Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 6) This permit does not authorize the interference with any existing or proposed Federal project, and the pernttee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. NOTE: Permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. General NOTE: The deed submitted with the permit application indicates that the property lines extend below the mean high water line. The permittee is advised that the State of North Carolina claims title to all lands falling waterward of the mean high water line. NOTE: Future development of the permittee's property may require a modification of this permit. Blue -line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. PROJECT SUMMARY: The applicant proposes to construct a community pier to be used by the property owners of Oak Harbor Subdivision. Oak Harbor Community Pier/Newman Stanley Page 2 9. PROJECT DESCRIPTION Oak Harbor Subdivision is located on both the north and south side of Goose Creek Road S.W.(SR 1155), off N.C. Hwy 179, -in the -Br ek-LandmgMea of Brunswick County. T'he existing fourteen (14) - acre subdivision consists of 16 platted, single-family,Jots,of,uwirich,,three (3) lots are currently develoR,ed with existing homes. There are plans to subdivide three additional tracts labeled future development, -which will add another. 7.84 acres to the total development plan. The property's southern perimeter consists of four (4) lots and a community access area, along 365 feet of shoreline, adjacent to the Atlantic Intracoastal Waterway. The shoreline is stabilized By rip rap (rock), landward of a narrow border of coastal wetland vegetation, which is approximately 20-40 feet wide. The wetland border is primarily Smooth Cordgrass (Snartina alterniflora), with some Spike grass (Distichlas s icata) and Sea Lavender (Limonium spp.). There is an existing ditch along the western property line which is connected to the AIWW by pipe. The previously listed coastal wetland species were observed, approximately 50 feet into this ditch. A community pier is proposed to be constructed in the common access area along the southwest comer of the subdivision. This common area access is a ten (10) feet wide strip between Lot 7 and the tract's western property line. The access crosses to Oak Harbor Court on the north side of Lots 6 and 7. The elevation of the property averages 18-20 feet mean sea level, but elevation drops sharply along the AIWW shoreline. Vegetation on the bluff includes large Live Oak, Hickory, and Pine trees, with an occasional Red Cedar. Ground cover is lawn grasses. The AIWW is approximately 500 feet wide in the project area. It is classified as SA by the N.C. Division of Environmental Management, and is OPEN for the harvest of shellfish. The N.C. Division of Marine Fisheries has not designated this area as a Primary Nursery Area. The applicant proposes to construct a community pier for use by the property owners of Oak Harbor Subdivision. The pier would be constructed from the common access area along the western property line, and would be 124 feet long and 4 feet wide. The community pier would terminate with a 10 feet by 10 feet T-head platform, 85 feet landward from the edge of the AIWW channel. Highground development would include a privacy fence between Lot 7 and the pier access area, and wooden walkway (80 ft. X 5 ft.) and gate, along the upper portion of the common access area. 10. ANTICIPATED IMPACTS The proposed structure would incorporate 100 square feet of Estaurine and Public Trust Waters. During the construction of the pier, there would be some trampling of marsh vegetation along the alignment of the walkway and -some short-term turbidity associated --with the -installation -of pilings. —The -pier — — walkway would shade approximately 160 square feet of coastal wetlands, but, if it is elevated sufficiently, no long-term adverse impacts are anticipated from the project. Area waters are classified SA and are open to shellfish harvest. The pier has potential to shade approximately 160 sq. ft. of coastal wetlands. We recommend that this potential be reduced by elevating pier decking a minimum of 4 ft. above the marsh floor, allowing sunlight penetration to the wetland vegetation underneath. PROJECT SUMMARY: The applicant proposes to construct a community pier to be used by the property owners of Oak Harbor Subdivision. Oak Harbor Community Pier/Newman Stanley Page 2 9. PROJECT DESCRIPTION Oak Harbor Subdivision is located on both the north and south side of Goose Creek Road S.W.(SR 1155), off N.C. Hwy 179, in the Brick Landing area of Brunswick County. The existing fourteen (14) acre subdivision consists of 16 platted, single-family lots, of which, three (3) lots are currently developed with existing homes. There are plans to subdivide three additional tracts labeled future development, which will add another 7.84 acres to the total development plan. The property's southern perimeter consists of four (4) lots and a community access area, along 365 feet of shoreline, adjacent to the Atlantic Intracoastal Waterway. The shoreline is stabilized by rip rap (rock), landward of a narrow border of coastal wetland vegetation, which is approximately 20-40 feet wide. The wetland border is primarily Smooth Cordgrass (Spartina alterniflora), with some Spike grass (Distichlas spicata) and Sea Lavender (Limonium spp.). There is an existing ditch along the western property line which is connected to the AIWW by pipe. The previously listed coastal wetland species were observed, approximately 50 feet into this ditch. A community pier is proposed to be constructed in the common access area along the southwest comer of the subdivision. This common area access is a ten (10) feet wide strip between Lot 7 and the tract's western property line. The access crosses to Oak Harbor Court on the north side of Lots 6 and 7. The elevation of the property averages 18-20 feet mean sea level, but elevation drops sharply along the AIWW shoreline. Vegetation on the bluff includes large Live Oak, Hickory, and Pine trees, with an occasional Red Cedar. Ground cover is lawn grasses. The AIWW is approximately 500 feet wide in the project area. It is classified as SA by the N.C. Division of Environmental Management, and is OPEN for the harvest of shellfish. The N.C. Division of Marine Fisheries has not designated this area as a Primary Nursery Area. The applicant proposes to construct a community pier for use by the property owners of Oak Harbor Subdivision. The pier would be constructed from the common access area along the western property line, and would be 124 feet long and 4 feet wide. The community pier would terminate with a 10 feet by 10 feet T-head platform, 85 feet landward from the edge of the AIWW channel. Highground development would include a privacy fence between Lot 7 and the pier access area, and wooden walkway (80 ft. X 5 ft.) and gate, along the upper portion of the common access area. 10. ANTICIPATED IMPACTS The proposed structure would incorporate 100 square feet of Estaurine and Public Trust Waters. During the construction of the pier, there would be some trampling of marsh vegetation along the alignment of the walkway and some short-term turbidity associated with the installation of pilings. The pier walkway would shade approximately 160 square feet of coastal wetlands, but, if it is elevated sufficiently, no long-term adverse impacts are anticipated from the project. Submitted by: E. F. Piers 2, 3, &4 have been removed from the drawing and the details for these two piers are not included. 2. The pavement you saw on an earlier drawing was not a part of the pier installation but is to provide a driveway to lot 7, it is not a part of the pier and is not shown. No paving is placed or any excavation planned for the pier. The users of the pier can walk on the turf. The pier installation and the walkway to the pier will cause no identifiable increase in storm water nmoff. All fencing and walkway definition is planned as shown. 3. The pier is considered within walking distance of all the Oak Harbour lots therefore no parking area is provided for pier users The property owners are aware that there is no parking and automobiles will be left at their residence when visiting or using the pier. 4. The survey with the latest date and defines the development details for lots 7, 7A, 8 & 9 is the correct survey. The survey dated 5/29/88 did not show all the platting details and an error was found when resurveying. There is no planned encroachment on wet lands that will require filling or displacement 5.
