1) This renewal shall be attached to Permit No. 26-14, which was issued to the permittee on 3/24/14, as
well as all subsequent modifications, refinements, and renewals, and copies of all documents shall be
readily available on site when a Division representative inspects the project for compliance.
2) All conditions and stipulations of the active permit remain in force under this renewal.
NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No.
13-1280 v2.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project SAW Action Id. No.
2017-01996.
NOTE: A permit renewal application processing fee of $100 was received by DCM for this project.
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

Please accept this letter as a request for extension of the referenced Permit. This Permit was first
issued on March 24, 2014. It received a Letter of Refinement on April 8, 2015; it was issued a
Major Modification on November 13, 2017, which extended the Permit to December 31, 2020. It
subsequently received a Minor Modification on May 6, 2019.
While a substantial amount of the work authorized by this Permit has been completed, and is
ongoing, it will not be possible to complete the work prior to the expiration of the Permit.
Development activity, now resumed, underwent a hiatus following the unfortunate death of Mr.
Thomas A. N. Miller, the Managing Member of the LLC. His surviving spouse, Catherine
Miller, has subsequently replaced Mt. Miller as the Managing Member of the LLC. Updated
Agent Authorization Forms are enclosed with this letter.
Approximately 600-ft of shoreline protection remains to be completed along the Perquimans
River at the northwest extreme of the properties, and approximately 450-ft of shoreline
protection remains to be constructed along Suttons Creek, which was the subject of the most
recent Minor Modification to the Permit. Construction of the four docking facilities along the
shoreline remains to be completed.
An onsite observation of the shoreline was conducted on November 20, 2020, and all work
appears to be in compliance with all conditions of the Permit.
We respectfully request that a two-year extension of this Permit be issued.

Shoreline Stabilization -Rio Rap
1) Unless specifically altered herein, this Major Modification authorizes the modification from the
previously authorized bulkhead to rip rap, all as expressly and specifically set forth in the attached
pemut application, project narrative, and workplan drawings. Any additional development activities
may require a modification of this permit.
2) The alignment of the toe of rip rap shall not exceed the alignment as depicted in the attached permit
application and workplan drawings.

ADDITIONAL CONDITIONS
3) The alignment of the authorized rip rap shall be staked by the permittee and verified by a representative
of the Division of Coastal Management within a maximum of 30 days prior to the start of construction.
4) Rip rap shall consist of clean rock or masonry materials such as, but not limited to, granite, marl, or
broken concrete. It shall be of a size sufficient to prevent its movement from the approved alignment by
wave or current action. The pern ittee shall be responsible for immediate removal of any materials that
become dislodged or move outside the authorized alignment.
Sedimentation and Erosion Control
5) An Erosion and Sedimentation Control Plan modification may be required for this project. If required,
this plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity.
Submit this plan to the Division of Energy, Mineral and Land Resources, Land Quality Section, 943
Washington Square Mall, Washington, NC 21889.
Docking Facility Relocation
6)* This permit authorizes only the docking facility relocation identified as Proposed Pier 1 on the attached
workplans, and uses located in or over the water that are expressly and specifically set forth in the
permit application. No other structure, whether floating or stationary, shall become a permanent part of
this marina/docking facility without permit modification. No non -water dependent uses of structures
shall be conducted on, in or over Public Trust waters without permit modification.
7) This permit does not authorize any additional formalized boat slips.
8) The relocated pier and associated structures shall have a minimum setback distance of 15 feet between
any parts of the structure and the adjacent property owner's riparian access corridor.
General
10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
11) This Major Modification shall be attached to the original Permit No. 26-14, which was issued on
3/24/14, and copies of both documents must be readily available on site when Division personnel inspect
the project for compliance.
12) All conditions and stipulations of the active permit remain in force, under this Major Modification,
