Schecter, Director February 3, 1998 R & Q Inc. 536 Work Farm Road Warsaw, NC 28398 Dear Sirs: E) FEE � This is with reference to your agent's request to modify State Permit'# 29-96rwhich was issued on March 5, 1996 and will expire on December 31, 1999. The action proposed in the submittal involves the use of a dragline operation to remove the dredge spoil which is located in Estuarine and Public Trust Areas of Environmental Concern. The project is located at Queens Grant in Topsail Beach, Pender County. Upon reviewing the submittal I have determined that the proposed action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. I hereby submit this Letter of Refinement authorizing.the modification of State Permit # 29-96 as described in your letter and plans dated January 28, 1998 and received in our office on January 28, 1998. By copy of this letter we are also notifying the U. S. Army Corps of Engineers of our action. If you have any questions concerning the above or if I can be of any other assistance, please advise. As per our con- versation, we are requesting a refinement in order to remove the material from the canals by dragline. We are proposing to place the spoil directly onto high ground as indicated on the attached diagram. In order to prevent any sloughing of the spoil material behind the bulkhead, we propose to dig a trench at least 2 ft. deep/paralellto the bulkhead. The material removed will be placed to the waterward side of the trench; therefore creating a 2-3 ft. burm. The burm will then be backed up with a silt fence that will have metal stakes every 6 ft.as we had discussed.
