This permit, issued on MARCH 15, 1996 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) The pier authorized under this permit is for temporary boat use as well as residential access for
interior lots. Tie piles for mooring boats are not authorized. Therefore, permanent mooring
is not authorized, nor advised.
2) The pier decking must be constructed at a height of four (4) feet over the substrate of coastal
marsh.
3) This permit authorizes only the docks, piers, and other structures and uses located in or over
the water that are expressly and specifically set forth in the permit application. No other
structures, whether floating or stationary, may become a permanent part of this pier without
permit modification. No non -water dependent uses of structures may be conducted on, in, or
over public trust waters without permit modification.
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

Dear Sir:
The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for compliance.
Please .sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the
Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20)
days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work
initiation. The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must
be carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request
that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

and cross -sectional drawings) drawn to scale in

prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by

On Jan 22, the applicant submitted a revised project drawing
showing a reduction in the overall length (relative to Mean High
Water) of the proposed pier from 157 ft. to 111 ft.(see sheet 4 of
4). Inadvertently, the original dimension was not changed on the
site plan (see sheet 3 of 4). and it was circulated as part of the
completed package to the various review agencies. There maybe some
confusion; but, I hope the detailed information provided in my
field report will be sufficient to evaluate the extent of the
proposed pier on the Public Trust.
I feel very comfortable with the proposed pier length after one of
my visits to the site when the position of the pier/platform at 111
feet from the mean high water mark was located. I also took water
depth measurements on a low tide condition which showed:

In addition to the pier revision received on Jan 22, the applicant
also eliminated the gazebo originally proposed on the highground.
I have reviewed the proposed project with regards to the 7H Use
Standards for development and I believe the project to be
consistent with the criteria for docks and piers. I have no other
problems or issues with the remainder of the development(s) and I
support issuance of the necessary LAMA permits as requested. The
following standard conditions should be considered:
�j #1 All construction activities associated with the permitted pier
must be under taken in strict accordance with the workplat
drawing (sheet 4 of 4) dated 12/19/95.
#2 This permit authorizes only the docks, piers, and other
�- structures and uses located in or over the water that are
expressly and specifically set forth in the permit
application. No other structures, whether floating or
stationary, may become a permanent part of this pier without
permit modification. No non -water dependent uses of
structures may be conducted on, in, or over public trust
waters without permit modification.
#3� No attempt will be made by the permittee to prevent the full
and free use by the public of all navigable waters at or
adjacent to the authorized work.
#4 J,,,The authorized structure and associated activity must not
cause an unacceptable interference with navigation.
05-5 The permittee must install and maintain, at his expense, any
signal lights and signals prescribed by the U.S. Coast Guard,
through regulations or otherwise, on authorized facilities.
4'6, NOTE: The permittee will maintain the authorized work in good
condition and in conformance with the terms and conditions of
this permit. The permittee is not relieved of this
requirement if he abandons the project without having the
permit transferred to a third -party.
NOTE: The permittee and/or the contractor is urged to meet
with a representative of the Division of Coastal Management
prior to project initiation.

structure in order to make it more visible during hours of
darkness or inclement weather.

The Picket Bay Subdivision is located on the White Oak River, north
of Swansboro, off SR 1448, in Onslow County. The applicant proposes
to construct a community access pier in conjunction with the
development of Picket Bay Subdivision, a 28 lot detached single
family development on 22 acres of property. The proposed pier will
also provide water access to Picket Manor, a planned 28 unit
complex located on an adjacent 4 acre tract.
AECs impacted by the project include the Estuarine Shoreline,
Estuarine Waters, and Coastal Wetlands. A section of '404, wetlands
will also be impacted by the proposed work. Waters at the site are
classified as SA and are open to the harvesting of shellfish. The
area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 1991 Town of
Swansboro Land Use Plan (LUP) Update and offer the following
comments.
The general area of the project is classified as Developed, while
the ABCs and 1404' wetlands impacted by the proposed work are
classified as Conservation.
Section III of the Plan discusses the Land Classification System.
The Developed classification provides for continued intensive
development and redevelopment of developed areas. The general area
of this project is described in the LUP as meeting the intent of
this class and is specifically mentioned as being in the Developed
classification. A proposal for subdivision development in this area
is consistent with this classification. While the area of the
project is shown in the LUP as being in the Town's Extraterritorial
Jurisdiction (ETJ), Swansboro recently annexed Picket Bay
Subdivision into the Town limits.
Specific allowable uses in the Conservation class are discussed on
Page 73 and include water oriented uses, such as piers, docks,
marinas, low -density residential development, necessary utility
service lines, and roadways. In 1404, wetland areas, the Town of
Swansboro accepts the permitting decisions of the U.S. Army Corps
of Engineers and does not impose any additional restrictions (Page
73).
Resource Protection Policies contained in the Plan (Pages 44-46)
reiterate the Town's desire to allow uses within AECs consistent
with State standards and local zoning. Page 45 of the Plan
discusses Estuarine Waters and Estuarine Shoreline areas.
Appropriate uses for Estuarine Waters include boat docks, piers and
mooring pilings. Residential, recreational, and commercial uses are
allowed within the Estuarine Shoreline provided all state minimum
use standards are satisfied. Page 45 discusses allowed uses in
Coastal Wetlands, which include piers and docks constructed in
compliance with state requirements.
Based on the above policies and land classifications, this project
appears to be consistent with the 1990 Town of Swansboro Land Use
Plan, provided all local, state and federal regulations are met.

project with regards to associated impacts on wildlife and fishery resources in the area Our
comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act
(48 Stat. 401, as amended; 16 U.S.C. 661 et seq ) and the Coastal Area Management Act (G S
I I3A-100 through 113A-L i)-
The applicant proposes to construct a community, access pier in conjunction with the
development of Picket Bay Subdivision Waters at the project site are classified as SA and are
opened to shelifishing.
The surface waters of the White Oak River in and around the project site support a variety
of commercial fishing activities including harvest of oysters and clams, net fishing, and crabbing
The length of the proposed structure may interfere with commercial and sport fishing activities as
well m boating safety. In order to accommodate the applicant's request while addressing the
previous concerns, we recommend that the structure n exceed the established 'e len on
adjacent properties. Any permitted pier should be well naked with tg is and/or reflective bands.
An adverse impact anticipated to result from the project is turbidity associated with construction
of the pier. Elevated turbidity could reduce water quality and stress marine organisms in the area,
particularly during warm weather. Excessive turbidity could be detrimental to larva development
of marine organisms. Therefore, we recommend that no construction be performed between April

8. PROJECT SUMMARY: The applicant proposes to construct a community access pier in conjunction
with the development of Picket Bay Subdivision, a 28 lot detached single family development on 22
acres of property. Water access will also be provided to Picket Manor a planned 28 unit complex
located on the adjacent 4 acre tract.

9. NARRATIVE DESCRIPTION: The project site is located on the White Oak River
just north of Swansboro off SR #1448 in Onslow County. The entrance to Picket Bay
Subdivision as well as the future site of Picket Manor is on Mt. Pleasant Road opposite
Oyster Bay Subdivision. Goodwill Drive is the name of the dirt road that services the
project site and the existing home owners on the White Oak River. The project site
consists of approximately 22 acres of highground property most of which is above the
25 foot contour elevation. The property is characterized by traditional farm fields that
make-up about two-thirds of the site, while the remaining area is boarded by a stand of
mixed hardwoods. As the location map shows on sheet 2 of 4, there are a half dozen
privately owned homes and individual properties that separate the proposed subdivision
from the river shoreline. The 4 acre tract of land adjacent to the southwest side of
Picket Bay Subdivision is know as Picket Manor. Clearing and grading activities
associated with construction the roads and utilities lines within Picket Bay were begun
in December of 1995. Newly excavated drainage ditches located beyond the Area of
Environmental Concern have caused sedimentation problems in the White Oak River.
A Notice of Violation has been issued and appropriate restoration and civil assessments
are being pursued. The site is zoned R-10 and it falls within the extra territorial
jurisdiction of Swansboro.
The applicant is listed as the Weetoe Development Corporation. The project is
represented by Mr. D. Michael Little, the agent/owner. As a amenity to Picket Bay
Subdivision and in the future to Picket Manor, the applicant proposes to construct a
community access pier into the White Oak River. The subdivision plat found on sheet
2 of 4 not only shows the division of the 28 lots but also how the community park was
designed to make maximum use of the 52 foot wide strip of property that makes
contact with the shoreline. Details of the pier are illustrated on Sheet 4 of 4. A 6 foot
wide gravel walkway will meander thorough the park until it joins a boardwalk section
of the pier as it extends over a pocket of 404 Wetlands on the landward side of the
fringe of salt marsh. The pier portion of the proposed structure is 6 feet wide and
calculated to be 111 feet long as measured from the mean high water level. The
overall length of the pier includes a T-head platform that measures 25 feet long by 20
feet wide. At the project site, a series of wooden, white topped 4 by 4's mark the
alignment of the pier as point "A", "B" and "C". The high water mark is represented
by point "B" and the total offshore length is represented by point "C". The water
depths along the pier alignment at mean low tide vary from -6 inches inshore to -2 feet
7 inches in front of the T-head platform. As the pier crosses the 40 foot wide fringe
of saltmarsh cordgrass, the elevation of the deck boards will be maintained at 36 inches
above the ground floor of the marsh.

No other structures are proposed with the construction of the community pier. The
workplat drawing on sheet 4 of 4 show the pier located in the center of the 52 foot
property. The applicant has provided a sideline clearance of 15 to 16 feet on the each
side of the 20 foot wide platform. Although boats will be welcome to visit the pier
from all 56 residential units within Picket Bay and Picket Manor, permanent boat tie-
ups and overnight usage will not be encouraged. The surface waters of the White Oak
in and around the project site are classified as SA and they are. open to the harvesting
of shellfish such as oysters and clams. Other commercial activities include net fishing
and crabbing. Other private piers exist downstream of the project site along the same
shoreline. Because of extensive sand bars and oyster rocks, boasters use the waterway
near of the proposed structure to gain access to other areas in the river.
10. ANTICIPATED IMPACTS: The proposed community pier will service two
residential developments with a combined 56 units. As the application states, the pier
will allow temporary boat docking at the platform end. The proposed pier will
generate a footprint * impact of about 1,616 square feet within the Areas of
Environmental Concern. That figure can be broken down to say that the 6 foot wide
pier will occupy some 600 square feet of 404 Wetlands, 180 square feet of coastal
marsh and 836 square feet of public trust waters. The proposed pier will extend 111
feet waterward of the mean high water mark.

NCGS II3A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card to
a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road right-
of-way where a private road would lead one into your property. Failure to post this notice could result in an
incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by
