Dockina Facility
1) Unless specifically altered herein, this permit authorizes only the two additional personal watercraft
lifts and uses located in or over the water that are expressly and specifically set forth in the permit
application. No other structure, whether floating or stationary, shall become a permanent part of this
docking facility without permit modification. No non -water dependent uses of structures shall be
conducted on, in or over public trust waters without permit modification.
2) No attempt shall be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work IMMV0

This ner nit action may be annealed by the oermittee or Signed by the authority of the Secre W43LYNR and the
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or

personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2017

interest.
5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
6) This permit authorizes two additional boat slips for a maximum of three formalized boat slips.
General
7) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
8) The permittee and/or his contractor shall meet with a representative of the Division of Coastal
Management prior to project initiation in order to discuss the conditions set forth in this permit
9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.

such activity for this determination. The permittee is finther advised that many development or
land disturbing activities are not allowed within the Environmental Management Commission's
Tar Pamlico River Basin. Contact a representative of the Division of Water Quality at (252) 946-

project site is a single-family residential lot located off SR 1969 at 1161 Whealton Point Road on the south side of
Lower Spring Creek near the Town of Aurora in Beaufort County, North Carolina The lot is approximately 0.3
acres (14,350 ft') in size and has approximately 72 linear feet of shoreline. Man-made features on the lot include a
single-family residence, f 153' long pier with a f8' by +22' T-head platform, t4' by f8' platform and an uncovered
boatlift. A narrow fringe of coastal wetlands is present along the shoreline on the west side of the property and
gradually widens to approximately 20' on the east side of the property and is separated from the upland portion of
the property with a broken concrete/ripmp revetment. Water depth at the terminal end of the pier structure is
approximately -4.0' below Normal Water Level (NWL). There was no SAV observed in the area of the existing
pier/docking facility. There is currently one formalized slip existing. Landward of the NWL the elevation gradually
slopes upward to an approximate elevation of:0.5' above the NWL. The lot is mostly vegetated with lawn grasses
and ornamental shrubs.
Both adjacent properties on the upstream (west) side and downstream (east) side are developed lots with
riprap stabilized shorelines and single family dwellings which have piers. Both the adjacent properties are similarly
vegetated lawn grasses, ornamental shrubs and a narrow fringe of Coastal wetlands along the shoreline.
Lower Spring Creek is classified as SA HQW NSW by the Environmental Management Commission at the
project site. Lower Spring Creek at this location is designated Inland Waters and is not open to shell fishing.
Project description
The applicant proposes to install two uncovered single -pile Personal Watercraft (PWC) lifts adjacent to the
existing pier. The addition of the two PWC lifts will bring the total number of slips to three. The water depth at the
proposed location of the PWC lifts is approximately -3.5' below NWL.
Anticipated impacts
The project will result in localized turbidity due to the installation of two 8" round pilings. The PWC lift will result
in a total shading impact of±20 W.

Staff has reviewed the proposed project with regard to rules found in Subchapter 7H concerning
development in a Public Trust Area. It is staffs recommendation that the proposed project appears consistent
with 15A NCAC 07H .0208 as described below.
This office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(E) which states in part
that "The total area enclosed by an individual boat lift shall not exceed 400 square feet except to accommodate
a documented need for a larger boat lift". The applicant has proposed two uncovered PWC lifts which is
approximately 20 ft2 in size.
Staff recommends the following conditions be included if the project is permitted.
1. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
2. This permit authorizes only the structures and uses located in or over the water that are expressly and
specifically set forth in the permit application. No other structure, whether floating or stationary, may
become a permanent part of this docking facility without permit modification. No non -water dependent
uses of structures may be conducted on, in or over public trust waters without permit modification.
3. This permit authorizes a maximum of three boat slips.

The project is new work. The purpose is to install two Personal WaterCraft, (PWC)
lifts to existing pier. The PWC lifts will be bolted to two existing pilings on the east
side of the pier using a drill and hand tools. No construction equipment will be
used to complete the project. The PWC lifts will be used to dock two 10'x 3'
PWCs. One boat lift exists on the property. Completion of the PWC lift project will
allow for 3 docking spaces on the property.

LUP Consistency Determination: The proposal is Consistent With & Not in Conflict with the
1997 Beaufort County Land Use Plan certified by the CRC on January 13, 2010.
Overview:
The Areas of Environmental Concern (AECs) impacted by the proposal include Estuarine Water and
Public Trust Area. The waters are classified as SA; HQW; NSW and are closed to the harvesting of
shellfish. The area is not classified as primary nursery area.
Development within the designated AECs is limited by CAMA regulations and development
guidelines. Applicable or related policy includes the following:
"Only development and land/water use activities that are consistent with the use
standards for coastal wetlands, estuarine waters, and public trust areas (15A NCAC

James R. Starling has submitted a CAMA Major Permit request for development onsite his property. The
project site is a single-family residential lot located off SR 1969 at 1161 Whealton Point Road on the south side of
Lower Spring Creek near the Town of Aurora in Beaufort County, North Carolina. The lot is approximately 0.3
acres (14,350 ftz) in size and has approximately 72 linear feet of shoreline. Man-made features on the lot include a
single-family residence, t153' long pier with a t8' by t22' T-head platform, t4' by t8' platform and an uncovered
boatlift. A narrow fringe of coastal wetlands is present along the shoreline on the west side of the property and
gradually widens to approximately 20' on the east side of the property and is separated from the upland portion of
the property with a broken concrete/riprap revetment. Water depth at the terminal end of the pier structure is
approximately -4.0' below Normal Water Level (NWL). There was no SAV observed in the area of the existing
pier/docking facility. There is currently one formalized slip existing. Landward of the NWL the elevation gradually
slopes upward to an approximate elevation of t3.5' above the NWL. The lot is mostly vegetated with lawn grasses
and ornamental shrubs.
Both adjacent properties on the upstream (west) side and downstream (east) side are developed lots with
riprap stabilized shorelines and single family dwellings which have piers. Both the adjacent properties are similarly
vegetated lawn grasses, ornamental shrubs and a narrow fringe of Coastal wetlands along the shoreline.
Lower Spring Creek is classified as SA HQW NSW by the Environmental Management Commission at the
project site. Lower Spring Creek at this location is designated Inland Waters and is not open to shell fishing.
Project description
The applicant proposes to install two uncovered single -pile Personal Watercraft (PWC) lifts adjacent to the
existing pier. The addition of the two PWC lifts will bring the total number of slips to three. The water depth at the
proposed location of the PWC lifts is approximately -3.5' below NWL.
Anticipated impacts
The project will result in localized turbidity due to the installation of two 8" round pilings. The PWC lift will result
in a total shading impact of ±20 ft2.

The project is new work. The purpose is to install two Personal WaterCraft, (PWC)
lifts to existing pier. The PWC lifts will be bolted to two existing pilings on the east
side of the pier using a drill and hand tools. No construction equipment will be
used to complete the project. The PWC lifts will be used to dock two 10'x 3'
PWCs. One boat lift exists on the property. Completion of the PWC lift project will
allow for 3 docking spaces on the property.

The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development of your property located off SR 1969 at 1161 Whealton Point
Road adjacent Lower Spring Creek near the Town of Aurora in Beaufort County, North
Carolina. It was received on 17 June 2014, and appears to be adequate for processing at this time.
The projected deadline for making a decision is 31 August 2014. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have not
been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day. Kelly Spivey,
Field Representative for the Division of Coastal Management is responsible for processing your permit
and he can be reached at 252-948-3853 or via email at Ke11y.Spivey@.ncdenr.gov if you have any
questions.
If this agency does not render a permit decision within 70 days from the 17 June 2014,
you may request a meeting with the Director of the Division of Coastal Management and permit
staff to discuss the status of your project. Such a meeting will be held within five working days
from the receipt of your written request and shall include the property owner, developer, and
project designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a 'Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property, or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.

The project is new work. The purpose is to install two Personal WaterCraft, (PWC)
lifts to existing pier. The PWC lifts will be bolted to two existing pilings on the east
side of the pier using a drill and hand tools. No construction equipment will be
used to complete the project. The PWC lifts will be used to dock two 10'x 3'
PWCs. One boat lift exists on the property. Completion of the PWC lift project will
allow for 3 docking spaces on the property.

Grantors, to JAMES ROBERT STARLING and Wife, ANTOINETTE ADELE
STARLING, hereinafter designated as Grantees;
W I T N E S S E T H:
That the Grantors for and in consideration of the sum of
TEN DOLLARS ($10.00) and other valuable considerations to
them paid by the Grantees, the receipt of which is hereby
acknowledged, have bargained and sold, and by these presents
do hereby bargain, sell and convey unto the Grantees, their
heirs, successors and assigns, in fee simple, all that
certain lot or parcel of land lying and being in Richland
Township, Beaufort County, North Carolina, more particularly
described as follows:
IT BEGINS at a stake in a ditch in the Southeast corner

Easterly direction approximately 70 feet to a stake on the

There is reserved, however, from the property above
described a 12 foot permanent easement for the use of J. W.
Hawkins and Wife, Alice R. Hawkins, their successors and

Begins at an iron stake in the ditch in the Southeast
corner of the Cecil B. Thompson property and from said point
of beginning it runs thence in an Easterly direction
approximately 70 feet to a stake on the ditch bank, corners;
and runs thence in a Northerly direction 12 feet, corners;
and runs thence in a Westerly direction 70 feet to a point in
the Southeasterly line of Cecil B. Thompson, corners; and
runs thence in a Southerly direction 12 feet to the point of
beginning.
Reference is made to deed in Book 806, Page 283, Beaufort

The above described property is the same as shown on that
map or survey entitled "James Robert Starling" dated May 26,

Also conveyed herewith is a right of ingress, egress and
regress from the above described property to State Road 1901
as evidenced by those deeds of easements recorded in Deed

A further exception is made for that 15 foot right of way
which was granted by the Grantors herein to Rita M. Harris,

and all privileges and appurtenances thereunto belonging or

liens and encumbrances, except 1992 Beaufort County Ad
