adequate ramp slope and area as described in the 6/13/95 permit application.
2) The boat ramp shall extend no more than 10 feet waterward of the normal water level.
3) Placement of fill materials below the normal water level will be limited to the ramp structure.
4) No excavated or fill material will be placed at any time, in any marsh or surrounding waters,
outside of the alignment of the work area indicated on the drawings.

This permilLaction may be appealed by the pemrittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunderrequires further Departmental approval.
All work must cease when the ermit expires on

A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" -white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
-Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

site. Include highway or secondary road (SR)
numbers, landmarks, and the like.

A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and
signed return receipts as proof that such owners
have received a copy of the application and plats

that they have 30 days in which to submit comments
on the proposed project to the Division of Coastal

Recommendations for State Permit - MICHAEL S. ODOM / BOATRAMP
The Wilmington Office has no objection to issuance of a permit provided that the following conditions
are placed on the permit:
1. The boatramp is to be for the private use of the Odoms.
2. There shall be no unreasonable interference with navigation or public use of the waters during or
after construction.
3. The proposed boat ramp must not extend farther than 20 feet below the mean high water level
contour.
4. Excavation and ground -disturbing activities above and below the mean high water level will be
limited to that absolutely necessary to establish adequate ramp slope and provide a ramp no greater in
size than specified by the permit application.
5. Placement of fill materials below the mean high water level will be limited to the ramp structure
itself.
6. No excavated or fill material will be placed at any time, in any marsh or surrounding waters, outside
of the alignment of the work area indicated on the drawings.
7. In order to protect water quality, runoff from the proposed work must not visibly increase the
amount of suspended sediments in adjacent waters.
8. This permit authorizes only the proposed work on the boatramp that is specifically set forth in the
application. No other structures or work may be performed without permit modification.

This permit consistency opinion is based on my review of the Michael S. Odom permit
application, the Field Investigation Report QM Russell, 11/29/95)), and my understanding and
interpretation of the policies presented in the Town of Surf City 1992 Land Use Plan.
The applicant requests permission to reconstruct his boat ramp by levelling soil in the boat ramp
and replace existing concrete slabs over coastal wetlands. The location and complete description
of the project are in the Field Investigation Report.

Dear Mr. Odom:
Through coordination with North Carolina Division of Coastal Management
(NCDCM), we have learned of your plans to place fill material in approximately
400 square feet of vegetated wetlands for the purpose of constructing a boat
ramp, adjacent to Stump Sound on the Atlantic Intracoastal Waterway, on lots 4
and 5, at 2058 First Street, in Old Settlers' Beach, Surf City, Onslow County,
North Carolina.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization,
pursuant to Section 10 of the Rivers and Harbors Act and Section 404 of the
Clean Water Act, was provided by Nationwide Permit No. 18 for discharges of
dredged or fill material into all waters of the United States provided:
a. The discharge does not exceed 25 cubic yards in open water areas;
b. The discharge will not cause the loss of more than 1/10 acre of a
special aquatic site, including wetlands. For the purposes of this nationwide
permit, the acreage limitation includes the filled area plus special aquatic
sites that are adversely affected by flooding and special aquatic sites that
are drained so that they would no longer be a water of the United States as a
result of the project;
Your work, sited in the coastal area, is authorized by this nationwide
permit provided it is accomplished. in strict accordance with the enclosed
conditions and any required State authorization. We have received a copy of
NCDCM permit, dated March 19, 1996, for this work. This nationwide permit
does not relieve you of the responsibility to obtain other required State or
local approval.
This verification will be valid until the nationwide permit is modified,
reissued or revoked, which will occur prior to January 21, 1997. It is
incumbent upon you to remain informed of changes to the nationwide permits,
which will be announced by public notice when they occur. If you commence, or
are under contract to commence, this activity before the date the nationwide
permit is modified or revoked, you will have twelve months from the date of
the modification or revocation, to complete the activity under the present
terms and conditions of this nationwide permit.

2. Need Certified Mail Receipts showing that application package has been mailed to the adjacent
property owners. (Both sides, beyond what's owned by family)
3. Need drawings, to scale, that show the property boundaries, any and all existing features on the lot,
the boat ramp and mean high water. A cross -sectional view of the boat ramp would also be helpful.
4. Submit a check .for $250.00 for the permit processing fee. Check should be made out to
D.E.H.N.R.
5. Submit a short, typed, narrative description of the property (2 lots) and the proposed work. Include
the fact that the boat ramp is presently covered in marsh grass and is rilled/rutted by erosion. Describe
and show a diagram of the slatted concrete slabs that you intend to use.
6. Need a vicinity map showing how to get to the site.
