For those structures to on the primary dune or nearer to the ocean, the pilings must extend to five feet below mean sea level. 6) In accordance with 15A NCAC 7H.0308(a), no seawall or riprap revetments will be allowed in the future should the condominium become threatened by erosion. This condition shall remain in force for the life of the permitted development. 7) The condominium structure(s) shall be relocated or dismantled within two years of the time when the structure(s) become imminently threatened by erosion, or in any case upon structural collapse or subsidence. However, if natural shoreline recovery or beach renourishment takes place within two years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, the structure need not be relocated or dismantled at that time. 8) The Division of Water Quality approved this project under stormwater management rules of the Environmental Management Commission on 10/31/96 (Permit No. SW8 960905). Any violation of or deviation from the plan approved by the D. W.Q. will be considered a violation of this CAMA permit NOTE: An Erosion and Sedimentation Control Plan will be required for this project. If approval has not yet been obtained, this plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. If the applicant is not claiming to be the owner of said property, then forward a copy of the deed or other instrument under which the owner claims title, plus written permission from the owner to carry out the project. • An accurate, dated work plat (including plan view and cross -sectional drawings) drawn to scale in black ink on an 8 1/2" by II" white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue -line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) PROJECT SUMMARY: The applicant is proposing to construct a 7 building, 42 unit condominium project directly adjacent to Pier Pointe Condominiums located adjacent to NC Highway 58 and the Atlantic Ocean, in the Town of Emerald Isle. FIELD INVESTIGATION REPORT: Jarrick, Inc. (Pier Pointe West) PAGE #2 9. NARRATIVE DESCRIPTION: The applicant's property consists of a ± 7 acre tract of land located on the south side of NC Highway 58 and adjacent to the Atlantic Ocean, just west of the Emerald Isle Fishing Pier, in the Town of Emerald Isle, Carteret County. The previous landowner received CAMA Major Permit #8-95 (Ocean Mist & Sound Mist Mobile Home Park) which authorized the construction of a 18 space mobile home park on this property as well as a 14 space park on a tract of land located on the north side of the highway and adjacent to Bogue Sound. The mobile home park on the sound side has been completed and a significant amount of "prep" work was done on the oceanfront property. This work included bring in a considerable amount of fill material to increase the elevations of the site and the installation of septic tank systems. The majority of vegetation landward of the primary dune system has been denuded. Hurricanes Bertha and Fran caused considerable beach erosion along this section of shoreline with ± 30' wide frontal dune system having been washed away. Immediately after both Bertha and Fran the applicant conducted beach bulldozing and pushed up a protective dune front. Today, the first line of stable natural vegetation is _+ 35' landward from the seaward toe of the reestablished dune. Landward of the bulldozed dune is a primary dune system with crest elevations averaging ± 20'. The remaining property is basically flat in topography. The average long term annual erosion rate has been established at 2' per year and the recession line that could be created from a 100 year storm is 50' The V-zone established by the Flood Insurance Rate Map is at 12' and 14' above mean seal level and is located in the area between the previous frontal dune and the primary dune. While the Atlantic Ocean has been designated as "SB" waters, a minute portion of the oceanfront tract is also located within the 575' Estuarine Shoreline as established form the mean high water line of Bogue Sound. A potential archaeological site has been identified on this or the adjoining oceanfront property but has been previously evaluated by the Dept. of Cultural Resources. Jarrick, Inc. has recently purchased the property and now proposes to expand their condominium complex which is currently being constructed on the adjacent property. This development received CAMA Permit #68-95 which authorized the construction of 48 condominium units in 8 buildings. Today, the project is nearly complete with work remaining to be done on 2 buildings. The proposes expansion into this tract will involve the construction of: 1) 7 buildings which will contain 42 condominium units; 2) 6 dune walkways which will be 4' wide with each having a 10' x 10' sitting area, 3) associated building parking lots, 4) swimming pool with associated equipment building and cabana, 5) tennis court and 6) utilities including potable water, wastewater and electrical service. Potable water will be provided by a public water system and the wastewater will be handle by individual septic tank systems. Two of the buildings will be constructed on the oceanfront and behind or slightly on the landward toe of the primary dune system. Each building will be ± 45' long x 52' wide and ± 39' in elevation. ANTICIPATED IMPACTS: The project as proposed will convert a previously permitted 18 space mobile home park into a 42 unit condominium project. The applicant has provided in the application package information which indicates the built . upon surfaces (driveway) within the Estuarine Shoreline adjacent to ORWs to be less than 25%. The built upon surfaces within the remainder of the project is ± 21%. Wastewater disposal is proposed to be serviced by septic tank systems which have not yet received County Health Department approval. The buildings will be located on pilings behind or slightly on the landward toe of the primary dune system. Fill material has or will be brought to increase the elevation of the building sites. The building will be behind the 120' erosion setback which is established for large structures and will be outside of any V-zone designation established by the Flood Insurance Rate Maps. NARRATIVE DESCRIPTION: The applicant's property consists of a ± 7 acre tract of land located on the south side of NC Highway 58 and adjacent to the Atlantic Ocean, just west of the Emerald Isle Fishing Pier, in the Town of Emerald Isle, Carteret County. The previous landowner received CAMA Major Permit #8-95 (Ocean Mist & Sound Mist Mobile Home Park) which authorized the construction of a 18 space mobile home park on this property as well as a 14 space park on a tract of land located on the north side of the highway and adjacent to Bogue Sound. The mobile home park on the sound side has been completed and a significant amount of "prep" work was done on the oceanfront property. This work included bring in a considerable amount of fill material to increase the elevations of the site and the installation of septic tank systems. The majority of vegetation landward of the primary dune system. has been denuded. Hurricanes Bertha and Fran caused considerable beach erosion along this section of shoreline with ± 30' wide frontal dune system having been washed away. Immediately after both Bertha and Fran the applicant conducted beach bulldozing and pushed up a protective dune front. Today, the first line of stable natural vegetation is ± 35' landward from the seaward toe of the reestablished dune. Landward of the bulldozed dune is a primary dune system with crest elevations averaging ± 20'. The remaining property is basically flat in topography. The average long term annual erosion rate has been established at 2' per year and the recession line that could be created from a 100.year storm is 50'. The V-zone established by the Flood Insurance Rate Map is at 12' and 14' above mean seal level and is located in the area between the previous frontal dune and the primary dune. While the Atlantic Ocean has been designated as "SB" waters, a minute portion of the oceanfront tract is also located within the 575' Estuarine Shoreline as established form the mean high water line of Bogue Sound. A potential archaeological site has been identified on this or the adjoining oceanfront property but has been previously evaluated by the Dept. of Cultural Resources. Jarrick, Inc. has recently purchased the property and now proposes to expand their condominium complex which is currently being constructed on the adjacent property. This development received CAMA Permit #68-95 which authorized the construction of 48 condominium units in 8 buildings. Today, the project is nearly complete with work remaining to be done on 2 buildings. The proposes expansion into this tract will involve the construction of: 1) 7 buildings which will contain 42 condominium units, 2) 6 dune walkways which will be 4' wide with each having a 10' x 10' sitting area, 3) associated building parking lots, 4) swimming pool with associated equipment building and cabana, 5) tennis court and 6) utilities including potable water, wastewater and electrical service. Potable water will be provided by a public water system and the wastewater will be handle by individual septic tank systems. Two of the buildings will be constructed on the oceanfront and behind or slightly on the landward toe of the primary dune system. Each building will be ± 45' long x 52' wide and ± 39' in elevation. ANTICIPATED IMPACTS: The project as proposed will convert a previously permitted 18 space mobile home park into a 42 unit condominium project. The applicant has provided in the application package information which indicates the built upon surfaces (driveway) within the Estuarine Shoreline adjacent to ORWs to be less than 25 %. The built upon surfaces within the remainder of the project is ± 21 %. Wastewater disposal is proposed to be serviced by septic tank systems which have not yet received County Health Department approval. The buildings will be located on pilings behind or slightly on the landward toe of the primary dune system. Fill material has or will be brought to increase the elevation of the building sites. The building will be behind the 120' erosion setback which is established for large structures and will be outside of any, V-zone designation established by the Flood Insurance Rate Maps. PROJECT SUMMARY: The applicant is proposing to construct a 7 building, 42 unit condominium project directly adjacent to Pier Pointe Condominiums located adjacent to NC Highway 58 and the Atlantic Ocean, in the Town of Emerald Isle. NARRATIVE DESCRIPTION: The applicant's property consists of a ± 7 acre tract of land located on the south side of NC Highway 58 and adjacent to the Atlantic Ocean, just west of the Emerald Isle Fishing Pier, in the Town of Emerald Isle, Carteret County. The previous landowner received CAMA Major Permit #8-95 (Ocean Mist & Sound Mist Mobile Home Park) which authorized the construction of a 18 space mobile home park on this property as well as a 14 space park on a tract of land located on the north side of the highway and adjacent to Bogue Sound. The mobile home park on the sound side has been completed and a significant amount of "prep" work was done on the oceanfront property. This work included bring in a considerable amount of fill material to increase the elevations of the site and the installation of septic tank systems. The majority of vegetation landward of the primary dune system has been denuded. Hurricanes Bertha and Fran caused considerable beach erosion along this section of shoreline with ± 30' wide frontal dune system having been washed away. Immediately after both Bertha and Fran the applicant conducted beach bulldozing and pushed up a protective dune front. Today, the first line of stable natural vegetation is ± 35' landward from the seaward toe of the reestablished dune. Landward of the bulldozed dune is a primary dune system with crest elevations averaging ± 20'. The remaining property is basically flat in topography. The average long term annual erosion rate has been established at 2' per year and the recession line that could be created from a 100 year storm is 50'. The V-zone established by the Flood Insurance Rate Map is at 12' and 14' above mean seal level and is located in the area between the previous frontal dune and the primary dune. While the Atlantic Ocean has been designated as "SB" waters, a minute portion of the oceanfront tract is also located within the 575' Estuarine Shoreline as established form the mean high water line of Bogue Sound. A potential archaeological site has been identified on this or the adjoining oceanfront property but has been previously evaluated by the Dept. of Cultural Resources. Jarrick, Inc. has recently purchased the property and now proposes to expand their condominium complex which is currently being constructed on the adjacent property. This development received CAMA Permit #68-95 which authorized the construction of 48 condominium units in 8 buildings. Today, the project is nearly complete with work remaining to be done on 2 buildings. The proposes expansion into this tract will involve the construction of: 1) 7 buildings which will contain 42 condominium units, 2) 6 dune walkways which will be 4' wide with each having a 10' x 10' sitting area, 3) associated building parking lots, 4) swimming pool with associated equipment building and cabana, 5) tennis court and 6) utilities including potable water, wastewater and electrical service. Potable water will be provided by a public water system and the wastewater will be handle by individual septic tank systems. Two of the buildings will be constructed on the oceanfront and behind or slightly on the landward toe of the primary dune system. Each building will be ± 45' long x 52' wide and ± 39' in elevation. Compatible fill material will be brought in from off site in order to provide suitable building site elevations. FIELD INVESTIGATION REPORT: Jarrick, Inc. (Pier Pointe West) PAGE N3 10. ANTICIPATED IMPACTS: The project as proposed will convert a previously permitted 18 space mobile home park into a 42 unit condominium project. The applicant has provided in the application package information which indicates the built upon surfaces (driveway) within the Estuarine Shoreline adjacent to ORWs to be less than 25%. The built upon surfaces within the remainder of the project is ± 21%. Wastewater disposal is proposed to be serviced by septic tank systems which have not yet received County Health Department approval. The buildings will be located on pilings behind or slightly on the landward toe of the primary dune system. Fill material has or will be brought to increase the elevation of the building sites. The building will be behind the 120' erosion setback which is established for large structures and will be outside of any V-zone designation established by the Flood Insurance Rate Maps. The applicant should be encouraged to incorporate appropriate lighting for buildings and walkways which will minimize adverse impacts to hatching sea turtles which may be nested adjacent to the project area. The condominium structures shall be relocated or dismantled within two years of the time when it become imminently threatened, and in any case upon its collapse or subsidence. However, if natural shoreline recovery or beach renourishment takes place within two years of the time the structure becomes threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. NOTE: Re -vegetation of any bare sand areas around the building sites should be initiated during the next growing season to reduce erosion. NOTE: In order to protect hatching loggerhead sea turtles, all lights on the building face, including balcony lights on the ocean side of all structures, should be eliminated. The Land Use Plan discussion of Ocean Hazard Areas permits development allowed by the policies contained in the Plan, the Emerald Isle Zoning Ordinance, and the 15A NCAC 7H Use Standards. Uses permitted by the Town's Zoning Ordinance, the Bogue Sound ORW Management Plan, the 7H Use Standards, and the policies contained in the LUP are allowed in the ORW Estuarine Shoreline AEC. Relevant policies contained in the LUP include Resource Protection Policies for Ocean Hazard Areas. These policies reiterate the Town's desire to allow uses in these areas as allowed by the 7H Use Standards and that are consistent with the Town's zoning and dune and vegetation protection ordinances. Resource Production and Management Policies contained in the Plan include those for Residential, Commercial, and Industrial Development Impacts on Resources. These policies also state the Town's intentions to allow residential development which meets applicable state and local requirements. Policies for Cultural/Historical Resources are also included in the Land Use Plan. Emerald Isle will protect any recorded archaeological sites by coordinating development in these areas with the N.C. Division of History and Archives. S. 113A-100 through 113A-128). The applicant is proposing to construct a 7 building, 42 unit condominium project directly adjacent to Pier Pointe Condominiums, in the Town of Emerald Isle. As described, the project would not result in any loss of wetlands. However, the project does have potential to negatively impact loggerhead sea turtles, a species listed as Threatened by the U.S. Fish and Wildlife Service. Loggerheads nest along the ocean beaches such as those found at the project site. Loggerhead hatchlings are easily disoriented by artificial lights and drawn inland where they die. The project, as written, does not address impacts of an increase in artificial fighting associated with this development. Therefore, we cannot concur with issuing a permit for the proposed project unless the following modification is implemented; • Parking lots, streets, walkways, dune crossovers, and other areas requiring lights on the ocean front should have lights directed away from the frontal dunes and ocean beach. This can be accomplished by placing light fixtures close the ground or placing screens, shades, or natural vegetation barriers between the light source and the dunes and ocean beach. Fixtures should be equipped with lights such as low pressure sodium luminaries, which emit wavelength that do not significantly disorient loggerhead hatchfings.
