Upland Development 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the clubhouse, pool, deck, mechanical building and sidewalks, all as expressly and specifically set forth in the attached permit application and workplan drawing. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (910) 796-7215 for this determination. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Any violation of the permit approved by the DEMLR shall be considered a violation of this CAMA permit. Sedimentation and Erosion Control 3) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 4) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). General 5) No wetlands shall be excavated or filled, even temporarily, without permit modification. 6) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 7) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. Wilmington, NC 28403 Subject: State Stormwater Management Permit No. SW8 131011 Topsail Island Yacht Club High Density Infiltration Trench Project Pender County Dear Mr. Violi: The Wilmington Regional Office received a complete, modified State Stormwater Management Permit Application for Topsail Island Yacht Club on March 29, 2016. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 and Session Law 2008-211. We are forwarding modified Permit No. SW 8 131011 dated April 29, 2016, for the construction, operation and maintenance of the BMP's and built -upon area associated with the subject project. This permit shall be effective from the date of issuance until March 19,2022, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions, certification of the BMP's, procedures for changing ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to record deed restrictions, to certify the BMP's, to transfer the permit, or to renew the permit, will result in future compliance problems The following modifications are included and covered by this permit: 1. A pervious gravel parking lot is permitted per S1,2015-149. See Section I(8). 2. The name of the project changed from "Beach House Yacht Club —Clubhouse and Pool" to "Topsail Island Yacht Club". If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). This permit shall be effectve from the date of issuance until March 19, 2022, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. The infiltration trench permitted for this facility was originally permitted under State Stormwater Permit Number SW8 990325 on October 30, 2001. A level spreader and vegetated filter strip were not required by that permit. The same trench is re -permitted under this permit, and so the level spreader and vegetated filter strip are not required. 3. The infiltration trench permitted for this facility was originally permitted under State Stormwater Permit Number SW8 990325 on October 30, 2001. A 50ft stormwater buffer was not permitted under that permit, and since the same trench is being re -permitted a stormwater buffer is not required under this permit. However, this project may be subject to other Federal, State or Local requirements and if so this project must comply with those requirements. 4. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 5. The runoff from all built -upon area within the permitted drainage area of this project must be directed FnJF—C E IV E D the permitted stormwater control system. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.7 of this permit. The stormwater control has been designed to handle the runoff described in Table 1 below. Of this amount, 62,388sf of impervious area has been allocated for buildings, sidewalks and other uses as shown on the permitted plans and application form. The future impervious area available inside the infiltration trench drainage area (ITDA) is 1,OOOsf. The ITDA is labeled on the plans as "Drainage Area 1 Boundary". This 1,000sf can be allocated at a future time via Plan Revision with no required change to the infiltration trench design. There is also 2, 612sf of future impervious area that is available outside of the ITDA that can be permitted at a future time to be built under the 1995 rule and subject to al. 5' design storm. The 2, 612sf is a placeholder for future construction under the 1995 rule that can be permitted at a future date. Construction of the $612sf of future impervious area outside the ITDA is not lure date. Since this 2,612sf of impervious area is permitted to be outside the infiltration trench's drainage area it does to the current infiltration trench, and therefore cannot be treated by the current infiltration trench without modifying the current infiltration trench. In order to use the 2, 612sf of impervious area at a future date the permittee may either modify the current trench to treat more impervious area (d the permittee later wants to construct the 2, 612sf inside the ITDA in the future), or the permitfee may construct a second stormwater treatment device (if the permiftee wants to continue with the plan to construct the 2, 612sf outside the ITDA in the future). The following design criteria have been permitted for the infiltration trench system and must be provided and maintained at design condition: a. Per Session Law 2015-149: The project is proposing 10,808 square feet of #57 stone laid at least four inches thick over a geotextile fabric as a pervious surface for a parking lot. The underlying soil must not be mechanically compacted prior to installation. If, in the future, this pervious surface is found to no longer meet SL 2015-149, a plan revision or modification will be required. Any future areas of #57 stone proposed within this development will need prior approval from the Division in order to demonstrate that the improvements are still considered pervious under the latest definition of built -upon area. Page 3 of 5 State Stormwater Management Systems Permit No. SW8131011 II. SCHEDULE OF COMPLIANCE 1. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of bypass structure, infiltration media, flow spreader, catch basins, piping and vegetated filter. g. A clear access path to the bypass structure must be available at all times. 4. The facilities shall be constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 5. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 6. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times. 7. Records of maintenance activities must be kept for each permitted BMP. The reports will indicate the date, activity, name of person performing the work and what actions were taken. 8. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 9. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: �E�,ENED a. GENERAL CONDITIONS Approved plans, application, supplement forms, Operation and Maintenance agreements, design calculations and specifications for this project are incorporated by reference and are enforceable parts of the permit. Any individual or entity found to be in noncompliance with the terms and conditions of this permit or the stormwater rules is subject to enforcement action in accordance with North Carolina General Statute 143, Article 21. 3. The issuance of this permit does not preclude the Perittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 4. This permit is not transferable to any person or entity except after notice to and approval by the Director. An ownership change including the sale or conveyance of the project area in whole or in part; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Bankruptcy; d. Foreclosure; e. Dissolution of the partnership or corporate entity; f. A name change of the current permittee; g. A name change of the project; h. A mailing address change of the permittee; 5. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 6. in the event that the facilities fail to perform satisfactorily, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 7. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 8. The permit issued shall continue in force and effect until revoked or terminated. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 9. Unless specified elsewhere, permanent seeding requirements for the stormwater controls must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 10. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Session Law 2008-211, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et. al. 11. PROJECT DESCRIPTION The project site is located at 111 North New River Drive, adjacent to the Atlantic Intracoastal Waterway (AIWW) and Topsail Sound, in Pender County. To locate the property from Market Street (NC Highway17 North) travel approximately 20 miles north and tum right on to NC-210 East. Follow NG-210 East/NC 50 across the Surf City Bridge. The road will turn into Roland Avenue. Travel approximately 2 miles and tum left onto North New River Drive. The subject property will be located on the left before Greensboro Avenue. Existing structures on the project site, which is a private/community marina and boat storage facility, includes two dry stack boat storage units, a gravel parking lot, a 24 slip docking facility and a boat ramp. The project site is approximately 2.9 acres and is vegetated primarily with domestic lawn grasses. The project site has approximately 330 feet of shoreline frontage which is stabilized with rip rap along the AIWW/Topsail Sound. The property slopes down from high ground to a narrow band of (approximately 10 ft.) of marsh, consisting primarily of Salt Meadow Cordgrass (Spartina aftemaflora), Black Needlerush (Juncus roemerianus and Sea Lavender (Limonium sp.) This area has been designated as urban waterfront. The average highground elevation is approximately 5 ft. abo D raD. stand Yacht Club formed use Marina and also as Treasure Coast Yacht Club. AMA Major Permit #27- 10'. was issue sure Coast Yacht Club and Marina on February 24, an expired on December 31, 2005. The permit authorized construction of a marina facility and maintenance dredging. CAMA Major Permit #27-00 was modified and refined to include alterations of the marina facility and spoil site along with reconfigurations of the docking facility and the name change to Beach House Marina. The modified permit expired on December 31, 2005. The Surf City Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Commercial/Urban Waterfront. The waters of the AIWW and Topsail Sound are classified SA by the Division of Water Resources. They ARE designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries. The immediate area within and adjacent to the marina is CLOSED to the harvesting of shellfish; however, the waters of Topsail Sound are OPEN. According to the application an approximately 50 ft. wide by 68 ft. long 2-story pile supported wood framed clubhouse with entry walk and decks would be constructed immediately landward of the rip rap along the shoreline. Immediately to the west, adjacent to the clubhouse, a pool with an approximately 60 ft. wide by 40 ft. long footprint would be constructed with a 12 ft. wide concrete apron. The pool is proposed to be a fiberglass one piece drop in pool with an adjacent approximately 8 ft. wide by 8 ft. long pool equipment/mechanical room to the southeast of the concrete apron on the western most side of the pool. An approximately 287 ft. long by 5 ft. wide sidewalk is proposed on the southeastern side of the property adjacent to North New River Drive. According to the application there would be limited fill and grading and the size of the area to be graded and filled is stated as 10,000 square feet. The application states that 75% of the tract within the coastal shoreline area would be covered by impervious/built-upon surfaces and 58.2% of the entire tract would be impervious/ built -upon. PROJECT DESCRIPTION The project site is located at 111 North New River Drive, adjacent to the Atlantic Intracoastal Waterway (AIWW) and Topsail Sound, in Pender County. To locate the property from Market Street (NC Highway17 North) travel approximately 20 miles north and turn right on to NC-210 East. Follow NC-210 East/NC 50 across the Surf City Bridge. The road will turn into Roland Avenue. Travel approximately 2 miles and turn left onto North New River Drive. The subject property will be located on the left before Greensboro Avenue. Existing structures on the project site, which is a private/community marina and boat storage facility, includes two dry stack boat storage units, a gravel parking lot, a 24 slip docking facility and a boat ramp. The project site is approximately 2.9 acres and is vegetated primarily with domestic lawn grasses. The project site has approximately 330 feet of shoreline frontage which is stabilized with rip rap along the AIWW/Topsail Sound. The property slopes down from high ground to a narrow band of (approximately 10 ft.) of marsh, consisting primarily of Salt Meadow Cordgrass (Spartina aftemaflora), Black Needlerush (Juncus roemerianus and Sea Lavender (Limonium sp.) This area has been designated as urban waterfront. The average highground elevation is approximately 5 ft. above normal high water (NHW) and the shoreline is stabilized by rip rap. Topsail Island Yacht Club formerly operated as Beach House Marina and also as Treasure Coast Yacht Club. CAMA Major Permit #27- 00 was issued to Treasure Coast Yacht Club and Marina on February 24, 2000 and expired on December 31, 2005. The permit authorized construction of a marina facility and maintenance dredging. CAMA Major Permit #27-00 was modified and refined to include alterations of the marina facility and spoil site along with reconfigurations of the docking facility and the name change to Beach House Marina. The modified permit expired on December 31, 2005. The Surf City Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Commercial/Urban Waterfront. The waters of the AIWW and Topsail Sound are classified SA by the Division of Water Resources. They ARE designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries. The immediate area within and adjacent to the marina is CLOSED to the harvesting of shellfish; however, the waters of Topsail Sound are OPEN. PROPOSED PROJECT The applicant proposes to construct a pile supported two story clubhouse, pool with concrete deck, pool equipment/mechanical building and sidewalks at the existing dry stack boat storage/docking facility in the AIWW/Topsail Sound. As stated in the narrative the applicant currently has two (2) dry stack twat storage facilities, a gravel parking lot, boat slips/docking facility and a concrete boat ramp (see sheet 1 of 1). These facilities serve as a private marina and boat storage service for the Topsail Island Yacht Club Owners Association. According to the application an approximately 50 ft. wide by 68 ft. long 2-story pile supported wood framed clubhouse with entry walk and decks would be constructed immediately landward of the rip rap along the shoreline. Immediately to the west, adjacent to the clubhouse, a pool with an approximately 60 ft. wide by 40 ft. long footprint would be constructed with a 12 ft. wide concrete apron. The pool is proposed to be a fiberglass one piece drop in pool with an adjacent approximately 8 ft. wide by 8 ft. long pool equipment/mechanical room to the southeast of the concrete apron on the western most side of the pool. An approximately 287 ft. long by 5 ft. wide sidewalk is proposed on the southeastern side of the property adjacent to North New River Drive. According to the application there would be limited fill and grading and the size of the area to be graded and filled is stated as 10,000 square feet. The application states that 75% of the tract within the coastal shoreline area would be covered by impervious/built-upon surfaces and 58.2% of the entire tract would be impervious/ built -upon. The applicant states that a site development plan has been submitted to the Division of Water Resources for review. 10, ANTICIPATED IMPACTS The proposed structures would impact approximately 7176 sq. ft. of Estuarine Shoreline Area. According to the application, the proposed club house structure would be constructed immediately adjacent to the rip rap shoreline structure and the pool apron would be set back approximately 8 ft. from the edge of rip rap along the shoreline.
