Excavation Fill and BulkheadinQ
1) The ditch proposed to be relocated along the northern property line shall be created prior to any
bulkheading and filling, in order to redirect and provide a continuous flow of surface runoff through
this site.
2) Prior to any filling activity within the canal and basin, a bulkhead shall be constructed within the 15'
x 100' long canal at the waterward limits of proposed fill activity to eliminate the possibility of fill
material entering surrounding waters and wetlands.
3) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the
structure.

13) Visible remains of landfill material such as chrome bumpers, tires, brake pads, propane tanks,
etc., shall be removed from the site.
Water Quality
14) In order to protect water quality, runoff from the construction must not visibly increase the
amount of suspended sediments in adjacent waters.
15) The Division of Environmental Management approved the stormwater management permit for
this project March 18, 1996. Any violation of that approval will be considered a violation of the
CAMA permit.

Dear Sir:
Reference your application for a Department of the Army (DA) permit to
place fill material in wetlands and a manmade canal and basin, on property
located at the terminus of State Road 1187, adjacent the Croatan Sound, in
Wanchese, Dare County, North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of General Permit No. 198000291. Therefore, you
may commence construction activity in strict accordance with applicable State
authorization and the enclosed plan. Failure to comply with the State
authorization or conditions of the general permit could result in civil and/or
administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action
is necessary as revised plans must be reviewed and the authorization modified.

I recommend that the project be permitted with the following conditions:

2) 'That �rior to any filling activity within the canal and basin, a bulkhead be
constructed within the 15' x 100' long canal at the waterward limitsl\of
proposed fill activity to eliminate the possibility of fill material entering
surrounding waters and wetlands.
3) The bulkhead must be structurally tight so as to prevent seepage of backfill
materials through the structure.
4) The bulkhead must be solid and constructed of treated wood, concrete slabs,
metal sheet piles, or other suitable materials approved by Department
personnel. No excavation is permitted, except for that which may be required
for the construction of the bulkhead wall, riprap, deadmen cables, etc. This
permit does not authorize any excavation waterward of the approved
alignment.
5) The fill material will be clean and free of any pollutants, except in trace

6) All backfill material will be obtained from a highground source and confined
behind the permitted bulkhead.
7) All fill material to be placed below normal water level will be confined behind
the permitted bulkhead.
8) No marsh grass will be excavated and/or filled.
9) The temporary placement or double -handling of excavated or fill materials
within waters or vegetated wetlands is not authorized.
10) No excavated or fill material will be placed at any time, in any marsh or
surrounding waters, outside of the alignment of the fill area indicated on the
workplat(s).
11) All excavated materials will be confined above mean high water and landward
of regularly or irregularly flooded marsh behind adequate dikes or other
retaining structures to prevent spill -over of solids into any marsh or
surrounding waters.
12) The disturbed areas will be properly graded and provided a ground cover
sufficient to restrain erosion within thirty (30) working days of project
completion.

SUBJECT: Dare County Major Permit Application Land Use Plan Consistency Review
DATE: April 26, 1996
This proposal involves the filling of 9,500 square -feet of estuarine waters, 3,645
square feet of non -coastal wetlands, the disturbance of 84,942 square feet of estuarine
shoreline and 174,096 square feet of highground. The applicant proposes to construct two
baseball fields, two press boxes, a playground area and a paved lot for 53 vehicles.
Applicable Dare County land use policies are as follows:
1) Estuarine Waters - In the plan narrative, the County indicates that the public
strongly supports the protection and preservation of estuarine waters. The
County's policy reads "Estuarine Shoreline development should continue to be
managed to protect and preserve the natural resources of the estuarine waters"
(sec 2, pg 53).
2) Public Trust Waters - In the plan narrative, the County points out that public
input indicates the need for a management program to regulate competing
recreation uses in public trust waters and that such a management program
should be the responsibility of State and Federal Agencies. The County's
policy reads: "Dare County supports the preservation and protection of the
public's right to access and use of the Public Trust Areas and Waters" (sec 2,
pg 54).
3) Fisheries Resources - In the plan narrative, the County indicates that
commercial fishing and recreational fishing are important and that fisheries
resources play an important role in the economy of Dare County. The County
points out that the importance of fishing has "highlighted the need for water
quality management programs" (sec 2, pg 70.). The County's policy is "the
continued productivity of commercial and recreational fisheries shall be
fostered through restoration and protection of the unique coastal ecosystems

4) Freshwater Wetlands - In the plan narrative, the County indicates that the
public supports continued regulatory programs to prevent large scale
destruction of freshwater wetlands. The plan narrative also indicates that the
concept of mitigation as an aspect of freshwater wetland management was
examined and that support for public purpose mitigation activities was
identified but mitigation for alteration of freshwater wetlands for private
development was less acceptable. The policy of the County is that "... Dare
County supports the Coastal Resources Commission's policy to mitigate losses
of coastal resources for those projects shown to be in the public interest as
defined by the standards in 15NCAC 7M.0700 et. seq. and only after all other
means of avoiding or minimizing such losses have been exhausted" (sec 2, pg.
60).
The loss of 3,645 square feet of non -coastal wetlands in this proposal will have to be
properly mitigated with acceptable wetland creation in order for that aspect of the proposal to
be consistent with the Dare County Land Use Plan. The proposed ball fields, press boxes,
playground area and parking lot are development activities found to be consistent with the
Dare County Land Use Plan.
The filling of the estuarine waters in the 50' x 160' basin and 15' x 100' long canal
resulting in the loss of 9,500 square feet of shallow water habitat must be evaluated against
the three other policies noted above. Those policies address the protection of water quality,
the environmental values of the resources, and the public rights of navigation. If it is
determined in consultation with other reviewing agencies that the basin and canal fill will
significantly impact water quality, result in the loss of valuable nursery habitat for fish and
shellfish, and/or result in the loss of significant public rights of navigation, then this aspect
of the proposal will be inconsistent with the Dare land use plan. However, if there is no or
only minimally valuable nursery habitat present, minimal public rights of navigation, and if
there are insignificant or even positive impacts to water quality resulting from the fill, then
this aspect of the proposal will be consistent with the Dare County land use plan. To
determine this final point, Elizabeth City Coastal Management staff will be available for
consultation once all reviewing agencies' comments are in to compare those comments with
the County's applicable polices.

This permit shall be effective from the date of issuance until
rescinded and shall be subject to the conditions and limitations as
specified therein.
If any parts, requirements, or limitations contained in this
permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request must be in the form
of a written petition, conforming to Chapter 150h of the North
Carolina General Statutes, and filed with the Office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 2.7611-7447.

The following comments by the North Carolina,. Division of Marine Fisheries are
provided pursuant to General Statute 113-131.
This agency approves of this project as proposed. The filling of the 9,500 square feet
of shallow water habitat will eliminate the dead end basin (8,000 sq. ft.) and 15' x 100' of
the canal. Based on information provided in the Bio-report the area has been utilized as a
dump. Removal of this material from the basin and filling should improve the water quality.

The Division commends Daze County for the creation of 3,645 sq. ft. of non -coastal
wetlands, which will result in no net loss.

1. The area be properly graded.
2. A permanent ground cover,sufficient to restrain erosion
be provided on all exposed areas within the shorter of
30 working or 120 calendar days after project comple-
tion.
3. The exterior slopes of the disposal area dikes be at an
angle no steeper than 1 1/2 H: 1 V.
4. Appropriate erosion and sedimentation control devices,
measures, or structures be used to prevent sediment
from entering the adjacent wetlands/watercourses/
property (e.g., silt fence, diversion swales/berms,
sand fence, etc.).
5. A ground cover sufficient to restrain erosion be
provided within 30 working days of completion of any
phase of grading on cut or filled slopes.
6. An erosion and sedimentation control plan be submitted
at least 30 days prior to initiation of land -disturbing
activities.
7. Additional information concerning the area of the land-
ward disturbance be submitted to determine if an
erosion control plan is required.

Dear Mr. Parker:
Reference the application of the County of Dare for a Department of the
Army (DA) permit to place fill material in wetlands and a manmade canal and
basin, on property located at the terminus of State Road 1187, adjacent the
Croatan Sound, in Wanchese, Dare County, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following condition(s) be included in the State
authorization:
1. All work authorized by this permit must be performed in strict
compliance with the permit plans.

2. No waters or vegetated wetlands will be excavated or filled outside of
the proposed project area.
3. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.
4. The fill material will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials, or unsightly debris will
not be used.
5. The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.

On February 11, 1991, we renewed General Permit No. 198000291 (copy
enclosed), which provides Federal authorization for construction activities
that receive authorization from the State of North Carolina.
A review of your application received March 29, 1996, for Department of
the Army (DA) authorization to place fill material in wetlands and a manmade
canal and basin, on property located at the terminus of State Road 1187,
adjacent the Croatan Sound, in Wanchese, Dare County, North Carolina,
indicates it to be a candidate for Federal authorization under this general
permit. Accordingly, the administrative processing of your application will
be accomplished by the North Carolina Division of Coastal Management.
Comments from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit process
for any reason, you will be informed regarding its further management. if
there are no unresolved differences in State -Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should You begin work.
Your application, pursuant to Section 10 of the River and Harbor Act and
Section 404 of the Clean Water Act, has been assigned Action ID No. 199601516.

Enclosed is the application of the County of Dare for Department of the
Army (DA) authorization and a State Water Quality Certification to place fill
material in wetlands and a manmade canal and basin, on property located at the
terminus of State Road 1187, adjacent the Croatan Sound, in Wanchese, Dare
County, North Carolina. Your receipt of this letter verifies your acceptance
of a valid request for certification in accordance with Section 325.2(b)(ii)
of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by May 31, 1996, the District Engineer will deem that
waiver has occurred.

Dare County owns an undeveloped 6.6 acre irregularly -shaped parcel of land at the end
of SR 1187 in the Village of Wanchese in Dare County. For approximately 30 years (ca. 1940-
1970) this site was used as a landfill. Glass, plastic, and styrofoam items and material such as
appliances, tires, automobiles, and propane tanks were noted at the site during a March 12, 1996
inspection. Near the northern property line is an old 50' wide X 160' long basin with waters
depths of 5' to 6'. Connecting the basin to Croatan Sound, which is classified SA waters by the
NC Division of Environmental Management, is a 15' wide, 4,000' long, "L" shaped canal with
water depths of 1 to 2 feet. Emptying into the eastern side of the basin is an 8' wide ditch
which, after heavy rains, drains water from an area lying east of the County's property.
Water within the basin is rust colored and no biological activity was noted in or around
the basin. Although water depths within the basin and canal are sufficient for navigation,
structures which might indicate historical or current navigation were not noted.
Surrounding the basin and canal are approximately 6 acres of uplands with predominantly
sandy soil. These uplands range from 2 feet in elevation in relatively undisturbed areas to 10
feet above normal water level where long-standing mounds of sand have been created. Average
elevation is approximately 4 feet above NWL. No coastal wetlands exist on this site. Other
wetlands total 27,000 square feet according to a determination by a representative of the US
Army Corps of Engineers. Approximately 16,000 square feet of these "404" wetlands lie within
3 separate areas along the western property line of this site.
The formerly wooded site has been cut over within the past month. Remaining stumps
and limbs indicate an overstory of loblolly pine (Pinus taeda), sweet gum (Liquidambar
styracii lua), and red maple (Acer rubrum) and an understory of wild black cherry (Prunus
serotina), wax myrtle (Myrica cerifera) and sweet bay (Magnolia virginiana) were removed.
PROPOSED DEVELOPMENT
The applicant proposes to create a family recreation park on this site by filling the 50'
x 160' basin and the easternmost 100 linear feet of the 15 foot wide canal. Also proposed is the
filling of 3,645 square feet of delineated "404" wetlands located near the western property line
and approximately 120 feet from the basin. The site will be graded and filled to create two
baseball fields, a playground area, two press boxes and a 53 car parking lot. Existing drainage
will be re-routed and directed into a system of grassed areas, then collected in grassed
infiltration swales and ditches. As mitigation for the 3,645 square feet of "404" wetlands
proposed to be filled, the applicant will create an equal area of "404" wetlands in the western
corner of the site. Approximately 6.25 acres of the site will be disturbed.

ANTICIPATED IMPACTS
The filling of the basin and canal will result in the filling of 9,500 square feet of shallow
water habitat in the man-made basin and canal. Approximately 3,645 square feet of non -coastal
wetlands are proposed to be filled. The loss of shallow water habitat could be more than offset
by the improvement in water quality within the 4,000' long canal system and the adjacent waters
of the Croatan Sound. The mitigation site which the applicant proposes to construct on a 1 to
1 ratio will do much to offset the loss of non -coastal wetlands on the site.
The upland areas will be impacted by the 6.25 acres of land disturbing activity and the
.5 acre of impervious coverage created by the construction of buildings and the asphalt parking
lot.
No archeological/historical significance has been associated with this site. No unique
remnant species or geologic formation are known to exist within the project area.

drawn off on the plat that you sent me. On the existing
plan you have shown my driveway on county land. Obviously
you must believe that I am on the County Board of
Commissioners and want to take, take, take. All I want is
:•ghat is mine. Nothing more and nothing less! Since I have
received your letter- Ray Meekins and Associates have re—
surveyed the land again and I am in agreement with their
last survey. It's interesting how when they first surveyed
my lot a 1/3 of it was disputed and now they see it: exactly
how it really is.
