1) The permittee or his agent will call the DCM at 910/395-3900 to arrange a pre -construction meeting
for the purpose of. 1) staking the building setback, and 2) an alignment along the landward base of
the dunes, on which, some type of barrier and sand fence shall be installed for dune protection.
2) The project must meet all N. C. Building Code Standards.
3) The Division of Water Quality approved this project under Storm Water Management Permit No.
S W8960404 on October 17, 1996. Any violation of the S WMP will be considered a violation of this
CAMA permit.
4) Low level lighting of a design that will not adversely affect nesting or hatching activities of sea
turtles shall be used for the facility.
(See attached sheet for Additional Conditions)
This permit_action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case maybe.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the pemtit expires on
December 31, 199E
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then

from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

8. PROJECT SUMMARY: The applicant proposes to construct a 70 unit motel, consisting of
seven separate buildings (10 units/bldg.) and associated amenities, swimming pool, beach access
walkway, and parking area, on oceanfront property at Ocean Isle Beach.

9. PROJECT DESCRIPTION
The project site is located at 57 West 1st Street, on the oceanfront, approximately 1000 feet west of
Ocean Isle Beach Fishing Pier, Ocean Isle Beach, NC, in southeast Brunswick County. The 1.4 acre
tract consists of eight (8) previously platted lots, that have been combined for the proposed project,
yielding a tract 400 feet wide (399.8 ft.) and approximately 150 feet deep, from the first line of stable,
natural beach vegetation to the right-of-way of West 1st Street. The northern two-thirds of the site
basically flat, 11-12 ft. elevation MSL. The northern one -thud of the property (ocean side) consists of
a natural dune system, which reaches a height of 22 ft. elevation MSL. Vegetation consists of Sea Oats
(Uniola paniculata), Bitter Panecum anecum spp.), Yucca, other dune grasses. Waterward of this
natural dune, there is a smaller, man-made dune that was created and planted with American Beachgrass
(Ammophila BrebUi ug lata) after Hurricane Hugo in 1989.
The waters of the Atlantic Ocean are classified SB, by the N.C. Division of Environmental
Management. The tract is within the Ocean Erodible and High Hazard Flood areas of the Ocean Hazard
Area of Environmental Concern, as designated by the North Carolina Coastal Resources Commission,
and requires a building setback, from the first line of stable, natural vegetation, of 60 feet for small
structures and 120 feet for large structures (greater than 5,000 sq.ft.). The Long Term Average Annual
Erosion Rate is 2 ft./yr. in this area of Ocean Isle Beach.
The applicant proposes to construct a motel on the site. The motel would consist of seven buildings,
each with ten (10) units. Each building would be two story, constructed above concrete pilings, and
have an outside dimension of 68 feet long and 43 feet wide. The buildings would be connected by
second story walkways. Required parking would be provided under five of the buildings. The motel
office and other amenities would be constructed beneath the two remaining buildings. A one-way, gravel
driveway would be located adjacent to the south side (ocean side) of the development to provide vehicle
flow around the buildings. The applicant proposes to grade the entire site, up to the base of the
landward side of the frontal and primary dune system, to facilitate construction. A swimming pool,
associated wooden decking, and beach access walkway are planned in the southeast corner of the
property

The proposed development would disturb approximately 1.4 acres of oceanfront property, and create
approximately 40,000 square feet of impervious surface area.

r Recommendations for State Permit - Odell Williamson/Ocean Isle Motel
The proposed project is a mirror image of the Tripp Sloane, Ocean Isle Motel development completed
several years ago, which was permitted by a CAMA minor permit, and created problems with the "no
more than four units" language, previously in our rules. This proposed development appears consistent
with current regulations, provided that it clears local approval. Extreme care should be exercised in
protecting existing dunes during construction. I recommend a requirement for a pre-cpnstnictio mn a mtmt g
to be held with a Division representative to stake e the building setback and an alignment along the
landward base of the dunes, on which, some type of barrier or sand fence shall be installed for dune
protection.

This permit consistency opinion is based on my review of the Odell Williamson/Ocean Isle
Motel permit application, the Field Investigation Report (EF Brooks, 9/9/96), and my
understanding and interpretation of the policies presented in the Town of Ocean Isle
Beach Land Use Plan.
The applicant proposes to construct a 70 unit motel comprising seven separate buildings
(10 units per building) and associated amenities, swimming pool, beach access walkway,
and parking area, on oceanfront property at Ocean Isle Beach. The site combines eight
previously platted lots into a single tract of approximately 1.4 acres in size. The location
and complete description of the project are in the Field Investigation Report.
LAND USE CLASSIFICATION: Conservation (Ocean Erodible/High Hazard Flood
AEC's); Urban Transition overlay.
CLASSIFICATION DESCRIPTION: Definitions mirror 15ANCAC713 guidelines. The area
is "Conservation" because it is an Area of Environmental Concern. The Town has also
designated the area as "Urban Transition," although "Urban" better defines the current
land uses and services available. Densities and allowed uses in the Ocean Hazard AEC
are not identified in the Town's Land Use Plan. "Accommodations" are permitted in both
Urban and Urban Transition classifications. There are density and lot size limitations for
single family residential development.
RELATED POLICIES AND IMPLEMENTATION MEASURES:
Policy: Ocean Hazards Area: Generally, all land uses in the areas classified under the
"Ocean Hazards" category... shall be consistent with the requirements of existing Sate,
federal, and local regulations, and the Ocean Isle Beach Zoning Ordinance, Subdivision
Regulations, Dune Maintenance and Protection Plan, and the Town's requirements for the
National Flood Insurance Program and the Town's and CAMA building set -back lines.
Allowable land uses shall generally be designed and constructed so as to maximize
structural protection from wind and water and to minimize damage to the protective land
forms of dunes and beaches.

When existing dunes are "added to" this shall be accomplished in a manner which minimizes
damage to existing vegetation. Any areas filled should be replanted immediately or stabilized
temporarily until planting can be successfully completed.
BA. Residential, Commercial and Industrial Land Development Impacts on any Resources
Residential land development is the predominant land use type in the Ocean Isle Beach planning
area with commercial land uses basically limited to retailing and services that support tourism ... (the
Town's desire to protect its resources} supports development while simultaneously protecting those
resources that are the reason for the Town's existence.
Policy: To allow residential and related commercial development to occur as long as
resource degradation does not occur.
In general, the Town's policies presented in the plan promote Ocean Isle Beach as a
family oriented residential community. The policies support commercial services which
revolve around a successful tourist economy. The Town relies on its zoning ordinance and
other local enforcement tools to regulate development compatible with these policies.
CONSISTENCY OPINION:
This project is located within an area classified as Conservation because the site is within
an Ocean Hazard Area of Environmental Concern. Land located in the Ocean Hazard Area
is susceptible to flooding and erosion from storms Strictures -in this area may pose a
health and safety threat to the public. This proje qc

1. All Ocean Hazard Use Standards of 15A NCAC7H.0306, .0308 and .0309 and any
other applicable AEC standards must be met.
2. This project must comply with all local zoning ordinance requirements and other

4. This project must not result in resource degradation.

The Wilmington Regional Office received the Stormwater Management Permit Application for Ocean Isle Beach Motel
on April 3, 1996, with final information on September 30, 1996. Staff review of the plans and specifications has
determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC
2H.1000. We are forwarding Permit No. SW8 960404 dated October 17, 1996, for the construction of Ocean Isle Beach
Motel.
This permit shall be effective from the date of issuance until October 17, 2006, and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit.
Failure to establish an adequate system for operation and maintenance of the stormwater management system will result
in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
ajudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be
in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this

I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the application and

this permit, the Project Data Sheet. The stormwater control has been designed to handle the runoff from 34,575
square feet of impervious area.

4. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved
plans.
5. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -
upon area.
6. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change. - C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
In addition, the Director may determine that other revisions to the project should require a modification to the
permit.
7. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time
schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been made. .
H. SCHEDULE OF COMPLIANCE
1. The permittee will comply with the following schedule for construction and maintenance of the stormwater
management system:
a. The stormwater management system shall be constructed in it's entirety, vegetated and operational for
it's intended use prior to the construction of any built -upon surface except roads.
b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be
repaired immediately.
2. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be
followed in it's entirety and maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
g. Access to the outlet structure must be available at all times.
3. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ.
The records will indicate the date, activity, name of person performing the work and what actions were taken.
4. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this
permit, the approved plans and specifications, and other supporting data.

5. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this
permitted facility, a certification must be received from an appropriate designer for the system installed certifying
that the permitted facility has been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and specifications must be noted
on the Certification.
6. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of
ten years from the date of the completion of construction.
M. GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is
a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality
accompanied by an application fee, documentation from the parties involved, and other supporting materials as
may be appropriate. The approval of this request will be considered on its merits and may or may not be
approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to
enforcement action by the Division of Water Quality, in accordance with North_ Carolina General Statute 143-
215.6(a)to 143-215.6(c). .
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, -
rules" -regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which
have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions,'the `
Permittee shall take immediate corrective action, including those as may be required by this Division, such as .
the construction of additional or replacement stormwater management systems. =
5. The permittee grants DEHNR Staff permission to enter the property for the purpose of inspecting all components
of the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit
modification, revocation and reissuance or termination does not stay any permit condition.

Carolina.
Wildlife Resources Commission staff have reviewed the
project for impacts to wildlife and fishery resources. A
site visit was made on October 4, 1996. Our comments are
provided in accordance with provisions of the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16
U.S.C. 661 et. seq.) and the Coastal Area Management Act
(G.S. 113A-100 through 113A-128).
The applicant proposes to construct a 70 unit motel on
8 currently -undeveloped oceanfront lots at Ocean Isle Beach.
The facility is to include a swimming pool, beach access
walkway, and parking area. Modular, 2-story motel
structures are to be built landward of the frontal and
primary dune system.
,Potential adverse environmental impacts from the
project include a significant increase in the area of
impervious surface with associated stormwater effects and
lighting that may interfere with sea turtle nesting and/or
hatching. Based on these concerns, we recommend that the
permit be conditioned as follows:
1. Impervious surface will not exceed 300 of the AEC
area of the property.
2. Facility lighting is of a design that will not
affect nesting or hatching activities of sea turtles.

Dear Mr. Williamson:
The Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of your property located at 57 West First St., in Ocean Isle Beach, in
Brunswick County, North Carolina. It was received on August 22, 1996, and appears to be adequate
for processing at this time. The projected deadline for making a decision is November 5, 1996. An
additional 75-day review period is provided by law when such time is necessary to complete the review.
If you have not been notified of a final action by the initial deadline stated above, you should consider
the review period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) inquires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a 'Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous
point along your property where it can be observed from' a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right -of --way fronting your property;
or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and
federal review agencies for their comments. If additional information is required based on this review,
the agencies may contact you directly.

AEC HAZARD NOTICE

This notice is intended to make you, the appli-
cant, aware of the special risks and conditions
associated with development in this area, which is
subject to natural hazards such as storms, erosion
or currents. The rules of the Coastal Resources
Commission require that you receive an AEC
hazard notice and acknowledge that notice in
writing before any permit for development in this
area can be issued.
The Commission's rules on building standards,
oceanfront setbacks and dune alteration are
designed to minimize, but not totally eliminate,
property losses from the hazards. By granting
permits, the Coastal Resources Commission does
not guarantee the safety of the development and
assumes no liability for future damage to the
development.
The best available information, as accepted by
the Coastal Resources Commission, indicates that
the annual ocean erosion rate or the area where
your property is located is feet per year.

This figure was established by careful analysis of
aerial photographs of the coastline taken over the
past 30 to 40 years.
Studies also indicate that the shoreline could
move as much as_SQ.S2_feet landward in a major
storm.
The flood waters in a major storm are predic-
ted to be about ' '�SZ in this area.
Preferred oceanfront protection measures are
beach nourishment projects and relocation of
threatened structures. Hard erosion protection
structures such as wooden bulkheads, seawalls,
rock and rubble revetments, wooden, metal,
concrete or rock jetties, groins and breakwaters,
concrete -filled sandbags and tire structures are
prohibited. Sandbag bulkheads or groins, beach
nourishment, beach bulldozing, and low intensity
off -shore passive sandtrapping devices may be
permiss! under cert '� conditions.

The applicant must acknowledge receipt of this information by signing this notice in the space above. Without
the proper signature, the application will not be complete.
SPECIAL NOTE: This hazard notice is required for development in areas subject to sudden and massive storms and
erosion. Permits issued in this area expire on December 31 of the third year following the year in which the permit was
issued. Shortly before work begins on the project site,'the Local Permit Officer will determine the vegetation line and
setback distance at that particular site. If the property has seen little change and the proposed development can still
meet the setback requirement the LPO will inform you that you may begin development: It is important that you
check with the LPO before the permit expires for official approval to continue work after your permit expires. Gener-
ally, if foundation pilings have been placed and substantial progress is continuing, permit renewal may not be necessary.
If substantial progress has not been made the permit must be renewed and a new setback may be applied. IT IS
UNLAWFUL TO CONTINUE WORK AFTER PERMIT EXPIRATION WITHOUT THIS APPROVAL.

There is excepted however, from the above property all of the,
following lots which have heretofore been conveyed from Odell
Williamson to M. C. Gore by Deeds which are duly recorded in the
