Shoreline Stabilization/ Offshore Sill
1) The alignment of offshore sill and riprap revetment shall be staked by the permittee and approved by
a representative of the Division of Coastal Management within a maximum of 30 days prior to the
start of any construction.
2) The authorized offshore sill and riprap revetment shall adhere to the alignment depiumkFan the
attached workplan drawings, including the location and design of the openings designed to allZy for
movement of the aquatic organisms. NOV t a MR

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit shall be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work shall cease when the permit expires on
December 31, 2017
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS

water level.
4) The sill material shall be free from loose dirt or any pollutant. The material shall be of a size sufficient
to prevent their movement from the approved alignment by wave or current action.
5) This permit does not authorize the placement of any backfill material behind the authorized structures.
6) The temporary placement or double handling of riprap materials within waters or vegetated wetlands is
not authorized.
7) If the crossing of wetlands with mechanized construction equipment is necessary, temporary
construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed
immediately upon completion of construction.
Sedimentation and Erosion Control
8) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property.
General
10) No open water areas shall be filled outside the alignment depicted on the attached workplan drawings.
11) This permit does not grant any property rights or exclusive privileges.
12) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
13) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.

approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The pemrittee is further advised that many development or
land disturbing activities are not allowed within the Environmental Management Commission's
Tar Pamlico River Basin. Contact a representative of the Division of Water Resources at (252)
946-6481 for more information concerning allowable uses within the Tar Pamlico River Buffer.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No. SAW-

package to be complete. Items (a) - (f) are always applicable to any major development application. Please consult the application
instruction booklet on how to properly prepare the required Items below.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored
form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign
both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and
proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty
(20) days of this decision on your permit. You should also be aware that another qualified party may submit an
objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance requires
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

Project Setting
The 2.88 acre project site is located at the terminus of Tuttels Lane (96 Tuttels Lane), an
unimproved dirt path off SR 1328 on the west side of Ocracoke Village adjacent Teaches Hole
channel, Pamlico Sound, in Hyde County, North Carolina The site is developed with a small
30' x 30' single family residence and associated septic system and grassed parking area. The
residence and septic system are located on an upland ridge between two herbaceous wetland
areas. There is an area of Coastal wetlands marsh between the house and the normal water level
(NWL) and an area of marsh cutoff from regular/irregular tidal flooding on the back/landward
side of the uplands ridge developed with the residence. Both wetland areas are vegetated
similarily with black needle rush Juncus roemerianus), salt grass Distichilis S icata , salt
meadow hay S artina atens) and narrow leaf cattail (Tvnha anQustifolia). The uplands are
vegetated with lawn grasses and red cedars. The applicant also owns an adjacent undeveloped
mostly wooded upland lot ±85' x 60'. The uplands have an elevation of t2.5' to 3'above the
NWL.
The shoreline along the project site is orientated North to South and is best characterized
as a sandy estuarine beach waterward of Coastal wetlands marsh. The width of the sandy beach
fluctuates by season and can be 3' to I W wide. Sand from the nearshore area has been deposited
forming an overwash berm in the marsh. The shoreline on the adjacent property to the north has
a riprap toe revetment waterward of Coastal wetlands marsh that was constructed during the
winter in 2002. The project site shoreline has retreated ±25' landward of this riprap revetment
since its construction. The eroded shallow area on the southern end of the revetment has
vegetated with smooth cordgrass S artina alternfflora). The sandy beach landward of the toe
revetment vegetated with salt meadow hay QEtina ateonce the revetment was built. The
natural unhardened shorelines in this area experienced severe erosion during Hurricane Irene in
2011 and the subsequent persistent northerly winds that followed the Hurricane. Some
shorelines areas adjacent the project site lost as much as 30' or more to erosion during this one
storm event.
DCM staff Kevin Hart and Steve Trowell investigated the nearshore area of the project
site on 7 May 2014 to evaluate the habitat and shellfish presence. Staff observations indicated a.
sandy subtidal bottom substrate with no submerged aquatic vegetation (SAV) and with the
exception of one bay scallop, no shellfish were present within 50' of the NWL. However,
significant SAV, mainly eel grass Zostera marina and shellfish, mainly hard clams, can be
found further offshore up and down the shoreline from the entrance into Silver Lake to Springers
Point and beyond toward Ocracoke Inlet. Water depths were shallow ranging from V to 1.5'
below the NWL. There is a broad shallow shoal (f400') between the shoreline and the edge of
Teaches Hole Channel.
The Pamlico Sound adjacent to the project area is designated as Coastal Waters by the
Marine Fisheries Commission, SA HQW by the Environmental Commissionjol ATWAM0
shellfish harvest.

Project Description
The applicant proposes to stabilize the project site shoreline by constructing a granite
riprap sill, offshore the Coastal Wetland marsh and a granite riprap revetment along the upland
shoreline. The primary offshore sill will be constructed in two - 70' long sections in line with
each other with a maximum alignment 35' offshore the NWL. There will be an
opening/separation between the sections that will have a dimension of 5' wide, toe to toe, and
15'wide, crest to crest. The opening will be baffled by a secondary sill to be constructed 30'
long centered on the opening 5' landward of the primary sill. The sills will have a 9' wide base
and will have a crest 1.5' above the NWL. The project site uplands will be stabilized with a
granite riprap revetment to be placed adjacent the existing erosion escarpment with the toe of the
revetment 5' below the NWL.
Anticipated Impacts
The construction of the offshore sills system will result in the filling of 1,530 ft2 of
Pamlico Sound bottom. The riprap revetment will result in the filling of an additional 250 ft2 of
shallow Pamlico Sound bottom. The installation of the aforementioned riprap revetment will
result in the clearing of f 1,000 ft2 of uplands for a work corridor during installation. Based upon
DCM staffs site investigation, the filling impacts will not affect any significant area of SAV or
shellfish. There will be some localized short-term turbidity during placement of the granite
revetment and sills.

This memo is in reference to the Major CAMA/Dredge and Fill permit application
submitted by Mr. Galan Brown, agent for Ms. Katharine Woodwetl,, for the construction of a
offshore sill to protect an existing Coastal Wetland marsh and toe revetment to stabilize an
upland sediment bank shoreline onsite the applicant's property located at the terminus of Tuttels
Lane (96 Tuttels Lane), an unimproved dirt path off SR 1328 on the west side of Ocracoke
Village adjacent Teaches Hole channel, Pamlico Sound, in Hyde County, North Carolina. Mr.
Brown is also the heavy equipment owner/operator hired to do the riprap installation.
Staff has reviewed the project per the development standards as found in North Carolina
Administrative Code 7H.0206 and .0208 and have determined the project to be consistent baring
any significant objections from the review agencies. Although this project was never subject of a
scoping meeting, DCM staff has a thorough knowledge of the aquatic habitats present due to a
considerable amount of staff time spent permitting and monitoring shoreline stabilization along
this stretch of shoreline including Mr. Bob Toth's sill nearby (less than 200 yards to the south).
Kevin Hart, while in his position as a Fisheries Habitat Specialist, reviewed the site during a pre -
application site visit and did not find any significant impacts to fishery habitat. Staff in the
Washington Regional Office feels this project is in keeping with DENRs commitment to
promote and expedite the permitting and use of this method of shoreline stabilization. Therefore,
Staff recommends that the permit be issued and in addition to the standard conditions, please
include the following:
1). The temporary placement or double handling of riprap materials within waters or
vegetated wetlands is not authorized
2). If the crossing of wetlands with mechanized construction equipment is necessary,
temporary construction mats shall be utilized for the areas to be crossed. The temporary
mats shall be removed immediately upon completion of construction
3). The alignment of the proposed rip rap sill shall be staked by applicant for approval by
DCM Staff prior to initiating construction of the sill. REMM

Woodwell Project Narrative:
Proposed Offshore Granit Riprap Sill to extend along parallel
with shoreline located at 96 Tuttels Ln, Ocracoke N.C.. The Sill
will have a baffled opening, along with open ends to allow water to
circulate. A 50' long toe revetment will be placed onshore at the
southern end of the property. (Refer to attached drawings for
dimensions).
The property has experienced sever erosion after Hurricane
Irene in 2011. Erosion has been in excess of 15 feet. Most of the
area that has been effected was covered with natural native types
of vegetation. Satellite images from 1993 were compared to
current images(2013). The images show that NWL (Normal Water
Line) has moved over 110 feet inshore in that elapsed
time(20 years). Due to the orientation of the shore line, erosion
rates are expected to continue.
The average distance offshore for the Sill is 35 feet. The foot
print for the proposed construction has been inspected and
observed to have no SAVs (Sub -Aquatic Vegetations). It has also
been observed that no SAVs on the shore side of proposed sill.
Some SAVs have been observed on the offshore side of the sill.
Construction should have no direct impact of SAVs.
The proposed area consist of a sandy bottom with minimal if
any shellfish. No clam beds we detected and one scallop was
found.
Materials for the project will be staged in a parking area near
the dwelling onsite. Logging Mats will be utilized to minimize
impact on existing vegetations and shore lines.

The 2.88 acre project site is located at the terminus of Tuttels Lane (96 Tuttels Lane), an
unimproved dirt path off SR 1328 on the west side of Ocracoke Village adjacent Teaches Hole
channel, Pamlico Sound, in Hyde County, North Carolina The site is developed with a small
30' x 30' single family residence and associated septic system and grassed parking area The
residence and septic system are located on an upland ridge between two herbaceous wetland
areas. There is an area of Coastal wetlands marsh between the house and the normal water level
(NWL) and an area of marsh cutoff from regular/irregular tidal flooding on the back/landward
side of the uplands ridge developed with the residence. Both wetland areas are vegetated
similarity with black needle rush Juncos roemerianusl, salt grass Distichilis 5 icata , salt
meadow hay artinapatens and narrow leaf cattail (Typha anrustifolial. The uplands are
vegetated with lawn grasses and red cedars. The applicant also owns an adjacent undeveloped
mostly wooded upland lot ±85' x 60'. The uplands have an elevation of f2.5' to 3'above the
NWL.
The shoreline along the project site is orientated North to South and is best characterized
as a sandy estuarine beach waterward of Coastal wetlands marsh. The width of the sandy beach
fluctuates by season and can be 3' to IW wide. Sand' from the nearshore area has been deposited
forming an overwash berm in the marsh. The shoreline on the adjacent property to the north has
a riprap toe revetment waterward of Coastal wetlands marsh that was constructed during the
winter in 2002. The project site shoreline has retreated ±25' landward of this riprap revetment
since its construction. The eroded shallow area on the southern end of the revetment has
vegetated with smooth cordgrass artina alterni ora . The sandy beach landward of the toe
revetment vegetated with salt meadow hay Qgrtina atens once the revetment was built. The
natural unhardened shorelines in this area experienced severe erosion during Hurricane Irene in
2011 and the subsequent persistent northerly winds that followed the Hurricane. Some
shorelines areas adjacent the project site lost as much as 30' or more to erosion during this one
storm event.
DCM staff Kevin Hart and Steve Trowell investigated the nearshore area of the project
site on 7 May 2014 to evaluate the habitat and shellfish presence. Staff observations indicated a.
sandy subtidal bottom substrate with no submerged aquatic vegetation (SAV) and with the
exception of one bay scallop, no shellfish were present within 50' of the NWL. However,
significant SAV, mainly eel grass Zostera marina and shellfish, mainly hard clams, can be
found further offshore up and down the shoreline from the entrance into Silver Lake to Springers
Point and beyond toward Ocracoke Inlet. Water depths were shallow ranging from V to 1.5'
below the NWL. There is a broad shallow shoal (f400') between the shoreline and the edge of
Teaches Hole Channel.
The Pamlico Sound adjacent to the project area is designated as Co yy the

Project Description
The applicant proposes to stabilize the project site shoreline by constructing a granite
riprap sill, offshore the Coastal Wetland marsh and a granite riprap revetment along the upland
shoreline. The primary offshore sill will be constructed in two - 70' long sections in line with
each other with a maximum alignment 35' offshore the NWL. There will be an
opening/separation between the sections that will have a dimension of 5' wide, toe to toe, and
15'wide, crest to crest. The opening will be baffled by a secondary sill to be constructed 30'
long centered on the opening 5' landward of the primary sill. The sills will have a 9' wide base
and will have a crest 1.5' above the NWL. The project site uplands will be stabilized with a
granite riprap revetment to be placed adjacent the existing erosion escarpment with the toe of the
revetment 5' below the NWL.
Anticipated Impacts
The construction of the offshore sills system will result in the filling of 1,530 ftZ of
Pamlico Sound bottom. The riprap revetment will result in the filling of an additional 250 ft' of
shallow Pamlico Sound bottom. The installation of the aforementioned riprap revetment will
result in the clearing of f 1,000 ftz of uplands for a work corridor during installation. Based upon
DCM staffs site investigation, the filling impacts will not affect any significant area of SAV or
shellfish. There will be some localized short-term turbidity during placement of the granite
revetment and sills.

Woodwell Project Narrative:
Proposed Offshore Granit Riprap Sill to extend along parallel
with shoreline located at 96 Tuttels Ln, Ocracoke N.C.. The Sill
will have a baffled opening, along with open ends to allow water to
circulate. A 50' long toe revetment will be placed onshore at the
southern end of the property. (Refer to attached drawings for
dimensions).
The property has experienced sever erosion after Hurricane
Irene in 2011. Erosion has been in excess of 15 feet. Most of the
area that has been effected was covered with natural native types
of vegetation. Satellite images from 1993 were compared to
current images(2013). The images show that NWL (Normal Water
Line) has moved over 110 feet inshore in that elapsed
time(20 years). Due to the orientation of the shore line, erosion
rates are expected to continue.
The average distance offshore for the Sill is 35 feet. The foot
print for the proposed construction has been inspected and
observed to have no SAVs (Sub -Aquatic Vegetations). It has also
been observed that no SAVs on the shore side of proposed sill.
Some SAVs have been observed on the offshore side of the sill.
Construction should have no direct impact of SAVs.
The proposed area consist of a sandy bottom with minimal if
any shellfish. No clam beds we detected and one scallop was
found.
Materials for the project will be staged in a parking area near
the dwelling onsite. Logging Mats will be utilized to minimize
impact on existing vegetations and shore lines.

LUP Consistency Determination: The proposal is Consistent With & not in Conflict with the
Hyde County Land Use Plan Certified by the CRC on March 27, 2008.
Overview:
Areas of Environmental Concern (AEC) impacted by the proposal include Estuarine Water, Coastal
Shoreline, and Public Trust Area. The waters at the project site are classified as SA HQW and are
open to the harvesting of shellfish. The area is not classified as a primary nursery area.
Development within the designated AECs is limited by CAMA regulations and development
guidelines. Applicable or related policy includes the following:
"...development which meets 15A NCAC 7H use standards will be allowed estuarine
shoreline, estuarine water, and public trust areas... " (Policy 30, pg. 192)
"Hyde County supports the use of erosion control structures in estuarine shoreline
areas" (Policy 33, pg. 193)

Woodwell Project Narrative:
Proposed Offshore Granit Riprap Sill to extend along parallel
with shoreline located at 96 Tuttels Ln, Ocracoke N.C.. The Sill
will have a baffled opening, along with open ends to allow water to
circulate. A 50' long toe revetment will be placed onshore at the
southern end of the property. (Refer to attached drawings for
dimensions).
The property has experienced sever erosion after Hurricane
Irene in 2011. Erosion has been in excess of 15 feet. Most of the
area that has been effected was covered with natural native types
of vegetation. Satellite images from 1993 were compared to
current images(2013). The images show that NWL (Normal Water
Line) has moved over 110 feet inshore in that elapsed
time(20 years). Due to the orientation of the shore line, erosion
rates are expected to continue.
The average distance offshore for the Sill is 35 feet. The foot
print for the proposed construction has been inspected and
observed to have no SAVs (Sub -Aquatic Vegetations). It has also
been observed that no SAVs on the shore side of proposed sill.
Some SAVs have been observed on the offshore side of the sill.
Construction should have no direct impact of SAVs.
The proposed area consist of a sandy bottom with minimal if
any shellfish. No clam beds we detected and one scallop was
found.
Materials for the project will be staged in a parking area near
the dwelling onsite. Logging Mats will be utilized to minimize
impact on existing vegetations and shore lines.

The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development of property of Ms. Katharine R. Woodwell located off SR 1328
at the terminus of an unimproved dirt path known as Tuttels Lane on the west side of Ocracoke
Village adjacent Teaches Hole, Pamlico Sound, in Hyde County, North Carolina. It was
received on 5 August 2014, and appears to be adequate for processing at this time. The projected
deadline for making a decision is 19 October 2014. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day. Steve Trowell,
Field Representative for the Division of Coastal Management is responsible for processing your permit
and he can be reached at 252-948-3854 or via email at Steve.Trowell�cdenr. if you have any
questions.
If this agency does not render a permit decision within 70 days from the 5 August 2014,
you may request a meeting with the Director of the Division of Coastal Management and permit
staff to discuss the status of your project. Such a meeting will be held within five working days
from the receipt of your written request and shall include the property owner, developer, and
project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
