Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Dockina Facility 1) Unless specifically altered herein, this permit authorizes only the two additional personal watercraft lifts and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work IMMV0 (See attached sheet for Additional Conditions) AUG Z 7 1 This ner nit action may be annealed by the oermittee or Signed by the authority of the Secre W43LYNR and the other qualified persons within twenty (20) days of the issuing date. Any maintenance work or project modification not covered hereunder requires further Division approval. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) This permit authorizes two additional boat slips for a maximum of three formalized boat slips. General 7) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 8) The permittee and/or his contractor shall meet with a representative of the Division of Coastal Management prior to project initiation in order to discuss the conditions set forth in this permit 9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is finther advised that many development or land disturbing activities are not allowed within the Environmental Management Commission's Tar Pamlico River Basin. Contact a representative of the Division of Water Quality at (252) 946- 6481 for more information concerning allowable uses within the Tar Pamlico River Buffer. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. SAW-201401213. The project site is a single-family residential lot located off SR 1969 at 1161 Whealton Point Road on the south side of Lower Spring Creek near the Town of Aurora in Beaufort County, North Carolina. The lot is approximately 0.3 acres (14,350 ftz) in size and has approximately 72 linear feet of shoreline. Man-made features on the lot include a single-family residence, t153' long pier with a t8' by t22' T-head platform, t4' by t8' platform and an uncovered boatlift. A narrow fringe of coastal wetlands is present along the shoreline on the west side of the property and gradually widens to approximately 20' on the east side of the property and is separated from the upland portion of the property with a broken concrete/riprap revetment. Water depth at the terminal end of the pier structure is approximately -4.0' below Normal Water Level (NWL). There was no SAV observed in the area of the existing pier/docking facility. There is currently one formalized slip existing. Landward of the NWL the elevation gradually slopes upward to an approximate elevation of t3.5' above the NWL. The lot is mostly vegetated with lawn grasses and ornamental shrubs. Both adjacent properties on the upstream (west) side and downstream (east) side are developed lots with riprap stabilized shorelines and single family dwellings which have piers. Both the adjacent properties are similarly vegetated lawn grasses, ornamental shrubs and a narrow fringe of Coastal wetlands along the shoreline. Lower Spring Creek is classified as SA HQW NSW by the Environmental Management Commission at the project site. Lower Spring Creek at this location is designated Inland Waters and is not open to shell fishing. Project description The applicant proposes to install two uncovered single -pile Personal Watercraft (PWC) lifts adjacent to the existing pier. The addition of the two PWC lifts will bring the total number of slips to three. The water depth at the proposed location of the PWC lifts is approximately -3.5' below NWL.
