This permit issued on / / 9G is subject to compliance with the application (where consistent
with the permit), all applicable r gulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) In order to protect juvenile shrimp and fmfish populations, no excavation will be permitted
between February 15 and October 31 of any year without the prior approval of the Division of
Coastal Management, in consultation with the Division of Marine Fisheries and the Wildlife
Resources Commission.
2) All excavation will be conducted below the normal water line.
3) The temporary placement or double -handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.
4) Excavation shall not exceed 5 ft. below the elevation of mean low water (MLW).
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons.within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

5) All excavated material shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover
of solids into any marsh or surrounding water.

possible damage by people or vehicles accessing the adjacent property north of the basin.
10) The permittee shall maintain a 2' freeboard and at 2:1 ratio of discharge to holding capacity. This
can be accomplished by dredging in two phases with no greater than 700 cu. yards of dredged
material discharged into diked disposal area at any one phase.
11) A 72-hour settling period is required prior to release of effluent into the basin.
12) The activity will be conducted in such a manner as to prevent a significant increase in turbidity
outside the area of construction or construction -related discharge. Increases such that the turbidity
in the water body is 25 NTUs or less in all saltwater classes are not considered significant.
13) The exterior slopes of the disposal area dikes must be at an angle no steeper than 1 1/2 H: 1 V.
14) Appropriate erosion and sedimentation control devices, measures, or structures must be used to
prevent sediment from entering the adjacent wetlands/watercourses/property (e.g., silt fence,
diversion swales/berms, sand fence, etc.).
15) A ground cover sufficient to restrain erosion must be provided within 30 working days of
completion of any phase of grading on cut or filled slopes.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for compliance.
Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the
Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20)
days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work
initiation. The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must
be carried out in accordance with your application -Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request
that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

numbers, landmarks, and the like.
• A Stormwater Certification, if one is necessary.
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and
signed return receipts as proof that such owners
have received a copy of the application and plats
by certified mail. Such landowners must be advised
that they have 30 days in which to submit continents
on the proposed project to the Division of Coastal
Management. Upon signing this form, the applicant

Dear Sir:
Reference your application for a Department of the Army (DA) permit to
undertake maintenance dredging activities within an existing boat basin and
access channel into Blounts Bay, located off State Road 1217, Colington
Island, Dare County, North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. 198000291. Therefore,
you may commence construction activity in strict accordance with applicable
State authorization and the enclosed plan. Failure to comply with the State
authorization or conditions of the general permit could result in civil and/or
administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action
is necessary as revised plans must be reviewed and the authorization modified.

I have reviewed your February 14, 1996 dredging extension request with resource
specialists within both DCM and DMF. After careful consideration of the various agency
opinions I have concluded you have a compelling need for a dredging period extension.
Therefore, I hereby authorize the extension of the dredging season to midnight February 29,
1996 for the projects permitted by CAMA Permits #10-96, #11-96 and #18-96. Any dredging
period extension beyond this date will be water temperaturelbiological activity dependent.
A copy of this authorization should be attached to each of the affected permits. All other
conditions, notes and deadlines remain in effect.

Although submerged aquatic vegetation exists in the basin to be dredged, it has been severely
impacted by prop scour from boat traffic due to the shallow waters. It appears that the overall
impact on SAV's would be insignificant. There is also documentation that two previous permits
have been issued for maintenance dredging at this site. I would like to recommend approval of
the request with the following conditions:
1) In order to protect juvenile sh 'mp and finfrsh populations, no excavation will be
permitted between February and October 31st of any year without the prior
approval of the Division of Coastal Management, in consultation with the Division
of Marine Fisheries_a _.s
3 2) The temporary placement of double -handling of excavated or fill materials within
waters or vegetated wetlands is not authorized.
S 3) All excavated material shall be confined above mean high water and landward of
regularly or irregularly flooded marsh behind adequate dikes or other retaining
structures to prevent spill -over of solids into any marsh or surrounding water.
Y\ 4) No excavated or fill material will be placed at any time, in any marsh or
surrounding waters, outside the alignment of the fill area indicated on the
workplat.
5) All excavation will be conducted below the normal water line.
6) The terminal end of the influent pipe will be positioned at or greater that 50' from
any part of the dike and a maximum distance from the spillway to allow settlement
of suspended solids.

7) A water control structure shall be installed at the intake end of the effluent pipe
to assure compliance with water quality standards.
C� 8) Adequate provisions will be taken to assure that the influent/ effluent pipe is
protected from possible damaged by people or vehicles accessing the adjacent
property (north of the basin).
9) The spoil will be properly graded and provided with a ground cover sufficient to
prevent erosion within 30 working days of the project completion.

The following comments by the North Carolina Division of Marine Fisheries are
provided pursuant to General Statute 113-131.
Blounts Bay functions as a nursery area for spot, croaker, flounder, weakfish, blue
crabs, shrimp and other commercially and recreationally important species. Extensive blue
crab shedding operations exist throughout the area, as well as commercial and recreational
fisheries.
The Division is concerned with the impacts to 16,585 sq. ft. of shallow water habitat,
even though this is maintenance dredging. Significant turbidity will result from the dredging,
which could impact fish and invertebrates in the area. Depending on the time of dredging
soft crab shedding operations could also be impacted due to turbidity. The proposed depth of
the basin and channel (-5' NWL) should not exceed the connecting depth in Blounts Bay.
This agency requests a dredging moratorium associated with the maintenance excavation.
The requested time frame is 15 February through 30 September. This will ensure the
environmental integrity of the area is protected during critical times of usage by the
previously mentioned species.
This agency is concerned with the loss of SAV's that will result from this project.
The importance of SAV's to fintish and invertebrate production and serving as habitat is well
documented. The effects of the dredging on the SAV's needs to be determined. An
assessment of the SAV's should be made prior to excavation, with semi-annual surveys
conducted on the re-establishment in the area. This should be monitored for up to 5 years.
Every effort should be made to avoid impacts to SAV's.

adjacent to coastal wetlands. Extreme caution must be taken to ensure that no fill is placed

Staff biologists with the Wildlife Resources Commission have completed a review of the
project with regards to associated impacts on wildlife and fishery resources in the area. A site .
visit was conducted on October 11, 1995. Our comments are provided in accordance with
provisions of the Coastal Area Management Act (G. S. 113A-100 through 113A-128), and the
Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to maintenance dredge an 11,485 ft2 man-made basin, and a 5,100
ftZ channel into Blount's Bay. The project will produce approximately 1,000 cubic yards of spoil
material that will be disposed of onsite. Waters at the project site are classified as SC and are
closed to shellfishing. There are extensive areas of submerged aquatic vegetation (SAV) at and
adjacent to the project site.
The Division of Coastal Management has determined that the project will have a
significant impact on submerged aquatic vegetation (SAVs) at the project site. Widgeon -grass
and Eurasian water-milfoil are located around the perimeter of the basin, and in the existing
channel.

Dredging will adversely effect water quality by significantly increasing turbidity. Because
of the direct removal of submerged aquatic vegetation during the project, and the potential to
significantly increase turbidity, we request that a dredge moratorium be implemented from March
1 to September 30. Impacts to fishery resources may be minimized if work is prohibited during
this critical spawning and rearing period. If the moratorium is considered unacceptable then a silt
boom should be installed across the mouth of the basin prior to dredging and remain for 72 hours
after dredging is completed.
Construction of the spoil disposal site should be adequate to insure no sediment entry into
adjacent wetlands. A water shut-off valve should be included, and should remain closed while the
sediment/water slurry is pumped into the spoil disposal area. In order to allow settling of
suspended sediments, the shut-off valve should remain closed for a minimum of 72 hours before
release of effluent water into Blounts Bay.

Dear Mr. Parker:
Reference the application of the Dare County -Oregon Inlet Waterway
Commission/Perry-Nunemaker for a Department of the Army permit to undertake
maintenance dredging activities within an existing boat basin and access
channel into Blounts Bay, located off State Road 1217, Colington Island,
Dare County, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following condition(s) be included in the State
authorization:
Y 1. All work authorized by this permit must be performed in strict
compliance with the permit plans.
2. All excavated materials will be confined landward of the mean
-' high water (MHW) elevation contour and any regularly or irregularly flooded
vegetated wetlands.
3. All excavated materials will be confined landward of the mean
high water (MHW) elevation contour within adequate dikes or other retaining
structures to prevent spillover of solids into any vegetated wetlands or
surrounding waters.
4. The terminal end of the pipeline from the dredge into the diked
retention area will be positioned at or greater than 50 feet from any part
of the dike and a maximum distance from spillways to prevent dike erosion
and to allow adequate settlement of suspended solids.
5. A water control structure will be installed at the intake end of
the effluent pipe leading from the retention area in order to ensure maximum
settlement of suspended solids.
6. Flow from the diked retention area will be confined by pipe,
trough, or similar device to a point at or below the mean low water (MLW)
elevation contour to prevent gully erosion and siltation.

7. No excavated or fill materials will be placed at any time in any
vegetated wetlands or waters.
B. Excavation activity shall not exceed 5 feet below the elevation
of mean low water (MLW).
V, 9. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.
10. The permittee will maintain the authorized work in good condition
and in conformance with the terms and conditions of this permit. The
permittee is not relieved of this requirement if he abandons the permitted
activity without having it transferred to a third party.

a significant increase in turbidity outside the area of construction or

MAINTENANCE DREDGING:
The work authorized herein includes periodic maintenance which may be
performed for ten years from the date of issuance of this permit provided:

b. The proposed area to be dredged, method of dredging and disposal of
dredged material will be in strict accordance with that authorized by this
permit.

Carolina. Your receipt of this letter verifies your acceptance of a valid
request for certification in accordance with Section 325.2(b)(ii) of our
administrative regulations.
We are considering authorizing the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification is required under the provisions of Section 401 of
the same law. A Department of the Army permit will not be granted until
the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases,
60 days after receipt of a request for certification is a reasonable time
for State action. Therefore, if you have not acted on the request, or
asked for an extension of time, by November 30, 1995, the District
Engineer will deem that waiver has occurred.

Site Description
The proposed dredge project is located adjacent to State Road 1217 on Blounts Bay,
Colington Island, Dare County. The channel and basin to be dredged accesses a commercial
seafood business known as Colington Crab Company (formerly Nunemaker Seafood). The
basin measures 210' from its head to Blounts Bay, is an average of 55' in width and
approximately 3.1' in depth (below the normal water line). The basin is lined with docks and
bulkheads, and has no open shoreline. Located behind the bulkhead along the southeast edge
of the basin is Common Reed (Phragmites communis) and Big Cordgrass S artina
cynosuroides). The existing channel, included in the dredging project, averages 4' below the
normal water level (NWL) and will extend 170' from the mouth of the basin into Blounts
Bay.
Field investigation of the basin revealed thick mats of submerged aquatic vegetation (SAV's)
along the perimeter of the basin, with lesser amounts towards the middle of the basin.
Changes in the density of the SAV's is probably due to boat traffic. Evidence of SAV's are
apparent in the channel where dredging is also proposed. Both Widgeon -grass (RuI212is
maritima and Eurasian Water-milfoil (Myriophyllum s icatum) can be found in both the
basin and the channel.
The property located to the north of the basin is owned by Vernon Perry. Adjacent to the
docks on the Perry side of the basin is a net house, crab shedders, two dwellings and a single
wide mobile home (landward of the project site). Located along the southern edge of the
basin is the Nunemaker property, upon which a large cinder block building is situated which
houses the Colington Crab Company. A spoil disposal site is proposed on the Nunemaker
property in front of the fish house, adjacent to Colington Road. Located to the north of the
spoil site is a section of coastal wetlands consisting primarily of Big Cordgrass S artina
cynosuroides) and Black Needlerush Juncus roemerianus). Currently located on the property
in the area of the spoil site is a dump consisting of vehicles and scrap metal. A private road
is located to the front of the fish house between the spoil site and the basin, which accesses
the dwelling units situated on the Perry property to the north of the project site.
Proposed Development
The applicant, Dare County, proposes to hydraulically dredge an 11,485 square foot man-
made basin and a 5100 square foot channel (170'x 30') in Blounts Bay. The proposed depth
for both the basin and the channel is 5' below the NWL. The basin averages 3.1' below
NWL and the channel averages 4' below NWL. Existing water depths and the connecting
depth were verified during a site visit with the applicants agent. The project will produce
between 996 an 1002 cubic yards of spoil material that will be placed in a bermed disposal
site on the Nunemaker property. The holding capacity of the retention area is estimated by
the applicant to be 1,912 cubic yards,

while staff calculations indicate that the disposal area will have a holding capacity of 1,422
cubic yards spoil of material. It is apparent from both calculations that the disposal site is
sufficient to retain the spoil material from the dredge project. The proposed depth of the
bermed spoil site is 8', for the purpose of determining the holding capacity a 6' depth was
used to assure adequate retention of the spoil material.
The proposed spoil site will be confined to a high ground area adjacent to a coastal wetland
marsh. Influent and effluent pipes will be use to transfer dredge material from the basin and
channel to the disposal site on the Nunemaker property. The pipe will be placed over an
unimproved road located between the basin and the spoil site. The road in question serves as
the only access to three residences on the Perry property. Once suspended solids have settled
the water will be returned to the basin in a manner as to prevent the reentry of sediment into
the basin.
Anticipated Impacts
It is anticipated that 11,485 square feet of shallow water habitat will be impacted by the
dredging project. Localized turbidity will occur during dredging, but should actually reduce
the current high rates of turbidity that result from heavy boat traffic in and out of the shallow
water basin. Field investigation revealed that high rates of turbidity occur on a day to day
basis as a result of the build-up of fine silt in the basin and channel.
There will be a significant impact on Widgeon -grass and Eurasian Water-milfoil located
around the perimeter of the basin and, to a lesser degree, in the existing channel. It should
be noted that the heavy matting around the perimeter of the basin occurs, in part, as a direct
result of boats churning up the vegetation in the shallow water and depositing it along the
perimeter of the basin.
Two previous permits have been issued for dredging projects along the basin and channel in
question. A permit was issued to Dare County in 1982 (#98-82) to dredge a channel in
Colington Bay and a connecting channel to what was then Nunemaker Seafood. A second
permit was issued in 1983 (#41-83) to maintenance dragline the basin to a depth of 6' below
the normal water level.
A concurrent application has been submitted on the behalf of Dare County to dredge a basin,
canal and channel adjacent to A&B Seafood along Dog Point Creek.
CAMA REVIEW
Blounts Bay is classified as "Joint Waters" by the Wildlife Resource Commission and Marine
Fisheries, while water quality in the project area is classified as SC by the Division of
Dare County/OIWC/ Perry-Nunemaker

Environmental Management. No primary or secondary nursery is located in or near Blounts
Bay. The project site is located in public trust water (PT) and estuarine water (EW), and as
such is in an area of environmental concern.
No unique remnant species, geologic formations or archeological sites are known to be
associated with this site. Submerged aquatic vegetation is evident within the area to be
dredged, as noted under anticipated impacts.
The 1994 Dare County Land Plan classifies unincorporated areas located in CAMA AEC's,
such as public trust and wetlands, as "Conservation". The purpose of the Conservation class
is to provide for the long term management and protection of significant, limited or
irreplaceable areas. The high ground area is classified as "Limited Transition". The purpose
of the Limited Transition Class is to provide for developed areas that will have some
services, but are suitable for lower densities in areas that are geographically remote from
existing towns and municipalities. Dare County advocates routine maintenance of all existing
navigable channels and will work to secure permit authorization whenever possible (p.89).
The county also supports the preservation and protection of the publics right to access and
use public trust waters (p.54).

Major Development and State Dredge and Fill permit to carry out construction on property
located adjacent Colington Crab Company and SR1217, Colington Island, in Dare County.
Although processing of the application is nearing completion, additional time is needed for this
office to complete the review and make a decision on your request. Therefore, it is necessary
that the standard review time be extended. An additional 75 days is provided by G.S. 113A-
122(c) which would make January 16, 1996 the new deadline for reaching a decision on your
request. However, we expect to teak ace oh n prior to that time and will do so as soon as

The Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of your property located Adjacent Colington Crab
Company and SR 1217, Colington Island, Dare County, Blounts Bay. It was received on
September 20, 1995, and appears to be adequate for processing at this time. The projected
deadline for making a decision is December 4, 1995. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of
the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard
which must be posted at the property of your proposed development. You should post this
notice at a conspicuous point along your property where it can be observed from a public
road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a
private road would lead one into your property. Failure to post this notice could result in an
incomplete application.
An onsite inspection will be made, and if additional information is required, you will
be contacted by the appropriate State or Federal agency. Please contact me if you have any

Site Description
The proposed dredge project is located adjacent to State Road 1217 on Blounts Bay,
Colington Island, Dare County. The channel and basin to be dredged accesses a commercial
seafood business known as Colington Crab Company (formerly Nunemaker Seafood). The
basin measures 210' from its head to Blounts Bay, is an average of 55' in width and
approximately 3.1' in depth (below the normal water line). The basin is lined with docks and
bulkheads, and has no open shoreline. Located behind the bulkhead along the southeast edge
of the basin is Common Reed (Phragmites communis) and Big Cordgrass S artina
cynosuroides). The existing channel, included in the dredging project, averages 4' below the
normal water level (NWL) and will extend 170' from the mouth of the basin into Blounts
Bay.
Field investigation of the basin revealed thick mats of submerged aquatic vegetation (SAV's)
along the perimeter of the basin, with lesser amounts towards the middle of the basin.
Changes in the density of the SAV's is probably due to boat traffic. Evidence of SAV's are
apparent in the channel where dredging is also proposed. Both Widgeon -grass (Ruppis
maritima and Eurasian Water-milfoil (MyrioQhyllum s icatum) can be found in both the
basin and the channel.
The property located to the north of the basin is owned by Vernon Perry. Adjacent to the
docks on the Perry side of the basin is a net house, crab shedders, two dwellings and a single
wide mobile home (landward of the project site). Located along the southern edge of the
basin is the Nunemaker property, upon which a large cinder block building is situated which
houses the Colington Crab Company. A spoil disposal site is proposed on the Nunemaker
property in front of the fish house, adjacent to Colington Road. Located to the north of the
spoil site is a section of coastal wetlands consisting primarily of Big Cordgrass S artina
cynosuroides) and Black Needlerush Juhcus roemerianus). Currently located on the property
in the area of the spoil site is a dump consisting of vehicles and scrap metal. A private road
is located to the front of the fish house between the spoil site and the basin, which accesses
the dwelling units situated on the Perry property to the north of the project site.
Proposed Development
The applicant, Dare County, proposes to hydraulically dredge an 11,485 square foot man-
made basin and a 5100 square foot channel (170'x 30') in Blounts Bay. The proposed depth
for both the basin and the channel is 5' below the NWL. The basin averages 3.1' below
NWL and the channel averages 4' below NWL. Existing water depths and the connecting
depth were verified during a site visit with the applicants agent. The project will produce
between 996 an 1002 cubic yards of spoil material that will be placed in a bermed disposal
site on the Nunemaker property. The holding capacity of the retention area is estimated by
the applicant to be 1,912 cubic yards,

while staff calculations indicate that the disposal area will have a holding capacity of 1,422
cubic yards spoil of material. It is apparent from both calculations that the disposal site is
sufficient to retain the spoil material from the dredge project. The proposed depth of the
bermed spoil site is 8', for the purpose of determining the holding capacity a 6' depth was
used to assure adequate retention of the spoil material.
The proposed spoil site will be confined to a high ground area adjacent to a coastal wetland
marsh. Influent and effluent pipes will be use to transfer dredge material from the basin and
channel to the disposal site on the Nunemaker property. The pipe will be placed over an
unimproved road located between the basin and the spoil site. The road in question serves as
the only access to three residences on the Perry property. Once suspended solids have settled
the water will be returned to the basin in a manner as to prevent the reentry of sediment into
the basin.
Anticipated Impacts
It is anticipated that 11,485 square feet of shallow water habitat will be impacted by the
dredging project. Localized turbidity will occur during dredging, but should actually reduce
the current high rates of turbidity that result from heavy boat traffic in and out of the shallow
water basin. Field investigation revealed that high rates of turbidity occur on a day to day
basis as a result of the build-up of fine silt in the basin and channel.
There will be a significant impact on Widgeon -grass and Eurasian Water-milfoil located
around the perimeter of the basin and, to a lesser degree, in the existing channel. It should
be noted that the heavy matting around the perimeter of the basin occurs, in part, as a direct
result of boats churning up the vegetation in the shallow water and depositing it along the
perimeter of the basin.
Two previous permits have been issued for dredging projects along the basin and channel in
question. A permit was issued to Dare County in 1982 (#98-82) to dredge a channel in
Colington Bay and a connecting channel to what was then Nunemaker Seafood. A second
permit was issued in 1983 (/i41-83) to maintenance dragline the basin to a depth of 6' below
the normal water level.
A concurrent application has been submitted on the behalf of Dare County to dredge a basin,
canal and channel adjacent to A&B Seafood along Dog Point Creek.
CAMA REVIEW
Blounts Bay is classified as "Joint Waters" by the Wildlife Resource Commission and Marine
Fisheries, while water quality in the project area is classified as SC by the Division of
Dare County/OIWC/ Perry-Nunemaker

Environmental Management. No primary or secondary nursery is located in or near Blounts
Bay. The project site is located in public trust water (PT) and estuarine water (EW), and as
such is in an area of environmental concern.
No unique remnant species, geologic formations or archeological sites are known to be
associated with this site. Submerged aquatic vegetation is evident within the area to be
dredged, as noted under anticipated impacts.
The 1994 Dare County Land Plan classifies unincorporated areas located in CAMA AFC's,
such as public trust and wetlands, as "Conservation". The purpose of the Conservation class
is to provide for the long term management and protection of significant, limited or
irreplaceable areas. The high ground area is classified as "Limited Transition". The purpose
of the Limited Transition Class is to provide for developed areas that will have some
services, but are suitable for lower densities in areas that are geographically remote from
existing towns and municipalities. Dare County advocates routine maintenance of all existing
navigable channels and will work to secure permit authorization whenever possible (p.89).
The county also supports the preservation and protection of the publics right to access and
use public trust waters (p.54).
