PROJECT SUMMARY: Applicant proposes to construct a new pier and add on to his existing dock. Thomas H. Peele/The Quarterdeck Construction of pier and addition to existing dock Bath, Beaufort County Project setting The project site is located in Beaufort County on NC Highway 92 adjacent Back Creek in Bath, North Carolina. The area of the project site encompasses f.4 acre and is situated at the northwest end of the NC 92 bridge over Back Creek. The project site is used for commercial purposes and includes a convenience store; a gas station, for both automobiles and watercraft; and a boat ramp. Structures currently on the project site are a store building (a portion of which is built out over the water) , bathroom building, a ±28' long by 14' wide pier adjacent the boat ramp, another ±48' long by t4' wide pier at the north end of the property, a f 175' long bulkhead, and a deck that surrounds the store. Also onsite this property are gas pumps and underground fuel storage tanks. The vegetation on the project site consists primarily of Bermuda grass and pine trees, however the majority of the area is covered by an asphalt parking lot. No Coastal Wetlands are present at this site. Back Creek is a Public Trust Area classified as SB NSW waters by the Environmental Management Commission. Back Creek is not designated as a Primary Nursery Area and is closed to harvesting shellfish. Project description The applicant is proposing to construct a f 28' long by f4' wide pier adjacent the northeast side of the existing boat ramp and widen his existing dock behind the store by f4'. The purpose of the proposed project is for increased safety when launching water craft and additional dock space for refueling of water craft. Anticipated impacts The proposed project will result in the shading of f164 square feet of creek bottom. No wetlands are present on the project site nor will there be any excavation activities. The installation of the pilings may result in short term, localized turbidity. Jeffrey R. The state purpose of the proposal is for increased launching safety and additional temporary dock space for refueling at this commercial use. The proposal involves Public Trust Areas of Environmental Concern only and comes under the auspices of the December 1991 CRC certified Town of Bath Land Use Plan update. The plan offers the following related guidance on proposals of this type: One noticeable theme throughout the plan is the town's desire to conserve its valuable natural and historic resources and the village character. Numerous policies and goals are linked to this overriding objective. Town position within the broad resources protection issues policy category, includes under public trust waters (page 46-47): "(i) The following uses shall not be permitted in or near any coastal wetland or other natural resources: open dumping of waste, including wastewater, dumping of trash, further development of commercial wet -docking storage facilities, and multi -level dry docking storage facilities." The town also (page 47) "0) ... encourages and supports stricter enforcement of CAMA regulation by CAMA permit officers, including regulation of bulkheading." Town policy (page 48) notes "(o) Only "water dependent" uses shall be allowed in coastal wetlands, public trust waters, and other areas of environmental concern located in the Bath planning district." Town policy on marina and floating home development and dry stack storage policies (page 60-63) includes much dialogue about the undesirability of the above uses due to natural resources, public health and safety, aesthetic and other reasons. Included in this dialogue is the following (page 62) (a) Bath prohibits further development of wet and dry storage marinas in Bath and Back Creeks and (a) The Bath Zoning Ordinance disallows all future marina development. Also page 63 notes on consistency between policies and other regulations and policies includes "(a) The zoning ordinance outlines the present regulations governing marina development." (Note that a certification of zoning compliance from the town is included with this proposal.) MEMORANDUM 14 December 1995 Page 2 Other revealing dialogue on page 74-75 dealing with commercial development notes (page 75 - 2nd paragraph): "While most residents are in favor of some sort of public water access for boating and recreational fishing, private commercial marinas will not be allowed in the Bath planning area." • Town policy on commercial development (page 80-81) includes "(b) Private commercial marinas are not allowed in the Bath planning area." Dialogue on the conservation land class (page 114-115) notes that "(b) The conservation classification applies along the coastal shorelines of Bath and Back Creeks, the public trust waters of the creeks, the coastal wetlands and the 404 wetlands in the planning area." The town's land classification map shows the landward portion of this site in the Developed land class, and by definition the public trust areas are in the Conservation class. (The developed class, page 109, notes the purpose is to provide for continued intense development and re -development of existing incorporated areas, and the Conservation class, page 114-115, includes public trust areas. AECs are treated in town policy under Hazardous and Fragile Areas (page 50) which notes "All development proposals must be within the strictest CAMA standards set forth in 15 NCAC 7H and outlined in "a handbook for development in North Carolina's coastal area"." a n� This proposal does not meet the Division's definition of marina and the town's plan does not — pose any more restrictive language of their own. Nothing can be found in the plan that speaks to prohibition of expansion of existing water dependent uses.
