Myrtle Grove Sound, 209 Florida Avenue, Carolina Beach as requested in the permittee's application dated 3/4/14, including the attached workplan drawings (2), both dated 3/4/14 This permit, issued on April R, 2014 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) Unless specifically altered herein, this permit authorizes the docks, piers, platforms and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary; shall become a permanent part of this docking facility without permit modification. No non -water dependentuses of structures shall be conducted on, in or over public trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at anytime from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) `This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case maybe. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work of project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2017 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. CONDITIONS 3) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. 4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5). The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 6) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7) _ The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. . 8}' This permit authorizes a total of (5) five formalized boat slips in association with this docking facility. General 9) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account .of any such removal or alteration. 10) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, without permit modification. This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. The N.C. Division of Water Resources has authorized the proposed project under DWR Project No. 10-0097 v2. The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. PROJECT DESCRIPTION: The physical address of the property is 209 Florida Ave., adjacent to the Carolina Beach Yacht Basin, in the Town of Carolina Beach, New Hanover County. To locate the applicant's property from the Wilmington Regional Office (WiRO) travel south onto College Road and then continue on Carolina Beach Road (US Highway 421) for approximately 15 miles. Approximately 2.5 miles from Snow's Cut Bridge, turn left onto Can Winner Drive and continue until you reach a stop sign at Canal Drive. Turn left onto Canal Drive and continue north approximately 2 miles until you reach Florida Ave. Turn left onto Florida Ave. and the property of interest will be located on the left hand side. The applicant's lot is approximately 0.51 acres and averages approximately 5 feet above normal high water (NHW). An elevated two story single family house remains on the applicant's property. Highground vegetation that exists on the property is primarily lawn grass and ornamental landscaping. The applicant's shoreline is stabilized by approximately 95 linear feet of timber retaining wall, which was authorized under CAMA General Permit No. 56607-D. Vegetation waterward of the existing retaining wall is an area of approximately 80 feet in width, which consists of mixed coastal wetlands and Section 404 wetlands consisting primarily of Black Needle Rush (Juncus roemarianus), Sea Oxeye (Borrichia frutescens) and Salt Meadow Grass (Spartina patens). These wetlands transition into low marsh, consisting of a narrow band of Smooth Cordgrass (Spartina altemiffora), approximately 15 feet in width. An existing 4 feet wide by 115 feet long elevated private pier extends over these wetlands into the Carolina Beach Yacht Basin/Myrtle Grove Sound. The pier terminates into an existing uncovered fixed platform, measuring approximately 12 feet in length by 12 feet in width. An access ramp leads onto an existing floating dock, measuring approximately 46 feet in length by 6 feet in width, which runs in the same alignment as the access pier. Another floating dock, measuring approximately 20 feet in length by 6 feet in width extends from the landward most end of this floating dock, which runs parallel to the shoreline. The floating dock then turns 90' a distance of approximately 25 feet in length by 6 feet in width, which extends perpendicular to the shoreline creating a "U-shaped" docking configuration. The existing docking facility was authorized to the previous property owner under State Permit No. 78-05, which accommodates up to four (4) vessels at this location. The applicant received CAMA General Permit No.57335-D to construct the existing fixed platform. The Carolina Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of the Carolina Beach Yacht Basin are classified SB# by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to replace an existing docking facilityCarolina Beach Yacht Basin in Myrtle Grove Sound. The existing access pier and platform wou d remain; howe a die existug floc in dock system would be entirely removed and replaced with a new "U-shaped" floating dock system. The proposed floating dock would consist of two (2) floating docks, each measuring 36 feet in length by 6 feet in width, which would run perpendicular to the shoreline towards the south. The floating dock on the western side of the "U-shaped" structure would run in the same alignment as the existing pier. Between the two floating docks would be one floating dock, measuring approximately 30 feet in length by 6 feet in width, which would run parallel to the shoreline. ANTICIPATED IMPACTS The proposed floating docks construction would incorporate approximately 612 sq. ft. of Estuarine Waters and Pubic Trust Area in an area essentially usurped by the existing docking facility. The proposed floating docks would extend approximately 80 feet into a waterbody which measures approximately 400 feet across. This distance would conform with both the 1/4 rule and the established pier lengths. As proposed, the applicant's proposal would not extend beyond the Town Carolina Beach Historical Pier -head Line. Minor increases in turbidity should be expected during construction. PROJECT DESCRIPTION: The physical address of the property is 209 Florida Ave., adjacent to the Carolina Beach Yacht Basin, in the Town of Carolina Beach, New Hanover County. To locate the applicant's property from the Wilmington Regional Office (WiRO) travel south onto College Road and then continue on Carolina Beach Road (US Highway 421) for approximately 15 miles. Approximately 2.5 miles from Snow's Cut Bridge, turn left onto Carl Winner Drive and continue until you reach a stop sign at Canal Drive. Turn left onto Canal Drive and continue north approximately 2 miles until you reach Florida Ave. Turn left onto Florida Ave. and the property of interest will be located on the left hand side. The applicant's lot is approximately 0.51 acres and averages approximately 5 feet above normal high water (NHW). An elevated two story single family house remains on the applicant's property. Highground vegetation that exists on the property is primarily lawn grass and ornamental landscaping. The applicant's shoreline is stabilized by approximately 95 linear feet of timber retaining wall, which was authorized under CAMA General Permit No. 56607-D. Vegetation waterward of the existing retaining wall is an area of approximately 80 feet in width, which consists of mixed coastal wetlands and Section 404 wetlands consisting primarily of Black Needle Rush (Juncus roemarianus), Sea Oxeye (Borrichia frutescens) and Salt Meadow Grass (Spartina patens). These wetlands transition into low marsh, consisting of a narrow band of Smooth Cordgrass (Spartina alterniflora), approximately 15 feet in width. An existing 4 feet wide by 115 feet long elevated private pier extends over these wetlands into the Carolina Beach Yacht Basin/Myrtle Grove Sound. The pier terminates into an existing uncovered fixed platform, measuring approximately 12 feet in length by 12 feet in width. An access ramp leads onto an existing floating dock, measuring approximately 46 feet in length by 6 feet in width, which runs in the same alignment as the access pier. Another floating dock, measuring approximately 20 feet in length by 6 feet in width extends from the landward most end of this floating dock, which runs parallel to the shoreline. The floating dock then turns 90° a distance of approximately 25 feet in length by 6 feet in width, which extends perpendicular to the shoreline creating a "U-shaped" docking configuration. The existing docking facility was authorized to the previous property owner under State Permit No. 78-05, which accommodates up to four (4) vessels at this location. The applicant received CAMA General Permit No.57335-D to construct the existing fixed platform. The Carolina Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of the Carolina Beach Yacht Basin are classified SB# by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to replace an existing docking facility within the Carolina Beach Yacht Basin, in Myrtle Grove Sound. The existing access pier and platform would remain; however, the existing floating dock system would be entirely removed and replaced with anew "U-shaped" floating dock system. The proposed floating dock would consist of two (2) floating docks, each measuring 36 feet in length by 6 feet in width, which would run perpendicular to the shoreline towards the south. The floating dock on the western side of the "U-shaped" structure would run in the same alignment as the existing pier. Between the two floating docks would be one floating dock, measuring approximately 30 feet in length by 6 feet in width,,which.would_ run parallel to the shoreline. The applicant states that the proposed floating dock structures would provide docking space for up to five (5) vessels in water depth ranging from approximately -1 :5 feet to -5 feet @ normal low water (NLW). ANTICIPATED IMPACTS The proposed floating docks construction would incorporate approximately 612 sq. ft. of Estuarine Waters and Pubic Trust Area in an area essentially usurped by the existing docking facility. This distance would conform with both the 1/4 rule and the established pier lengths. As proposed, the applicant's proposal would not extend beyond the Town Carolina Beach Historical Pier -head Line. Palm Cove, PDA, Inc., C/o Bert Exum Page Two 9. PROJECT DESCRIPTION The applicant's property is located at the far eastern end of Sunset Beach in Brunswick County. The property is located at the intersection of Canal Drive and Main Street, along the Main Street Extension. Directions from the Sunset Beach bridge are as follows: turn left at the stop sign after crossing the bridge and causeway onto Main Street; follow Main Street until it dead ends; turn right onto Main Street extension. The project site is located on a peninsula of land bordered by the waters of Tubbs Inlet to the north, and the Atlantic Ocean to the south. The property is 12.67 acres in size and is vegetated with typical ocean front vegetation along both the northern and southern side, consisting of Sea Oats (Uniola paniculato), American Beachgrass (Ammophilo breviligulata), Seashore Elder (Iva imbricate), Curly Leaf Yucca (Yucca filamentoso) and Prickly Pear Cactus (Opuntia spp.). The average elevation of the tract ranges from 6-12 feet above mean sea level. The property is a gated subdivision with an access road, electrical utilities and water services provided to the ten vacant lots. Each lot within the subdivision is platted from the MHW boundary of the Atlantic Ocean to the MHW boundary of Tubbs Inlet. The access road and utilities are located in the north central section of the property, outside of the 120 feet Ocean Hazard large structure setback, but well within the Ocean Hazard Area of Environmental Concern (AEC). CAMA Major Permit #11-06 was issued on January 18, 2006 and authorized the subdivision, roadway and utility improvements. The permit was modified on February 5, 2007 to include sand fencing. This permit was due to expire on December 31, 2009. However, the permit was subject to extension by the Session Law 2009-406, and as amended by Session Law 2010-177, the Permit Extension Act. The major permit was renewed on January 9, 2014 and is now due to expire on December 31, 2015. The Town of Sunset Beach has issued minor development permits to Brunswick Land Holdings, LLC for the construction of single family residences on Lot 2 and Lot 3, although construction has not been initiated. Currently, there is one private docking facility constructed adjacent to Lot 1. This structure was authorized by CAMA general permit # 38948 issued to Dean Belk on July, 26, 2005 and authorized a private two (2) slip docking facility in accordance with 15A NCAC 07H.1200. The property has approximately 950linear feet of shoreline bordering Tubbs Inlet and approximately 700linear feet bordering the Atlantic Ocean. No coastal wetland vegetation is present along the shoreline and an erosion escarpment is present along the entire northern shoreline adjacent to Tubbs Inlet, i.e. the location of the proposed pier. The erosion scarp along the northern shoreline varies in height and ranges from three to six feet. An on -site investigation and comparison of the submitted work plan drawings from this submission and the approved work plan drawings for Permit #11-06 reveal that the shoreline near the shared property boundary of Lot 2 and Lot 3 has eroded approximately 40 feet in the last ten years. The long-term average annual erosion rate in the vicinity of the property is 2.0 feet per year. The 100-year storm recession line for this area of Sunset Beach is 320 feet creating a total Ocean Erodible Area (OEA) of 440 feet. The waters of Tubbs Inlet are classified as SA HQW bythe North Carolina Division of Water Quality and are open to the harvest of shellfish and the waters of the Atlantic Ocean are classified as SB. This area of Tubbs Inlet is NOT designated as Primary Nursery Area. PROPOSED PROJECT The applicant is proposing to modify CAMA Major Permit #11-06 and construct a private nine (9) slip community docking facility. The applicant is proposing to establish a ten feet wide easement and community area for access to the proposed boating facility along the shared property boundary between Lot 2 and Lot 3. Lot 2 has approximately 132 linear feet of frontage along Tubbs Inlet and Lot 3 has approximately 105 linear feet of shoreline along Tubbs Inlet. The proposed community docking facility would originate from the high ground of the shared lot line and would extend approximately 15 feet water ward of the Mean High Water boundary (MHW). The access pier would terminate at a proposed gazebo measuring approximately 20 feet wide by 20 feet long. The gazebo would be connected via an access ramp, to a proposed main spine floating dock. The proposed main spine floating dock would measure approximately 6 feet in width and 135 feet in length. The applicant is proposing to install six (6) finger piers each measuring approximately 4 feet in width and 24 feet in length adjacent to the main spine. The finger piers would be oriented perpendicular to the proposed main spine floating dock and would define the nine (9) slips (see sheet 2 of 2). As proposed, each slip would be equipped with a boatlift measuring approximately 12 feet in width by 12 feet in length. The width of Tubbs inlet in the location of the proposed docking facility is approximately 766 feet as measured from the erosion scarp on the near shore side and the edge of coastal wetland vegetation on the opposite shoreline. As proposed, the docking facility would extend approximately 90 feet into a water body that measures approximately 766 feet in width. The applicant has sited the proposed docking facility the conform to the established pier head line of the adjacent docking facility and would not extend into the channel portion of the water body, which is located along the -4 feet MLW contour. Water depths in the location of the docking facility average -2.5 feet at MLW. The proposed docking facility would provide mooring for nine (9) vessels and would serve the residents of the private community. 11. ANTICIPATED IMPACTS: As proposed the docking facility would extend approximately 90 feet into a water body that measures approximately 766 feet in width. The proposed docking facility would not extend into the channel portion of the water body and would be located along the -4 feet water depth contour of Tubbs Inlet. The proposed docking facility would incorporate approximately 4,660 square feet of Public Trust Area and Estuarine Waters Areas of Environmental Concern. The proposed docking facility would result in the shading of approximately 1,876 square feet of Public Trust Area and Estuarine Waters Areas of Environmental Concern. As proposed, the docking facility would not exceed the X of the width of the water body limitation, not exceed the established pier head line, nor encroach into the channel portion of the water body. The proposed docking facility would not encroach into either 15 foot adjacent riparian property owner setback. As proposed the docking facility would provide mooring for nine (9) vessels; however, it appears that an additional two (2) vessels could be moored on the sides of the outboard finger piers. Jink's Creek is located in the Lumber River Basin and designated as SA-HQW waters by NCDENR with a stream index #15-25-9 The subdivision is not built out with homes yet due to the down turn in the residential development economy. Lot #1 has an existing boat dock and pier. All roads and utilities are installed. Stormwater Permit #SW8 051025 was approved for Palm Cove on December 16, 2005. Because of the low density classification and the substantially high infiltration rates of the sand there are no permitted BMP's required. A copy of the approved Stormwater Permit is included in Appendix B. A Water Distribution Permit and Authorization to Construct (#DEH-0501612) were issued for Palm Cove on 10/11/2005. CAMA Minor Permits for Lot 2 (SB-09-02) and Lot 3 (SB-09-03) were issued to Brusnwi*k Land Holdings, LLC on 4/13/2009. Proposed Project Palm, Cove POA, Inc. is proposing the addition of community amenities to the Palm Cove subdivision (see vicinity map in Appendix C) including a wooden access walkway, gazebo and floating dock and pier with 9 boat slips. A wooden walkway is proposed along the easement from the roadway and terminating at the mean high water (MHW) line. From the MHW line a 6' wooden dock ends in a 20' x 20' gazebo. The gazebo will be constructed on wood pilings at the approximate MLW line. A ramp will connect the gazebo to the proposed floating dock. The dock system consists of a floating dock spine located along the lot line between Lot #2 and Lot #3 which extends perpendicular from the shore attached to a floating dock spine which extends parallel to the shore (forming a "tee") to the 1/4-width of the waterbody limit. The nine slips are located on the north side of the parallel dock spine accessed by floating finger docks. A hydrographic survey was completed in October, 2013 by Cape Fear Engineering, Inc. The proposed site plan and section details are included in Appendix E. In addition, boat lifts are proposed to prevent boats from sitting on the intertidal mud flat during portions of the tidal cycle. Water depths inside the slips would be between -3' MLW and -4' MLW. Existing Fixed platform = 144 sq. ft. Proposed floating dock (western side)= 216 sq. ft. (not calculated due to width and alignment.) Proposed floating dock (eastern side)= 216 sq. ft. Proposed floating dock (between the eastern and western docks)= 180 sq. ft. Total = 540 sq. ft. The replacement of the existing docking facility would provide docking space for the total up to five (5) vessels at this location. It appears that the project is consistent with the use standards set forth in NCAC 07H .0208(b)(6), including the'% width rule, the eight square foot rule and the pier width rule. The proposed structures would be located entirely over open water. If the project is determined to be consistent with NCAC 07H .0208(b)(6), it is recommended that any permit issued should include the following conditions: This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the established pierhead line. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 5. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 6. This permit does not authorize the interference with any existing or proposed Federal project, and, the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third -party. 8. This permit authorizes a maximum of five (5) boat slips. At no time shall more than five (5) vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. 9. PROJECT DESCRIPTION: The physical address of the property is 209 Florida Ave., adjacent to the Carolina Beach Yacht Basin, in the Town of Carolina Beach, New Hanover County. To locate the applicant's property from the Wilmington Regional Office (WiRO) travel south onto College Road and then continue on Carolina Beach Road (US Highway 421) for approximately 15 miles. Approximately 2.5 miles from Snow's Cut Bridge, turn left onto Carl Winner Drive and continue until you reach a stop sign at Canal Drive. Turn left onto Canal Drive and continue north approximately 2 miles until you reach Florida Ave. Turn left onto Florida Ave. and the property of interest will be located on the left hand side. The applicant's lot is approximately 0.51 acres and averages approximately 5 feet above normal high water (NHW). An elevated two story single family house remains on the applicant's property. Highground vegetation that exists on the property is primarily lawn grass and ornamental landscaping. The applicant's shoreline is stabilized by approximately 95 linear feet of timber retaining wall, which was authorized under CAMA General Permit No. 56607-D. Vegetation waterward of the existing retaining wall is an area of approximately 80 feet in width, which consists of mixed coastal wetlands and Section 404 wetlands consisting primarily of Black Needle Rush (Juncus roemarianus), Sea Oxeye (Borrichia frutescens) and Salt Meadow Grass (Spartina patens). These wetlands transition into low marsh, consisting of a narrow band of Smooth Cordgrass (Spartina a/temiflora), approximately 15 feet in width. An existing 4 feet wide by 115 feet long elevated private pier extends over these wetlands into the Carolina Beach Yacht Basin/Myrtle Grove Sound. The pier terminates into an existing uncovered fixed platform, measuring approximately 12 feet in length by 12 feet in width. An access ramp leads onto an existing floating dock, measuring approximately 46 feet in length by 6 feet in width, which runs in the same alignment as the access pier. Another floating dock, measuring approximately 20 feet in length by 6 feet in width extends from the landward most end of this floating dock, which runs parallel to the shoreline. The floating dock then turns 90' a distance of approximately 25 feet in length by 6 feet in width, which extends perpendicular to the shoreline creating a "U-shaped" docking configuration. The existing docking facility was authorized to the previous property owner under State Permit No. 78-05, which accommodates up to four (4) vessels at this location. The applicant received CAMA General Permit No.57335-D to construct the existing fixed platform. The Carolina Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of the Carolina Beach Yacht Basin are classified SB# by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to replace an existing docking facility within the Carolina Beach Yacht Basin, in Myrtle Grove Sound. The existing access pier and platform would remain; however, the existing floating dock system would be entirely removed and replaced with anew "U-shaped" floating dock system. The proposed floating dock would consist of two (2) floating docks, each measuring 36 feet in length by 6 feet in width, which would run perpendicular to the shoreline towards the south. The floating dock on the western side of the "U-shaped" structure would run in the same alignment as the existing pier. Between the two floating docks would be one floating dock, measuring approximately 30 feet in length by 6 feet in width, which would run parallel to the shoreline. The applicant states that the proposed floating dock structures would provide docking space for up to five (5) vessels in water depth ranging from approximately -1.5 feet to -5 feet @ normal low water (NLW). This distance would conform with both the 1/4 rule and the established pier lengths. As proposed, the applicant's proposal would not extend beyond the Town Carolina Beach Historical Pier -head Line.
