Docking Facility 8) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 9) The docking facility will display a sign showing the location of the nearest pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier(s). 10) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application and workplan drawings dated 4/2/96. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 11) The permittee must install and maintain, at his own expense, any signal lights and signals prescribed by the U.S. Coast Guard, by regulation or otherwise, on the authorized structures. Crystal Coast Tournaments Genera Permit #98-96 Page 3 of 3 12) The permittee's scheme of development, of which the authorized work is part, contemplates the presence of structures and their attendant utilities on lands subject to an easement in favor of the United States for the operation, maintenance, improvement, and enlargement of a federal channel. Accordingly, the permittee will be required to remove such structures and improvements at his own expense in the event that, in the judgement of the U.S. Army Corps of Engineers acting on behalf of the United States, the lands are needed at any time for any purpose within the scope of the easement. Permanent buildings will not be constructed Within the easement. 13) It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats. The permittee shall not hold the United States liable for any such damage. 14) This permitdoes not authorize the interference with any existing or proposed Federal Project, and the permittee shall not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. 15) No attempt will be made by the permittee to prevent the free and full use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 16) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. NOTE: The N.C. PROJECT SUMMARY: The applicant proposes to remove an existing pier, add 6 additional boat slips, and conduct maintenance excavation. A FIELD INVESTIGATION REPORT: CRYSTAL COAST TOURNAMENTS INCJCARTERET COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: Project Setting The applicant, Crystal Coast Tournaments Inc., leases a narrow strip of waterfront property which measures approximately 230' from the North Carolina Railroad located along the 600 Block of Evans Street in downtown Morehead City. There is a 90'-long pier on the property line separating the Railroad property and the adjacent tract owned by Lucky International, a seafood market company. An "L" extends off the end of the pier and extends approximately 105' in front of the Railroad property creating an artificially defined basin area. Water depths within the basin average around -5' below MLW except around the existing boat slips where the water depths average -2' below MLW. Likewise, along the landward end of the proposed slips, water depths also average -2' below MLW. This area has historically been used to dock charter boats along the waterfront. There are currently 4 slips located at the "basin" site with a 90'-long X 5'-wide boardwalk along the western end of the bulkhead. Geer Oil Company sits on the adjacent property upstream. Harbor Channel is classified SC, is not a PNA, and is closed to shellfishing. Project Description The applicant proposes to remove the existing 105' pier that runs parallel to the bulkhead, install five 20'-long X 4'-wide finger piers, drive 7 additional mooring pilings, thus creating six additional 40' slips. The applicant also proposes to extend the 5' wide boardwalk the entire 230' length of the property. In addition, prior to dock construction, the applicant proposes use a barge and clamshell crane to maintenance excavate an area measuring 10' X 185' and 25' X 45' immediately in front of the bulkhead to a depth of -5' below MLW. All construction and excavation would take place well within the established "basin" area. Anticipated Impacts Although there are currently four existing slips and a 105' "L" shaped pier at the project site, the proposed project would more formally usurp approximately 9,925 fe of Public Trust Area of Harbor Channel within Bogue Sound. However, the project would open up 4,400 ft2 of Public Trust Area that has been "semi -enclosed" by the existing "L"-shaped pier. Maintenance excavation of the areas near the bulkhead and around the existing slips would result in the removal of approximately 430 yds3 of material, affecting approximately 2,975 ftz of shallow water habitat. Major Permit Application -- Morehead City, Carteret County DATE: May 28, 1996 I have reviewed the subject application in regards to 07H.0206, .0207 & .0208 and have determined that with one exception, the proposed project is consistent with the aforementioned rules. The one exception is the absence of a statement from the riparian property owner to the East waiving the minimum 15' setback. I have contacted the applicant regarding this omission and he has assured me that the waiver would be obtained and forwarded to our office shortly. Once the waiver has been received, I have no objection to the permit being issued with the following conditions: 1) The docking facility will display a sign showing the location of the nearest pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier. 2) No sewage, whether treated or untreated, shall be discharged at any time from boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 3) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly set forth in the permit application and shown on the workplat dated 4/2/96. No other structures, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 4) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5) The authorized structures and associated activity must not cause anrunainterference with navigation. (Big Rock Marlin Tournament) leases a narrow strip of property located on the waterfront in Morehead City, in the 600 Block of Evans Street, adjacent Harbor Channel and Bogue Sound. This area of the downtown Morehead City waterfront has customarily been used to dock charter boats. The applicant proposes to remove an existing pier, add 6 additional boat slips (for a total of 10 slips), and conduct maintenance excavation. According to the applicant, the purpose of the work is to enhance the Big Rock Marlin Tournament, as well as provide additional dockage for charter boats along the Morehead City waterfront. AECs impacted by the work include Public Trust Areas and Estuarine Waters. Harbor Channel is classified as SC and is closed to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the 1991 Town of Morehead City Land Use Plan (LUP) Update and offer the following comments. (The municipal Land Use Plan is the plan of record for Morehead City and takes precedence over the Carteret County Land Use Plan, which is cited in the Field Investigation Report as being the applicable Plan.) The general area of the project is classified as Developed, while the AECs impacted by the proposed work are classified as Conservation. The LUP discusses allowed uses in Conservation classified areas on Page 73. In general, the Town agrees with the 7H Use Standards for development in AECs. Although the Town imposes certain restrictions which exceed the state 7H standards, none of these more restrictive policies appear to be applicable to this proposal. Resource Protection Policies contained in the LUP reiterate the Town's concurrence with the 7H Use Standards. Policies on Page 50 discuss the Estuarine Waters and Public Trust Areas AECs. While this section contains local policies regarding the construction of marinas in Primary Nursery Areas which exceed state standards, this policy is not applicable to this proposal. Economic and Community Development Policies for Tourism are discussed on Page 59 of the Plan. Morehead City supports efforts to promote tourism and tourism related businesses (such as fishing charters and tournaments). The Town also supports efforts to upgrade and improve the downtown waterfront district. Based on the above policies, this project appears to be consistent with and supported by the 1991 Town of Morehead City Land Use Plan, provided all state requirements can be satisfied. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following condition(s) be included in the State authorization: 1. All work authorized by this permit must be performed in strict cort(pliance with the permit plans. 2. All excavated materials will be confined landward of the mean high water (MHW) elevation contour and any regularly or irregularly flooded vegetated wetlands within adequate dikes or other retaining structures to "" prevent spillover of solids into any vegetated wetlands or surrounding waters. 3. No excavated or fill materials will be placed at any time in any vegetated wetlands or waters. 4. No vegetated wetlands will be excavated. 5. Excavation will not exceed -5 feet MLW feet below the elevation of mean low water (MLW). 6. The permittee's scheme of development, of which the authorized work is a part, contemplates the presence of structures and their attendant utilities on lands subject to an easement in favor of the United States for the operation, maintenance, improvement, and enlargement of the Atlantic Intracoastal Waterway (AIWW). Accordingly, the permittee will be required to remove such structures and improvements at his own expense in the event that, in the judgment of the U.S. Army Corps of Engineers acting on behalf of the United States, the lands are needed at any time for any purpose within the scope of the easement. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. S. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 9. It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats. The permittee will not hold the United States liable for any such damage. 10. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 11. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 12. This Department of the Army permit does not obviate the need to obtain other Federal, State, or local authorizations required by law. 13. This permit does not grant any property rights or exclusive privileges. 14. In issuing this permit, the Federal Government does not assume any liability for: a. Damages to the permitted project or uses thereof as a result of other permitted or unpermitted activities or from natural causes. b. Damages to the permitted project or uses thereof as a result of current or future Federal activities initiated on behalf of the general public. c. Damages to other permitted or unpermitted activities or structures caused by the authorized activity. d. Design and construction deficiencies associated with the permitted work. e.
