additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel

PROJECT SUMMARY: The applicant proposes to construct a handicap accessible kayak launch and fishing
pier at an existing gravel parking lot on the Cashie River.
PROJECT SETTING
The Town of Windsor has submitted a Major CAMA permit request for development on a leased
property on the Cashie River. The Town of Windsor has leased the property from Stanely Thompson for 25
years. The site has historically been utilized for fishing access during the Hickory shad migration. The lot is a
0.6 acre site north of the Town of Windsor off Hoggard Mill Road (SR 1303) downstream of the North
Carolina Division of Transportation Bridge. There is an existing gravel parking lot with no other upland
structures present. The parking lot was permitted to fill wooded wetlands in 2013 and occurred outside of
any of the North Carolina Division of Coastal Management Areas of Environmental Concern. The natural
shoreline consists of wooded wetlands comprised of cypress, black gum, and river birch with emergent plants
just water ward of Normal Water Level (NWL). At the time of the site visit there was no SAV observed at the
location of the proposed structure. The adjacent properties up and down stream are currently undeveloped
wetlands. Water depths 20' water ward of NWL are t-10'NWL.
The Cashie River is classified as C SW by the Environmental Management Commission at the project
site. The project site is located in inland waters and is designated as Anadromous Fish Spawning Area by the
North Carolina Wildlife Resource Commission.
PROJECT SETTING
The applicant proposes to construct an 18' x 24' floating kayak launch connected to a 70' x 4.75' shore
parallel fishing pier by a 25' x 5' gangway. The upper end of the fishing pier will be doubled in width to
create a 9.5' x 40' area with additional room for shad fishing. The pier will connect to the parking lot by two
walkways (50' x4.7 5' and 45' x 4.75') elevated 2.5' above the wetland substrate. In the existing gravel
parking lot, gravel will be removed to create one concrete handicap parking spot and gravel will be used to
dissipate stormwater discharge velocity into the adjacent wetlands.
ANTICIPATED IMPACTS
The project will result in localized turbidity due to the installation of pilings. The platforms and piers
will result in shading t 1,295.75flof the Cashie River bottom and 228fl of wooded wetlands.

SUBJECT: CAMA Dredge/Fill Permit Application for Town of Windsor, Bertie County,
North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the
permit application with regard to impacts on fish and wildlife resources. The project site is located off SR
1303 on the downstream side of the Hoggard Mill Road Bridge off the Cashie River near Windsor, NC.
Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S.
113A-100 through I I3A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended,
and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to construct a handicap accessible kayak launch and fishing pier at an
existing gravel parking lot by installing two walkways that extend over wetlands accessing the Cashie
River. The 18' by 24' launch will be connected to a 70' by 4.75' parallel fishing pier that is doubled in
width on the upper end to 9.5' by 40' area that allows additional room for shad fishing. One concrete
parking area will replace a gravel parking area. The Cashie River at this location is classified C SW by the
Environmental Management Commission and is designated an anadromous fish spawning area (AFSA)
by the NCWRC.
The NCWRC has reviewed the permit application and does not object to permit issuance. To
minimize impacts to anadromous fish species, we request a February 15 — June 30 moratorium be placed
on all pile driving and bottom disturbing activities within the Cashie River and inundated riparian
wetlands.

TOWN OF WINDSOR, NORTH CAROLINA
HOGGARD MILL ROAD KAYAK LAUNCH
JUL I r 2(!•;
July 9, 2014
The proposed kayak launch site is located on the Cashie River, north of the Town of Windsor. It
is on the east side of Hoggard Mill Road on the north bank of the Cashie River. The site is
neither within the Town of Windsor's corporate limits nor their E.T.J. The Town of Windsor is
very committed to providing safe shoreline fishing opportunities to the public along the Cashie
River at convenient points of access. They also want to provide boating access to the isolated
areas of the Cashie River and have chosen to promote the use of kayaks and canoes.
The Town of Windsor has a long term, 25 year lease, with the property owner, Stanley
Thompson. Following recent North Carolina Department of Transportation construction of a new
replacement bridge on Hoggard Mill Road (SR 1303), the Town cleared a small access area and
had stone placed to facilitate vehicles having off right of way parking during the peak spanning
runs of transient fish. We understand that the work performed on site has been completed under
the direction of the applicable resource agencies.
The Town of Windsor recognized the site to be very favorable for a fishing platform and a
kayak/canoe launch platform. They secured grant funding and authorized the design and
permitting phase to begin. There is an underlying mandate that all Governmental Agencies,
Stake Holders, Designers, and Resource Agencies are in complete harmony with, Handicap
Access to Recreation Facilities. The useful range of elevations possible with a floating platform
can vary dramatically from location to location. The extreme higher elevation possible on the
Roanoke River as well the upper Cashie River will cause the platform to exceed the maximum
slope for handicap use. The platform's rising is a safety feature to protect it and to avoid having
to remove the platform during the storm events that cause a water elevation rise. The higher .
elevations are accompanied by an increased risk of danger in boating and most likely will not be
used by any boaters during the extreme events.
There will be a concrete pad constructed at the southeast comer of the parking area for handicap
access to the launch and fishing pier. The access ramps, elevated walk over the 404 jurisdictional
areas will be below the thirty inches from the land surface and railings will not be required. The
pier over the public trust water will also be below the required elevation and rails will not be
provided. The structure, pilings, framing, girders, etc. will be treated wood and the decking will
be ADA approved hog slats made of concrete. The launch will be aluminum and anchored by
four wooden piling. The ramp is aluminum and pivot anchored to the end of the piling platform.
The section of pier joining the ramp will serve as a platform. The ramp will have rails. The
launch deck will have handicap bumpers on its perimeter and a handicap seat, rail and provide
fall access according to the current ADA codes.
The Cashie River at Hoggard Mill Road is historically a well used location for fishing. This is
especially true during the Spring runs of Herrings and Shad fish. The fishermen use artificial
lures and nets depending on the species in season. The castings of lures and nets require more
room than fishing with poles and natural baits. The design addresses handicap and physically
impaired access to all the facility. The access is most important during the peak use periods. The
pier has a widened section of an additional hog slat width. It is felfJ
f techniques to
be used in casting, tackle boxes, cooler, etc. that more width of thwwoou provide a better
1 L 31 2014
measure of safety and ease of use. During periods of off-peak use, the additional width will
enhance the use of chairs and stools without restricting access for other users.
There will be very limited earth disturbing activities. The impacts will be limited to construction
of the pile driving and placement of the structures to receive the hog slats. The only disturbance
in the Cashie River will be for pile driving andxlacement of the structures to receive the hog
slats. The owners are aware of the February 15 to June 30s` restrictions on construction
activities. The design has been driver to avoid the removal of trees and every attempt made to
avoid damage or removal.
The existing parking lot is considered to be an existing feature and no work is to be performed to
it other than removal of stone and placement of concrete for the handicap vehicles. The
stormwater management will be reviewed under the rules of redevelopment exclusion. There is
no additional impervious area planned. However, the points of accumulated discharge from the
parking lot to the wetlands, a stone trench will be provided as a BMP to attenuate the discharge
velocity and cause a uniform, level, overflow. The flow from the stone will then pass over the
grassed filter strip to help reinforce the site from erosion. The work will not be permitted to take
place when the site is wet or the conditions unfavorable that may lead to rutting, erosion or off -
site discharge. Silt fences and/or other devices will be employed to contain the disturbed material
on site.
There will be no slips provided nor any boat launching except boats that can be carried to the
water such as kayaks, canoes, or small boats. There will be no services provided other than
boating and fishing access.

To Whom It May Concern:
The NCDOT property adjacent to the referenced Hoggard Mill Road, SR 1303, is also classified
as an adjacent riparian ownership. As such, there is a requirement by the North Carolina Costal
Resources Commission to notify you by certified mail of a request from the Town of Windsor to
the Commission for a major CAMA permit. The permit request includes two above ground
boardwalks connecting the existing gravel parking area to a new pier in the Cashie River running
parallel to the property line. On the west side of the pier is an enlarged area to accommodate
fishing activities and nature watching. On the east side of the pier is a floating kayak launch with
one ADA slip. A site plan is attached for your review along with a copy of the permit application
and MP attachments. The Washington CAMA office will be the lead agency for the permit
request. Feel free to discuss any concerns with them. The review officer is David Moye at 252-

Date: August 7, 2014
Subject: Major Permit request by the Town of Windsor, to construct a handicap accessible kayak
launch and fishing pier, on property located on Hoggard Mill Road, adjacent to the
Cashie River, near the Town of Windsor, Bertie County, North Carolina.
LUP Consistency Determination: The proposal is Consistent With & not in Conflict with the
1998 Bertie County Land Use Plan certified by the CRC on September 8, 1999.
Overview:
Areas of Environmental Concern (AEC) impacted by the proposal include Public Trust Area and
Public Trust Shoreline. The waters at the project site are classified as C; SW and are closed to the
harvesting of shellfish. The area is not classified as a primary nursery area.
Development within the designated AECs is limited by CAMA regulations and development
guidelines. Applicable or related policy includes the following:
Estuarine Waters and Estuarine Shorelines: Page 61.
"Bertie County officials are very much aware that protection of the estuarine waters
and adjacent estuarine shorelines is of paramount importance to fishing, both
commercially and for recreation. Bertie County recognizes that certain actions
within the estuarine shoreline, which is defined as the area extending 75 feet
landward of the mean high water line of the estuarine waters, could be detrimental
to these sensitive areas and wishes to protect them.
In order to promote the quality of the estuarine waters, Bertie Count officials will
consider land use controls which protect the values of the estuarine system.
Residential, recreational, and commercial uses would also be controlled within the
estuarine shoreline, provided that:
• A significant change of pollution occurring from the development does
not exist.
• Development does not have a significant adverse impact on estuarine
resources
• Development does not significantly interfere with existing public rights
or access to, or use of, navigable waters or public resources."

Public Trust Areas: Pages 61 and 62.
"Bertie recognizes that the public has established rights to certain water areas, and
that these public areas also support commercial, recreational, and aesthetic values.
Bertie County will continue to promote reasonable conservation management
practices of Public Trust Waters. Appropriate uses include those which protect
public rights for navigation and recreation. Projects which would directly block or
impair existing navigation channels, increase shoreline erosion, deposit spoils below
mean high tide, cause adverse water circulation patterns, violate water quality
standards, or cause degradation of shellfish waters shall be discouraged.
Encouraged uses shall be those which do not cause unreasonable detriment to the
physical or biological functions of Public Trust Waters. Such uses as navigational
channels, drainage ditches, bulkheads to prevent erosion, piers, docks, marinas, and
bridges will be encouraged."

Sam Jarvis has submitted a Major CAMA application for a kayak and fishing facility on the Cashie
River in Bertie County, North Carolina
Staff has reviewed the proposed project with regard to rules found in Subchapter 7H concerning
development in Coastal Shorelines. It is staffs recommendation that the proposed project appears consistent
with 15A NCAC 07H .0208 and 15A NCAC 07H .0209 as described below.
Staff has reviewed the project, and considering the Town owns a total of 192 linear feet of shoreline, the
proposed project appears to be consistent with the rules found in 7H.0208(b)(6). In regards to (B) of this rule,
which in part states, "total square footage of shaded impact allowed shall be 8 112 per linear foot of shoreline
with a maximum of 2,000 W." There is no upland development proposed at the Town's site.
The applicants have properly notified the riparian neighbors to the project via a signed statement of no
objection and a copy of the mail receipt is provided for NCDOT. You will be sent a copy of the signed and
dated green card as proof of receipt by NCDOT once the applicants have provided them to staff. Stanley
Thompson has provided an adjacent property form indicating that he has no objection to the project and he
waives the 15' setback. If the permit is issued, staff would suggest the following conditions:

DC + TOWN OF WINDSOR, NORTH CAROLINA
HOGGARD MILL ROAD KAYAK LAUNCH
JUL 11 2014:
July 9, 2014
WARD
The higher
elevations are accompanied by an increased risk of danger in boating and most likely will not be
used by any boaters during the extreme events.
There will be a concrete pad constructed at the southeast corner of the parking area for handicap
access to the launch and fishing pier.
The
launch deck will have handicap bumpers on its perimeter and a handicap seat, rail and provide
full access according to the current ADA codes.
The access is most important during the peak use eriods. The
pier has a widened section of an additional hog slat width. It is felt that 'ques to
be used in casting, tackle boxes, cooler, etc. that more width of the pier uld provide a better
1 JUL 1 S 2014
SSCV,V-qDC.rM
measure of safety and ease of use. During periods of off-peak use, the additional width will
enhance the use of chairs and stools without restricting access for other users.
There will be very limited earth disturbing activities. The impacts will be limited to construction
of the pile driving and placement of the structures to receive the hog slats. The only disturbance
in the Cashie River will be for pile driving andxlacement of the structures to receive the hog
slats. The owners are aware of the February 15 to June 30`s restrictions on construction
The work will not be permitted to take
place when the site is wet or the conditions unfavorable that may lead to rutting, erosion or off.
site discharge. Silt fences and/or other devices will be employed to contain the disturbed material
on site.
There will be no slips provided nor any boat launching except boats that can be carried to the
water such as kayaks, canoes, or small boats. There will be no services provided other than
boating and fishing access.

Re: Adjacent Riparian Property Owners CAMA Notification
Town of Windsor Kayak Launch
SR 1303 - Hoggard Mill Road Bridge over the Cashie River
To Whom It May Concern:
The NCDOT property adjacent to the referenced Hoggard NO Road, SR 1303, is also classified
as an adjacent riparian ownership. As such, there is a requirement by the North Carolina Costal
Resources Commission to notify you by certified mail of a request from the Town of Windsor to
the Commission for a major CAMA permit. The permit request includes two above ground
boardwalks connecting the existing gavel parking area to a new pier in the Cashie River running
parallel to the property line.
The review officer is David Moye at 252-
946-6481. Please feel free to contact me with any questions or comments about the plan and
permit at the contact data in the letterhead. You do not have to respond to this notification.
Should you have questions, feel free to let us know.

Dear Mr. Castelloe:
NCDENR
Department of Environment and Natural Resources
Division of Coastal Management
15 July 2014
John E. Skvarla, III
Secretary
The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development of your property located off SR 1303 on the downstream side of
the Hoggard Mill Road Bridge of the Cashie River near the Town of Windsor in Bertie County,
North Carolina. It was received on 11 July 2014, and appears to be adequate for processing at
this time. The projected deadline for making a decision is 24 September 2014. An additional 75-
day review period is provided by law when such time is necessary to complete the review. If you
have not been notified of a final action by the initial deadline stated above, you should consider
the review period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day. Kevin
Hart, Field Representative for the Division of Coastal Management is responsible for processing your
permit and he can be reached at 252-948-3936 or via email at Kevin.H4d@!Icdenr.gov if you have any
questions.
If this agency does not render a permit decision within 70 days from the 11 July 2014,
you may request a meeting with the Director of the Division of Coastal Management and permit
staff to discuss the status of your project. Such a meeting will be held within five working days
from the receipt of your written request and shall include the property owner, developer, and
project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property, or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
