Bulkhead
1) In order to minimize impacts to high quality wildlife habitat, the proposed bulkhead shall be
positioned no more than an average of 2 feet waterward of the toe of the riverbank.
2) The alignment of the proposed bulkhead must be staked by a representative of the Division of
Coastal Management within a maximum of 30 days prior to the start of construction. Failure to
initiate construction within 30 days, or erosion of the shoreline by adverse weather co will

3) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or
othexsuitable_materials approved by department personnel. No excavation is permitted except for
that which maybe regntred-for the construction of -the -bulkhead wall, riprap, deadmen cables, etc.
This permit does not authorize any excavation waterward of the approved alignment.
4) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the
structure.
5) The bulkhead must be constructed prior to any backfilling activities.
6) All backfill material shall be obtained from a highground source and confined landward of the
permitted bulkhead.
7) The fill material shall be clean and free of any pollutants except in trace quantities. Metal
products, organic materials, or unsightly debris shall not be used.

8) The temporary placement or double handling of excavated or fill material within waters or
vegetated wetlands is not authorized.
9) In order to protect water quality, runoff from the construction must not visibly increase the
amount of suspended sediments in adjacent waters.
NOTE: The N.C. Division of Environmental Management has authorized the proposed project
under General Water Quality Certification No. 3025.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action ID
No. 199601497.

Dear Mr. Ricks:
Reference your application for a Department of the Army (DA) permit to
construct a bulkhead and place fill material in wetlands, on property located
off State Road 1321, adjacent the Perquimans River, New Hope, Perquimans
County, North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of General Permit No. 198000291. Therefore, you may
commence construction activity in strict accordance with applicable State
authorization and the enclosed plan. Failure to comply with the State
authorization or conditions of the general permit could result in civil and/or
administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.

You have our approval to place fill material in 767 square feet of wetlands or waters for the
purpose of constructing a bulkhead with back fill at SR 1321 on your lot, as you described in your
application dated 26 March 1996. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 3025.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable,
the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for
assistance. By working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

I recommend the permit be approved with the following conditions:

[1] The bulkhead will not extend waterward more than 2 feet from the normal
water level at any point along its alignment at the time of construction.
[2] The alignment of the proposed bulkhead must be staked by a representative of
the Division of Coastal Management (DCM) within a maximum of thirty (30)
days prior to the start of construction. Failure to initiate construction within
thirty (30) days, or erosion of the shoreline by adverse weather conditions,
will require the alignment to be re -staked by DCM within a maximum of thirty
(30) days prior to the new expected start of construction.
[3] The bulkhead must be constructed prior to any backfilling activities.
[4] The bulkhead must be structurally tight so as to prevent seepage of backfill
materials through the structure.
[5] The bulkhead must be solid and constructed of treated wood, concrete slabs,
metal sheet piles, or other suitable materials approved by Department
personnel. No excavation is permitted, except for that which may be required
for the construction of the bulkhead wall, riprap, deadmen cables, etc. This
permit does not authorize any excavation waterward of the approved
alignment.
[6] The fill material will be clean and free of any pollutants, except in trace
quantities. Metal products, organic materials, or unsightly debris will not be
used.

[7] All backfill material will be obtained from a highground source and confined
behind the permitted bulkhead.
[8] All fill material to be placed below normal water level will be confined behind
the permitted bulkhead.
[9] No excavated or fill material will be placed at any time, in any marsh or
surrounding waters, outside of the alignment of the fill area indicated on the
workplat(s).

of the County land use plan. In that land class, the County allows all those uses that can be
permitted under the existing state, federal and local regulations. No other specific policies
apply to the activities contained in this proposal.
Based on the above, so long as the proposal is found to satisfy applicable CAMA
regulations, it is -consistent with the Perquimans County land use plan.

SUBJECT: CAMA/Dredge and Fill Permit Application for WrHRun Ricks, SR 1321 (Muddy
Creek Road), New Hope Area, Perquimans County.
Wildlife Resources Commission biologists have completed a review of the project with
regards to associated impacts on wildlife and fishery resources in the area. A site visit was
conducted on April 11, 1996. Our comments are provided in accordance with provisions of the
Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.) and the
Coastal Area Management Act (G. S. 113A-100 through 113A-128).
The applicant proposes to construct a 110 ft. long x 3 ft. high bulkhead. In the shoreline
area where the existing bulkhead is located, the applicant proposes to construct the new bulkhead
an average of 2 ft. with a maximum of 5 ft. waterward of the normal water level (NWL). In the
unprotected wetland area, the applicant proposes to construct his bulkhead an average of 10.2 ft.
waterward of the riverbank and to backfill the entire area. The estimated annual rate of erosion is
1 ft. Waters at the project site are classified as SB.
The applicant's property abruptly changes from a mowed lawn 6 ft. above NWL to a wide
wetland fringe at NWL. The riverbank is stabilized with lawn grass and the wetland fringe is
vegetated with various wetland plants except where the 3,326 ft deck extends over the wetlands
and water. Drift lines were observed in the wetlands but no signs of riverbank erosion were seen.
The applicant proposes to construct the new bulkhead an average of 10.2 ft. waterward of the
riverbank and to backfill over the wetlands. We recommend that the bulkhead be aligned along
the toe of the riverbank and landward of all wetlands.

The following comments by the North Carolina, Division of Marine Fisheries are
provided pursuant to General Statute 113-131.
Pergnimanc River functions as a spawning and n a for blueback herring and
alewife. Striped bass, white perch, yellow perch, spot, cro er, blue crabs and other
commercially and recreationally important species also utilize the area as a nursery. SAV's
are found along the shoreline.
The Division approves of this project with the following modifications. 1"%osed
110 foot long bulkhead should be constructed landward of the wetland area. The wetland
area is rather extensive, and is a continuous wetland. In the past 15-20 years the size of the
wetland area has increased significantly. Wetlands are of great importance serving as
sources of biological productivity and providing food directly and indirectly. Finally,
wetlands perform important roles in modifying acute impacts of hydrologic events,
moderating stormwater flows, trapping sediments, and providing nutrients for incorporation
into resident plants.

Site Description
In July, 1995 the applicant purchased a .9 acre tract located on the Perquimans River and
on SR 1321 (Muddy Creek Road), New Hope area, Perquimans County. The tract is developed
and has 110 feet shoreline, a single family house, a utility shed, a 4' x 100' pier with a 12' x
12' platform, an 8' x 20' boatramp, 43' of 11h' high bulkhead, a 3,326 square foot elevated
deck, several grapevines and a maintained yard.
The house is situated approximately 6 feet above normal water level and the deck is
approximately 5 feet above normal water level and is attached to the house and functions as a
backporch. The soils of the tract are sandy loam and the elevation of the tract changes from a
uniform 5 feet to 1 foot in a sloping transition area along the riverbank that varies in width from
10 to 15 feet.
A freshwater wetland area consisting of common reed (Phragmites australis), wax myrtle
(Myrfca cerifera) and bald cypress (Taxodium distichum) lies waterward of the river bank along
the unbulkheaded shoreline. Adjacent property consists of an unbulkheaded and undeveloped
tract and unbulkheaded and cleared and maintained building lot. The Perquimans County Land
Use Plan classifies the area as Conservation. The Division of Environmental Management
classifies the waters of the Perquimans River in this area as SB.
Development Proposal
The riverbank is eroding and the applicant proposes to construct a 110 foot long, 3 foot
high, continuous bulkhead along the embankment. In the shoreline area where the existing
bulkhead is present, the applicant proposes to construct the new bulkhead an average of 2 feet
with a maximum of 5 feet waterward of the normal water level. In the unprotected wetland
area, the applicant proposes to construct his bulkhead an average of 10.16 feet waterward of the
riverbank and to backfill that area.
Anticipated Impacts
The project as proposed will fill 681 square feet of vegetated wetlands in the Estuarine
Shoreline and 86 square feet of Public Trust and Estuarine Waters. Turbidity increases are to
be expected during construction. The project will stabilize the applicant's riverbank and protect
his house.

Reference the application of William E. Ricks for a Department of the
Army (DA) permit to construct a bulkhead and place fill material in wetlands,

The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following condition(s) be included in the State
authorization:
1. All work authorized by this permit must be performed in strict
Aompliance with the permit plans.
t„2. The bulkhead will not be positioned farther waterward than 10 feet
Z'q-y from the normal water level elevation contour at any point along its
alignment.
U 3. All backfill materials will be obtained from a highground source and
confined landward of the permitted bulkhead.
4. No vegetated wetlands will be excavated or filled outside of permitted
project area.
5. The temporary placement or double handling of excavated or fill
�-M {Irials within waters or vegetated wetlands is not authorized.
6. The fill material will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials, or unsightly debris will
not be used.

On February 11, 1991, we renewed General Permit No. 198000291 (copy
enclosed), which provides Federal authorization for construction activities
that receive authorization from the State of North Carolina.
A review of your application received March 25, 1996, for Department of
the Army (DA) authorization to construct a bulkhead and place fill material in
wetlands, on property located off State Road 1321, adjacent the Perquimans
River, New Hope, Perquimans County, North Carolina, indicates it to be a
candidate for Federal authorization under this general permit. Accordingly,
the administrative processing of your application will be accomplished by the
North Carolina Division of Coastal Management. Comments from Federal review
agencies will be furnished to the State.
If your application must be withdrawn from this general permit process
for any reason, you will be informed regarding its further management. If
there are no unresolved differences in State -Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such

Enclosed is the application of William E. Ricks for Department of the
Army (DA) authorization and a State Water Quality Certification to construct
a bulkhead and place fill material in wetlands, on property located off State
Road 1321, adjacent the Perquimans River, New Hope, Perquimans County, North
Carolina. Your receipt of this letter verifies your acceptance of a valid
request for certification in accordance with Section 325.2(b)(ii) of our
administrative regulations.
We are considering authorizing the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification is required under the provisions of Section 401 of
the same law. A Department of the Army permit will not be granted until
the certification has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by May 25, 1996, the District Engineer will deem that
waiver has occurred.

prepared by Charles E. Brown, III, Registered Surveyor,
under date of March 2, 1992, of record in Plat Cabinet 2,
Slide 32, Map 3 in the Office of the Register of Deeds of
Perquimans County, NC. The property herein described is
the same property that is delineated on plat entitled in
part, "Property Being Conveyed to William E. Ricks and wife,
Billie S. Ricks," prepared by Charles E. Brown, III,
Registered Surveyor, under date of June 17, 1995.
