Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be nun ana vota. Docking Facility 1) Unless specifically altered herein, this permit authorizes only the additional boatlift and personal watercraft lift to the existing docking facility and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Smithwick Permit # 62-14 Page 2 of 3 ADDITIONAL CONDITIONS 2) p shall be made by the permittee to prevent the full and free use by the public of all navigable weadjacent to the authorized work 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) This permit authorizes a maximum of two formalized boat slips. Upland Development 7) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the relocation of the residence and the construction of the deck, driveway, and retaining wall, all as expressly and specifically set forth in the attached permit application and workplan drawing. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (252) 946-6481 for this determination. Shoreline Stabilization 8) Unless specifically altered herein, this permit authorizes refurbishing the existing riprap that are expressly and specifically set forth in the permit application and workplan drawings. 9) The authorized riprap shall adhere to the alignment depicted on the attached workplan drawings. 10) The riprap material shall be free from loose dirt or any pollutant. It must be of a size sufficient to prevent its movement from the approved alignment by wave or current action. 11) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite, marl, or broken concrete. Smithwick Permit # 62-14 Page 3 of 3 ADDITIONAL CONDITIONS Sedimentation and Erosion Control 12) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.) General 14) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 15) No vegetated wetlands shall be excavated or filled outside the area indicated on attached workplan drawings. 16) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 17) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The pennittee is further advised that many development or land disturbing activities are not allowed within the Environmental Management Commission's Tar Pamlico River Buffer. Contact a representative of the Division of Water Resources at (252) 946-6481 for more information concerning allowable uses within the Tar Pamlico Buffer. NOTE: The N.C. This property will be used as a single family residence. The project involves moving a 1100sq ft river cottage onto this property from the adjacent property. The house will be picked up and moved approximately 150ft to its new location. Meetings have taken place on site with Kelly Spivey - NC DENR, William Wescott —Army Corps of Engineers, and Anthony Scarborough — NC DWQto understand the environmental considerations relating to the subject property and project. A septic permit has also been approved by Beaufort County. The building pad will be leveled and slightly raised to accommodate the home. Careful consideration was given to the placement of the home. The building pad will not encroach on any wetlands. The wetlands have been delineated by William Wescott. I am requesting to fill 404 wetlands in front of the home towards the waterfront. This is needed to create a path from the home to the waterfront. Fill area is approximately 3583sq ft. and will avoid zone 1 of the TarPam buffer. I need to be able to go over the ground with a golf cart or other small vehicle. My wife's grandfather is physically impaired due to recent brain surgery and cannot walk on his own. He must be moved by vehicle. He is an avid fisherman and he looks forward to fishing from our pier, but we must get him to the water via vehicle. I will also need to have vehicle access to the pier in order to service the boat and watercraft that will be there. I propose to improve the existing rip rap along the shoreline. It was put in place several years ago, but has started to degrade in recent years. I also propose to install a land based bulkhead to separate the wetland area from the upland area. The bulkhead will not cross into the TarPam Zone 1 Buffer. The existing driveway will have additional fill brought in. Some of the driveway falls within the 50ft Tar Pam Buffer. The only land based access to the property is through an easement off Nance Lane which is in the TarPam 50ft buffer. Efforts were made to minimize impact on the buffer. Finally, I proposed to install 2 uncovered boat lifts on the existing dock. One will be a boat slip and one will be a personal watercraft slip. The boat slip will have 4 poles installed. The personal watercraft slip will have 1-2 poles installed. Each will have electric lifts to raise the vessels out of the water. All improvements to the property will be done by professional contractors and me. Every effort will be made to minimize environmental impact based on the described work above. Approximately 2,100 ft2 of crush and run will be placed within the N.0 Division of Water Resources Tar -Pamlico Basin 50' Buffer for the construction of a driveway. The applicant proposed to fill approximately 4,322 ft2 of delineated Section 404 wooded wetlands which are located between the proposed dwelling and the Pamlico River. The fill will be retained with an approximately 70' long retaining wall. The applicant proposes to continue this retaining wall along the landward edge of the delineated Section 404 wooded wetlands. Additionally, the applicant proposes to install a 13' by 13' uncovered boatlift and 4' by 8' single pile Personal Watercraft lift on the downstream side of the existing pier for a total of two fixed slips. The existing rip rap revetment that was permitted via CAMA Major Permit # 165-96 will be repaired and maintained by placing new rip rap atop the existing. Staff has reviewed the proposed project with regard to rules found in Subchapter 7H, specifically those governing development in a Public Trust Area (7H.0208), Estuarine Water (7H.0206) and Coastal Shoreline (7H.0209). Barring any denial of the other required permits or authorizations from the USACOE or Division of Water Resources and any significant objections from the commenting agencies responsible for the review of this permit application, staff recommends that the permit be issued. This office feels the development is consistent with 15A NCAC 07H .0209(d)(2) which states in part that "Impervious surfaces shall not exceed 30% of the AEC area of the lot". The applicant is proposing an impervious surface coverage of f3,520ft2, or 8% of the Coastal Shoreline Area of Environmental Concern. This office also feels the construction of the boat lifts is consistent with 15A NCAC .0208(b)(6)(E) which states in part "The total area enclosed by an individual boat lift shall not exceed 400 square feet". Smithwick Pamlico River Beaufort County Proiect Settine RECENED MAY 12 2014 DCM-MHD CITY The project site is located off SR 1309 at 270 Nance Lane adjacent Pamlico River near the City of Washington in Beaufort County, North Carolina. The lot is approximately 1.24 acres (53,578ft2) in size and has approximately 588 linear feet of shoreline. Along the downstream (eastern) edge of the property a canal is present which connects to the Pamlico River. The canal is f 15' in width and has not been maintained in many years. The adjacent upstream (western) property is a developed lot which features a single-family dwelling with a bulkhead and pier with boathouse. The U.S. Army Corps of Engineers has delineated Section 404 wetlands along both the edge of the Pamlico River and canal. Man-made features on the project site include a pier with platform and a rip rap revetment for shoreline stabilization along the River edge. Water depths at the terminal end of the existing pier structure range from -4.0 to — 4.5' below Normal Water Level (NWL). Landward of the Normal Water Level the elevation gradually slopes upward to an approximate elevation of f6' above the NWL. The uplands are vegetated with pines, and mixed hardwoods, while the scrub/shrub non coastal wetland vegetation includes Carex spp., Tvpha spp. and Peltandra virginica. Mr. N. HenryMoore and Stuart B. Moore were issued CAMA Major Permit No. 165-96 on 6 December 1996 for development located on this same property. The permit was issued for the construction of a bridge, excavation of a man-made basin, maintenance excavation within the canal, canal widening, shoreline stabilization, and pier. The only development completed under the previous permit was the construction of the pier and installation of rip rap along the River shoreline. The permit was renewed several times. The permit was transferred to Figure 8 Partners, LLC on 4 January 2005 and then transferred to Mr. Andrew Rose on 23 March 2005. The permit expired on 31 December 2005. The Pamlico River is classified as SB NSW by the Environmental Management Commission at the project site. The Pamlico River at this location is Coastal Waters and is not open to shell fishing. Project Description The applicant proposes to relocate the existing 23' x 39' residence from the adjacent property to the west to the project site. A 12' x 39' deck will be located on the River side of the dwelling. The dwelling will be approximately 60' landward of the canal and 130' landward of the Pamlico River. Approximately 2,100 ftz of crush and run will be placed within the N.0 Division of Water Resources Tar -Pamlico Basin 50' Buffer, as measured from the canal, for the construction of a driveway. The applicant proposes to fill approximately 4,322 ft2 of delineated Section 404 wooded wetlands which are located between the proposed dwelling and the Pamlico River. The fill will be retained with an approximately 70' long retaining wall. The applicant proposes to continue this retaining wall along the landward edge of the delineated Section 404 wooded wetlands. Additionally, the applicant proposes to install a 13' by 13' uncovered boatlift and 4' by 8' single pile Terry A. Anticipated Impacts The project will result in localized turbidity as a result of the installation of the boatlift pilings. Approximately 4,322 ft2 of delineated U.S Army Corps of Engineers Section 404 wooded wetlands will be filled. Approximately 1,375 ft' of the Section 404 wetland fill is located within the Tar -Pamlico River Basin 50' Buffer. The proposed driveway will impact approximately 2,100 W of the N.C. Division of Water Resources Tar -Pamlico River Basin 50' Buffer. The construction of single-family dwelling with associated driveway will result in the impervious coverage off 3,520 ft' (approximately 8%) of the Estuarine Shoreline Area of Environmental Concern. Kelly Spivey - Washington Regional Office - 8 May 2014 CAMA Major Permit Application Project Narrative The subject property is located on the north side of the Pamlico River near Washington North Carolina. This property will be used as a single family residence. The project involves moving a 1100sq ft river cottage onto this property from the adjacent property. The house will be picked up and moved approximately 150ft to its new location. Meetings have taken place on site with Kelly Spivey - NC DENR, William Wescott —Army Corps of Engineers, and Anthony Scarborough — NC DWQ to understand the environmental considerations relating to the subject property and project. A septic permit has also been approved by Beaufort County. The building pad will be leveled and slightly raised to accommodate the home. Careful consideration was given to the placement of the home. The building pad will not encroach on any wetlands. The wetlands have been delineated by William Wescott. I am requesting to fill 404 wetlands in front of the home towards the waterfront. This is needed to create a path from the home to the waterfront. Fill area is approximately 4300sq ft. I propose to improve the existing rip rap along the shoreline. It was put in place several years ago, but has started to degrade in recent years. I also propose to install a land based bulkhead to separate the wetland area from the upland area. The existing driveway will have additional fill brought in. Some of the driveway falls within the 50ft Tar Pam Buffer. The only land based access to the property is through an easement off Nance Lane which is in the TarPam 50ft buffer. Efforts were made to minimize impact on the buffer. Finally, I proposed to install 2 uncovered boat lifts on the existing dock. One will be a boat slip and one will be a personal watercraft slip. The boat slip will have 4 poles installed. The personal watercraft slip will have 1-2 poles installed. Each will have electric lifts to raise the vessels out of the water. All improvements to the property will be done by professional contractors and me. Every effort will be made to minimize environmental impact based on the described work above.
