1) The breakwater segments shall be no greater than 200 feet in length and the opening between each
segment shall be five (5) feet.
2) To promote flushing and fish passage, a one (1) foot opening will be provided in every ten feet of
breakwater section.
3) The breakwater structure will average not more than 20 feet offshore from the normal water level
elevation contour.
4) The height of the breakwater shall not exceed six (6) inches above the normal water level.
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31.1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

Roanoke Properties, Limited is developing Pirates Cove, a 609 acre planned unit
development located off US 64/264 on the north side of the Washington Baum Bridge in
Manteo, Dare County, adjacent Roanoke Sound and Shallowbag Bay. Existing development
on this site consist of condominiums, single-family homes, a restaurant and tsarina.
Construction of single-family homes has been initiated within Ballast Point, a 40 acre
subdivision with 5,000 square foot to 20,000 square foot lots. This last parcel of
undeveloped property is being developed in accordance with CAMA Major Permit #36-90
which was issued on March 2, 1990 and last renewed on May 10, 1995.
The Ballast Point Subdivision is approximately 4,600 feet long, and 400 feet wide and
is surrounded by Roanoke Sound on the east, Shallowbag Bay on the northwest, and by a 70'
wide man-made canal on the south and west sides. Elevation of this tract ranges from 1' -
10' above mean sea level. Along most of the shoreline there is a 20' - 40' wide fringe of
coastal wetlands vegetated with a mixture of black needlerush Juncus roemerians) and salt
meadow grass S artina patens . Located landward of the coastal wetlands are wetlands
vegetated with wax myrtle Mrica cerifera and marsh elder vava frutescens which have
been delineated as section 404 wetlands by the U.S. Army Corps of Engineers. The
shoreline along Roanoke Sound and Shallowbag Bay is eroding approximately 4' per year as
a result of storm events and the wake from boats using the 80' wide navigational channel
lying about 200' east of the property.
Project Description
The applicant proposes to construct 26 segments of breakwater with a total length of
4,075' designed to protect the shoreline along Roanoke Sound and Shallowbag Bay. The
distance waterward will average 20'. Breakwater height is proposed at 1' above mean high
water with half -inch gaps provided every six inches. The breakwater segments will overlap
but a 5' wide space is proposed between segments with a maximum length of 200'. The
breakwater is proposed within waters 1.5' - 2' deep. No backfilling of the breakwater within
wetlands, estuarine waters, or public trust areas is proposed.
Anticipated Impacts
The installation of 4,075' of breakwater will cause some localized turbidity. The
breakwater will affect flushing and will tend to restrict the movement of marine life within
the vicinity of the breakwater.
The breakwaters will act to stabilize the rapidly eroding shoreline and the fringe of
coastal wetlands located thereon.

Roanoke Properties, Limited is developing Pirates Cove, a 609 acre planned unit
development located off US 64/264 on the north side of the Washington Baum Bridge in
Manteo, Dare County, adjacent Roanoke Sound and Shallowbag Bay. Existing development
on this site consist of condominiums, single-family homes, a restaurant and marina.
Construction of single-family homes has been initiated within Ballast Point, a 40 acre
subdivision with 5,000 square foot to 20,000 square foot lots. This last parcel of
undeveloped property is being developed in accordance with CAMA Major Permit #36-90
which was issued on March 2, 1990 and last renewed on May 10, 1995.
The Ballast Point Subdivision is approximately 4,600 feet long, and 400 feet wide and
is surrounded by Roanoke Sound on the east, Shallowbag Bay on the northwest, and by a 70'
wide man-made canal on the south and west sides. Elevation of this tract ranges from 1' -
10' above mean sea level. Along most of the shoreline there is a 20' - 40' wide fringe of
coastal wetlands vegetated with a mixture of black needlerush Juncus roemerians) and salt
meadow grass (Spartinapate ns . Located landward of the coastal wetlands are wetlands
vegetated with wax myrtle M rica cerifera and marsh elder (Iva frutescens which have
been delineated as section 404 wetlands by the U.S. Army Corps of Engineers. The
shoreline along Roanoke Sound and Shallowbag Bay is eroding approximately 4' per year as
a result of storm events and the wake from boats using the 80' wide navigational channel
lying about 200' east of the property.
Project Description
The applicant proposes to construct 26 segments of breakwater with a total length of
4,075' designed to protect the shoreline along Roanoke Sound and Shallowbag Bay. The
distance waterward will average 20'. Breakwater height is proposed at l' above mean high
water with half -inch gaps provided every six inches. The breakwater segments will overlap
but a 5' wide space is proposed between segments with a maximum length of 200'. The
breakwater is proposed within waters 1.5' - 2' deep. No backfilling of the breakwater within
wetlands, estuarine waters, or public trust areas is proposed.
Anticipated Impacts
The installation of 4,075' of breakwater will cause some localized turbidity. The
breakwater will affect flushing and will tend to restrict the movement of marine life within
the vicinity of the breakwater.
The breakwaters will act to stabilize the rapidly eroding shoreline and the fringe of
coastal wetlands located thereon.

breakwater, on property located off US Highway 64/264, in the Pirates Cove
development, adjacent the Roanoke Sound and Shallowbag Bay, in Manteo, Dare
County, North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the administrative
processing of your application will be accomplished by the North Carolina
Division of Coastal Management. Comments from Federal review agencies will be
furnished to the State.
If your application must be withdrawn from this general permit process
for any reason, you will be informed regarding its further management. If
there are no unresolved differences in State -Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.

I recommend that the Roanoke Properties proposal for 4,075 linear feet of wooden
breakwater be permitted with the following conditions:
1) To promote flushing and fish passage, one (1) foot opening will be provided in
every ten feet of breakwater section.
6` 2) The proposed breakwater alignment must be marked by a representative of the
Division of Coastal Management during an on -site meeting with the applicant.
The alignment must be staked within a maximum of thirty (30) days prior to the
start of construction.
3) The height of the breakwater shall not exceed six inches above the normal water
level.
4) The breakwater will not extend waterward more than 35 feet from the normal
water level at any point along its alignment at the time of construction.
r 0 5) The breakwater shall be marked at 50 foot intervals with yellow reflectors
extending at least three feet above mean high water.
�0 6) No backfrll of the breakwater or any other fill of wetlands, estuarine waters,
public trust areas landward of the proposed breakwater is authorized by this
permit.

7) The breakwater shall not cause an unacceptable interference with navigation or
the use of the waters by the public.
0 8) Perpendicular sections, return walls, or sections which would enclose estuarine
waters or public trust areas shall not be allowed under this permit.
9) The permittee shall maintain the breakwater in good condition and in
conformance with the terms and conditions of this permit or the remaining
breakwater shall be removed within 90 days of notification from the Division of
Coastal Management.

The applicant proposes to construct 4,075 linear foot of wooden breakwater about 20 feet
waterward of mean high water adjacent to the Ballast Point Subdivision in the Town of
Manteo.
The anticipated impacts are expected to be limited to some local turbidity during construction,
Results of the breakwater will be some minor restriction in in marine life movement associated
with moderated flushing. To facilitate flushing, the Field Representative has required one foot
gaps at ten foot intervals. The is project will have a beneficial result in shoreline and fringe
coastal wetland stabilization.
Consistency Determination: This request is consistent with and not in conflict with the
Town of Manteo's 1992 "Land Use Plan (LUP)" certified by the CRC on September 26,
1992.

The following comments by the North Carolina Division of Marine Fisheries are
provided pursuant to General Statute 113-131.
Roanoke Sound and Shatlowbag Bay function as a nursery area for spot, croaker,
weakfish, spotted seatrout, flounder, blue crabs and other commercially and recreationally
important species.
The Division approves of this project with the following minor amendment. The
proposed Ih inch gap every six inches in the breakwater is not adequate for water exchange
nor fish and invertebrate passage between the shoreline and the breakwater. This agency
recommends that one sheetpile be left out of the breakwaters every 8 or 10 feet. This would
provide adequate water exchange and allow fish and invertebrate passage to occur.

Project Location: US 64/264 north side Washington Baum Bridge, adjacent Roanoke Sound
and Shallowbag Bay, Dare County.
Proposed Project: Construct 4,075 linear feet of wooden breakwater approximately 20,
waterward of mean high water along approximately 5,000' of shoreline
of Roanoke Sound and approximately 700' of shoreline of Shallowbag
Bay at Ballast Point Subdivision.

The Division of Coastal Management hereby acknowledges receipt of your application.
for State approval for development of property located US 64/264 north side of Washington
Baum Bridge, adjacent Roanoke Sound and Shallowbag Bay, Ballast Point Subdivision, Dare
County. It was received on September 23, 1996, and appears to be adequate for processing
at this time. The projected deadline for making a decision is December 7, 1996. An
additional 75-day review period is provided by law when such time is necessary to complete
the review. If you have not been notified of a final action by the initial deadline stated
above, you should consider the review period extended. Under those circumstances, this
letter will serve as your notice of an extended review. However, an additional letter will be
provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of
the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard
which must be posted at the property of your proposed development. You should post this
notice at a conspicuous point along your property where it can be observed from a public
road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a
private road would lead one into your property. Failure to post this notice could result in an
incomplete application.
An onsite inspection will be made, and if additional information is required, you will
be contacted by the appropriate State or Federal agency. Please contact me if you have any

The renewal request submitted by Roanoke properties for the renewal of CAMA Permit No. 173-
96 will need to be refunded due to a misunderstanding between the applicant and Coastal
Management concerning the renewal process. The applicant was requesting to renew a project
that has been completed and CAMA rules do not allow for this. The refund should be for the
amount of $100; a copy of the original check is attached. Roanoke Properties can be reached at

Re: Renewal request of permit 173-96, Roanoke properties (breakwater maintenance)
Rich Weaver discussed this renewal request with Frank Jennings. Frank stated that Roanoke
properties has finished construction of all the breakwaters, however, they would like to keep the
permit active strictly for maintenance and repair purposes in order to keep the breakwaters in
good condition. They also mentioned to Frank that they would like to keep the permit active in
the event that a storm were to destroy the breakwaters, they could quickly and easily repair the
damage and protect the marsh fringe. Frank suggests that we grant them the renewal.

SUBJECT: CAMA Major Permit #173-96, Breakwater Wall Renewal Request
CAMA Major Permit #173-96 was issued on December 20, 1996, to Roanoke Properties
for a marsh enhancement breakwater for Pirates Cove Subdivision on Roanoke Island,
Dare County. Several of the structures have been built; however, the project is not
complete. Maintenance of existing structures appears to be intensive and ongoing.
The applicant has submitted a renewal request and check #61651 for $100. It is
recommended that the permit be renewed.

Information gathered by the Division of Coastal Management shows that you have
undertaken Major Development in violation of the Coastal Area Management Act.
No person may undertake Major Development in a designated Area of Environmental
Concern without first obtaining a permit from the North Carolina Coastal Resources
Commission. North Carolina General Statutes (hereinafter abbreviated NCGS 113A-118). I
have information that you have undertaken Major Development by placing concrete rip rap
within the waters of Roanoke Sound, located adjacent the Ballast Point Subdivision in Pirates
Cove Development in Dare County. This development is being undertaken within the Estuarine
Shoreline, Estuarine Waters and Public Trust Waters, designated Areas of Environmental
Concern, and no permit has been issued for it. Therefore, I have concluded that you are in
violation of the permit requirement of the Coastal Area Management Act.
I request that you immediately CEASE AND DESIST any further development and
contact me about this matter. Since the development you have undertaken is not consistent with
the applicable standards, you will be required to restore the area to its former condition. A civil
assessment of up to $2500.00 may be assessed against any violator. Each day that the
development described in this Notice is continued or repeated may constitute a separate violation
which is subject to an additional assessment of $2500.00. An injunction or criminal penalty may
also be sought to enforce any violation NCGS 113A-126.
It is the policy of the Coastal Resources Commission to assess a minimum civil penalty

natural resources. Whether a higher amount will be assessed will depend on several factors,
including the nature and area of the resources which were affected and the extent of the damage
to them. If restoration of the affected resources is requested but is not undertaken or completed
satisfactorily, a substantially higher civil penalty will be assessed and a court injunction will be
sought ordering restoration.
Any restoration necessary to bring this project into compliance with the Act will be
determined during our on -site meeting scheduled for April 10, 1997.
The relevant statutes and regulations are available from this office, and I am villing to
assist you in complying with the requirements of these laws. Mr. Richard Watts, District
Manager of the Elizabeth City office and I look forward to our on -site meeting scheduled for

Dear Mr. Futrell:
Please reference the Notice of Violation sent to you on April 9, 1997 for the unauthorized
placement of concrete rip rap within the Estuarine Shoreline, Estuarine Waters and Public Trust
Waters on your property in the Pirates Cove Development in Dare County.
On April 28, .1997, Raleigh Bland, US Army Corps of Engineers, Richard Watts. and I
(NC Division of Coastal Management) met with you on -site of your property in Manteo. The
purpose of our meeting was to determine what restoration would be required for the unauthorized
development on your property.
During our meeting we agreed on two areas from which the rip rap must be removed.
The northern site involves approximately 100 linear feet of shoreline lying waterward of a newly
installed breakwater. It was agreed that all rip rap material lying waterward of a line which was
delineated by two stakes with CAMA flags must be removed.
The southern site involves approximately 200 linear feet of shoreline. It was agreed that
all concrete material lying waterward of a line which was delineated by two Corps on Engineers
flags must be removed. The rip rap within the two designated areas must be removed prior to
May 10, 1997. We will inspect the sites periodically to determine the progress in complying
with our restoration request.
It is the policy of the Coastal Resources Commission to assess a minimum civil penalty
