Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Dockine Facility 1) Unless specifically altered herein, this permit authorizes the docks, piers, platforms and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Davis, Director Division of Coastal Management This permit and its conditions are hereby accepted. e of Permittee v' Surf City Crab, Inc. c/o Adrian Kugatow Permit 9108-14 Page 2 of 3 ADDITIONAL CONDITIONS C.11,v3) No p�rtion of the authorized docking facility shall extend beyond the established pier head line, beyond '/< the width of the waterbody or into the channel portion of the waterbody. 4) Any portion of the docking facility built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 5) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. New dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 6) The construction and/or operation of the authorized facilities shall not directly result in any closure of any waters that are open to the taking of shellfish. Any such closure directly attributable to the docking facility shall require that the permittee undertake remedial actions to remedy the situation. Such actions may include, but are not limited to, a removal of any unauthorized slips or mitigative measures to reduce or eliminate the cause(s) of the closure. 7) Should the adjacent property to the south be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) agreeing to allow the placement of the docking facility within the riparian corridor of that property, and a copy of the new agreement shall be submitted to the Division of Coastal Management prior to initiating construction of the docking facility. 8) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor to the north. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 10) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 11) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 12) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 13) This permit authorizes a total of (4) formalized boat slips in association with this docking facility. 'Surf City Crab, Inc. c/o Adrian I�ugatow Permit #108-14 Page 3 of 3 ADDITIONAL CONDITIONS General 14) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 15) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at b-q://www.fws.gov/ne- es/mammal/manatee guidelines.ndf. 16) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, without permit modification. 17) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 18) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is farther advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Resources has authorized the proposed project under DWR Project No. 14-1025. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. No. SAW-2014-01809. Shoreline length =103 Allowable square footage (Shoreline length X 8 ft.2) = 824ft.2 Proposed floating dock and floating finger piers = 6' x 82' = 492 ft2 = 4@4' x 16' = 256 ft2 Total = 748 ft.' The applicant's proposal to install a 6' x 82' floating dock and four-4' x 16' floating finger docks, resulting in a total of seven (7) slips, appears to be CONSISTENT with the Rules of 15 NCAC 7H.0205 (d) Use Standards for Coastal Wetlands, Rules of 15 NCAC 7H.0206 (d) Use Standards for Estuarine Waters, and Rules of 15 NCAC 7H.0207 (d) Use Standards for Public Trust Areas. It is staff s recommendation that the proposed docking facility is CONSISTENT with the Rules in 15 NCAC 7H.0208 (b) (6) Use Standards for Docks and Piers. Based on these factors, it is recommended that a permit be issued to install the proposed facility adjacent to the subject property. This office has no objections to the proposed project. Any permit issued should also include the following conditions: This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the established pier head line. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. This permit does not authorize the interference with any existing or proposed Federal project, and, the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 6. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third -party. 8. This permit authorizes a maximum of seven (7) boat slips at this facility. At no time shall more than seven (7) vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. 9. Condition emphasizing no heads, no cabins, limited to 24' in length, etc. should be applied. The attached notice requests federal agency comments on this project by November 6, 2014. The applicant proposes to construct a docking facility at 512 Roland Avenue, adjacent to Yow's Channel/Stump Sound, in Surf City, Pender County, North Carolina. The proposed docking facility includes the a 6' x 28' fixed pier, a 4' x 16' ramp, 6' x 82' floating dock and four 3' x 24' floating finger piers. Please see the field investigation report and the application for more detailed information concerning the proposed project and how the proposed facility compares to the existing facility. A copy of the applicant's permit application and plans is attached. Also, attached is a Google Earth (kmz) file and an image (jpg) file of the project area. This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery Conservation and Management Act. The Corps' initial determination is that the proposed project will not adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils or the National Marine Fisheries Service. The proposed water depths in the location of the proposed docking facility are between -2' and -8' relative to NLW. The project area is designated as PNA, but no dredging is proposed. SAV is not expected to be present due to the water depths at the project location. The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest North Carolina Natural Heritage Database. Based on available information, the Corps has determined that the project may affect but is not likely to adversely affect the West Indian manatee. The use of the Manatee Guidelines will be required as a result of this project. The project will not affect any other species listed as i threatened or endangered or their critical habitat formally designated pursuant to the Endangered Species Act of 1973 (ESA) within the project area. Pursuant to Section 106 of the National Historic Preservation Act (NHPA) of 1966, Appendix C of 33 CFR Part 325, and the 2005 Revised Interim Guidance for Implementing Appendix C, the District Engineer consulted district files and records and the latest published version of the National Register of Historic Places and initially determines that no historic properties, nor properties eligible for inclusion in the National Register, are present within the Corps' permit area: therefore, there will be no historic properties affected. PROJECT DESCRIPTION: The applicant's property is located at 512 Roland Avenue (NC Highway 50), approximately 0.2 miles beyond the Surf City swing bridge, in Surf City, Pender County. To find the property, take Highway 17 North from Wilmington and turn right on N.C. State Highway 50 (approximately 30 miles from Wilmington). Head east on Hwy 50 and cross over the Surf City swing bridge (turns into Roland Avenue). The property will be located on the left hand side of the road, between Max's Pizza and Hardee's. The high ground portion of the property is mostly cleared of vegetation and is relatively flat with an approximate elevation of 6.0' to 8.0' above Mean High Water (MEW). A gravel parking area comprises most of the site, but there are some small vegetated areas throughout. A few Southern Wax Myrtles (Merica cerifera) and Yaupons (Ilex vomitoria) exist on the water ward side of the property (bordering Yow's Channel), but no other shrub or woody vegetation exist otherwise. The property has approximately 103 linear feet of shoreline, which is naturally vegetated, but contains a fair amount of rubble and old concrete (rip -rap). The limited high ground vegetation is bordered by transitional species including Sea Oxeye (Borrichia frutescens) and Grounsel- bush (Baccharus halimifolia). Coastal marsh vegetation including: Spike Grass (Distichlis spicata) and Sea Lavender (Limonium, spp., exist in the inter -tidal zone and Salt Meadow Grass (Spartina patens) completes the transition to the waters edge where Smooth Cordgrass (Spartina alternii fora) is the predominant species. The area of Coastal Wetlands bordering the property, along the northern side, measures approximately 20'-25' in width. The project site is bordered to the west by Century 21 Action Properties, to the east by Surf City Crab, to the north by Yow's Channel and to the south by Roland Avenue (NC Highway 50). According to the Surf City Land Use Plan, the project site is located within an Urban Waterfront in the Town's Central Business District. The waters of Yow's Channel and Stump Sound, adjacent to the project site, are classified as SA by the North Carolina Division of Water Quality. They ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and according to maps provided by the Shellfish Sanitatio&n, they are CLOSED to the harvest of shellfish. SfP 2810 PROPOSED PROJECT: OCM.MHO cIM As designed, the applicant proposes to install a 6' x 30' access pier, 6' x 82' floating dock (spine) and four, 4' x 16' finger piers. According to the application package, the applicant would construct a 6' x 30' access pier from the central point of the property bordering Yow's Channel. The pier would originate from high ground and would extend approximately 30' toward the north, spanning a 20'-25' section of Coastal Wetlands before crossing any open water areas. At its terminus, the access pier would connect to a 4' x 16' ramp which would connect to the proposed 6' x 82' floating dock "spine". The spine would run parallel to the shoreline, and would be positioned approximately 25'-35' beyond the outer edge of marsh. Four, 4' x 16' floating finger piers would connect to the spine and would also span toward the north, providing dockage for up to seven (7) vessels (see Sheet 2 of 3 for layout of finger piers). As proposed, the docking facility would extend beyond the established pier -head line (*in this case the pier -head Rule restriction would not apply b/c the proposed pier structure is <100 feet), but would be located within `/< of the width of the water body. In addition, the proposed structures would be located outside of the adjacent channel (defined maintained dredged channel). The width of the water body (as measured from outer edge of marsh on one bank to the opposing edge of marsh on the opposite bank, and in the vicinity of the proposed structure) measures approximately 207' to 240', per the applicant's drawings. Surf City Crab, Inc. Page Two Date: September 23, 2014 The variation in the width of the water body is due to an indention in the shoreline in the immediate vicinity of the proposed access pier. The placement of the proposed structure(s) indicates that the adjacent 15' riparian corridor setback would be maintained to the west, but would result in an encroachment (up to and possibly within 6' of the riparian corridor line) to the east. As a result, the applicant has obtained a waiver from the property owner to the east, allowing the encroachment (see waiver form). Water depths surrounding the proposed structure(s) range from -2.0' to -8.0', relative to the Normal Low Water (NLW) contour. 10. ANTICIPATED IMPACTS As proposed, the planned development would incorporate approximately 2,460 sq. ft. of Public Trust and Estuarine Waters. The applicant has approximately 103 linear feet of shoreline allowing up to 824 sq. ft. of platform or docking space. As constructed, the total square footage of the planned pier/dock would equal 748 sq. ft. As designed, no impacts to Coastal or "404" wetlands would occur as a result of construction. Also and as previously indicated, the planned development would be located within '/4 of the width of the waterbody and outside of the adjacent defined maintained channel limits. As stated in the proposed project section, the applicant has received a written waiver from the adjacent riparian property owner to the east, allowing encroachment into the 15' Riparian Corridor Setback.
