NARRATIVE DESCRIPTION: Project Setting The applicant owns an approximate 3-acre "point of land" off SR 1224 near Mesic, adjacent Gale Creek and the AIWW in Pamlico County. The property is located on the south side of Gale Creek/AIWW near its confluence with the Bay River. The lot is part of a larger tract of land known as Gale Creek Point. This larger tract is separated from the "mainland" by a manmade canal running northwest/southeast. Estuarine waters and an expansive intertidal marsh system dominate most of the landscape adjoining Gale Creek Point. The applicant's property is bordered to the north and east by Gale Creek/AIWW while the manmade canal defines the southern and western property lines. The marsh, 'dominated by Snartina cynosuroides and Juncus roemerianuscan be found along much of the northern and southern property lines. A narrow 8' to 12' fringe of Distichlis snicata and S. patens exists along a 55' stretch of shoreline adjacent Gale Creek/AIWW. Moderate erosion is occurring along this stretch of shoreline. Over the past few years, the applicant estimates that the erosion rate has been 5' to 6' per year. A single family residence is currently being constructed in the center of the property, and a 210' pier has previously been authorized through the CAMA General Permit process but has yet to be constructed. Project Description The applicant proposes to place rock rip rap in front of a fringe of Coastal Wetlands along 55' of eroding shoreline, and to install a 40' long X 12' wide concrete boat ramp. According to the applicant, marl rock will be hand placed on top of "filter screen" along the erosion escarpment, extending a maximum distance of 4' waterward of the NWL. The applicant does not propose any backfilling activities. The applicant_ proposes to construct the boat ramp by forming and pouring 6" concrete slabs on high ground and sliding the slabs into the water. Approximately 20' of the 12' wide boat ramp would extend into the water while 20' would extend back onto the high ground. Anticipated Impacts A total of 460 fO of Estuarine Waters would be filled as a result of rock rip rap and boat ramp construction (approximately 220 ftz for the rip rap and 240 ftz for the boat ramp). Approximately 96 fP of Coastal Wetlands would be lost and another 144 W of high ground impacted as a result of installation of the 12' wide X 40' long concrete boat ramp. Approximately 220 fO of eroding sandy shoreline above the NWL would also be filled by placement of the rock rip rap 4' landward of the NWL. M. The riprap material must be free from loose dirt or any other pollutant. It must be of a size sufficient to prevent its movement from the site by wave or current action. 4. The riprap material must consist of clean rock or masonry materials such as, but not .1000 limited to, granite or broken concrete. Materials such as tires, car bodies, scrap metal, paper products, tree limbs, wood debris, organic material or similar material, are not considered riprap. 5. No backfilling of the wetlands landward of the proposed rip rap is authorized. 6. AECs impacted by the proposed work include Public Trust Areas, Estuarine Waters, the Estuarine Shoreline and Coastal Wetlands. Waters at the site are classified as SA NSW and are open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the 1992 Pamlico County Land Use Plan (LUP) Update and offer the following comments. The project is located in an area classified as Conservation II (defined by the LUP as areas which may contain 1404' wetlands, although an on -site determination by the appropriate permitting agency is required for identification). AECs impacted by the work are classified as Conservation I (Estuarine Shoreline), Conservation III (Coastal Wetlands) and Conservation IV (Public Trust Areas and Estuarine Waters). Pamlico County's intentions regarding allowed uses in the various classifications are addressed in Section III, Land Classification System. Pamlico County has established a permanent conservation zone located within seventy-five (75) feet of the natural mean high water level for all shorelines bordering primary nursery areas, estuarine waters and public trust waters. This zone, which corresponds to the Estuarine Shoreline AEC, is classified as Conservation I. Development activities in these areas are strictly limited, although allowed uses include boat ramps and shoreline stabilization activities and structures allowed by CAMA permitting requirements. The Conservation II class in Pamlico County includes pocosin and '404' wetland areas. Development consistent with federal, state, and local regulations is allowed in this classification. Pamlico County allows all uses in Coastal Wetlands and Public Trust and Estuarine Waters as allowed by 15A NCAC 7H (Conservation III and IV). Applicable policies contained in the LUP include Policies for Residential, Commercial and Industrial Development Impacts on Resources (Pages IV-12 through IV-14) and Marine Resource Areas (Page IV-14). These policies reiterate the County's intentions regarding development in the Estuarine Shoreline, Coastal Wetlands, Public Trust Areas and Estuarine Waters AECs as described in the above discussion of the Conservation classification. Bulkhead Construction policies are found on Page IV-10 and state the County's approval of bulkhead construction in all areas, consistent with the 7H Use Standards and the North Carolina State Building Code.
