This permit, issued on 6l�i�/ is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Pier and Dock Construction
1) The proposed drawbridge has been determined to be an unacceptable interference with navigation.
Therefore, in place of the proposed drawbridge, an arch over the most navigable portion of the
waterway shall be incorporated into the pier design. The arch shall provide a 10 foot minimum
horizontal clearance and a 10 foot minimum vertical clearance, as measured from the bottom of the
structure to the mean high water line. The exact location of the arch shall be determined by a
representative of the Division of Coastal Management within a maximum of 60 days prior to the start
of construction.
2) The pier shall be elevated a minimum of four feet above the marsh substrate.
3) The pier shall have a maximum width of six feet.

This permit_action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31,1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS
4) The gazebo shall not be completely enclosed or have side coverage more than one half the height
of the side, from the roof waterward. The floor area shall not exceed 500 square feet.
5) No vegetated wetlands will be excavated or filled.
Docking Facility Operation
6) No sewage, whether treated or untreated, shall be discharged at any time from any boats using
the docking facility. Any sewage discharge at the docking facility shall be considered a violation
of this permit for which the pernttee is responsible. This prohibition shall be applied and
enforced throughout the entire existence of the permitted structure.
7) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, may become a permanent part of this docking facility without
permit modification. No non -water dependent uses of structures may be conducted on, in or over
public trust waters without permit modification.
General
8) The permittee's scheme of development, of which the authorized work is part, contemplates the
presence of structures and their attendant utilities on lands subject to an easement in favor of the
United States for the operation, maintenance, improvement, and enlargement of the Atlantic
Intracoastal Waterway (AIW W). Accordingly, the permittee will be required to remove such
structures and improvements at his own expense in the event that, in the judgement of the U.S.
Army Corps of Engineers acting on behalf of the United States, the lands are needed at any time
for any purpose within the scope of the easement. Permanent buildings will not be constructed
within the easement.
9) This permit does not authorize the interference with any existing or proposed Federal project,
and the permittee will not be entitled to compensation for damage to the authorized structure or
work, or injury which may be caused from existing or future operations undertaken by the United
States in the public interest.
10) It is possible that the authorized structure may be damaged by wavewash from passing vessels.
The issuance of this permit does riot relieve the permittee from taking all proper steps to ensure
the integrity of the permitted structure and the safety of moored boats. The permittee will not
hold the United States liable for any such damage.
11) No attempt will be made by the permittee to prevent the free and full use by the public of all
navigable waters at or adjacent to the authorized work. Use of the permitted activity must not

12) ..The permittee must install and maintain, at his own expense, any lights and signals prescribed by
the U.S. Coast Guard, through regulation or otherwise, on the authorized structure.
13) The permittee will maintain the authorized work in good condition and in conformance with the
terms and conditions of this permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without having it transferred to a third party.

Dear Mr. Dull:
Reference your application for a Department of the Army permit to
construct a 420 foot long pier on Greenville Sound, at 6300 Seamist Court, in
the Cedar Island North development, in Wilmington, New Hanover County, North
Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. 198000291. Therefore, you may
commence construction activity in strict accordance with applicable State
authorization and the enclosed plan. Failure to comply with the State
authorization or conditions of the general permit could result in civil and/or
administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.

• A copy of the deed (with state application only) or
other instrument under which the applicant claims tide
to the affected properties.. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

numbers, landmarks, and the like.
• A Stormwater Certification, if one is necessary
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and

On February 11, 1991, we renewed general permit No. CESAW-CO80-N-000-0291
(copy enclosed), which provides Federal authorization for construction
activities that receive authorization from the State of North Carolina.
A review of your application received February 16, 1996, for Department
of the Army (DA) authorization to construct a pier on Greenville Sound, Cedar
Island, near Wilmington, New Hanover County, North Carolina, indicates it to
be a candidate for Federal authorization under this general permit.
Accordingly, the administrative processing of your application will be
accomplished by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit process
for any reason-, you will be informed regarding its further management. If
there are no unresolved differences in State -Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.

To Whom it May Concern:
I have received plans for a proposed pier next door to me
property from Land Management Group, Inc. Owner of the proposed
Pier is Mr. Ken Dull,
I do not have any objections to private piers in principle, and
Jjcertainly believe that access to navigable water is important
for any waterfront property owner.
I do, :however, have a problem with the scale of this structure.
.It is almost 500' long with a 61' wide float at the terminus,
and could accomidate four very large boats, which seems out of
,scale with normal residential use.
Also, this pier cuts off an access creek to the front of my
property, which I have used for twenty years. I notice an 8'
man-..;il drawbridge, but I believe this stream will be blocked in
three places, not one.
My primary concern, however is aesthetic. The residents of
Cedar island have enjoyed a beautiful view to the north for many
Years, including Shinn's Creek and the southern end of Wrightsville
Beach. am afraid that a massive structure
moorin_; p_lir_g will ruin this forever, o gazebo, and large
If the pier platform can be built at marsh level, and if handrails
can be eliminated, and if the gazebo can be of light c ,lstruction
SO as not to cut off the view, and if mooring pilings can be driven
to marsh level, then I withdraw any objections I have.
Please understand that I want Mr. Dull to have deepwater access;
my only concern is preserving one Of the primary assets of my
property.

this one, I cannot foresee any direct impacts to prevent the construction of this pier. The structure in
itself could be authorized on lots never intended for other development. I recommend the project be
approved subject to the following conditions:
1) The location of the drawbridge shall be determined within 60 days prior to construction by a
representative of the Division of Coastal Management.
2) The drawbridge must cross the most navigable area with a minimum 10' span.
3) The design of the drawbridge must be such that operation can be accomplished from the water.
4) The pier must be elevated a minimum of 4' above the marsh substrate.
5) No more than 4 vessels shall be moored at this docking system. Pt, h I !" t fx s 14jw
6) No sewage, whether treated or untreated, shall be discharged at any time from boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation
of this permit for which the permittee is responsible. This prohibition shall be applied and
enforced throughout the entire existence of the permitted stricture.
7) This permit authorizes only the docks, piers, and other structures and uses located in or over
the water that are expressly and specifically set forth in the permit application. No other
structures, whether floating or stationary, may become a permanent part of this docking facility
without permit modification. No non -water dependent uses of structures may be conducted on,
in, or over public trust waters without permit modification.
8) The authorized structure and associated activity must not cause an unacceptable interference with
navigation.

This permit consistency opinion is based on my review of the CAMA permit application, the Field
Investigation Report (T Barrett, 4/10/96), and my understanding and interpretation of the policies presented
in the Wilmington/New Hanover County Land Use Plan.
The applicant proposes to construct a pier on a joint property line to serve two single family residential lots.
The pier would terminate in a gazebo, ramp, floating dock and two finger piers. The dockage is for four
vessels. There is no dredging associated with this application. The location and complete description of the
project are in the Field Investigation Report.
LAND USE CLASSIFICATION: Conservation (CAMA AEC)
RELATED POLICIES AND IMPLEMENTATION MEASURES:
1.1(3) DEVELOPMENT ACTIVITIES WITHIN THE 100 YEAR FLOODPLAIN SHALL BE CAREFULLY CONTROLLED TO
MMVHZE DEVELOPMENT, ENCOURAGE LOW INTENSITY USES SUCH AS OPEN SPACE AND RECREATION, AND
ENSURE STRICT COMPLIANCE WITH STATE AND FEDERAL REGULATIONS CONCERNING WETLAND PROTECTION.
4. All land areas falling within the 100 year floodplain will be designated Conservation on the Land Classification Map.
1.2(1) ESTUARINE WATERS, ESTUARINE SHORELINES AND PUBLIC TRUST AREAS SHALL BE PROHIBITED FROM USE
BY DEVELOPMENT ACTIVITY WHICH WOULD RESULT IN SIGNIFICANT ADVERSE IMPACT TO THE NATURAL
FUNCTION OF THESE AREAS.
1.2(8) THE COUNTY AND CITY SHALL TAKE ALL NECESSARY ACTIONS TO PREVENT FURTHER DETERIORATION
OF ESTUARINE WATER QUALITY AND LASS OF PUBLIC TRUST USES IN THE CREEKS AND SOUNDS AND TO BRING
ALL COASTAL WATERS UP TO THE HIGHEST QUALITY POSSIBLE.
1.2(9) THE CITY AND COUNTY SHALL ALLOW USES OF ESTUARINE AND PUBLIC TRUST WATERS THAT PROVIDE
BENEFITS TO THE PUBLIC AND WHICH SATISFY RIPARIAN ACCESS NEEDS OF PRIVATE PROPERTY OWNERS.
CONSISTENCY OPINION: The Wilminglon/New Hanover County Land Use Plan supports protection of
water quality (especially SA-ORW, primary nursery and open waters) and public trust areas. The plan also

Biologists on the Wildlife Resources Commission staff have reviewed this permit
application and are familiar with habitat values of the project area. Our comments are provided in
accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-
128), as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16
U.S.C. 661 et seq.).
The applicant proposes to construct a 420 ft. pier, a 14 ft. x 14 ft. gazebo, an access ramp
to a 6 ft. x 61 ft. floating dock with two finger piers and six mooring pilings. The proposed
project will extend 115 ft. into AIWW right-of-way and terminate 90 ft. from the marked
channel. Waters at the site are classified as SA-ORW and are open to shellfish harvest. The
waters are also designated as primary nursery area by Division of Marine Fisheries.
Waters at the site are estuarine therefore, we will support any decision and comments
made by the Division of Marine Fisheries.

Dear Mr. Dull:
The Division of Coastal Management hereby allilkilowledges receipt of your application for State
approval for development of your property located at Lots 6 & 7 Cedar Island North in New Hanover
County. It was received on completed on 4/08/96, and appears to be adequate for processing at this
time. The projected deadline for making a decision is Jfte.25, bW6. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous
point along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property;
or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and
federal review agencies for their comments. If additional information is required based on this review,
the agencies may contact you directly.
