1) No additions beyond the pre -Bertha structure are being authorized.
2) This permit authorizes only the pier structure and uses located in or over the water that are expressly
and specifically set forth in the permit application. No other structures, whether floating or
stationary, may become a permanent part of this fishing pier facility without permit modification.
3) The authorized structure and associated activity must not cause an unacceptable interference with
navigation.
4) All storm damaged timber and piling that is not reusable must be removed to an approved
highground area so that it will not become either a floating or stationary hazard to navigation.

This permiLaction may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.

covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
July 31,1998
In issuing this permit, the State of North Carolina agrees

It is my understanding that Occwt City Fishing Pier, Inc. located at 408 Ocean Drive, North
Topsail Beach, N. C. has applied to the Division Of Coastal Management of the North Carolina
Department Of Environment, Health, & Natural Resources for a Major Permit to rebuild the
ocean pier that was destroyed by Hurricane Bertha on July 12, 1996. As the owner of Lot 6 in
Block 3, being property adjacent to that on which the ocean pier is located, I have so aijoction to
the ocean pier being rebuilt as requested by Ocean City Fishing Pier, Inc. in their Application For
Permit To Develop In North Carolina's Coastal Area dated July 26, 1996.

This permit consistency opinion is based on my review of the Ocean City Fishing Pier permit application, the
Field Investigation Report (JM Russell, 8/5/96), and my understanding and interpretation of the policies
presented in the Town of North Topsail Beach 1991 Land Use Plan.
The permit requests permission to repair and replace the Ocean City Fishing Pier damaged by Hurricane
Bertha. The pier was more than 50% destroyed; pier house repairs (if any) are not considered in this permit.
The location and complete description of the project are in the Field Investigation Report.
LAND USE CLASSIFICATION: Conservation (public trustlocean hazard AEC's)
CLASSIFICATION DESCRIPTION: Acceptable uses within this classification include piers and water
dependent structures.
RELATED POLICIES AND IMPLEMENTATION MEASURES:
From the Land Use Plan:
3.b.Flood Prone Areas
All of North Topsail Beach is within at least the 100 year flood zone, with much of the Town being
subject to high velocity conditions. The town believes that development should be allowed within these
areas, but only under strict adherence to the Town's ordinances and land use controls, IE. zoning,
subdivision regulations, flood damage prevention ordinance and NC Building Code.
CONSISTENCY OPINION
This project is consistent with the Land Use Plan when:
Proposed re -construction of a destroyed structure as proposed is consistent with CAMA
Guidelines; and
Proposed reconstruction is consistent with local zoning, subdivision, flood damage
ordinances and with the NC Building Code.

Gentlemen:
Through coordination with Ms. Janet Russell of the North
Carolina Division of Coastal Management, we have learned of your
plans to replace/repair the Ocean City Fishing Pier, damaged by
Hurricane Bertha, on the Atlantic Ocean, North Topsail Beach,
Onslow County, North Carolina.
For the purposes of the Corps of Engineers' Regulatory
Program, Title 33, Code of Federal Regulations (CFR), Part 330.6,
published in the Federal Register on November 22, 1991, lists
nationwide permits. Authorization, pursuant to Section 10 of the
Rivers and Harbors Act of 1899 and Section 404 of the Clean Water
Act, was provided for the repair, rehabilitation, or replacement
of any previously authorized, currently serviceable structure or
fill; or of any currently serviceable structure or fill
constructed before the requirement for authorization, if the
structure or fill is not to be put to uses differing from those
uses specified or contemplated for it in the original permit or
the most recently authorized modification.
Your work is authorized by this nationwide permit provided it
is accomplished in strict accordance with the enclosed conditions
and provided you receive a Coastal Area Management Act (CAMA)
permit from the North Carolina Division of Coastal Management
(NCDCM). This nationwide permit does not relieve you of the
responsibility to obtain other required State or local approval.
Copies of the Department of the Army (DA) permit for
construction of your pier, issued February 24, 1958, and a
subsequent modification, dated February 29, 1960, are enclosed.
This verification will be valid until the nationwide permit
is modified, reissued or revoked, which will occur by January 21,
1997. It is incumbent upon you to remain informed of changes to
the nationwide permits, which will be announced by public notice
when they occur. If you commence, or are under contract to

commence, this activity before the date the nationwide permit is
modified or revoked, you will have twelve months from the date of
the modification or revocation to complete the activity under the
present terms and conditions of this nationwide permit.

NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed construction. You should post this notice at a conspicuous point in your
parking lot where it can be observed from Highway 210. Failure to post this notice could result in an
incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal
review agencies for their comments. If additional information is required based on this review, the
agencies may contact you directly.

As we have discussed on a couple of occasions during the past two weeks, Ocean City Fishing
Pier, Inc. desires to reconstruct as quickly as possible the section of the ocean pier destroyed on
July 12, 1996 by Hurricane Bertha. From those discussions, it was learned that an application for
a Coastal Area Management Act (CAMA) Major Permit must be issued by the Coastal
Management Division of the North Carolina Department of Environment, Health & Natural
Resources (DEHNR).
Following the instructions contained in the application package, coupled with some guidance from
you, the application has been completed and is being submitted herewith. The following
documents are attached for DEHNR's review and consideration for issuance of a Major Permit:

since HurricaW Bertha.
It also should be noted that this pier, while being a commercial venture, has provided public access
to the ocean for recreational fishermen for the past thirty-seven (37) years. The number of
fisherman that enjoy public access to the ocean for recreation through Ocean City Pier is estimated
to be between 15,000 to 20,000 annually. The annual number of individuals that utilize during the
summer the beach area immediately in front of the facilities provided by Ocean City Pier are
estimated to double the number of fisherman that use the pier.

9. PROJECT DESCRIPTION
The Ocean City Fishing Pier is a commercial ocean pier located within the boundaries of North Topsail
Beach, Onslow County. The pier is heavily used for recreational fishing. It was constructed around
1959 and is one of the older ocean piers on Topsail Island. The most oceanward end of the pier was
destroyed during Hurricane Bertha, July 1996. The applicants wish to put back what was there before
Bertha and repair the portion of the pier that was not destroyed. Associated with the pier is a pier
house which was not severely damaged by the Hurricane and has no consideration under this permit
request. This application was necessitated because more than 50% of the pier structure was destroyed.
The pier extends from the pier house on high ground across approximately 125' of public beach before
reaching the waters of the Atlantic Ocean. Before the storm the pier structure extended approximately
688 feet out over the ocean. About 450 linear feet of the pier was destroyed by the Hurricane.
The waters of the Atlantic Ocean are classified as SB by the Division of Environmental Management.
The upland portion of the property is classified as Urban Transition by the Town of North Topsail
Beach and is zoned for commercial business.
10. ANTICIPATED IMPACTS
Approximately 16,260 square feet of public trust areas would be shaded by the pier structure. Positive
impacts include ocean access provided to recreational fishermen and vacationers.
