Important to my evaluation is that the isolated wetlands are in fact a closed pocket rather than a continuous trough connected by drainage to other wetlands on other properties. Additionally, the wetland area to be filled does not directly filter or connect run-off to the ORW waters of Bogue Sound. I believe a CAMA permit can be issued with confidence not only for the house and pier construction but also for the filling of the wetlands. I have no objections to the issuance of the LAMA permit. They propose to construct a private residence with a pier into Bogue Sound. AECs impacted by the proposed work include the Estuarine Shoreline, Coastal Wetlands, and Estuarine Waters. '404' wetlands will also be impacted by the driveway planned for the house. Waters at the site are included in the Western Bogue Sound Outstanding Resource Waters (ORW) and are classified as SA. The area is open to the harvesting of shellfish and is not a Primary Nursery Area. I have reviewed this proposal for consistency with the 1992 Town of Emerald Isle Land Use Plan (LUP) Update and offer the following comments. The general area of the project is classified as Developed Residential, while the AECs and 1404' wetlands impacted by the work are classified as Conservation. The LUP discusses the Conservation classification on Pages IV-2 through IV-4. Emerald Isle allows development in Coastal Wetlands, the ORW Estuarine Shoreline and ORW Estuarine Waters which meets the 7H Use Standards, town zoning, policies contained in the LUP, and the ORW Management Plan. A few policies in the Plan exceed the State's minimum use standards for development in AECs, but none of these more restrictive policies appear to be applicable to this proposal. Development in Conservation classified 1404' wetlands must be consistent with local zoning and the policy section of the LUP. Beyond these requirements, Emerald Isle will accept the permitting standards of the U.S. Army Corps of Engineers. Applicable policies contained in the Land Use Plan include those for Marine Resource Areas (Page V-9). These policies provide that with the exception of the construction of signs, Emerald Isle supports the 7H Use Standards for development in Estuarine Waters. These policies also state support for the Western Bogue Sound Management Plan. f Resource Production and Management Policies include those for Residential, Commercial and Industrial Impacts on Resources (Page V-8). These policies reiterate the Town's intentions to allow residential development in Estuarine Shoreline Areas which meets the 7H Use Standards, where applicable the Bogue Sound ORW Management Plan, and the policies contained in the Plan. Resource Protection Policies regarding Physical Limitations (Pages V-1 and V-2) address septic tanks. Emerald Isle opposes the installation of septic tanks in any areas classified as '404' wetlands. A site visit was conducted on January 3, 1996. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.) and the Coastal Area Management Act (G. S. 113A-100 through 113A-128). The applicant proposes to construct a private pier approximately 223 feet long as measured from the mean high water level. The 6 foot wide pier will extend some 38 feet across the marsh grass and continue another 175 feet into Bogue Sound before terminating with a T- head platform measuring 10 feet wide by 40 feet long. Waters at the site are classified SA by the Division of Environmental Management and are open to the harvest of shellfish. The primary adverse impact anticipated to result from the project is turbidity associated A &qw-FM with construction. Elevated turbidity could reduce water quality in this area and stress marine organisms. Excessive turbidity is particularly damaging to egg and larval life stages of marine organisms. The project site has good quality waters (SA) and is open to the harvest of shellfish, Therefore, we recommend that excavation be prohibited between April 1 and September 30. PROJECT SUMMARY: The applicants propose to construct their private residence adjacent to the Outstanding Resource Waters of Bogue Sound, at lot 27 in Archers Point Subdivision. The driveway plans require filling about 1,700 square feet of isolated 404 Wetlands; a pier 223 feet long with T- head is also scheduled for constructed. FIELD INVESTIGATION REPORT: JOHN G. & MARIE T. FLETCHER PAGE #2 9. NARRATIVE DESCRIPTION: The project site is located on Bogue Sound in the Town of Emerald Isle. The street address for lot 27 in Archers Point Subdivision is 7220 Sound Drive. The general vicinity is typical of the established (single family) residential neighborhoods on the sound in Emerald Isle. The applicant's property is one of the few remaining undeveloped lots along this section of shoreline. The site measures 75 feet wide and extends from the road about 225 feet to the sound. Although the elevation of the property averages 15 feet above Mean Sea Level, a low trough of "wetland" runs across the lot about 100 feet north of the paved road. The small pocket of isolated 404 wetlands measures less than 40 feet wide by 45 feet long. The applicant has calculated 1,446 square feet of wooded wetlands are directly involved. Overall, the site is well vegetated with a mix of pines and hard woods typical to Bogue Banks. On the shoreline, the toe of the 16 foot high bank is protected by a 30 to 40 foot wide fringe of saltmarsh cordgrass. Mr. Wayne Ragland, the applicant's agent, has facilitated the project's design and the application submittal. As shown on the workplat drawings sheet 2 of 3, the proposed house with a foot print of 45 feet by 45 feet has been located 30. to 35 feet landward of the mean high water line. Siting the house has been dictated by the Carteret County setback requirement for the septic tank and drain field and the proximity to the isolated wetlands. That is, the septic system will occupy the viable highground on the west side of the property 100 feet landward of the mean highwater level. The sewage disposal site, which has already received an Improvements Permit, is also located ,on the south side of the 404 wetlands closest to Sound Drive. These controls limit access to the building site; the proposed driveway must cross the isolated wetlands on the east side of the property. The applicant is pursuing a Nationwide Permit # 26 to authorize the wetland fill requirements for a minor road crossing. The applicant also proposes to construct a private recreational pier approximately 223 feet long as measured from the mean high water level. As the workplat drawings show, a 6 foot wide walkway will connect the house to the stairway leading down the bank to the water. The 6 foot wide pier will extend some 38 feet across the marsh grass and continue another 175 feet into Bogue Sound before terminating with a T- Head platform measuring 10 feet wide by 40 feet long. The length of the proposed pier appears to be in line with other piers along this same shoreline. Water depths in and around the proposed pier are not provide; however, average water depths in this area range from -2.5 feet to -3.5 feet on mean low water. 10. ANTICIPATED IMPACTS: The project site is located on the Outstanding Resources Waters of Western Bogue Sound. It has been designed with a 30 foot buffer zone to be maintained between the built -upon surfaces and the mean high water level. The amount of surface area involved with the driveway and the house construction equals about 21 to 24 percent of the overall, lot within the Estuarine Shoreline AEC. Approximately 1,446 to 1,700 square feet of isolated wetlands will be displaced by the proposed driveway/project. The bowl shaped wetland depression will act as a self contained unit for the fill material. Silt fences will also be installed to control possible sediment runoff. Proceeding East on Emerald Drive (Hwy 58) in Emerald Isle, turn left at the first intersection past the police department (Lee Avenue), go to the dead end intersection with Sound Drive and turn right. The lot is on the left at about 3 blocks from Lee Avenue. Both neighboring lots are built upon & have the street address numbers either on the mail boxes or a small yard sign at the driveway entrances.
