Any violation of these terms may )e suojecr to Imes, imprisonment or Civil aCr1011; or slay cause ulc pcnnu w uc uun an" VUIU. 1) Unless specifically altered herein, this Minor Modification authorizes the placement of an additional 450 linear feet of rip rap at the southern terminus of the existing bulkhead and extending up Suttons Creek, all as expressly and specifically set forth in the attached letter and workplan drawings. Any additional development activities may require a modification of this permit. 2) The alignment of the toe of rip rap shall not exceed the alignment as depicted in the attached workplan drawings. 3) No vegetated wetlands shall be filled, even temporarily. (See attached sheet for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit No. 26-14 Page 2 of 2 ADDITIONAL CONDITIONS 3) In order to satisfy concerns of the resource agencies, all woody debris, such as tree trunks and limbs, shall remain in place outside of the authorized rip rap alignment. 4) The alignment of the authorized rip rap shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. 5) The rip rap shall consist of clean rock or masonry materials such as, but not limited to, granite, marl, or broken concrete. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. General 6) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 7) This Minor Modification shall be attached to the original Permit No. 26-14, which was issued on 3/24/14, as well as all subsequent modifications, refinements, and renewals, and copies of all documents must be readily available on site when Division personnel inspect the project for compliance. 8) All conditions and stipulations of the active permit remain in force unless specifically altered herein. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252-264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level or landward edge of any coastal wetlands, whichever is more restrictive. NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW- 2017-01996. NOTE: The N.C. Division of Water Resources has authorized the proposed project under General Water Quality Certification No. 4175 (DWR Project No.13-1280 V3), which was issued on 4/15/19. Newbold Miller, LLC, to seek a modification to the referenced Permit for erosion protection of a section of the Suttons Creek shoreline through placement of riprap. The development is located at the confluence of Sutton Creek with the Perquimans River, commencing at the southern terminus of the existing bulkhead, and extending for approximately 450-ft up the shoreline of Sutton Creek. The Miller site is located at the terminus of Bundy Road in Perquiman County. Please accept this letter as the written request required under 15A NCAC 07J.0405(a) to modify the terms of the referenced Permit. This modification request seeks authorization for the development to place riprap shoreline protection along an escarpment that is elevated above the Normal Water Level (NWL) a distance ranging from 4-ft to 14-ft, with most of the escarpment approximately 8-ft to 12-ft above NWL. To minimize disturbance of existing trees along the upland portions of the shoreline adjacent to the escarpment, the intent is to place the riprap against the existing escarpment, to a height of approximately 6-ft above NWL, with minimal, or no disturbance of the escarpment that extends above the 6-ft height. Because the lateral distance between the bottom of the escarpment and the NWL varies over this length of shoreline, the toe of the riprap will in places terminate landward of the NWL and in other places extend beyond the NWL. This modification request seeks authorization to place the toe of the riprap up to 10-ft waterward of NWL where needed to maintain an appropriate slope for the riprap, which is intended to vary between 1:1.5 and 1:3, depending on the specific terrain. This modification request does not seek to place riprap waterward of any wetlands. Please find enclosed a drawing that depicts the section of Sutton Creek shoreline for which riprap erosion protection is requested. The shoreline does not seem to show much sign of erosional forces but, as long as the rip - rap does not end up as fill in the hardwood wetland complex along the shoreline I am ok with the proposed alignment. I would add however than any tree removal along the shore should be avoided as the shaded area does provide some thermal and light refuge in the shallow water. The shoreline along the main river is devoid of any canopy and the shoreline hardening has removed most of the fish habitat of any quality; that situation should be avoided along the shoreline of the tributary on the property. Newbold Gregg, I have looked at the information provided by Mr. Sampson and understand that DWR and USACE have approved the wetland alignment. However, I do not see the erosion stated to be on site. The efforts made to avoid and minimize wetland fill is appreciated, but I do not see the demonstration of erosion on the shore and have concern that "stabilization" activities will compromise the shoreline — with regard to both waterward wetlands and wildlife habitats. I agree with Shane that if riprap is allowed to be installed, that it remains completely outside any wetland features, that shoreline trees remain for bank stability, thermal regulation, and overall aquatic and terrestrial wildlife habitat opportunities. These areas provide a myriad of benefits for the riparian area and removal or detriment to their overall function should be avoided. If stabilization measures need to be made, consideration should be given to location of BUA on the lots. The shoreline appears to be that of a typical, stable creek system. Overall I do not believe an elevated erosion rate has been demonstrated on the property and that the installation of riprap, especially adjacent the hardwood wetland complexes, will diminish habitat quality. This was our position on another project for areas similar to these hardwood wetlands along Middleton Creek. The proposal does not however appear to place riprap directly in wetlands. Maria Maria T. The original permit authorized 6,013' of bulkhead, four pier structures (each with a finger pier, platform boatlift and boathouse), and the reconstruction of a pre-existing pier and platform with a lift. The site is located at the end of Bundy Road, adjacent to the Perquimans River, in Perquimans County. 2. The applicant received a "Refinement" on April 8, 2015, authorizing the installation of a culvert through the approved bulkhead with a riprap apron on the waterward side (south of the dwelling), and the installation of a riprap swale and culvert north of the dwelling. 3. There are some areas in the provide pictures where there is clearly an escarpment and a revetment would not be an issue but there are other sections where it appears there is a substantial wetland fringe (cypress and gum) that would be filled along the shoreline. The living trees along the shoreline and the habitat provided by the root complexes are great fisheries habitat I would like to see avoided. There are some areas in the provide pictures where there is clearly an escarpment and a revetment would not be an issue but there are other sections where it appears there is a substantial wetland fringe (cypress and gum) that would be filled along the shoreline. The living trees along the shoreline and the habitat provided by the root complexes are great fisheries habitat I would like to see avoided. Let me know when you want to meet, and the proposed topics for discussion/identification. Are you intending that we stake the maximum extent of the riprap along this shoreline section? So far, you have not indicated what additional information is needed from the applicant. If the applicant is prepared to construct all riprap landward of the wetlands (in this case, largely cypress tree roots) what is there to discuss? If DWR objects to the riprap design, which meets use standards for riprap and is quite standard for this type of shoreline protection, can they at least enunciate what they would like to see changed? If they do not want any shoreline protection at all, then the escarpment will continue to erode, with the result being the continued deposit of upland material within the wetlands, which will raise the elevation in the wetlands and further limit the area for a wetland fringe to develop and expand along this upland/water interface. I have encouraged the applicant to pursue the use of riprap, rather than a bulkhead for shoreline protection wherever possible, which is in accordance with one of the State's comments provided when the lengthy shoreline bulkhead Permit application was submitted. The applicant is very sensitive to preserving existing tree/root systems, and is envisioning a shoreline protection mechanism that will minimize/eliminate any such impacts of concern to DWR. A. Newbold Miller Major Permit (Minor Modification). There are 37 stakes, with one end of the alignment beginning at the existing bulkhead — so a total of 38 points (0— 37). 1 have also taken a good number of pictures to assist in your evaluation of the alignment. These pictures take up quite a few megs, so I will send 6 separate emails to attach them. I am also attaching spreadsheet that lists the various photos by riprap stake number (R/R #), and this gives some'orientation as to the location the photo was taken from and the R/R stakes visible in the photo. I am also attaching a revised Permit drawing on which I have plotted the stakes for the riprap toe on the Permit drawing. I also placed a representation of the approximate wetland limits on the drawing. This is not a delineation, and not exact, and was based on observations, refreshed with viewing the photos. I placed the riprap stakes landward of where I believed the wetland line would be called. Most are well landward, but some get a little closer due to the high escarpment immediately adjacent.
