Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. Pier and Dock Construction 1) The proposed drawbridge has been determined to be an unacceptable interference with navigation. Therefore, in place of the proposed drawbridge, an arch over the most navigable portion of the waterway shall be incorporated into the pier design. The arch shall provide a 10 foot minimum horizontal clearance and a 10 foot minimum vertical clearance, as measured from the bottom of the structure to the mean high water line. The exact location of the arch shall be determined by a representative of the Division of Coastal Management within a maximum of 60 days prior to the start of construction. 2) The pier shall be elevated a minimum of four feet above the marsh substrate. 3) The pier shall have a maximum width of six feet. (See attached sheets for Additional This permit_action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31,1999 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee r Ken Dull Permit #87-96 Page 2 of 3 ADDITIONAL CONDITIONS 4) The gazebo shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. The floor area shall not exceed 500 square feet. 5) No vegetated wetlands will be excavated or filled. Docking Facility Operation 6) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the pernttee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 7) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. General 8) The permittee's scheme of development, of which the authorized work is part, contemplates the presence of structures and their attendant utilities on lands subject to an easement in favor of the United States for the operation, maintenance, improvement, and enlargement of the Atlantic Intracoastal Waterway (AIW W). Accordingly, the permittee will be required to remove such structures and improvements at his own expense in the event that, in the judgement of the U.S. Army Corps of Engineers acting on behalf of the United States, the lands are needed at any time for any purpose within the scope of the easement. Permanent buildings will not be constructed within the easement. 9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 10) It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does riot relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats. The permittee will not hold the United States liable for any such damage. 11) No attempt will be made by the permittee to prevent the free and full use by the public of all navigable waters at or adjacent to the authorized work. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. NOTE: The N.C. Owner of the proposed Pier is Mr. Ken Dull, I do not have any objections to private piers in principle, and Jjcertainly believe that access to navigable water is important for any waterfront property owner. I do, :however, have a problem with the scale of this structure. .It is almost 500' long with a 61' wide float at the terminus, and could accomidate four very large boats, which seems out of ,scale with normal residential use. Also, this pier cuts off an access creek to the front of my property, which I have used for twenty years. I notice an 8' man-..;il drawbridge, but I believe this stream will be blocked in three places, not one. My primary concern, however is aesthetic. The applicant proposes to construct a pier on a joint property line to serve two single family residential lots. The pier would terminate in a gazebo, ramp, floating dock and two finger piers. The dockage is for four vessels. There is no dredging associated with this application. The location and complete description of the project are in the Field Investigation Report.
