The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable,
the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for
assistance. By working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

The direct impact to the Public Trust Waters of Brice Creek should be negligible if
any at all. Therefore, I have no objections to the proposed project, but recommend the
following conditions:

Craven County Water System Improvements
DATE: August 6, 1996
Craven County's water system is a rural type supply system located
in and around small communities east and west of New Bern. Water is
drawn from wells west of New Bern and pumped across the Trent River
to the James City community and beyond. Proposed improvements to
the system include the installation of approximately 62,000 linear
feet of 12' water main throughout the area being served. With these
improvements the County proposes to attach a new 12" water line to
the south side of the bridge over Brice Creek on SR 1004 near James
City. The County also proposes to convert the existing 8" water
line on the north side of the bridge to a force main for future
transport of reclaimed water to a nearby proposed sewage land
application site.
Brice Creek is classified as Inland Waters. The only Area of
Environmental Concern (AEC) impacted by the work is the Public
Trust Areas AEC. Waters at the project site are classified as C Sw
NSW above the Brice Creek bridge and SC Sw NSW below the bridge.
The area of the project is not a Primary Nursery Area (PNA) and the
waters are closed to the harvesting of shellfish.
I have reviewed this proposal for consistency with the 1996 Craven
County Land Use Plan (LUP) Update, as certified by the Coastal
Resources Commission on July 26, 1996, and offer the following
comments.
The general area of the project is classified as Urban Transition,
while the Public Trust Areas AEC impacted by the work is classified
as Conservation.
Throughout the LUP, Craven County supports the extension of central
water and sewer services into all areas. With the exception of two
policies (neither one is applicable to this proposal) Craven County
adopts the State's minimum use standards for development in ABCs.
Specific applicable policies contained in the 1996 Update include
Resource Protection Policies for Soils (Page IV-2). These policies
state the County's support for the development of central water and
sewer systems in all areas of the County.
Resource Production and Management Policies for Marine Resource
Areas (Page IV-8) state Craven County's support for the State's
,f
minimum use standards for estuarine and public trust areas.
Economic and Community Development Policies for the County's Water
Supply and Sewer System are discussed on Page IV-10. These policies
reiterate Craven County's support for the extension of central
water and sewer services into all areas of the county, including
the construction of lines to and through conservation areas to
serve development which meets all applicable state and federal
regulations.
Section V of the LUP discusses the relationship of policies
contained in the Plan with the various land classifications. Urban
Transition lands are intended to accommodate future urban growth
within the planning period. Mixed land uses are allowed by Craven
County in this classification. Urban services, including water,
sewer, streets, police and fire protection are to be provided.
Craven County specifically includes land application systems as
being appropriate in the Urban Transition classification.
The Conservation classification discussion states the County's
support for all uses in these areas, as allowed by 15A NCAC 7H.
This proposal, to attach a new water line to the Brice Creek bridge
and to convert the existing water line to a force main to be used
in conjunction with a future land application system, appears to be
consistent with the 1996 Craven County Land Use Plan Update,
provided all state and federal requirements can be satisfied.

Through coordination with the North Carolina Division of Coastal
Management, we have learned of your plans to attach a new 12" water line to
the south side of the bridge over Brice Creek, and convert the existing 8"
water line on the north side of the bridge to a force main, located on State
Road 1004, in James City, Craven County, North Carolina.
On January 1, 1994, we renewed General Permit No. 198100049, (copy
enclosed) that authorizes the maintenance, repair and installation of aerial
and subaqueous utility lines with attendant structures and the discharge of
excavated or fill materials,within-construction/access corridors, associated
with utility line..maintenance,' repair and installation in navigable waters and
waters,of-.the United States in the State of North Carolina.
Your proposed work is authorized if you can comply with all permit
conditions. Please read the enclosed permit to prevent an unintentional
violation of Federal law. As this Department of the Army general permit does
not relieve you of the responsibility to obtain any other required approvals,
you should contact appropriate State and local agencies before beginning work.

9. NARRATIVE DESCRIPTION:
Project Setting
Craven County's rural water supply system is located in and around small
communities east and west of New Bern. Water is essentially drawn from wells west
of New Bern and pumped through transmission lines across the Trent River to the
James City area. Part of that route includes a line previously installed adjacent to SR
1004 and suspended from the bridge over Brice Creek, located approximately 500 feet
east of SR 1143. The creek at the project site on SR 1004 at the Brice Creek bridge
crossing is approximately 320' in width. There is currently an 8" water line suspended
from the north side of the concrete structure. Brice Creek is an Inland Water and
classsified C Sw NSW above the bridge and SC Sw NSW below.
Project Description
Craven County proposes improvements to their rural water supply system
including the installation of some 62,000 linear feet of 12" water main throughout the
service area. As part of this system improvement, the County proposes to suspend a
new 12" water main line from the south side of the.Brice Creek bridge and in doing
so, disconnect the existing 8" water line on the north side of the bridge. All services,
distribution laterals, and fire hydrants will be disconnected and reconnected to the new
12" water line. Several CAMA General Permits have been recently issued to the
applicant authorizing the water line crossing of various other creeks associated with the
overall project. Eventually the applicant proposes to convert the existing 8" water
main to a force main transporting reclaimed water to a proposed land application site
nearby. The new 12" water line will require trenching along the roadway shoulders.
Anticipated Impacts
Since Brice Creek is an Inland Water, there is no CAMA Estuarine Shoreline
AEC jurisdiction. The land disturbing activities within the high ground of the roadway
shoulders would be minimal and any impact to Brice Creek should be neglible.

Dear Mr. Woodard:
Enclosed for your information is a complete copy of the permit application to the
Division of Environmental Management required by the Coastal Area
management Act (CAMA) for the proposed attachment of a 12-inch water main
to the Brice Creek Bridge and conversion of the existing 8" water main for future
use as a reclaimed water transmission line. This work is part of proposed water
system improvements designed to alleviate pressure problems and increase fire
flows in the Brice Creek area.
Be advised that you have 30 days to submit any comments on the proposed
project to the division of Coastal Management. Addresses and phone numbers
for the various field offices are listed on the attached application form.

Dear Mr. Temple:
The Division of Coastal Management hereby acknowledges receipt of Craven County's
application for State approval for development of property located on SR 1004 over Brice Creek,
near James City. It was received complete on June 26, 1996, and appears to be adequate for
processing at this time. The projected deadline for making a decision is September 9, 1996.
An additional 75-day review period is provided by law when such time is necessary to complete
the review. If you have not been notified of a final action by the initial deadline stated above,
you should consider the review period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an additional letter will be provided on
or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be
contacted by the appropriate State or Federal agency. Please contact me if you have any
questions and notify me in writing if you wish to receive a copy of my field report and/or
comments from reviewing agencies.
