Excavation

other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.

All work must cease when the permit expires on
December 31 1909

Dear Sir:
The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original
(buff -colored form) is retained by you and it must be available on site when the project is inspected for
compliance. Please sign both the original and the copy and return the copy to this office in the enclosed
envelope. Signing the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B
with the Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698
within twenty (20) days of this decision on your permit. You should also be aware that if another qualified
party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be
resolved prior to work initiation. The Coastal Resources Commission makes the final decision on any
appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance require additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact
Department personnel at any time for assistance. By working in accordance with the permit, you will be
helping to protect our vitally important coastal resources.

The Rock Golf Links
The applicant has submitted the enclosed plans showing minor changes to the golf course and subdivision
layouts and is requesting to modify the above referenced permit. The revised plan reduces wetland
impacts by 1.25 acres, eliminates 260 L.F. of bulkhead, and reduces the total number of residential units
by 66 units. I recommend a minor modification be issued to authorize the change in the permit, provided
a 401 certification is obtained for the changes in wetland road crossings, and the modifications are
approved to the stormwater permit.

The Rock Golf Links is requesting the revision of Permit #27-96 issued on February 27, 1996.
Our request consists of some minor changes of our golf course layout and sub -division layout as
per the attached plans. The new layout reduces the wetland impact of 1.25 acres. We expect
this plan will reflect the final design with little or no further changes.

APPROVAL of 401 Water Quality Certification and ADDTPIONAL CONDITIONS
Dear Mr.White:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material inl 25 acres
of wetlands or waters for the purpose of developing in the RuckGotf Links and residential development, as you described in your
modified application dated 4 December, 1998. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you
go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non -Discharge and
Water Supply Water abed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless
otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation maybe required
as described in 15A NCAC 2H .0506 (h) (6) and M. For this approval to be valid you must follow the conditions listed in the
attached certification and any additional conditions fisted below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters to notify the
state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days
of the date of this letter or the issuance of the 404 Permit (whichever is later).
2. An condition is that a final, written stormwater plan including a wet detention basin for the golf & tub house area must be approved
by DWQ before wedand (or stream) impacts occur. Also, before any building is occupied at the subject site the stormwater
treatment facilities shall be constructed and operational and the stormwater management plan be implemented. Stormwater from
the golf course shall not directly discharge into estuarine Waters or streams.
3. Compensatory mitigation is required as outlined in your 4 December1998 letter. DWQ shall be copied on the mitigation plan and
annual monitoring reports.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This
certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act If you have

The Rock Golf Links
The applicant has submitted the enclosed plans showing minor changes to the golf course and subdivision
layouts and is requesting to modify the above referenced permit. The revised plan reduces wetland
impacts by 1.25 acres, eliminates 260 L.F. of bulkhead, and reduces the total number of residential units
by 66.units. I recommend a minor modification be issued to authorize the change in the permit, provided
a 401 certification is obtained for the changes in wetland road crossings, and the modifications are
approved to the stormwater permit.
