Canal Excavation
1) In order to protect juvenile shrimp and fin fish populations, no excavation will be permitted
between April 1 and August 30 of any year without the prior approval of the Division of Coastal
Management, in consultation with the Division of Marine Fisheries.
2) In order to protect adjacent shellfish resources, the width of the authorized excavation in the
channels is hereby restricted to 40 feet for the length of all channels.
3) Excavation will not exceed 6 feet below the mean low water level.

other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.

All work must cease when the permit expires on
December 31, 1999

5) All excavated materials shall be confined above the mean high water line and landward of
vegetated wetlands behind adequate dikes or other retaining structures to prevent spill -over of
solids into any marsh or surrounding waters.
6) The return water from the diked disposal area shall be discharged into the adjacent canal system,
and not into the waters of the Atlantic Intercoastal Waterway.
7) The disposal area effluent will be contained by pipe, trough, or similar device to a point at or
beyond the normal water level to prevent gully erosion and unnecessary siltation.
8) The terminal end of the pipeline will be positioned at or greater than 50 feet from any part of
the dike and a maximum distance from spillways to allow settlement of suspended sediments.
9) A water control structure will be installed at the intake end of the effluent pipe to assure
compliance with water quality standards.
Sedimentation and Erosion Control
10) An Erosion and Sedimentation Control Plan will be required for this project. This plan must
be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit
this plan to the Department of Environment, Health and Natural Resources, Land Quality
Section, 127 Cardinal Drive Extension, Wilmington, NC 28405.
11) The permitted activity will be conducted in such a manner as to prevent a significant increase
in turbidity outside of the area of construction or construction -related discharge. Increases
such that the turbidity in the waterbody is 25 NTU's or less in all saltwater classes are not
considered significant.

12) The temporary placement or double handling of excavated or fill material within waters or
vegetated wetlands is not authorized.
13) No attempt will be made by the permittee to prevent the free and full use by the public of all
navigable waters at or adjacent to the authorized work. Use of the permitted activity must not
interfere with the public's right to free navigation on all navigable waters of the United States.
14) This permit does not eliminate the need to obtain other Federal, state or local permits that may
be required by law.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable,
the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 15013 with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for
assistance. By working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

of Ocean Isle Beach, canals connected to the AIWW
between Laurinburg and Concord Streets, Brunswick
County, North Carolina.
The Wildlife Resources Commission has reviewed the
project for impacts to wildlife and fishery resources. A
site visit was made on July 23, 1996. Our comments are
provided in accordance with provisions of the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16
U.S.C. 661 et. seq.) and the Coastal Area Management Act
(G.S. 113A-100 through 113A-128).
The applicant proposes to maintenance dredge 4
bulkheaded canals providing boat access to the AIWW at Ocean
Isle Beach. Dredge spoil is to be placed in an existing
diked spoil disposal area near the project. A margin of
coastal wetlands up to 20 ft. in width and providing wading
bird habitat occurs along the canal shorelines. Area waters
are classified SA. Waters outside the canals are open to
shellfishing, while the canals themselves are closed to
shellfish harvest.
Primary adverse impacts associated with the project
appear to be potential loss of wetlands along canal
shorelines and turbidity -induced water quality decline. To
counter these impacts, we recommend the following project
modifications.

2. Avoid excavation between April 1 and September

Dear Mr. Taylor.
You have our approval to dredge in 1.54 acres of waters for the purpose of conducting maintenance
dredging at canals between Iaurinburg and Concord Streets in Ocean Isle Beach, as you described in your
application dated 16 July 1996. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 3025.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application. For this approval to be valid, you must follow the conditions listed in the attached certification
and any additional conditions listed below. The return water from the upland diked disposal basin shall be
discharged back into the canal that is to be dredged. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non -Discharge and Water Supply Watershed regulations.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petidon which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

IThe proposed dredging project is located within a closed shellfishing area and disposal is
to a spoil island located in an open shellfishing area. Although it is noted in the permit application
that a pipe will be placed within the spillway to drain back to the closed shellfishing waters of the
canals, every precaution should be taken to ensure there is no spillage. Any spillage of the dredge
water from the spoil island to open shellfishing waters would require recommendation for a
temporary closure until the project is completed.

connected to the AIWW, between Laurinburg and Concord Streets, in Ocean Isle Beach, in

is needed for this office to complete the review and make a decision on your request. Therefore, it
is necessary that the standard review time be extended. An additional 75 days is provided by G.S.
113A-122(c) which would make November 17,1996 the new deadline for reaching a decision on

approval for development located at Ocean Isle Beach. It was received complete on June 21, 1996, and
appears to be adequate for processing at this time. The projected deadline for making a decision is
SWtemNEW1996. An additional 75-day review period is provided by law when such time is necessary
to complete the review. If you have not been notified of a final action by the initial deadline stated
above, you should consider the review period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an additional letter will be provided on or about
the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous
point along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property;
or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.

You may use this site if you obtain the proper permits, maintain the dikes and
spillways throughout dewatering, and continue your procedure of regularly removing
material from the disposal area without disturbing the dikes.

Reference the application of Ocean Isle Beach for a Department of the
Army permit to maintenance dredge approximately 67,200 square feet of material
from four existing canals, each 250 feet long by 40 feet wide, off the
Intracoastal waterway, between Laurinburg and Concord Streets, in Ocean Isle
Beach, Brunswick County, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
1. All work authorized by this permit must be performed in strict
compliance with the permit plans.
2. All excavated materials will be confined landward of the mean high
water (MHW) elevation contour and any regularly or irregularly flooded
vegetated marsh within adequate dikes or other retaining structures to prevent
spillover of solids into any vegetated wetlands or surrounding waters.
3. Dikes or retaining structures will be maintained and repaired if
necessary, throughout the duration of the project.
4. The terminal end of the pipeline from the dredge into the diked
retention area will be positioned at or greater than 50 feet from any part of
the dike and a maximum distance from spillways to prevent dike erosion and to
allow adequate settlement of suspended solids.
5. A water control structure will be installed at the intake end of the
effluent pipe leading from the retention area in order to ensure maximum
settlement of suspended solids.
6. Flow from the diked retention area will be confined by pipe, trough,
or similar device to a point at or below the mean low water (MLW) elevation
contour to prevent gully erosion and siltation.

7. No excavated or fill materials will be placed at any time in any
vegetated wetlands or waters. This includes the temporary placement or double
handling of excavated or fill materials.
8. No vegetated wetlands will be excavated.
9. Excavation will not exceed 6 feet below the elevation of mean low
water (MLW).
10. No attempt will be made by the permittee to prevent the full and
free use by the public of all navigable waters at or adjacent to the
authorized work. Use of the permitted activity must not interfere with the
public's right to free navigation on all navigable waters of the United
States.
11. The permittee will maintain the authorized work in good condition
and in conformance with the terms and conditions of this permit. The
permittee is not relieved of this requirement if he abandons the permitted
activity without having it transferred to a third party.
12. The authorized activity will not cause an unacceptable interference
with navigation.
13. The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction -related discharge. Increases such that the turbidity in the
waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Water Quality (NCDWQ), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in
trout waters, are not considered significant.
14. This Department of the Army permit does not obviate the need to
obtain other Federal, State, or local authorizations required by law.

On February 11, 1991, we renewed general permit No. 198000291 (copy
enclosed), which provides Federal authorization for construction activities
that receive authorization from the State of North Carolina.
A review of your application received July 10, 1996, for Department of
the Army authorization to maintenance dredge approximately 67,200 square feet
of material from four existing canals, each 250 feet long by 40 feet wide, off
the Intracoastal Waterway, between Laurinburg and Concord Streets, in Ocean
Isle Beach, Brunswick County, North Carolina, indicates it to be a candidate
for Federal authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished by the
North Carolina Division of Coastal Management. Comments from Federal review
agencies will be furnished to the State.
If your application must be withdrawn from this general permit process
for any reason, you will be informed regarding its further management. If
there are no unresolved differences in State -Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.
On February 6, 1990, the DA and the U.S. Environmental Protection Agency
(EPA) signed a memorandum of agreement (MOA) establishing procedures to
determine the type and level of mitigation necessary to comply with the Clean
Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding
impacts to waters and wetlands through the selection of the least damaging,
practical alternative; second, taking appropriate and practical steps to
minimize impacts on waters and wetlands; and finally, compensating for any
remaining unavoidable impacts to the extent appropriate and practical. To
enable us to process your application in full compliance with this MOA, we
request that you provide the following additional information:
a. Permits for work within wetlands or other special aquatic sites are
available only if the proposed work is the least environmentally damaging,
practicable alternative. Please furnish information regarding any other
alternatives, including upland alternatives, to the work for which you have
applied and provide justification that your selected plan is the least
damaging to water or wetland areas. T

b. It is necessary for you to have taken all appropriate and practical
steps to reduce wetland losses. Please show all that you have done,
especially regarding development and modification of plans and proposed
construction techniques, to reduce adverse impacts.

required for all unavoidable adverse impacts remaining after all appropriate
and practical minimization has been employed. Please show your plan to
mitigate for the projected, unavoidable loss of waters or wetlands or provide
information as to the absence of any such appropriate and practical measures.

of this information must be sent to the North Carolina Division of

8. PROJECT SUMMARY: The applicant wishes to obtain a permit for maintenance excavation
of the four existing canals, between Laurinburg and Concord streets, and proposes, initially,
to complete maintenance dredging in at the entrances of the four existing canals. The canals are
approximately 2500 feet long and the channel width is 40 feet. The Town is proposing to
complete maintenance excavation of the northern 320-400 feet of the canals and the connecting
channels to the AIWW, in conjunction with work to be completed under State Permit 59-96.

9. PROJECT DESCRIPTION
The project site consists of four (4) existing canals which connect to the AIWW, on the north side of
Ocean Isle Beach, between I aurinburg and Concord streets. The canals are approximately 2500 feet
long and 100 feet wide, and provide water access for adjacent residential development. Most of the lots
adjoining the canal system are currently developed with single-family residences, and the majority of
the shoreline is stabilized with a individual wooden bulkheads on each lot. Along the shoreline of the
canals, there is a border of coastal wetland vegetation, varying from 0 to 20 feet in width. It is
primarily Smooth Cordgrass (Spartina alterniflora), but some high marsh species were observed in the
transition slope to highground on lots without bulkheads. These include: Sea Lavender(Limonium spp.),
Saltwart (Salicornia, spp.), Spike Grass (Distichlis spicata), and Salt Meadow Grass (Spartina patensl.
The Atlantic Intracoastal Waterway is approximately 550 feet wide in the project area
and the waters are classified SA by the N. C. Carolina Division of Environmental Management. The
waters inside the canal system are Closed to shellfishing, however, once outside the plane across the
access channels, the waters of the AIWW are OPEN to shellfish harvest. The N. C. Division of Marine
Fisheries does not consider the project area as primary nursery area.
For maintenance purposes, the applicant proposes a 40 ft. wide channel, 6 ft. deep at MLW, in the
center of the four existing canals, which accumulatively total, 9600 feet in length (2400 ft. ea.).
Currently, the canal system has adequate water depth (4-6 ft. @ MLW) for navigation during all tide
stages, however , the mouths of the access channels are beginning to narrow as a result of shoaling. The
Town of Ocean Isle Beach is proposing to complete maintenance excavation of the northern 250 - 300
feet of the canals and the connecting channels to the AIWW, in conjunction with work to be completed
this fall, under State Permit 59-96. The Town is requesting to flair the AIWW end of the channels,
from 40 feet, to 80 feet, over the last 100 feet of the access channel, in an effort to control the shoaling
problem. Although the applicant is requesting maintenance dredging for the entire length of the access
canals, given the existing water depths, initial work by the Town would be limited to the shoaled area
at the northern end of the canals (vanes 320-400 ft.) and waterway portions of the channels. The Town
estimates that the proposed maintenance excavation and flair expansion would create approximately 6000
cubic yards of spoil material. The project would be completed using a hydraulic dredge and spoil
material would be placed in an existing diked area, approximately 1/4 mile east of the project. The
portion of the existing spoils disposal area to be used for the project measures approximately 380 feet
square, with approximately 8 feet of depth available for spoils disposal inside the diked area.
10. ANTICIPATED IMPACTS
The proposed project would disturb approximately 67,200 square feet of shallow water bottom. Of that
total. approximately 10,400 square feet would consist of previously undredged bottom. There would be
144,400 square feet of highground disturbance within the existing spoils disposal area. There would be
some short-term turbidity and siltation associated with the dredging

SUBJECT: Request by Town of Ocean Isle Beach to combine CAMA Major Permits
55-_94, 56-96 and 133-96 into one maintenance permit.
At your request, John Parker and I have reviewed the August 11, 1997 letter by the Town
of Ocean Isle Beach (copy enclosed) asking that the Division combine three active dredging
permits into one maintenance permit. While this action would simplify matters somewhat for the
applicant, it would also make record keeping and enforcement more difficult for the Division,
especially when considering that these permits may be renewed for numerous five-year periods.
Therefore, in order to ensure that confusion over these projects is kept to a minimum, it has been
determined that each of these three permits should remain as separate project files, and the Town
may request maintenance renewals on each one individually. This determination should not in
any way hinder the Town's long-term maintenance efforts, and will allow the Division to
adequately track the three permits over the life of the projects.

Dear Mr. Taylor:
Reference your application for a Department of the Army permit to
maintenance dredge approximately 67,200 square feet of material from four
existing canals, each 250 feet long by 40 feet wide, off the Intracoastal
Waterway, between Laurinburg and Concord Streets, in Ocean Isle Beach,
Brunswick County, North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. 198000291. Therefore, you may
commence construction activity in strict accordance with applicable State
authorization and the enclosed plan. Failure to comply with the State
authorization or conditions of the general permit could result in civil and/or
administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.
