� 7. Golf cart bridges over wetlands shall be elevated approximately 2 feet above the average height t of wetland vegetation. Golf cart bridges over navigable waters shall provide 6-8 feet of clearance above the MHW elevation contour and 14-16 feet clear span width. NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This Plan must be filed at least thirty (30) days prior to the beginning of any land -disturbing activity. Submit this Plan to the Department of Environment, Health and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, North Carolina 28405-3845.
