The buoys and pilings shall conform with any and all appropriate regulations governing such structures,
including but not limited to marking and lighting requirements of the NC Wildlife Resources
reflectors in order to make them more visible during hours of darkness or inclement weather.
The permittee shall maintain the authorized buoys and pilings in good condition and in conformance
with the terms and conditions of this permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without having it transferred to a third parry.
The authorized buoys and pilings shall not cause more than a minimal adverse effect on navigation.
This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
that may be caused from existing or future operations undertaken by the United States in the public
interest.
General
The permittee understands and agrees that, if future operations by the United States requires the
;J removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be.

made against the United States or the state of North Carolina on account of any such removal or
alteration.
The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
Future development of the permittee's property may require a modification of this permit.

The buoys will be installed to delineate the boundary for the no surfing zone which entends '300 feet on either side of the
Surf City Ocean Fishing Pier. Pilings shall be installed at a distance of 300 feet on either side of the fishing pier to delineate
the no swimming and surfing zone. These are safety markers and will be in place year round. The buoys located at Surf City
Pier will be located approximately 500' from the NFIW.
c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type
of equipment and where it is to be stored.
The buoy will consist of a concrete anchor ( 24"Square x 5"deep with a rebar handle) The buoy itself is a 5-7/8"x 13-3/4"
bullet nose orange float made of compression molded pvc. The buoy and anchor will be connected by a galvanized
3/16"chain and two stainless steel shackles. The 8x8 pilings to be installed at 300' from either side of the commercial fishing
pier shall be jetted in. The buoys will be similar to those installed at the Wrightsville Beach project.
d. List all development activities you propose.
Install 2 buoys 300 'from either side of the Surf City Ocean Pier. Jet in two 8X8 pilings to either side the Surf City Ocean Pier
at a distance of 300'.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is retained by
you and it must be available on site when the project is inspected for compliance. Please sign both the original and the
copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have
waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or
113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days
of this decision on your permit. You should also be aware that if another qualified parry submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prigr to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions; environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance.
By working in accordance with the permit, you will be helping to protect our vitally important coastal resources.

9. PROJECT DESCRIPTION:
The project site is located adjacent to the Surf City fishing pier which is located at 112 S. Shore Drive in Surf
City, Pender County. To get to the project site from the Wilmington office, head north on US Hwy 17 toward
Jacksonville. At the intersection of US Hwy 17 and NC Hwy 210, turn right onto NC Hwy 210 towards Surf
City. Cross the AIWW (swing bridge) leading into Surf City and continue straight through the traffic light at the
intersection of Highway 210 and Highway 50 (Roland Avenue). At the stop sign, turn right onto S. Shore Drive
and the subject property will be located on the left hand side of the road, adjacent to the Surf City pier.
The areas north, west and south of the project site are a combination of residential and commercial properties and
the area to the east is comprised of the Atlantic Ocean. The existing Surf City pier (centrally located within the
project boundary) extends approximately 700' seaward from the mean high water (MHW) boundary. There is a
public parking area, restroom and pier house in the immediate vicinity of the fishing pier. The sites average
approximately 12' above mean high water (MHW) along the public beach area. The oceanfront beach area
consists of dune vegetation such as American Beach Grass (Ammophila breviligulata), Bitter Panicum (Panicum
amarum) and Sea Oats (Uniola paniculata). Law grasses and ornamental landscaping combine to fill in the
remaining vegetation around the project site.
The Surf City Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of
the project area as Developed. The waters of the Atlantic Ocean are classified SB# by the Division of Water
Quality. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they
are OPEN to the harvest of shellfish.
The beach front bordering the project site is not part of a beach re -nourishment program; however, the Town has
historically requested permission to beach bulldoze the area(s) following significant erosion events. The Long Term
Average Annual Shoreline Change Rate is 2' per year, as designated by the NC Division of Coastal Management
in the 2011 update.
PROPOSED PROJECT:
The applicant proposes to install buoys and pile supported signs to locate designated no swimming and surfing
zones adjacent to the existing fishing pier. The applicant has indicated that the Town of Surf City has been
pursuing this endeavor for some time and that their local ordinance preventing the no swim/surf encroachment has
been in place since the late 1960's. As proposed, surfing and swimming areas would be limited to a distance of at
least 300 feet from the pier. In order to educate the public of the no swim/surf zone boundaries, the applicant is
proposing to install two (2) buoys on each side of the existing fishing pier, each with a bullet nose orange float
made of compression PVC. As indicated on the work plan drawings, the buoys would extend a distance of
approximately 450-500 feet offshore (below the Normal High Water (NHW) level) at a distance of approximately
300 feet north and south of the existing pier. The buoys would be tethered (via a galvanized 3/16" chain) to a 5" x
24" (diameter) submerged concrete anchor. As noted on the plans, the concrete anchor would rest on the ocean
floor, and would not include any helical anchors or other subsurface devices. As shown, the buoys would rest in
approximately 12-20 feet of water (varying tide).
The application states that two (2) pile supported signs, each measuring approximately 8" x 8" would be installed
approximately 300' on each side of the fishing piers. Each piling would have signage, measuring approximately
2' in length by 2' in width, which would indentify either "No Swimming or No Surfing Beyond This Point". As
proposed, the pilings would be located within the public beach area above MHW.

10. ANTICIPATED IMPACTS:
The proposed buoys and associated anchor systems would incorporate approximately 4 sq. ft. of Public Trust and
ocean bottom, and the proposed pile supported signs would incorporate approximately 6 sq. ft. of Public Ocean
Beach Area. Access along the beach should not be impeded by the piling structures. The two buoys would be
placed approximately 620 feet apart, which would potentially eliminate approximately 270,000 sq. ft. of Public
Trust Area to swimming and surfing access adjacent to each fishing pier. The bottom substrate is course sand and
installation of the buoys should result in minimal increases in turbidity.

The Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources received a copy of the CAMA Major
Permit Application for the subject project on December 18, 2013. Staff review of the plans and specifications has determined
that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The
Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from
stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000, the
stormwater rules. By copy of this letter, we are informing you that this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also subject to
the National Pollutant Discharge Elimination System (NPDES) stornvater discharge requirements. You are required to have an
NPDES permit for stormwater discharge from projects meeting these criteria. All temporary built -upon area associated with the
construction of the project must be removed within 30 days of completion of the project, or when it is no longer needed,
whichever occurs first.

9. PROJECT DESCRIPTION:
The project site is located adjacent to the Surf City fishing pier which is located at 112 S. Shore Drive in Surf
City, Ponder County. To get to the project site from the Wilmington office, head north on US Hwy 17 toward
Jacksonville. At the intersection of US Hwy 17 and NC Hwy 210, turn right onto NC Hwy 210 towards Surf
City. Cross the AIW W (swing bridge) leading into Surf City and continue straight through the traffic light at the
intersection of Highway 210 and Highway 50 (Roland Avenue). At the stop sign, turn right onto S. Shore Drive
and the subject property will be located on the left hand side of the road, adjacent to the Surf City pier.
The areas north, west and south of the project site are a combination of residential and commercial properties and
the area to the east is comprised of the Atlantic Ocean. The existing Surf City pier (centrally located within the
project boundary) extends approximately 700' seaward from the mean high water (MHW) boundary. There is a
public parking area, restroom and pier house in the immediate vicinity of the fishing pier. The sites average
approximately 12' above mean high water (MHW) along the public beach area. The oceanfront beach area
consists of dune vegetation such as American Beach Grass (Ammophila breviligulata), Bitter Panicum (Panicum
amarum) and Sea Oats (Uniola paniculata). Law grasses and ornamental landscaping combine to fill in the
remaining vegetation around the project site.
The Surf City Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of
the project area as Developed. The waters of the Atlantic Ocean are classified SB# by the Division of Water
Quality. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they
are OPEN to the harvest of shellfish.
The beach front bordering the project site is not part of a beach re -nourishment program; however, the Town has
historically requested permission to beach bulldoze the area(s) following significant erosion events. The Long Term
Average Annual Shoreline Change Rate is 2' per year, as designated by the NC Division of Coastal Management
in the 2011 update.
PROPOSED PROJECT:
The applicant proposes to install buoys and pile supported signs to locate designated no swimming and surfing
zones adjacent to the existing fishing pier. The applicant has indicated that the Town of Surf City has been
pursuing this endeavor for some time and that their local ordinance preventing the no swim/surf encroachment has
been in place since the late 1960's. As nroposed, surfing and swimmi areas would he limited o a dictate at
st 300 feet from the pier. In order to educate the public of the no swim/surf zone boundaries, the applicant is
proposing to install two ugys on each side of the existing fishing pier, each with a bullet nose orange float
made of con ession PVC. As indicated on the wor plan r
aawings-1 e buoys would extend a distance of
5 approximately 450-00 feet -offshore (below the Normal High Water (NHW) level) at a distance of approximately
300 feet north and south of the existing pier. The buoys would be tethered (via a galvanized 3/16" chain) to a 5" x
24" (diameter) submerged concrete anchor. As noted on the plans, the concrete anchor would rest on the ocean
floor, and would not include any helical anchors or other subsurface devices. As shown, the buoys would rest in
approximately 12-20 feet of water (varying tide).
The application states that two (2) pile supported signs, each measuring approximately 8" x 8" would be installed
approximately 300' on eac si e o e fishing pier" s.--Each piling would have signage, measuring approximately
2' in length by 2' in width, which would indentify either "No Swimming or No Surfing Beyond This Point". As
proposed, the pilings would be located within the public beach area above MHW.

10. ANTICIPATED IMPACTS:
The proposed buoys and associated anchor systems would incorporate approximately 4 sq. ft. of Public Trust and
ocean bottom, and the proposed pile supported signs would incorporate approximately 6 sq. ft. of Public Ocean
Beach Area. Access along the beach should not be impeded by the piling structures. The two buoys would be
placed approximately 620 feet apart, which would potentially eliminate approximately 270,000 sq. ft. of Public
Trust Area to swimming and surfing access adjacent to each fishing pier. The bottom substrate is course sand and
installation of the buoys should result in minimal increases in turbidity.

Project Narrative: The Surf City Police Department is trying to find a solution for violators in
our no surfing, swimming and wading zone. Each year we are having increased calls for service
for citizens surfing, swimming and wading too close to the Surf City Ocean Pier. This year, we
have responded to approximately 75-100 calls for service with minimal results. Unfortunately,
our court system has been questioning officers on whether these surfers, swimmers and
waders were in fact, inside the no surfing, swimming and wading zone, due to it not being
properly marked. This is not only an ordinance violation, but a safety factor to all those too
close to the pier.
We have reached out to numerous agencies and found that the attached application is a
working solution to our problem with positive results. Though it's not a permanent solution, it's
a solution that will keep our citizens and tourists safer throughout the years to come.

The buoys will be installed to delineate the boundary for the no surfing zone which entends'300 feet on either side of the
Surf City Ocean Fishing Pier. Pilings shall be installed at a distance of 300 feet on either side of the fishing pier to delineate
the no swimming and surfing zone. These are safety markers and will be in place year round. The buoys located at Surf City
Pier will be located approximately 500' from the NHW.

The buoy will consist of a concrete anchor ( 24"Square x 5"deep with a rebar handle) The buoy itself is a 5-7/8"x 13-3/4"
bullet nose orange float made of compression molded pvc. The buoy and anchor will be connected by a galvanized
3/16"chain and two stainless steel shackles. The 8x8 pilings to be installed at 300' from either side of the commercial fishing
pier shall be jetted in. The buoys will be similar to those installed at the Wrightsville Beach project.

Recommendations for State Permit — Town of Surf City C/o Ron Shanahan
It is the staffs recommendation that the proposal appears that the project is CONSISTENT with the use standards and
guidelines set forth under 15A NCAC 07H .0206, 15A NCAC 07H .0207, and ISA NCAC 07H.0300. The proposed piled
supported signs would be located seaward of the first line of stable natural vegetation; however, it appears that regulatory
signs have been allowed in this location for the publics benefit. As proposed, this office has no objection to the proposed
project. If the project is determined to be consistent with 15A NCAC 07H .0206, 15A NCAC 07H .0207, and 15A NCAC
07H.0300, it is recommended that any permit issued should include the following conditions:
1. All precautions should be taken to ensure that navigation is not unnecessarily impacted. No attempt will be
made by the permittee to prevent the free and full use by the public of all navigable waters at or adjacent to
the authorized work Use of the permitted activity must not interfere with the public's right to free
navigation on all navigable waters of the United States.
2. The area shall not be "roped off' or "barricaded" at anytime.
3. The buoys should be marked with permanent reflectors in order to make them more visible during hours of
darkness or inclement weather.
4. The authorized structures and associated activity must not cause an unacceptable interference with navigation.
5. The permittee shall maintain the structure in good repair. In the event the structure is damaged by storms, or falls
into disrepair, the permittee shall be responsible for removal of the structure upon notification from the Division.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or
authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit. Contact a
representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination.

DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as required by NCGS
113A-119(b) that an application for development permit in an Area of Environmental Concern as designated
under the CAMA was received complete on December 16, 2013.
According to said application, the Town of Surf City proposes to install buoys and pile supported
signs to identify restricted swimming & surfing zones, near 112 N. Shore Drive, at the Surf City Ocean
Fishing Pier in Pender County. A copy of this entire application may be examined or copied at the office of
Jason Dail, N.C. Environment and Natural Resources, Division of Coastal Management, 127 Cardinal Drive
Extension, Wilmington, North Carolina 28405, (910-796-7215) during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400 Commerce
Avenue, Morehead City, NC 28557-3421, prior to January 10, 2014, will be considered in making the permit
decision. Later comments will be accepted and considered up to the time of permit decision. Project
modification may occur based on review and comment by the public and state and federal agencies. Notice of

Project Narrative: The Surf City Police Department is trying to find a solution for violators in
our no surfing, swimming and wading zone. Each year we are having increased calls for service
for citizens surfing, swimming and wading too close to the Surf City Ocean Pier. This year, we
have responded to approximately 75-100 calls for service with minimal results. Unfortunately,
our court system has been questioning officers on whether these surfers, swimmers and
waders were in fad, inside the no surfing, swimming and wading zone, due to it not being
properly marked. This is not only an ordinance violation, but a safety factor to all those too
close to the pier.
We have reached out to numerous agencies and found that the attached application is a
working solution to our problem with positive results. Though it's not a permanent solution, it's
a solution that will keep our citizens and tourists safer throughout the years to come.

The Division of Coastal Management hereby acknowledges receipt of your application requesting State approval
for development of your property located adjacent to 112 S. Shore Drive, within and next to the Atlantic Ocean, in Surf
City, Pender County. Your application was received complete on December 16, 2013, and appears to be adequate for
processing at this time. The projected deadline for making a decision is March 3, 2014. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have not been notified of a final
action by the initial deadline stated above, you should consider the review period extended. Under those circumstances,
this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the
75s' day.
If this agency does not render a permit decision within 70 days from December 16, 2013, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project.
Such a meeting will be held within five working days from the receipt of your written request and shall include the
property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property; or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
An onsite inspection may be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to
receive a copy of my field report and/or comments from reviewing agencies.

I received the CAMA Major permit application from you, on behalf of the Town of Surf City, for development
activities located adjacent to Town property, near the Surf City Pier, in Surf City, Pender County NC. The below
referenced items should be addressed and the applicable information submitted to our office.
The Division of Coastal Management hereby acknowledges receipt of your application (date received November
27, 2013), requesting state approval for development at 112 s. Shore Drive, adjacent to the Atlantic Ocean, in
Surf City, Pender County. However, your application lacks information necessary for complete processing. The
below referenced items indicate the deficiencies of your application. Once you have fulfilled the request
specified below, you should submit the information to our office at 127 Cardinal Drive, Wilmington, NC 28405.
Additional information may be required pending further review by the fifteen (15) review agencies.
✓ Please provide a project narrative
✓ Please provide a copy of the deed for the subject property.
✓Please provide a signed copy of the permit application package (all forms should be signed and dated)
✓Please provide the signed certified mail receipts that were returned as part of the adjoining neighbor
notification process.
✓Please provide a top view, or aerial view showing the approximate location of the proposed structures.
Each structures should be labeled and identified as a "mooring buoy", "piling" etc.
✓As required by the Rules established by the Coastal Resources Commission, each drawing submitted
shall contain a north arrow, title block, legend, page number, water body, date, etc. I have attached a
copy of the "LAMA Major Permit Checklist' which you can use as a cheat sheet for completing the
package. If you go through the checklist and mark each items off one by one as it applies, your
application should be complete when you return it to our office.

NOTICE OF FILING OF
APPLICATION FOR CAMA MAJOR
DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as required by NCGS
113A-119(b) that an application for development permit in an Area of Environmental Concern as designated
under the CAMA was received complete on December 16, 2013.
According to said application, the Town of Surf City proposes to install buoys and pile supported
signs to identify' restricted swimming & surfing zones, near 112 S. Shore Drive, adjacent to the Atlantic
Ocean, in Pender County. A copy of this entire application may be examined or copied at the office of Jason
Dail, N.C. Environment and Natural Resources, Division of Coastal Management, 127 Cardinal Drive
Extension, Wilmington, North Carolina 28405, (910-796-7215) during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400 Commerce
Avenue, Morehead City, NC 28557-3421, prior to January 10, 2014, will be considered in making the permit
decision. Later comments will be accepted and considered up to the time of permit decision. Project
modification may occur based on review and comment by the public and state and federal agencies. Notice of
the permit decision in this matter will be provided upon written request.
