The original (buff -colored form) is retained by you and it must be available on site when the project is inspected for compliance. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS I I3A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the final decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance require additional approval. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. The dolphins will be connected with 6" x 12" x 22' timbers. Elizabeth City, City of Bio Report-, Page Two Site Description The applicant, the City of Elizabeth City, owns an underwater pipeline that traverses Knobbs Creek at its mouth. The project is located at the north end of Poindexter Street, Elizabeth City, North Carolina and at the point where Knobbs Creek enters the Pasquotank River. Adjacent properties consists of a private park, a dead-end street (Poindexter Street), a wood chip barge loading facility on the south creek bank and undeveloped land on the north creek bank. Knobbs Creek has a depth of 15 feet at NWL and is used by commercial barge traffic carrying wood products. The creek is approximately 175 feet wide at the development site. Man-made features include three lighted dolphins located approximately 35 feet offshore. These dolphins are positioned parallel along the south shore of Knobbs Creek and are arranged equidistant in a 40 ft. straight line. The sewer pipeline lies submerged between two of the existing dolphins and their intended purpose is to protect the sewer pipeline from being hit by the barge traffic. The waters of Knobbs Creek are classed by DEM as C Sw. Project Description In order to offer more protection for the underwater sewer pipeline, the applicant proposes to construct two additional dolphins, each consisting of 19 pilings banded together and centered approximately 17 feet apart. Their height above normal water level will be 16 feet. The dolphins will be located a maximum distance of 54 feet from NWL and will be in seven feet of water. They will have a diameter of nine feet. The applicant proposes to link the dolphins with several 6" x 12" x 22' timbers running horizontal to a height of 14 feet. The purpose of the timbers is to act as a fender. Anticipated Impacts The project will result in 138 sq. ft. of Public Trust Waters being utilized for the dolphins and the fender system. The project should protect the underwater sewer pipeline and reduce the number of raw sewage spills in the Pasquotank River. The project will reduce the usable width of the channel by 17 feet. The project is within Public Trust Waters. The purpose of the project is to protect a sewer trunk line crossing the creek which has been ruptured in the past by barge traffic. Consistency Comments: Elizabeth City's 2002 Land Use Plan (currently in force), was certified by the Coastal Resources Commission on September 23, 1994. While no specific policy is provided in the City's Plan associated with dolphins, it is clear that this project warrant a determination that it is consistent with the purpose and intent of the City's Plan's policy found on page 75, section G. 2. b. (1), as follows: "Elizabeth City believes that the statutory Areas of Environmental Concern (AEC's) which occur within its jurisdiction, ie., Coastal...... and Public Trust Waters should be protected from undue encroachment in order to preserve their natural and important ecological functions."
