be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) The marina will display a sign showing the location of the onsite pumpout facility, and other
appropriate waste disposal information, at the entrance and exit from the main pier.
2) No sewage, whether treated or untreated, shall be discharged at any time from the marina. Any
sewage discharge at the marina shall be considered a violation of this permit for which the
permittee is responsible. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
3) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly set forth in the permit application and shown on work plan #3 of 4 dated
8/9/95. No other structures, whether floating or stationary, may become a permanent part of this
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the

branch of Whittaker Creek by constructing 4 additional boat slips.

9. NARRATIVE DESCRIPTION:
Project Setting
The applicant owns Deaton Yacht Service, Inc. a full service marina located on
1.4 acres of land at 200 Neuse Drive on Tarpon Canal and Whittaker Creek in the
Town of Oriental, Pamlico County, North Carolina. The marina is located
approximately 750' from the mouth of the western branch of Whittaker Creek. The
boatyard and marina currently has 23 boat slips (the exact number depends on the
length of the boats docked parallel to the Tarpon Canal bulkhead dock) of which all but
5 are located along the southern bank of Tarpon Canal. These five slips are located
near the mouth of Tarpon Canal immediately north of an existing travel lift along the
west bank of Whittaker Creek. An office building, a work shed, a graveled parking
lot, and a graveled work yard are also on the site. Directly across Tarpon Canal and
immediately upstream on Whittaker Creek is Sail Craft Marina, an approximate 35-slip
marina. Immediately downstream from the site on Whittaker Creek is Whittaker Creek
Yacht Harbor, a 160-slip marina. Deaton Yacht Services currently provides two on -
site sewage pumpout facilities. The marina also enforces a locked head policy and
there are no fuel sales on the site.
Most of the tract is high ground and developed as described above except for
approximately 4,400 ftz of coastal wetlands dominated by Spartina cynosuroides and
Juncus roemerianus along the southeastern edge of the property. Water depths in the
proposed expansion ranges from -3' to -5.8' below normal water level (NWL).
Tarpon Canal and Whittaker Creek are classified as SA NSW waters, are designated
Primary Nursery Areas, and are closed to shellfishing.
Project Description
The applicant proposes to expand the existing 23-slip marina by constructing an
additional 4 slips out into the western branch of Whittaker Creek immediately
downstream of the existing travel lift. The four slips would be added by constructing a
6'-wide access walkway from the travel lift that would run along the shoreline for
approximately 100' and then would turn perpendicular to Whittaker Creek and extend
out into Whittaker Creek a total of 80'. Thirty feet from the landward end of this
dock, a 75'-long dock would extend to the north and run parallel with Whittaker and
would utilize two finger piers and six mooring pilings to create the four 15' X 45'
slips. Each finger pier would be 4' wide and 15' long, and would taper down to 1.5'
in width at the waterward end. The northernmost slip would extend 103' out into
Whittaker Creek and would extend approximately 25' to 30' beyond the end of the

existing travel lift. The project would extend to one third the width of the creek. In a
Draft Environmental Assessment, the applicant has stated that the backside and outside
areas of the walkways/docks could provide temporary dockage for an additional 4
boats.
Anticipated Impacts
The actual footprint of the project which includes the docks, finger piers, and
formal slips would result in the loss of 4,676 ft2 of Public Trust Area, but the marina
expansion would have additional impacts to Public Trust Areas. The construction of
the docks/formal slips would impact an additional 4,111 fe of Public Trust Area by
enclosing the area on three sides with docks and on the fourth side with the existing
travel lift. Only a 19' opening adjacent the travel lift would remain for ,public boat
ingress/egress. This area behind (landward of) the docks and formal slips would
essentially be removed from the public use. This loss of Public Trust is emphasized by
the applicant proposing to used the area to dock additional boats "temporarily".
Consequently, a total of 8,787 ftz would be directly impacted by the marina expansion.
The construction of the walkway would probably result in temporary
construction -related impacts to the coastal wetlands as a result of the trampling down
of the marsh during driving of the pilings. In addition, minor increases in turbidity of
the estuarine waters would also probably result from the driving of dock and mooring
pilings. The 6'-wide elevated walkway would have minor impacts to approximately
330 ftZ of coastal wetlands due to shading.
In addition to the loss of Public Trust Areas to the general public, the
construction -related impacts to the Coastal Wetlands and Estuarine Waters, and the
post construction impacts to the Coastal Wetlands from shading, there is the potential
for impact to boaters as a result of the project reducing the navigable portion of the
creek. This constriction of the navigable portion of Whittaker Creek could potentially
impact the traditional navigation affecting ingress and egress of boats up the western
Branch of Whittaker Creek. And although the applicant does not propose to extend
beyond one third the width of the Creek, his proposal is to reach that distance.

This project proposal has been extensively reviewed and'has successfully proceeded
through the SEPA process. And most recently r have reviewed the subject application in regards
to 07H.0206, .0207 & .0208 and have determined that the project is consistent with those
regulations. I have also attached a statement from Mr. Craven, the downstream adjacent
property owner, waiving the ld' required setback. As a result, I have no objection to the
permit being issued with the following conditions:
11) The marina will display a sign 'showing the location of the onsire pumpout
facility, including other appropriate waste disposal information, at the entrance
and exit from the main pier(s).
' 2) No sewage, whether treated or untreated, shall be discharged at any time from
' the marina. Any sewage discharge at the marina shall be considered a violation
of this permit for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.
3) This permit authorizes only the docks, piers, and other structures and uses located
in or over the water that are expressly set forth in the permit application and
shown on workplat #3 of 4 dated 8/9/95. No other structures, whether floating
or stationary, may become a permanent part of this marina without permit
modification. No non -water dependent uses of structures may be conducted on,
in, or over public trust waters without permit modification.
4) No attempt will be made by the permittee to prevent the full and free use by the
public of all navigable waters at or adjacent to the authorized work.
5) The authorized structures and associated activity must not cause an unacceptable
interference with navigation.
6) The permittee ,gust install and maintain., at his expense, any signal lights and
signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on
authorized facilities.

The Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of your property located at 200 Neuse Drive on Tarpon
Canal and the western branch of Whittaker Creek in the Town of Oriental, Pamlico County,
North Carolina. It was received complete on August 22, 1995, and appears to be adequate for
processing at this time. The projected deadline for making a decision is November 5, 1995.
An additional 75-day review period is provided by law when such time is necessary to complete
the review. If you have not been notified of a final action by the initial deadline stated above,
you should consider the review period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an additional letter will be provided on
or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be
contacted by the appropriate State or Federal agency. And in accordance with the North
Carolina Environmental Policy Act, the Draft Environmental Assessment that you submitted with
your application, is being circulated to the various agencies and pending their review and
comments, you may be required to address those comments. Please contact me if you have any

dolphins and jetties in navigable waters of the United States in the State

As you recall, back on August 22, 1995 Bob Deaton submitted a Major CAMA
Permit Application for the expansion of Deaton Yacht Service, Inc. in Oriental, Pamlico
County. And as you recall, the project was deemed subject to review under the North
Carolina Environmental Policy Act (NCEPA). On September 8, 1995 the application was
placed on hold pending the submittal of an environmental assessment (EA) and subsequent
letter of compliance with the NCEPA. Since that time, the appropriate EA has been
submitted, received clearance under internal review, and successful proceeded through the N.
C. State Clearinghouse (see attached letter from Ms. Chris Baggett).
The application has now been taken off hold and as a result of the above process, Mr.
Deaton has submitted a modified application that addresses a couple of points that were noted
during the EA process. These changes essentially involve formally defining two additional
slips located on the landward side of the docking facility and include the installation of three
additional pilings. Two additional parking spaces have been added as a result. These limited
changes are being forwarded to you for your review.
I have also enclosed the compliance letter from the Town of Oriental for the
additional parking along with the return receipt "green cards". If you have any questions,
please give me a call.
